Prpnent and exceptin authrity. The prpnent f this regulatin is the Deputy Chief f Staff, G 1. The prpnent has the authrity t apprve exceptins r waivers t this regulatin that are cnsistent with cntrlling law and regulatins. The prpnent may delegate this apprval authrity, in writing, t a divisin chief within the prpnent agency r its direct reprting unit r field-perating agency, in the grade f clnel r the civilian equivalent. Activities may request a waiver t this regulatin by prviding justificatin that includes a full analysis f the expected benefits and must include f r m a l r e v i e w b y t h e a c t i v i t y s s e n i r legal fficer. 5 Chapter 1 Intrductin 1 1. Purpse This regulatin establishes plicies and prcedures fr all Unifrmed Service cmmissined and warrant fficers serving n the active duty list (ADL). This includes students enrlled in the Unifrmed Services University f the Health Sciences (USUHS); DODI gverns all ther Inter-Service transfers. This regulatin gverns the determinatin f grade and date f rank when cmmissined r warrant fficers f ne Unifrmed Service are reappinted t anther Unifrmed Service n the ADL due t Inter-Service transfers References See appendix A Explanatin f abbreviatins and terms See the glssary Respnsibilities a. The Assistant Secretary f the Army (Manpwer and Reserve Affairs) (ASA (M&RA) will indicate final cncurrence r nn-cncurrence fr the Army when the Cmmanding General (CG), U.S. Army Human Resurces Cmmand (HRC), The Judge Advcate General (TJAG), r Chief f Chaplains (CCH), as apprpriate, cncurs with the prpsed transfer. b. The Deputy Chief f Staff, G 1 will act as an intermediate review authrity between the CG, HRC and the ASA (M&RA). c. The HRC, TJAG, r CCH, as apprpriate, will (1) Mnitr prgram plicies and prcedures. Cmmanders f cmmissined r warrant fficers f ther Unifrmed Services t include USUHS will prcess applicatins fr Inter-Service transfer t the Army in accrdance with the prvisins f their respective Service regulatins Authrity The authrity fr this regulatin is Title 10, United States Cde, Sectin 716 (10 USC 716) and DODI Chapter 2 Interservice Transfer 2 1. Transfer plicy a. Cmmissined r warrant fficers wh are qualified t cntribute t an activity f anther Unifrmed Service may be transferred and reappinted int anther Unifrmed Service, subject t this regulatin. This will be dne withut interrupting their Service careers. b. Transfer, mainly in technical fields, is t permit the fullest pssible use f fficers with critical r unusual skills. Hwever, transfers between the Unifrmed Services are nt restricted t technical specialists. c. Officers will be transferred nly within authrized strength limitatins f the gaining Unifrmed Service. d. N fficer will be transferred withut their written request r cnsent. e. N fficer will be transferred frm ne Unifrmed Service and reappinted in anther Unifrmed Service with a precedence r relative rank higher than that held n the day befre transfer. f. N Regular Cmpnent fficer may be transferred t a Reserve Cmpnent f anther Service nr may a Reserve Cmpnent fficer be transferred t a Regular Cmpnent f anther Service. The Natinal Oceanic and Atmspheric Administratin (NOAA) Cmmissined Crps des nt have a Reserve Cmpnent. g. Release f an fficer fr an Inter-Service transfer under this regulatin, is nt a release frm fulfillment f the AR June

6 military service bligatin, established by 10 USC 651 r any ther active duty bligatin. Hwever, additinal service perfrmed after a transfer will be cunted tward fulfillment f such bligatins. h. N Army fficer will be apprved fr an Inter-Service transfer until all service bligatins incurred, under the prvisins f AR , AR 351 3, and AR 27 1 have been cmpleted. i. Army fficers may request an Inter-Service transfer, t anther Unifrmed Service, 12 mnths prir t the expiratin date f their service bligatin incurred under the prvisins f AR , AR 351 3, and AR j. Terminatin f current cmmissin and reappintment in the gaining Unifrmed Service will be accmplished withut interrupting