1 AmBank Win a Holiday Campaign Terms and Conditions The terms and conditions herein ( Terms and Conditions ) are in addition to and are to be read together with the AmBank (M) Berhad (8515-D) / AmBank Islamic Berhad ( U) (collectively referred to as the Bank ) relevant credit card/-i agreement(s) (collectively referred to as Cardholder Agreement ) which govern the use of the credit card/-i issued by the Bank. In the event of any discrepancy or inconsistency between these Terms and Conditions and the Cardholder Agreement, these Terms and Conditions shall prevail in so far as it relates to the Campaign. Except where the context otherwise requires, or unless these Terms and Conditions otherwise provide, all words, names and expressions defined in the Cardholder Agreement when used or referred to in these Terms and Conditions shall have the same meaning as that provided in the Cardholder Agreement. Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and viceversa. Words importing the masculine gender shall include the feminine and neuter gender. Campaign 1. The Campaign means Win a Holiday Campaign organized by the Bank in accordance with the Terms and Conditions as herein stipulated. Campaign Duration 2. The Campaign is from 1 May 2018 to 31 July 2018, both dates inclusive ( Campaign Duration ) or such other Duration(s) as may be determined at the sole and absolute discretion of the Bank with at least five (5) calendar days notice to Cardholders before the new terms and conditions take effect. Eligibility 3. Eligible Cardholders means customers of the Bank having a Principal Credit Card/-i ( Card ) during the Campaign Duration as herein described but do not include:- (a) cardholders of debit card(s), prepaid card(s), corporate card(s), commercial card(s), or insurance card(s) issued by the Bank; and/or (b) cardholders whose Card accounts have been suspended, cancelled or terminated for whatsoever reasons during and up till twelve (12) weeks after expiry of the Campaign Duration. 4. For the avoidance of doubt, this Campaign does not require any registration for participation and that all related Eligible Cards of Eligible Cardholders including his/her supplementary Cards(s) shall be automatically tracked for purposes of tabulation of the Eligible Transactions throughout the Campaign Duration. 2 Eligible Transaction and Campaign Entries 5. Subject to the Terms and Conditions hereinafter appearing, all Eligible Cardholders who use their Eligible Cards to perform retail transaction(s) at Agoda (online travel agency) and/or AirAsia (airline), to include conversion of AirAsia BIG Points (loyalty programme points) from AmBonus Points ( Eligible Transaction ) during the Campaign Duration shall earn Campaign Entries as follows: Number of Campaign Entries Eligible Transaction Minimum RM50 retail spend transaction in a single receipt at any merchant Every RM50 retail spend transaction in a single receipt at Agoda or AirAsia Every conversion of 1,000 AirAsia BIG Points from AmBonus Points 6. Eligible Transaction refers to local retail transactions made at Agoda and/or AirAsia during the Campaign Duration and will be tracked by their respective Merchant Description Name and Merchant Category Code (MCC) as per the Bank s system except for the following transactions: (a) transactions which are subsequently cancelled or refunded; (b) (c) disputed, unauthorized or fraudulent purchase transactions; or transactions made by Eligible Cardholders with association with or control over Agoda or AirAsia (whether as business owner, shareholder or director) 8. The assignment of MCC for Agoda and AirAsia are subject to classification by their respective acquiring bank(s) ( Merchant Acquiring Bank ) and it is the responsibility of the relevant Merchant Acquiring Bank to assign the correct MCC for Agoda and AirAsia. The Bank is not responsible for nor does the Bank have any control whatsoever on any incorrect and/or inconsistent assignment of MCC by the relevant Merchant Acquiring Bank that may result in the Eligible Cardholder being omitted from the Campaign Entries entitlement. 