1 pattee Lmharges on Shore, Rchdale Dropped; Tral of Farb, Youngberg Contnues Court Dschar ges Two Stude nts By GLENN KRANZLEY Collegan Managng Edtor Centre County Crmnal Court yesterday dropped charges aganst two Unversty students charged wth publshng and dstrbutng obscene materal. The par. Jay Shore and Tom Rchdale, along wth Alvan Youngberg and Russ Farb, were on tral for ther nvolvement wth the underground newspaper, the Water Tunnel. Court wll reconvene at 9:3 a.m. today. Prosecuton rested ts case yesterday and defense was stll presentng wtnesses when the sesson ended. A jur y of eght women and four men was chosen from a pool of more than 4 jurors. 'Later nformaton' Centre County Dst. Atty. Charles Brown Jr. requested that the charges'aganst Shore be dropped on the bass of "later nformaton regardng hs complcty" n publshng the Water Tunnel.. Brown and counsel for the defence Thomas Sterlng of State College sad they agreed that Farb and Younaberg dd n fact publsh the Water Tunnel and Hchdale dd dstrbute t. Charges aganst Rchdale were dropped as a resu lt of a moton by the defense. Rchdale was nvolved wth the dstrbuton of the second ssue of the Water Tunnel, but snce evdence presented by wtnesses for the prosecuton showed that the second ssue was not obscene, J udge R. Paul Campbell ruled that charges aganst Rchdale be dropped. Sterlng quoted the.statute wth whch the court was dealng. He sad that accordng to the law, materal must meet three requrements to be ruled legally obscene: ts domnant theme must as a whole appeal to prurent nterests; t must be patently offensve and an affront to communty standards, and t must be wthout redeemng socal value. A pont of dsagreement arose as-to what the word "prurent" meant. Paul Francs, a clncal psychologst who was wtness for the prosecuton sad that prurent materal causes the reader to have lascvous thoughts, or aroused sexual nterest. Two Un versty professors who were called as wtnesses for the defense offered another defnton of the term. George Guthre -nd.eon Gorlow, professors of psychology, both defned prurent as meanng that whch nctes someone to abnormal or llegal sexual actvty. G'.thre r,ad, "Dr. Francs equates prurence wth sexual desre, and don 't want my actvtes wth my wfe referred to as prurent." Francs testfed that the cover of ssue no. of the Water Tunnel, whch featured a pcture of Beatle John Lennon and wfe Yoko Ono n the nude, appealed to prurent nterests. Prurent Theme He sad that the domnant theme of ssue no. appea ls to prurent nterests, but the domnant theme of ssue no.' 2 does not. n cross-examnng Francs, Sterlng asked the wtness to read quotatons from Playboy magazne: the Natonal nformer, a sensatonal tablod newspaper; "Candy " and "Fanny Hll," and also asked hm to descrbe photographs appearng n " am Curous (Yellow)." Except for an artcle wrtten by Alan Gnsberg n the Playboy ssue. Francs sad all of these appeal to prurent nterests. Francs sad that although much of the materal n ssue no. of the Water Tunnel deals wth matters other than sex. the total mpact caused by the ssue, especally the cover, rases prurent nterests. Magazne of Protest Applyng ther defnton of "prurent, " defense wtnesses Guthre and Gorlow sad that the portons of ssue no. dealng wth sex dd not appeal to prurent, nterests. Guthre descrbed the Water Tunnel as a magazne of protest. He sad t was "publshed by a group of people who don 't lke the war n Vetnam? latlu (Emlr gtan Mostly cloudy today wth chance of a few lght showers, hgh n the mddle 6's. A lttle warmer Thursday. and who are dssatsfed wth the way the Admnstraton runs the Unversty. Hugh Manchester, edtor of the Centre Democrat, a weekly newspaper publshed n Bellefontc. testfed for the prosecuton that the Water Tunnel s offensve to communty standards, and that t s wthout redeemng socal value. He sad the Water Tunnel used nudes on ts cover for shock value. 'Shock Treatment' Ma nchester then sad under cross-examnaton that porton s of the Water Tunnel dd have redeemng socal value, but the "shock treatment" gven the newspaper by ts edtors blotted out ths value. The Court last Thursday convcted Laura Hahn, an employe of Nttany News, of sellng obscene materal (ssue no. 2 of the Water Tunnel). Mrs. Hahn, along wth the four students nvolved n yesterday 's ltgaton, were arrested on Feb. 7 by State College polce. 2 Edtoral Opnon Dscussons Offce: Possbly ft Good dea THEODORE W. KHEEL, s a strong belever n dscusson as a means of solvng dsputes. A natonally known labor medator, Kheel came to the Unversty two weeks ago n an attempt to open dscussons wth students, faculty and admnstrators to nvestgate ways of medatng student dsputes. After two vsts, Kh'eel and hs assstant, Lous B. Walker announced that an Offce for Student Dscussons wll be es- tablshed mmedately n accordance wth Kheel 's recommendatons. Walker expressed the hope that such an offce would contrbute sgnfcantly to a clmate of open dscusson. We are pleased wth the swft manner n whch Walker has compled wth Kheel's suggeston. But there are a few questons left unanswered by Walker, and a clarfyng reply on Walker 's part would allevate the uncertanty whch many students now feel. WE WOULD LKE to know, for nstance, whch group s gong to select the ndvdual to head the offce. f Walker plans to select the drector of ths offce unlaterally, then we must object. No : > screamng throngs, snappy band routnes or cartwheelng cheerleaders were around to usher n the event. n fact, the crowd of onlookers numbered about 3 and the only musc was provded by " a youngster \wth a whstle. But wth the openng of sprng practce the Nttany Lons were begnnng the routne that wll last untl the end of the fall. Coach Joe Paterno.,. check that. Make t Joe "Coach of the Year" Paterno, would be happy f the Lons could start from the begnnng wthout thnkng back. Last season s gong to be a hard act to follow and Paterno s acutely aware of the problems memores can cause. " thnk every sprng s dfferent," Paterno sad. "Ths one s, and n many ways t may be the most dffcult." Strange -words to hear from a coach who has 4 starters back from a team that went - last year and has gone' 9 consecutve games wthout a loss. Head coaches from Los Angeles to Tuscaloosa would gve half of ther trophes to have the squad Paterno.s workng wth ths sprng. "We've got.a lot of good football players' Paterno M sad.