the fficer s ttal service. Officers, wh transfer, will receive credit fr the ttal amunt f unused leave and military service accrued as f the date prir t transfer. k. Transfers are subject t cncurrence f bth the gaining and lsing Unifrmed Services. l. Applicatins frm fficers, wh have been nn-selected fr prmtin in their current grade, will nt be cnsidered. m. Officers wh have a mandatry release r mandatry remval date, have an apprved retirement, invluntarily separated, r have been separated prir t finalizatin f their request, are ineligible t apply. n. Inter-Service transfer applicatins frm cmmissined r warrant fficers, with undergraduate and/r graduate degrees in science, technlgy, engineering, mathematics, and any health prfessin academic disciplines, are highly encuraged Applicatin fr transfer f cmmissined r warrant fficers a. Secretaries f all Unifrmed Services r the fficers cncerned may prepare applicatins fr Inter-Service transfer. b. Applicatins shuld cnsist f the fllwing: (1) Inter-Service transfer request, in memrandum frmat (see fig 2 1). (2) Officers written request r cnsent f Inter-Service transfer if submitted by the gaining r lsing cmmand. (3) Ecclesiastical endrsement (chaplains nly). (4) Cpies f current authrized DD Frm 2808 (Reprt f Medical Examinatin), and DD Frm (Reprt f Medical Histry). (5) Current cpy f fficer s military persnnel data sheet. (6) Cnditinal release frm current cmpnent s persnnel headquarters. (7) Applicatins frm USUHS students will include a recmmendatin frm the president f USUHS. (8) Army applicants shuld als include any ther dcuments r infrmatin required by the requested Service Cmpnent. c. Applicatins f Army cmmissined r warrant fficers, will be prcessed thrugh nrmal cmmand channels, t the apprpriate addressee in paragraph 2 2h(1). d. Applicatins f cmmissined r warrant fficers, f ther Unifrmed Services, will be prcessed thrugh their respective services nrmal cmmand channels, t the apprpriate addressee in paragraph 2 2h(2). Applicatins frm USUHS r Health Prfessinal Schlarship Prgram (HPSP) students f ther Unifrmed Services will be prcessed thrugh United States Army Recruiting Cmmand (RCHS SD), rd Avenue, Frt Knx, KY e. Army cmmissined and warrant fficer applicants will be cunseled (AR ), with cnfirmatin f cunseling nted in a memrandum (see fig 2 2) by the first clnel-level cmmander thrugh which the applicatin is prcessed. The cmmander, at their discretin, may designate field grade fficers t cmplete the cunseling. If cunseling by a clnel is nt feasible, due t gegraphical separatin, the senir field grade fficer assigned nearest t the applicant will perfrm the cunseling. Cunseling will be explained by smene ther than a clnel-level cmmander in the endrsement memrandum. f. Cncurrence r nn-cncurrence with Inter-Service transfers apprvals r disapprvals will be determined based upn the applicant s skills, knwledge, qualificatins, and the current and/r future needs f the gaining Unifrmed Service. g. If disapprval is recmmended due t nn-cncurrence by an endrsing authrity, the specific reasns will be stated in the endrsement memrandum. Each memrandum may include any infrmatin cnsidered apprpriate. h. Applicatins will be sent t the fllwing addresses, as apprpriate: (1) Army cmmissined r warrant fficers in the basic branches, functinal areas, Army Medical Department (AMEDD) and USUHS students t Cmmander, U.S. Army Human Resurces Cmmand, (AHRC ORD A), 1600 Spearhead Divisin Avenue, Frt Knx, KY (2) Army Chaplains will submit applicatins t Headquarters, Department f the Army (DACH PE Z), 2700 Army Pentagn 1D143, Washingtn, DC (3) Army Judge Advcate General s Crps will submit applicatins t Headquarters, Department f the Army (DAJA PT), 2200 Army Pentagn, Washingtn, DC (4) Cmmissined r warrant fficers f ther Unifrmed Services, in accrdance with their respective Service 2 AR June 2016