9. Eligible retail spend transactions are all local retail spend transactions as explained in Clause 5 and Clause 7 above that are charged to any Eligible Cardholder s Principal Credit Card(s)/-i during the Campaign Duration for purchase of goods or services incurred for personal consumption, and not for business purposes, excluding the following transactions:- (a) quasi cash transactions for betting and/or gaming; (b) on-going monthly instalments of AmFlexi-Pay Program / Easy Payment Plan; (c) corporate Bill Payments or Corporate GIRO transactions; (d) cash advance / deposit / withdrawal transactions; (e) any fees or charges imposed by the Bank; (f) trade financing transactions; (g) transactions which are under special corporate arrangement where rebate is applicable; (h) (i) retail spend transactions which are not defined in Clause 5 and Clause 7 above; and retail spend transactions which are subsequently cancelled, disputed, refunded, unauthorized, suspicious or fraudulent transactions of any nature. 10. Any determination by the Bank as to what constitutes Eligible Transaction is conclusive and cannot be challenged in any manner whatsoever. All transactions as recorded by the Bank shall also be final and conclusive. 11. All Eligible Transactions within the Campaign Duration must be based on Malaysian time as captured by the Bank s transaction records and posted to the Eligible Cardholder s Card account within five (5) calendar days from the date of the transactions. The Bank is not responsible in any manner whatsoever for any failure and/or delay in the transmission of evidence of sales transactions by Mastercard, Visa, merchant establishments or any other party. Campaign Prize 12. The following are the Campaign Prizes to be won, subject to the maximum as stated below for each category of Prizes:- Page 3 of 7 AmBank Win a Holiday Campaign

Subject to the Terms and Conditions herein stipulated, the Bank s automated system shall assign to each and every Campaign Entry earned by all Eligible Cardholder during the Campaign Duration its respective unique serial number, which is then used for sorting all Campaign Entries in an ascending numeric order. Following this sorting, each Campaign Entry is numbered sequentially starting from 1 for the serial number with the lowest value ( Sequential Number ). Following this numbering, the total number of Campaign Entries is divided by 30 to return the multiplier value for shortlisting thirty (30) Eligible Cardholders ( Shortlisted Campaign Prize Winners ). Example: 360,000 Campaign Entries is divided by 30 to return the multiplier value of 12,000, which means that the Participants with the 12,000 th Campaign Entry and its multiples: 12,000 th, 24,000 th 36,000 th, 48,000 th and 60,000 th 360,000 th Campaign Entries are the Shortlisted Campaign Prize Winners. 14. An Eligible Cardholder can only be shortlisted once to win one (1) Campaign Prize in the Campaign. In the event the same Eligible Cardholder is shortlisted more than once for the Campaign Prize, he/she shall only be shortlisted based on his/her lowest Campaign Entry value. His/her other Campaign Entry(ies) shall be disregarded and the Eligible Cardholder with the next Campaign Entry value shall be shortlisted instead, as exemplified below:- Example based on Clause 14: If the 36,000 th and 120,000 th Campaign Entries are from the same Eligible Cardholder, then he/she shall only be shortlisted based on the 36,000 th Campaign Entry. For the 120,000 th Campaign Entry which is not selected, the Eligible Cardholder with the next Campaign Entry, which is the 120,001 st Campaign Entry, shall be shortlisted instead. 15. The first ten (10) Shortlisted Campaign Prize Winners with the lowest Campaign Entry values shall be contacted for a question and answer session via SMS at their mobile number maintained in the Bank s system, between 8.45am until 5.45pm from Mondays to Thursdays and between 8.45am until 4.45pm on Fridays (except public holidays), within twelve (12) weeks from the end of the Campaign Duration at the sole and absolute discretion of the Bank and shall be required to answer a question correctly via SMS reply within the deadline of one (1) calendar day from the date the SMS that was sent by the Bank ( SMS Q&A ) to be Page 4 of 7 AmBank Win a Holiday Campaign

