1 Terms and Conditions AmOnline Win a Mini Cooper Campaign 1.0 Definitions 1.1 For the purposes of this Terms and Conditions, the following words and expressions shall have the meanings assigned to them except where the context otherwise requires: AmBank Group means all the related corporations and associate corporations of the Bank whether incorporated inside or outside Malaysia, existing now or in the future and reference to AmBank Group in these Terms and Conditions herein shall include all or any entity within the AmBank Group. the Bank refers to AmBank Berhad (Company No: 8515-D) or AmBank Islamic Berhad (Company No: U), and having its registered address at Level 22, Bangunan AmBank Group, No. 55, Jalan Raja Chulan, Kuala Lumpur. Campaign means AmOnline Mini Cooper Campaign organised by the Bank in accordance with the Terms and Conditions stipulated herein. AmOnline means AmBank s Internet Banking services offered by AmBank Group to their customers to perform banking transactions via Internet in accordance to the Terms and conditions at altnc_ pdf. The term associate corporations shall have the same meaning assigned to it under Section 2(1) of the Financial Services Act The term related corporations shall have the same meaning assigned to it under Section 6 of the Companies Act Eligible Participant means the AmBank and/or AmBank Islamic s customer, as the context so requires, that is eligible under Clause 3.0. Entry(ies) means the eligible entries earned by fulfilling the criteria in clause 6.1 which entitles Eligible Participants to qualify for the campaign prizes. Prior Notice means notice by the Bank of certain facts or a particular state of affairs of at least three (3) calendar days. Retail Banking refers to consumer banking that caters for individual and non-individual customers. Retail Individual Customers refers to individual customers of AmBank/AmBank Islamic under Retail Banking. 1.2 Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and vice-versa. Words importing the masculine gender shall include the feminine and neuter gender. 2.0 Campaign Period 2.1 The Campaign shall run from 8th January 2018 until 15 April 2018 (both dates inclusive and will be referred to as Campaign Period ). 2 3.0 Eligibility 3.1 The following categories of persons shall be eligible to participate in the Campaign: a) Customers of the Bank without AmOnline b) Customers of the Bank with AmOnline 3.2 The following categories of persons shall NOT be eligible to participate in the Campaign: a) Individuals below the age of eighteen (18) years old (unless the Eligible Product is held in trust); b) Non-individual customers that include: (i) Sole-proprietorships/Partnerships; and/or (ii) SMEs (Small Medium Enterprises with turnover up to RM25 million annually); and/or (iii) Non-profit Organisations/Charitable Bodies/Societies c) Permanent and/or contract employees of AmBank Group (including its subsidiaries and related corporations Companies) and their immediate family members (spouses, children and parents); and/or d) Representatives, vendors and/or agents (including advertising and promotion agents) of AmBank Group (including its subsidiaries and related corporation s companies) and their immediate family members (spouses, children and parents). 4.0 Registration 4.1 Eligible Participants must first register their participation in the Campaign by: a) replying to the SMS sent from by the Bank to their mobile number maintained in the Bank s system by way of SMS; or b) sending an SMS to by typing MINI1 or MINI2 or MINI3 or MINI5 or MINI6<space>Eligible Participant s NRIC number: MINI1<space>12-digit new National Registration Identity Card (NRIC) number Example: MINI c) registering on the Campaign website at or d) by auto-enrolment via an SMS sent by the Bank to their mobile numbers maintained in the Bank s records stating that they have been auto-enrolled to participate in the Campaign. Through this method, the Eligible Participants will not be required to selfregister themselves in the Campaign. 4.2 Telecommunication service providers that permit SMS registrations are Celcom, DiGi, Maxis, U Mobile, XOX, Tune Talk and Webe. Eligible Participants shall bear the standard telecommunication charges imposed by their respective telecommunication service provider for each SMS registration in accordance with Clause 4.1. Eligible Participants with mobile numbers by telecommunication service providers that do not permit SMS registrations or without their National Registration Identity Card (NRIC) number maintained in the Bank s system must contact the Bank in accordance with Clause 12.7 to register their participation during the Campaign Period. 4.3 The sending of SMS by an Eligible Participant is not proof that the registration is successful. Upon completing the registration as mentioned in Clause 4.1, an SMS confirmation shall be sent from by the Bank to the same mobile number used for the SMS registration at no cost to the Eligible Participant. In the event of unsuccessful registration, an SMS notification shall be sent from by the Bank to the same mobile number used for the registration at no cost to the Eligible Participant to notify the Eligible Participant to re-register pursuant to Terms & Conditions: AmOnline - Win a Mini Cooper Campaign Page 2