In additin t any ther military service bligatin incurred in ther military services and any ther active duty service bligatin, in accrdance with DODI Officers f ther military services transferring t the Army will incur a 3 year active duty service bligatin t run cnsecutively t all ther active duty service bligatins, as a result f their apprved Inter-Service transfer. 11 2 3. Prcessing f applicatins a. Applicatins f Unifrmed Service cmmissined/warrant fficers fr Inter-Service transfer in r ut f the Army will be sent t the prper addressee in paragraph 2 2h fr cncurrence r nncncurrence. b. The applicatin f an Army cmmissined/warrant fficer will be sent t the prper addressee in paragraphs 2 2h(1), 2 2 h(2), and 2 2h(3)fr cncurrence r nncncurrence. If the CG, HRC, TJAG, TSG, r CCH (as apprpriate) nncncurs, the applicatin will be disapprved by that fficer as the designee f the Secretary f the Army. The TSG s ffice will review all AMEDD and USUHS students Inter-Service transfer requests that invlve active duty service bligatins related t AMEDD dllars and/r expenditures (fr example, training, special pays, r accessin bnuses). Applicatins nncncurred by the CG, HRC, TJAG, r CCH (as apprpriate) will be returned t the applicant thrugh prper cmmand channels as disapprved. Applicatins cncurred by the CG, HRC, TJAG, r CCH (as apprpriate) will be submitted t the ASA (M&RA) fr review in accrdance with paragraph 1 4a. c. All Army cmmissined and warrant fficer applicatins submitted thrugh the chain f cmmand, t the ASA (M&RA), will include: all service bligatins the applicant currently has and the date each bligatin ends; specialty; Army strength, by specialty and grade; and a statement as t whether the service member is n active duty, under the prvisins f a special prgram (fr example, Call t Active Duty Prgram and date f cmpletin). d. Fr service member applicatins, if the ASA (M&RA) cncurs, the request will be frwarded t the service Secretary f the requested service. If the ASA (M&RA) nn-cncurs, the applicatin will be disapprved and returned t the applicatin thrugh prper cmmand channels. Apprved Inter-Service transfer f an Army fficer, transferring t anther Unifrmed Service is valid fr 1 year frm the date f signature by the ASA (M&RA), unless therwise stated. e. Fr service member applicatins, requesting transfer t the Army, if the ASA (M&RA) cncurs with the request f the Secretary f the lsing Unifrmed Service, the cmmissined/warrant fficer will be prcessed fr accessin int the Army. If the ASA (M&RA) nn-cncurs with the request f the Secretary f the lsing Unifrmed Service, the applicatin will be disapprved and returned t the Secretary. f. When the transfer is acceptable t bth the lsing and gaining Unifrmed Services, the fficer will be transferred Grade determinatin upn transferring a. Except fr cmmissined fficers in the Public Health Service, cmmissined r warrant fficers transferred between tw Unifrmed Services will cntinue t hld the same grade, date f rank, and cmpnent held in the lsing Unifrmed Service n the day befre transfer. The fficer will be placed in an apprpriate psitin n the ADL f the gaining Unifrmed Service in accrdance with regulatins f the gaining Service. b. As an exceptin t paragraph a abve, an fficer wh transferred frm a prfessinal categry (such as chaplain, AMEDD, r judge advcate) int the Army t ther than the same r cmparable prfessinal categry in the gaining Unifrmed Service (1) May lse cnstructive service credit granted under 10 USC 533 and 10 USC in accrdance with the gaining Service s regulatins. (2) Will be appinted in an apprpriate grade based n ttal active Federal cmmissined service and placed n the ADL f the gaining Unifrmed Service in accrdance with regulatins f that Service. c. Except fr cmmissined fficers in the Public Health Service, a cmmissined fficer transferred t the Army under an Inter-Service transfer will have their Army grade determined using the prcedures fr fficers transferring ut f the Army. Determinatin f date f rank and placement n the ADL f the Army will be in accrdance with AR , except that active cmmissined service in Public Health Service will be cunted as active cmmissined service under AR d.
