Natinal Defense Authrizatin Act (NDAA): Natinal Defense Authrizatin Act fr Fiscal Year 2017 (shrt title), P.L , 23 December 2016: - In the FY17 NDAA there is significant refrm, cnslidatin, and cdificatin f existing SC prgrams, alng with ther majr changes t the business f security cperatin. In fact, Sectin 1241 establishes a new Chapter 16 in Title 10, U.S.C. called Security Cperatin Sme key changes are: Defined Security Cperatin Prgrams as any prgram, activity (including exercise), r interactin f the Department f Defense with the Security 2

3 establishment f a freign cuntry t achieve a purpse as fllws: (A) T build and develp allied and friendly security capabilities fr self-defense and multinatinal peratins. (B) T prvide the armed frces with access t the freign cuntry during peacetime r a cntingency peratin. (C) T build relatinships that prmte specific United States security interests. P.L , Sectin 1241(a). Requires the Secretary f Defense t designate an individual and ffice at the Under Secretary f Defense-level r belw with respnsibility fr versight f strategic plicy and guidance and respnsibility fr verall resurce allcatin fr security cperatin prgrams and activities f the Department. Als, in this new Chapter 16, there are Sectins that encmpass the main aspects f previus SC prgrams that have been repealed, re-cdified, and/r cdified; and smetimes cnslidated int a new a Prgram/Sectin. Fr instance, Sectin 332 Friendly freign cuntries; internatinal and reginal rganizatins; defense institutin capacity building encdes the majr aspects f tw previus Defense Institutin Building (DIB) prgrams: Assignment f DD as MD Advisrs (MODA) & Defense Institutin Refrm Initiative (DIRI). Abut 21 existing SC prgrams will be cnslidated int eight new prgrams (Sectins). These eight new Sectins will then be permanent U.S. law and n lnger need peridic reauthrizatin; the first eight new prgrams reviewed belw are these new Sectins: - In the FY17 NDAA there are 13 New Security Cperatin Prgrams Authrized fr FY17: Sectin 311, Exchange f defense persnnel between United States and friendly freign cuntries: authrity Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that allws DD rganizatins t exchange military r civilian persnnel with ther friendly cuntries; the mutual exchange f military r civilian engineers and scientists with friendly cuntries in a permanent change f statin t becme prducing members f the hst natin s military RDT&E cmmunity; and, includes nn-reciprcal exchange f defense persnnel with allied and friendly cuntries and internatinal rganizatins, P.L , Sectin 1242(a)(1). Repeals the fllwing three prgrams, which Sectin 311 will replace: Defense Persnnel Exchange Prgram, Engineers and Scientists Exchange Prgram, & Nn-Reciprcal Exchange f Defense Persnnel, P.L , Sectin 1242(c). Sectin 312, Payment f persnnel expenses necessary fr theater security cperatin Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that allws, within certain specified limitatins, the payment f persnnel expenses (travel, subsistence, & similar expenses) fr Defense persnnel f friendly freign gvernments that the DD cnsiders necessary 3