3 Clause 4.1. In the event that an Eligible Participant does not receive the SMS confirmation whatsoever, the Eligible Participant must contact the Bank in accordance with Clause 12.7 herein for assistance. 4.4 Upon registration, there will be an acknowledgement SMS sent from the Bank to the Eligible Participant s mobile number used for the registration. Proof of SMS sent by an Eligible Participant does not denote as proof that the SMS is received by the Bank. 4.5 Eligible Participants are responsible to ensure that their mobile numbers and new NRIC numbers used to register their participation in the Campaign are the same as that maintained in the Bank s system. The Bank shall not be responsible for any incomplete or inaccurate registration details. 4.6 The Bank is not responsible for, nor does the Bank have any control whatsoever on the SMS traffic, network failure and/or interruptions on the part of the respective telecommunications service providers or the Bank s SMS vendor, for any other reason(s) whatsoever, resulting in the delay of the SMS during the Campaign Period. 4.7 To the extent permitted by law and the Bank not being in breach of this Campaign or is negligent, the Bank will not be held responsible and reserves the absolute discretion to disqualify any registration due to reason(s) including, but not limited to; incomplete/inaccurate SMS entries, error message, unsuccessful registration due to network failure and/or interruption experienced by the telecommunication service providers or for any reasons whatsoever as the Bank may, in its absolute discretion, deem fit. 4.8 Upon successful registration, the Eligible Participant shall be entitled to participate in the Campaign in accordance with the Terms and Conditions herein. 5.0 Participation Criteria 5.1 For purposes of the Campaign, 00:00 hours until 23:59 hours based on Malaysian time as recorded in the Bank s system is considered one (1) day ( Campaign Day ). The Campaign Period consists of four (4) months ( Campaign Month ) defined as follows: Campaign Month Duration Total Campaign Days 1 8 January 31 January February 28 February March 31 March April 15 April Total Campaign Days The Participating Campaign Month for an Eligible Participant commences from the month of his successful registration until the end of the Campaign, as exemplified below: Example Successful SMS Registration Date Participating Campaign Month Participant 1 15 January 2018 Campaign Months 1,2,3 & 4 Participant 2 28 Feb 2018 Campaign Months 2,3 & 4 Participant 3 15 March 2018 Campaign Month 3 & 4 Participant 4 15 April 2018 Campaign Month 4 only 5.3 All Eligible Participants agree and authorise the Bank to disclose their personal details (including but not limited to name, new NRIC number for Malaysians/passport number for non- Malaysians, mobile/telephone number and mailing address) only to the extent necessary to the Bank s service providers for the purposes of this Campaign. All Eligible Participants also agree and consent to the Bank s entitlement to display and / or publish information and/or materials, including but not limited to name and photographs for advertising and publicity purposes in any manner the Bank deems appropriate. By participating in this Campaign, the Eligible Participants hereby agree to and shall abide by these Terms and Conditions and have read, understood Terms & Conditions: AmOnline - Win a Mini Cooper Campaign Page 3

4 and consent to AmBank Group s Privacy Notice which can be found at [ ]. 