5 confirmed as the Winners of the Campaign, where the Shortlisted Campaign Prize Winner who answers the SMS Q&A correctly in the fastest time will be entitled to win the Campaign Grand Prize, with the Shortlisted Campaign Prize Winner who answers the SMS Q&A correctly in the second fastest time will be entitled to win the Campaign Second Prize, while the eight (8) other Shortlisted Campaign Prize Winners who answer the SMS Q&A correctly in the third fastest time onwards will be entitled to win the available eight (8) Campaign Consolation Prizes. 16. In the event a Shortlisted Campaign Prize Winner s reply is not received by the Bank within one (1) calendar day from the date of the SMS Q&A that was sent by the Bank or if a reply containing a wrong answer of the SMS Q&A was received by the Bank, he/she will be deemed disqualified from the Campaign. The Bank then reserves the right to replace a disqualified Shortlisted Campaign Prize Winner with the next-in-line Shortlisted Campaign Prize Winner at its sole discretion. 17. If a Shortlisted Campaign Prize Winner sends more than one SMS, only the first SMS received by the Bank will be counted. Standard telecommunication charges to reply to the SMS Q&A will apply. 18. To the extent permitted by law, the Bank shall not be responsible for any undelivered SMS with due to the unavailability of the said Shortlisted Campaign Prize Winner at the appointed date and time and/or due to any other reasons whatsoever. Winners 19. Winners of this Campaign shall be notified by Think BIG Digital ( TBD ) who is the owner and operator of the AirAsia BIG Loyalty Programme, via SMS/telephone/electronic mailer/mailer based on their contact details maintained in the Bank s system. Notwithstanding the foregoing, the Bank reserves the right to use any other medium or method, including the Bank s website at as it deems fit in its sole and absolute discretion for the purpose of announcing the Winners. 20. Campaign Grand Prize, Campaign Second Prize and Campaign Consolation Prize Winners shall be required to attend the prize presentation ceremony and/or other publicity programs at their own costs and expenses as and when required as notified by TBD or the Bank via telephone call and/or electronic mailer with regards to the date, time and venue of the prize presentation ceremony and/or other publicity programs. TBD and the Bank shall make three (3) attempts to contact the Winners. If a Winner fails to be contacted after these attempts, the Bank shall make no further attempts or if the Winner is successfully contacted but fails to attend such ceremony and/or programs without any valid reason(s), the Bank reserves the right to forfeit the said Winner s Prize and to select the next Shortlisted Prize Participant via Q&A as the Winner. 21. BIG Points shall be credited into the respective Winners AirAsia BIG accounts within ninety (90) days from Winner announcement date by TBD and the Bank. BIG Points are subject to the BIG Membership Terms and Conditions. 22. TBD and the Bank s liability with regards to the Campaign Grand Prize and Campaign Second Prize is only to pay the purchase price of the AirAsia BIG Points and hotel room stay charges of the same to the vendors, and shall not be inclusive of any local taxes, service fees and additional charges. The Campaign Prizes are given on an as is basis, which is non-transferable and non-exchangeable for cash or other kinds, whether in part or in full. Page 5 of 7 AmBank Win a Holiday Campaign

6 23. The inclusion of the Campaign Prizes in this Campaign cannot be construed as any endorsement or recommendation of the Campaign Prizes by the Bank. For any dispute in relation to quality or warranty of the Campaign Prizes or any Terms and Conditions in respect thereof, the Winner shall deal with the vendors directly without any recourse to the Bank. The Bank shall not be held liable for any breach of quality, service or warranty of the Campaign Prizes or any Terms and Conditions in respect thereof and shall not entertain any complaints whatsoever in relation with the Campaign Prizes. 24. By receipt of the Campaign Prizes, the Winners agree not to hold the Bank liable from any action, claim, damage, expense, judgment, liability or proceeding suffered in relation with their participation in the Campaign or receipt, redemption or usage of the Campaign Prizes. The Bank reserves the absolute right to disqualify the participation of any Eligible Cardholders for the purpose of this Campaign without having to alert him/her in the event:- (a) the Eligible Cardholder s Card account is in default of facilities granted at any time during the Campaign Duration; or (b) the Eligible Cardholder s Card account is closed within twelve (12) weeks from the expiry of the Campaign Duration; or (c) the Eligible Cardholder has provided untrue information or acted fraudulently in any manner during the Campaign Duration; or Page 6 of 7 AmBank Win a Holiday Campaign