4 fr theater security cperatin. This includes administrative services and supprt (travel, subsistence, and sme medical) fr liaisn fficers f a freign cuntry while that individual is temprarily assigned t a DD headquarters; csts nt t exceed $150,000 in any fiscal year. Persnnel expenses can cver csts t attend sme cnferences and seminars, P.L , Sectin 1243(a). Repeals the fllwing fur prgrams, which Sectin 312 will replace: African Cperatin, LATAM Cperatin: Payment f Persnnel Expenses, Payment f Expenses t attend Bilateral r Reginal Cnferences, & Payment f Freign Natin Liaisn Officer Expenses P.L , Sectin 1243(b)(1). Sectin 321, Training with friendly freign cuntries: payment f training and exercise expenses Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that allws U.S. armed frces, under the jurisdictin f the Secretary f Defense, t train with military frces r ther security frces f a friendly freign cuntry, if the Secretary determines that it is in the natinal security interest t d s. Csts allwed includes deplyment expenses, the incremental expenses f a friendly freign frce f a develping cuntry as a direct result f participating; and, small-scale cnstructin (nt t exceed $750K) that is directly related t the effective accmplish f the training exercise, P.L , Sectin 1244(a). Repeals the prgram 1203, Training f General Purpse Frces f the United States Armed frces with Military and ther Security Frces f Friendly Freign Cuntries and re-cdifies the prgram Develping Cuntry Cmbined Exercise Prgram (DCCEP) int Sectin 321, P.L , Sectin 1244(a) & (c). Sectin 331, Friendly freign cuntries: authrity t prvide supprt fr cnduct f peratins Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that prvides supprt (lgistics, supplies, and services) t frces f a friendly freign cuntry participating in: an peratin with the armed frces f the DD, military/stability peratin that benefits U.S. natinal security interests; and/r slely fr the purpse f enhancing interperability f military frces in a cmbined peratin. Additinally, the Secretary f Defense can als prvide this supprt t peratins in which the United States is nt participating if the Secretary f Defense and State jintly certify t Cngress that the peratin is in U.S. natinal security interests and the apprpriate reprt is filed. P.L , Sectin 1245(a). This supprt includes the prcurement f equipment fr the purpse f laning such equipment t the military frces f a friendly freign cuntry participating in a U.S.-supprted calitin r cmbined peratin. The aggregate value f all lgistic supprt, supplies, and service prvided in any fiscal year may nt exceed $450M. P.L , Sectin 1245(a) The fllwing prgram has been transferred and recded int Sectin 331: Lgistic Supprt fr Allied Frces in Cmbined Operatins & the fllwing Prgram has been repealed and replaced with Sectin 331: 1207, Supprt t Natinal Military Frces f Allied Cuntries fr Cunterterrrism Operatins in Africa, P.L , Sectin 1245(a) Sectin 332, Friendly freign cuntries; internatinal and reginal rganizatins: defense institutin capacity building. Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that allws SMEs, civilian advisrs, and ther expertise in helping a respective cuntry s MDs and/r varius security agencies with Defense Institutin Building (DIB). DIB is the develpment f effective and accuntable freign defense establishments, P.L , Sectin 1241(c)(1). Cdifies the fllwing tw prgrams int the new Sectin 332, Chapter 16 f Title 10 U.S.C.: Assignment f DD Civpers as MD Advisrs (MODA) & Defense Institutin Refrm Initiative (DIRI), P.L , Sectin 1241(c)(3). Sectin 333, Freign security frces: authrity t build capacity. Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that allws the Secretary f Defense t prvide equipment, services, and training t the natinal security frces f ne r mre freign cuntries fr the purpse f building capacity t d ne r mre f the fllwing peratins: Cunterterrrism, Cunter-weapns f mass destructin, Cunter-illicit drug trafficking, Cunter-transnatinal rganized crime, Maritime/brder security, Military intelligence, r Activities that cntribute t an internatinal calitin peratins, P.L , Sectin 1241(d)(1). Alng with varius reprting requirements, this new sectin prhibits assistance t units that have cmmitted grss vilatins f human rights, and n mre than five years f sustainment supprt can be prvided fr equipment prvided by this sectin r fr equipment previusly prvided by the DD in fiscal year 2015 r 2016, P.L , Sectin 1241(d)(1). FY2017 funding earmarked fr Sectin 333 cmes frm varius surces: what remains f the $750M f CTPF fr FY17; $125M transferred frm Drug Interdictin and Cunter-Drug Activities; a prtin f DSCA s $621M O&M budget; and, part f the $1.17B Cunter-ISIL Fund fr cunter-isil purpses in cuntries ther than Iraq and Syria. All this funding is derived nly frm DD O&M and made available fr DSCA t use fr Sectin 333 fr what 5

6 begins is ne fiscal year and ends nt later than the end f the secnd fiscal year thereafter, P.L , Sectin 1241(d)(1) & tables 4301, 4302, 4501, & days after enactment f the NDAA the fllwing fur prgrams will be repealed, which Sectin 333 will then replace: 1204, Authrity t Cnduct Activities t Enhance the Capability f Freign Cuntries t Respnd t Incidents invlving Weapns f Mass Destructin, 2282, Building Capacity f Freign Security Frces, 1033, DD Assistance fr C/N Activities by Certain Cuntries, & Assistance t the Gvernment f Jrdan fr Brder Security Operatins, P.L , Sectin 1241(d)(5). Sectin 341, Department f Defense State Partnership Prgram. Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that allws the Natinal Guard t interact and exchange persnnel with civil, military, and emergency/disaster respnse persnnel f friendly partner natins, P.L , Sectin 1246(a). Alng with varius reprting requirements, this new sectin prhibits assistance t units that have cmmitted grss vilatins f human rights and strikes bslete prvisins cnfrm t the new cdificatin in Sectin 341, P.L , Sectin 1246(b). Repeals the fllwing tw prgrams; which Sectin 341 will replace: State Partnership Prgram & Natinal Guard State Partnership Exchange Prgram, P.L , Sectin 1246(e). Sectin 347, Internatinal engagement authrities fr service academies. Purpse: Cdificatin int permanent U.S. law f the befre mentined prgram that allws the service academies (The U.S. Naval Academy, the U.S. Military Academy, and the U.S. Air Frce Academy), under the authrity f each Service Secretary, t permit persns frm freign cuntries t receive instructin at said service academy. This includes student exchanges with freign military academies fr educatinal purpses r cultural activities, P.L , Sectin 1248(a). Each service academy shall bear the csts f such attendance frm funds apprpriated fr that academy and frm such additinal funds as may be available t that academy frm a surce, ther than apprpriated funds, t supprt cultural immersin, reginal awareness, r freign language training. Expenditures frm apprpriated funds in supprt f any such activity may nt exceed $40K during any fiscal year, P.L , Sectin 1247(a). Repeals the fllwing tw prgrams; which Sectin 347 will replace: Attendance at Military Academies & Military Academy Exchange Prgram, P.L , Sectin 1247(b) 6