7 (d) the Eligible Cardholder breaches any of these Terms and Conditions stipulated herein. Liability 30. The Bank shall not be liable to any Eligible Cardholder for any damage of whatsoever nature or loss suffered (including but not limited to, loss of goodwill, income or profits or consequential, direct or indirect, exemplary, incidental, punitive or special damages) howsoever arising in relation to participation in the Campaign, or the Bank exercising its rights pursuant to any of the Terms and Conditions herein. General 31. The Bank s decision on all matters relating to the Campaign is binding and final and no further correspondence or appeal shall be entertained. All Terms and Conditions stipulated herein are governed by and construed in accordance to the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur. 32. All Eligible Cardholders have read and understood all the Terms and Conditions specified herein and the Bank shall have the absolute right to suspend, terminate or cancel the Campaign at any time without assigning any reason with at least five (5) calendar days notice to Cardholders on the Bank s website at before the new terms and conditions take effect. 33. All Eligible Cardholders are deemed to have expressly agreed to be bounded by these Terms and Conditions (as varied or changed), the decisions of the Bank and, to the fullest extent permitted by law, to have consented to and authorized the Bank to disclose their particulars to the third party service providers engaged by the Bank for purposes of the Campaign. The Bank warrants that the disclosure of such particulars to any third party service providers shall be limited to the Eligible Cardholders names, addresses, Frequent Flyer membership number and telephone numbers and shall be used only in relation to and for purposes of the Campaign. The Bank s decision on all matters relating to the Campaign (including the interpretation of these Terms and Conditions) shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained. 34. For avoidance of doubt, cancellation, termination or suspension of this Campaign by the Bank shall not entitle the Eligible Cardholder(s) to any claim or compensation against the Bank for any and all losses or damages suffered or incurred by the Eligible Cardholder(s) as a direct or indirect result of the act of cancellation, termination or suspension. 35. To the extent permitted by law, the Bank shall not be liable to the Eligible Cardholder(s) for any losses or costs (including loss of business opportunities or profits) caused by abnormal and unforeseeable circumstances outside the Bank s reasonable control which is unavoidable, including but not limited to any accident, act of terrorist, breakdown of machinery, civil commotion, fire, industrial dispute, labour unrest, lock-out, natural disaster, riot, strike, war (whether declared or undeclared), or data processing system, electrical, telecommunication system or transmission link failure. 36. 8 Terma dan Syarat Terma-terma dan syarat-syarat di sini ( Terma dan Syarat ) adalah tambahan kepada dan untuk dibaca bersama dengan perjanjian kad kredit/-i yang berkaitan ( Perjanjian Pemegang Kad ) AmBank (M) Berhad (8515-D) / AmBank Islamic Berhad ( U) (secara kolektif dirujuk sebagai pihak Bank ) yang masing-masing mentadbir ke atas penggunaan kad kredit/-i yang dikeluarkan oleh pihak Bank. Sekiranya terdapat sebarang percanggahan atau ketidakseragaman antara Terma dan Syarat ini dan Perjanjian Pemegang Kad, Terma dan Syarat ini akan digunapakai setakat berkaitannya dengan Kempen ini. Kecuali di mana konteks memerlukan sebaliknya, atau melainkan jika Terma dan Syarat ini memperuntukkan selainnya, semua perkataan, nama dan ekspresi yang ditakrifkan di dalam Perjanjian Pemegang Kad, apabila digunakan atau dirujuk di dalam Terma dan Syarat ini, hendaklah mempunyai maksud yang sama seperti yang dinyatakan di dalam Perjanjian Pemegang Kad. Perkataan yang melambangkan orang termasuklah orang yang hidup dan, jika dan di mana berkenaan, badan atau orang yang diperbadankan atau tidak diperbadankan. Perkataan yang bererti tunggal juga hendaklah termasuk jamak dan sebaliknya. Perkataan yang bermaksud jantina lelaki hendaklah termasuk jantina perempuan dan neuter. Kempen 1. Kempen bermaksud Kempen Percutian untuk Dimenangi yang dianjurkan oleh pihak Bank selaras dengan Terma dan Syarat yang ditetapkan di sini. Tempoh Kempen 2. Kempen ini adalah dari 1 Mei 2018 hingga 31 Julai 2018, termasuk kedua-dua tarikh ( Jangka Waktu Kempen ) atau mana-mana tempoh lain sebagaimana yang ditentukan mengikut budi bicara tunggal dan mutlak pihak Bank dengan notis sekurang-kurangnya lima (5) hari kalendar terlebih dahulu. Kelayakan 3. "Pemegang Kad Yang Layak" bermaksud pelanggan pihak Bank yang mempunyai Kad Kredit/- i Utama ( Kad ) semasa Tempoh Kempen seperti yang diterangkan di sini tetapi tidak termasuk:- (a) pemegang kad kredit selain yang disenaraikan di Klausa 3 di atas, kad debit, kad prabayar, kad korporat, kad komersial atau kad insurans yang dikeluarkan oleh pihak Bank; dan/atau (b) pemegang kad dengan akaun Kad yang telah digantung, diberhentikan atau dibatalkan atas apa jua sebab semasa dan sehingga dua belas (12) minggu setelah Jangka Waktu Kempen tamat. 4. Bagi mengelakkan keraguan, Kempen ini tidak memerlukan sebarang pendaftaran untuk penyertaan dan bahawa semua Kad Pemegang Kad Yang Layak yang berkaitan termasuk Kad Page 1 of 9

9 tambahan beliau akan dijejaki secara automatik bagi tujuan penjadualan Transaksi Yang Layak sepanjang Jangka Waktu Kempen. Transaksi Yang Layak dan Entri Kempen 5. Tertakluk kepada Terma dan Syarat yang akan dinyatakan selepas ini, semua Pemegang Kad Yang Layak yang menggunakan Kad mereka untuk melaksanakan transaksi perbelanjaan runcit di Agoda (agensi pelancongan dalam talian) dan/atau AirAsia (syarikat penerbangan), termasuk penukaran AirAsia BIG Points (mata ganjaran program loyalty) daripada AmBonus Points ( Transaksi Yang Layak ) sepanjang Jangka Waktu Kempen akan memperoleh Entri Kempen seperti berikut:- Bilangan Entri Kempen Transaksi Yang Layak Minimum RM50 dalam satu transaksi perbelanjaan runcit di mana-mana saudagar Setiap RM50 dalam satu transaksi perbelanjaan runcit di Agoda atau AirAsia Setiap penukaran 1,000 AirAsia BIG Points daripada AmBonus Points 6. Semua kegunaan Kad Kredit/-i Utama dan Kad Kredit/-i Tambahan seorang Peserta akan dijejak untuk tujuan menghitung bilangan Entri Kempen yang diperoleh untuk semua Transaksi Yang Layak yang tertakluk seperti yang dicontohkan di bawah:- Page 2 of 9

10 Akaun Kad Tarikh Kegunaan Kad di mana-mana saudagar Kegunaan Kad di Agoda / AirAsia Penukaran AirAsia BIG Points Bilangan Entri Kempen Kad Kredit Utama Platinum AmBank Kad Kredit Tambahan di bawah Kad Utama Platinum AmBank Kad Kredit Utama Platinum AmBank Kad Kredit-i AmBank Islamic Platinum AmBank Kad Kredit Tambahan di bawah Kad Utama Platinum AmBank Kad Kredit Utama Platinum AmBank Kad Kredit Utama Platinum AmBank Kad Kredit-i AmBank Islamic Platinum AmBank Kad Kredit-i AmBank Islamic Emas AmBank 2 Mei - RM Mei - RM Mei RM Jun - - 1, Jun - - 3, Jun - RM Jun RM Julai - RM Julai RM Jumlah Bilangan Entri Kempen Perbelanjaan Yang Layak merujuk kepada sebarang transaksi runcit tempatan yang dilakukan di Agoda atau AirAsia sepanjang Jangka Waktu Kempen dan akan direkodkan berdasarkan Penghuraian Nama Peniaga dan Kod Kategori Peniaga (MCC) bagi Agoda dan AirAsia seperti yang direkod dalam sistem Pihak Bank kecuali untuk transaksi yang berikut: (a) transaksi yang kemudiannya dibatalkan atau dibayar balik; (b) (c) dipertikaikan, transaksi tanpa kebenaran atau penipuan; atau transaksi yang dilakukan oleh Pemegang Kad Yang Layak dengan sebarang Peniaga Barangan Runcit yang berkaitan atau dikawal oleh mereka (sama ada sebagai pemilik perniagaan, pemegang syer atau pengarah Agoda atau AirAsia) 8. Penentuan MCC untuk Agoda dan AirAsia adalah tertakluk kepada pengelasan oleh bank pemeroleh saudagar ( Bank Pemeroleh Saudagar ) dan adalah menjadi tanggungjawab Bank Pemeroleh Saudagar yang berkaitan untuk memberikan MCC yang betul untuk Agoda dan AirAsia. Bank tidak bertanggungjawab ke atas dan juga tidak mempunyai apa-apa jua kawalan ke atas sebarang pemberian MCC yang tidak betul dan/atau tidak konsisten oleh Bank Pemeroleh Saudagar yang berkaitan yang boleh mengakibatkan Pemegang Kad Yang Layak disingkirkan daripada hak mendapat Entri Kempen. Transaksi perbelanjaan