7 Sectin 1287 Glbal Engagement Center Purpse: DS, in crdinatin with DD, will create a Glbal Engagement Center (GEC) that shall be t lead, synchrnize, and crdinate effrts f the Federal Gvernment t recgnize, understand, expse, and cunter freign state and nn-state prpaganda and disinfrmatin effrts aimed at undermining United State natinal security interests P.L , Sectin 1287(a)(2). nt mre than 50 United States citizens r aliens are emplyed as persnal services cntractrs under the authrity f this paragraph at any time P.L , Sectin 1287(d)(2)(C). Sectin 1281, Enhancement f Interagency Supprt During Cntingency Operatins and Transitin Perids Purpse: The Secretary f Defense and the Secretary f State may enter int an agreement under which each Secretary may prvide cvered supprt, supplies, and services n a reimbursement basis, r by exchange f cvered supprt, supplies, and services, t the ther Secretary during a cntingency peratin and related transitin perid fr up t 2 years fllwing the end f such cntingency peratin. P.L , Sectin 1281(a). Sectin 1274 Reprt n the Ptential fr Cperatin Between the United States and Israel n Directed Energy Capabilities Althugh technically nt a new prgram, it culd lead t a new prgram s is listed here. Purpse: Nt later than 180 days after the date f the enactment f this Act, the Secretary f Defense shall submit t the apprpriate cmmittees f Cngress a reprt n the ptential fr cperative develpment by the United States and Israel f a directed energy capability t defeat ballistic missiles, cruise missiles, unmanned aerial vehicles, mrtars, and imprvised explsive devices that threaten the United States, deplyed frces f the United States, r Israel. P.L , Sectin 1274(a). Sectin 381, Cnslidated Annual Budget fr Security Cperatin Prgrams and Activities f the Department f Defense Purpse: shall set frth by budget functin and as a separate item the amunts requested fr the Department f Defense fr such fiscal year fr all security cperatin prgrams and activities f the Department f Defense, including the military departments, t be cnducted in such fiscal year, including the specific cuntry r regin and the applicable authrity, t the extent practicable, P.L , Sectin 1241(a)(3). 7

8 HOWEVER: The FY17 NDAA prpsal t create a Security Cperatin Enhancement Fund (SCEF) was nt adpted (see Significant FY17 NDAA Prvisins Nt Adpted later in this article fr mre details) Sectin 384, Department f Defense security cperatin wrkfrce develpment Prgram Required: The creatin and cdificatin f prgram t be knwn as Department f Defense Security Cperatin Wrkfrce Develpment Prgram (in this sectin referred t as the Prgram ) t versee the develpment and management f a prfessinal wrkfrce supprting security cperatin prgrams and activities f the Department f Defense, P.L , Sectin 1250(a). Purpse: t imprve the quality and prfessinalism f the security cperatin wrkfrce in rder t ensure that the wrkfrce (1) has the capacity, in bth persnnel and skills, needed t prperly perfrm its missin, prvide apprpriate supprt t the assessment, planning, mnitring, executin, evaluatin, and administratin f SA/SC prgrams; and (2) is assigned in a manner that ensures persnnel with the apprpriate level f expertise and experience are assigned in sufficient numbers t fulfill requirements fr SA/SC prgrams and activities. SC Wrkfrce Defined: Members f armed frces and civilian emplyees f the DD wh plan, mnitr, and/r cnduct SC/SA prgrams in the security cperatin rganizatins f verseas U.S. missins; gegraphic and functinal cmbatant cmmands; military departments (including technlgy release); Defense Agencies and Field Activities; and ther DD persnnel (e.g. OSD, Jint Staff) wh cntribute significantly t SA/SC prgrams and activities. P.L , Sectin Guidance: Nt later than 180 days after the date f the enactment f the Natinal Defense Authrizatin Act fr Fiscal Year 2017, the Secretary shall issue interim guidance fr the executin and administratin f the Prgram. & Nt later than ne year after the date f the enactment f the Natinal Defense the Secretary shall issue final guidance P.L , Sectin 1250(a). This Guidance will identify SC wrkfrce career paths, certificatin fr SC psitins, define SC training, and develp a means t track SC wrkfrce skills/certificatins.