runcit yang layak semuanya adalah transaksi perbelanjaan runcit seperti yang diterangkan dalam Klausa 5 dan Klausa 7 di atas yang dicajkan kepada mana-mana Kad Kredit/-i Utama Pemegang Kad Yang Layak semasa Jangka Waktu Kempen untuk pembelian barangan atau perkhidmatan yang ditanggung untuk penggunaan peribadi dan bukan bagi tujuan perniagaan, tidak termasuk transaksi-transaksi yang berikut:- (a) transaksi tunai separa untuk perjudian dan/atau permainan; (b) ansuran bulanan Program AmFlexi-Pay / Pelan Bayaran Mudah yang sedang berjalan; (c) transaksi Bayaran Bil Korporat atau GIRO Korporat; (d) transaksi pendahuluan tunai / deposit / pengeluaran; (e) sebarang yuran atau caj yang dikenakan oleh Bank; (f) transaksi pembiayaan perdagangan; (g) transaksi yang berada di bawah pengaturan korporat khas yang mana rebat boleh (h) digunakan; transaksi perbelanjaan runcit yang tidak ditakrifkan dalam Klausa 5 dan Klausa 6 di atas; dan (i) transaksi perbelanjaan runcit yang kemudiannya dibatalkan, dipertikaikan, dikembalikan, tidak dibenarkan, mencurigakan atau transaksi palsu dalam apa-apa bentuk. 10. Sebarang penentuan oleh Bank mengenai apa yang dimaksudkan sebagai Transaksi Yang Layak adalah muktamad dan tidak boleh dicabar dalam apa jua cara. Semua transaksi seperti yang direkod oleh pihak Bank akan juga menjadi muktamad dan konklusif. 11. Semua Transaksi Yang Layak dalam Jangka Waktu Kempen mesti berdasarkan waktu Malaysia seperti yang dirakamkan oleh rekod transaksi pihak Bank dan diposkan ke akaun Kad Peserta dalam tempoh lima (5) hari kalendar dari tarikh transaksi-transaksi tersebut. Pihak Bank tidak bertanggungjawab dalam sebarang cara apa jua untuk sebarang kegagalan dan/atau kelewatan dalam transmisi bukti transaksi jualan oleh Mastercard, Visa, pertubuhan peniaga atau sebarang pihak lain. Hadiah Kempen 12. Berikut adalah Hadiah Kempen untuk dimenangi, tertakluk kepada yang maksimum seperti yang dinyatakan di bawah untuk setiap kategori:- Page 4 of 9

Tertakluk kepada Terma dan Syarat yang ditetapkan di sini, sistem automatik pihak Bank akan memberi setiap satu Entri Kempen yang diperoleh oleh para Pemegang Kad Yang Layak nombor siri unik masing-masing, yang kemudiannya diguna untuk menyusun semua Entri Kempen dalam satu tertib nombor menaik. Berikutan susunan ini, setiap Entri Kempen dinomborkan berturutan bermula dari 1 untuk nombor siri dengan nilai yang paling rendah ( Nombor Berturutan ). Berikutan penomboran ini, jumlah bilangan Entri dibahagi dengan 30 untuk mengembalikan nilai pengganda untuk menyenarai pendek tiga puluh (30) Pemegang Kad Yang Layak ( Pemenang Hadiah Kempen Yang Disenarai Pendek ). Contoh: 360,000 Entri Kempen dibahagi dengan 30 untuk mengembalikan nilai pengganda 12,000, yang bermaksud Pemegang Kad Yang Layak dengan Entri Kempen ke-12,000 dan gandaannya: Entri Kempen ke-12,000, ke-24,000, ke-36,000, ke-48,000 dan ke-60,000 ke- 360,000 ialah Pemenang Hadiah Kempen Yang Disenarai Pendek. 14. Seorang Pemegang Kad Yang Layak hanya boleh disenarai pendek sekali untuk satu (1) Hadiah Kempen dalam Kempen ini. Sekiranya Pemegang Kad Yang Layak yang sama disenarai pendek lebih daripada sekali untuk Hadiah Kempen, beliau hanya akan disenarai pendek berdasarkan nilai Entri Kempen beliau yang terendah. Entri(-Entri) Kempen lain beliau akan diketepikan dan Pemegang Kad Yang Layak dengan nilai Entri yang seterusnya akan disenarai pendek sebaliknya, seperti yang dicontohkan di bawah:- Contoh berdasarkan Klausa 14: Jika Entri Kempen ke-36,000 dan ke-120,000 adalah dari Pemegang Kad Yang Layak yang sama, maka beliau hanya akan disenarai pendek berdasarkan Entri ke-36,000. Untuk Entri Kempen ke-120,000 yang tidak dipilih, Peserta dengan Entri Kempen yang seterusnya, iaitu Entri ke-120,001, akan disenarai pendek sebaliknya. Page 5 of 9

Sepuluh (10) Pemenang Hadiah Kempen Yang Disenarai Pendek terdahulu dengan nilai-nilai Entri Kempen yang terendah akan dihubungi untuk sesi soal dan jawab melalui SMS di nombor telefon bimbit mereka yang dikekalkan dalam sistem pihak Bank, antara 8.45am sehingga 5.45pm, dari Isnin hingga Khamis dan antara 8.45am sehingga 4.45pm pada Jumaat (kecuali cuti umum), dalam dua belas (12) minggu setelah Tempoh Kempen tamat mengikut budi bicara tunggal dan mutlak pihak Bank dan akan dikehendaki untuk menjawab satu soalan dengan betul melalui balasan SMS dalam tarikh akhir satu (1) hari kalendar dari tarikh SMS tersebut dihantar oleh pihak Bank ( Q&A SMS ) untuk disahkan sebagai Pemenang Hadiah Kempen, di mana Pemenang Hadiah Kempen Yang Disenarai Pendek yang menjawab Q&A SMS dengan betul dalam masa yang tersingkat akan memenangi Hadiah Utama Kempen, Pemenang Hadiah Kempen Yang Disenarai Pendek yang menjawab Q&A SMS dengan betul dalam masa kedua tersingkat akan memenangi Hadiah Kedua Kempen, manakala lapan (8) Pemenang Hadiah Kempen Yang Disenarai Pendek yang lain yang menjawab Q&A SMS dengan betul dalam masa ketiga tersingkat dan seterusnya akan memenangi lapan (8) Hadiah Saguhati Kempen yang sedia ada. 16. Jika Pemenang Hadiah Kempen Yang Disenarai Pendek tersebut gagal menjawab Q&A SMS dengan betul atau tidak membalas dalam tarikh akhir, maka Pemegang Kad Yang Layak tersebut akan disingkirkan dan tidak layak untuk memenangi Hadiah Kempen. Pemegang Kad Yang Layak seterusnya dengan nilai Entri Kempen yang terendah dari senarai dalam Klausa 29 kemudiannya akan dihubungi sehingga terdapat sepuluh (10) Pemenang Hadiah Kempen yang disahkan untuk Kempen ini. 17. Sekiranya terdapat lebih daripada satu balasan SMS daripada seorang Pemegang Kad Yang Layak, hanya balasan SMS yang terawal yang diterima oleh pihak Bank berdasarkan tarikh dan masa seperti yang direkod oleh sistem pihak Bank akan diterima. 18. Setakat yang dibenarkan oleh undang-undang, pihak Bank tidak akan bertanggungjawab untuk sebarang penghantaran SMS yang dibuat kepada Peserta Yang Disenarai Pendek yang tidak dilengkapi atau diteruskan akibat daripada ketiadaan Pemegang Kad Yang Layak tersebut pada hari dan masa yang ditetapkan dan/atau akibat daripada sebarang sebab lain apa jua. Pemenang-Pemenang 19. Think BIG Digital ( TBD ) yang merupakan pemilik dan pengendali AirAsia BIG Loyalty Programme akan memaklumkan semua Pemenang melalui SMS/telefon/kiriman pos elektronik/kiriman pos berdasarkan butiran hubungan mereka yang disenggara dalam sistem Bank. Walau apa pun yang dinyatakan di atas, Bank berhak menggunakan sebarang medium atau kaedah lain, termasuk laman web Bank di yang difikirkan wajar menurut budi bicara mutlaknya bagi tujuan mengumumkan Pemenang. 20. Pemenang Hadiah Utama Kempen, Hadiah Kedua Kempen dan Hadiah Saguhati Kempen akan dikehendaki untuk hadir ke majlis penyampaian hadiah dan/atau lain-lain program publisiti dengan kos dan perbelanjaan ditanggung sendiri dan apabila dikehendaki seperti yang dimaklumkan oleh TBD atau Bank melalui panggilan telefon dan/atau kiriman pos elektronik mengenai tarikh, masa dan tempat majlis penyampaian hadiah dan/atau lain-lain program publisiti. TBD dan Bank akan membuat tiga (3) percubaan untuk menghubungi Pemenang. Jika seseorang Pemenang gagal dihubungi selepas semua percubaan ini, Bank tidak akan membuat percubaan lain atau jika Pemenang berjaya dihubungi tetapi gagal menghadiri majlis dan/atau program yang sedemikian tanpa sebarang alasan yang sahih, Bank berhak untuk menarik balik Page 6 of 9

14 Hadiah untuk Pemenang tersebut dan memilih Peserta Hadiah Yang Disenarai Pendek berikutnya melalui Soal Jawab sebagai Pemenang. 21. BIG Points akan dikreditkan ke dalam akaun AirAsia BIG Pemenang masing-masing dalam masa sembilan puluh (90) hari dari tarikh pengumuman Pemenang-Pemenang oleh TBD dan Bank. BIG Points adalah tertakluk kepada Terma dan Syarat BIG Membership. 22. Liabiliti TBD dan Bank berkaitan Hadiah Utama Kempen and Hadiah Kedua Kempen hanyalah untuk membayar harga belian AirAsia BIG Points dan pembayaran penginapan bilik hotel kepada vendor, dan tidak termasuk sebarang cukai tempatan, yuran perkhidmatan dan caj tambahan. Hadiah Utama diberikan berdasarkan 'sedia ada', yang tidak boleh dipindah milik dan tidak boleh ditukarkan dengan wang tunai atau lain-lain barangan, sama ada sebahagian atau sepenuhnya. 23. Penglibatan Hadiah-Hadiah Kempen dalam Kempen ini tidak boleh dianggap sebagai sebarang pengendorsan atau pengesyoran terhadap Hadiah-Hadiah Kempen oleh Bank. Untuk sebarang pertikaian berkaitan kualiti atau waranti Hadiah-Hadiah Kempen atau mana-mana Terma dan Syarat yang berkaitan dengannya, Pemenang hendaklah berurusan dengan vendor secara langsung tanpa sebarang bantuan daripada Bank. Bank tidak boleh dipertanggungjawabkan atas sebarang perlanggaran kualiti atau waranti Hadiah-Hadiah Kempen atau mana-mana Terma dan Syarat yang berkaitan dengannya dan tidak akan melayan sebarang aduan apa jua pun berkaitan dengan Hadiah-Hadiah Kempen. 24. Dengan menerima Hadiah-Hadiah Kempen, Pemenang bersetuju untuk tidak mempertanggungjawabkan Bank ke atas sebarang tindakan, tuntutan, kerosakan, perbelanjaan, pengadilan, liabiliti atau prosiding yang ditanggung berhubung penyertaan mereka dalam Kempen atau penerimaan, penebusan atau penggunaan Hadiah-Hadiah Kempen. Penyingkiran 29. Pihak Bank berhak secara mutlak untuk menyingkirkan penyertaan sesiapa Pemegang Kad Yang Layak untuk tujuan Kempen ini tanpa keperluan untuk memaklumkan beliau sekiranya:- (a) akaun Kad Pemegang Kad Yang Layak tersebut mengingkari kemudahan-kemudahan yang diberi pada bila-bila masa semasa Jangka Waktu Kempen; atau (b) akaun Kad Pemegang Kad Yang Layak tersebut ditutup dalam dua belas (12) minggu setelah Jangka Waktu Kempen tamat; atau (c) Pemegang Kad Yang Layak telah memberikan maklumat yang tidak benar atau melakukan penipuan dalam sebarang cara ssemasa Jangka Waktu Kempen; atau (d) Pemegang Kad Yang Layak tersebut memungkiri sebarang Terma dan Syarat yang dinyatakan di sini. Liabiliti 30. Pihak Bank tidak akan bertanggungjawab kepada sesiapa Peserta untuk sebarang kerosakan dalam apa jua bentuk atau kerugian yang dialami (termasuk tetapi tidak terhad kepada, kehilangan nama baik, pendapatan atau keuntungan atau kerosakan berbangkit, secara langsung atau tidak langsung, teladan, sampingan, punitif atau khas) sebagaimana yang timbul berkaitan dengan penyertaan dalam Kempen ini, atau pihak Bank melaksanakan haknya menurut sebarang Terma dan Syarat di sini. Umum 31. Keputusan pihak Bank untuk semua perkara berkaitan dengan Kempen ini adalah terikat dan muktamad. Semua Terma dan Syarat yang ditetapkan di sini adalah ditadbir oleh dan ditafsirkan selaras dengan undang-undang Malaysia dan sebarang pertikaian undang-undang akan dimulakan dan dibicarakan di mahkamah di Kuala Lumpur. 32. Semua Peserta telah membaca dan memahami semua Terma dan Syarat yang dinyatakan di sini dan pihak Bank akan mempunyai hak mutlak untuk mengantung, memberhentikan atau membatalkan Kempen ini pada bila-bila masa tanpa memberi sebarang sebab dengan memberi notis sekurang-kurangnya lima (5) hari kalendar terlebih dahulu pada laman web pihak Bank di Semua Pemegang Kad Yang Layak dianggap sebagai telah menyatakan persetujuan untuk terikat dengan Terma dan Syarat ini (seperti yang diubah atau berubah), keputusan Bank dan, setakat yang benarkan oleh undang-undang, untuk membenarkan dan memberi kuasa kepada Bank untuk mendedahkan butiran peribadi mereka kepada penyedia perkhidmatan pihak ketiga yang digunakan oleh Bank bagi tujuan Kempen. Bank menjamin bahawa pendedahan Page 8 of 9

16 butiran yang sedemikian kepada mana-mana penyedia perkhidmatan pihak ketiga akan terhad kepada nama, alamat, nombor keahlian Penerbang Kerap dan nombor telefon Pemegang Kad Yang Layak dan akan digunakan hanya dalam hal berkaitan dengan dan bagi tujuan Kempen. Keputusan Bank ke atas semua perkara yang berkaitan dengan Kempen (termasuk interpretasi Terma dan Syarat ini) adalah muktamad dan mengikat dan sebarang surat-menyurat selanjutnya atau percubaan untuk mempertikaikan keputusan yang sedemikian tidak akan dilayan. 34. Untuk mengelakkan keraguan, pembatalan, pemberhentian atau penggantungan Kempen ini oleh pihak Bank tidak akan memberi hak kepada para Peserta untuk sebarang tuntutan atau pampasan terhadap pihak Bank untuk sebarang dan kesemua kerugian atau kerosakan yang dialami atau ditanggung oleh para Peserta sebagai akibat langsung atau tidak langsung dari tindakan pembatalan, pemberhentian atau penggantungan tersebut. 35. Setakat yang dibenarkan oleh undang-undang, pihak Bank tidak akan bertanggungjawab kepada para Peserta untuk sebarang kerugian atau kos (termasuk kehilangan peluang perniagaan atau keuntungan) yang disebabkan oleh keadaan-keadaan yang luar biasa dan tidak dapta diduga di luar kawalan munasabah pihak Bank yang tidak dapat dielakkan, termasuk tetapi tidak terhad kepada sebarang kemalangan, tindakan pengganas, kerosakan mesin, kekacauan awam, kebakaran, pertikaian perindustrian, kekacauan buruh, sekatan masuk kerja, bencana alam, rusuhan, mogok, peperangan (sama ada diisytiharkan atau tidak diisytiharkan) atau kegagalan sistem pemprosesan data, elektrik, sistem telekomunikasi atau sambungan transmisi. 36.