6.0 Entries 6.1 Subject to the Terms and Conditions appearing hereinafter, all Eligible Participants who fulfil the following eligibility criteria during the Campaign Period shall be entitled to earn Entries as tabulated below: Eligibility Criteria Campaign Entries (which qualify for all categories of Prizes) Sign up for AmOnline (Not applicable for Eligible Participant who has signed up for AmOnline before the Campaign Period) or Perform a Bill Payment transaction via AmOnline* or Perform a Prepaid Reload transaction via AmOnline Number of Entries 10 Note: * Entries earned from Bill Payment transaction via AmOnline is only limited to a single bill account number and will only be refreshed on the following month. Examples below: Scenario 1: If customer A performs one transaction to bill account number, 1234, customer A earns 10 entries. If customer performs another transaction to the same bill account number on the same month, there will be no entries rewarded to him/her. Entries will only be rewarded if he/she performs the bill payment transaction to the same bill account number on the following month. Scenario 2: If customer B performs multiple transactions to account bill 5678, customer B earns 10 entries. Scenario 3: If customer C performs one transaction to account bill 2468 followed by another transaction to same account bill (because first transaction was not in full), customer C earns 10 entries. Customer can only earn 10 entries per bill account number per month. 6.2 Entries earned during the Campaign Period will only be valid if the Eligible Participant registered as per the criteria stated in Clause 4.1. Once the Eligible Participant has registered, all the Entries earned during the Campaign Period will be taken into account for this Campaign. 7.0 Prizes 7.1 The following are the ( Prizes ) to be won, subject to the maximum as stated below for each category of Prizes: Tier Category Prize Number of Winners Total Number of Winners 1 Grand Prize Mini Cooper S (Auto 2.0) Daily Prizes RM Cash 5 per Campaign Day for 98 Days Eligible Participants that have won the Daily Prize are still in the running to win the Grand Prize. 5 7.3 The maximum number of prizes that an Eligible Participant can win throughout the Campaign Period is only one (1) prize per Campaign within the Bank. In the event if the Eligible Participant is shortlisted to win multiple prizes from multiple campaigns organized by the Bank, the Eligible Participant shall be entitled to win only one (1) prize at the sole and absolute discretion of the Bank. 7.4 The Prizes are non-transferable to any third party and non-exchangeable for up-front cash, credit or any such other kind. 8.0 Winners Selection (A) Grand Prize 1 Winner x Grand Prize: Mini Cooper S (Auto 2.0) 8.1 The Bank s automated system shall assign to each and every Entry earned by all Eligible Participants during the Campaign Period its respective unique serial number, which is then used for sorting all Entries in an ascending numeric order. Following this sorting, each Entry is numbered sequentially starting from 1 for the serial number with the lowest value ( Sequential Number ). 8.2 Following the numbering as stated in Clause 8.1, the total number of Entries are divided by twenty (20) to return the multiplier value for shortlisting twenty (20) Eligible Participants ( Potential Grand Prize Winner s ). Example: 1,200,000 Total Entries is divided by 20 to return the multiplier value of 60,000, which means that the Eligible Participants with the 60,000 th and its multiples: 120,000 th, 180,000 th until 1,200,000 th Entry shall be the shortlisted Potential Grand Prize Winners. 8.3 An Eligible Participant can only be shortlisted once for the Grand Prize. In the event the same Eligible Participant is shortlisted more than once for the Grand Prize, the Eligible Participant shall only be shortlisted based on his/her lowest Sequential Number. The Eligible Participant s other Entry(ies) shall be disregarded and the Eligible Participant with the next-in-line Sequential Number shall be shortlisted instead, as exemplified below: Example based on Clause 8.2: If the 60,000 th and 180,000 th Entries are from the same Eligible Participant, then he shall only be shortlisted based on the 60,000 th Entry. For the 180,000 th Entry which is not selected, the next-in-line shortlisted Potential Grand Prize Winners which is the 240,000 th Entry, shall be shortlisted instead. 8.4 The shortlisted Potential Grand Prize Winner with the lowest Sequential Number shall be contacted for a recorded question and answer session via telephone call at their mobile numbers maintained in the Bank s system, between 8.45am to 5.45pm from Monday to Thursday and between 8.45am to 4.45pm on Friday (except public holidays), within twelve (12) weeks from the end of the Campaign Period, at the sole and absolute discretion of the Bank. 8.5 The shortlisted Potential Grand Prize Winner shall be required to answer up to three (3) questions correctly ( Phone Q&A ) to be confirmed as the winner of the Grand Prize ( Grand Prize Winner ). 8.6 The Bank shall make three (3) attempts to contact the Potential Grand Prize Winner. If the first contact attempt fails due to reasons such as no answer, mobile number not in service, no connection or any reasons whatsoever, then the Bank shall make the other two (2) attempts within two (2) calendar days at the next available time at the Bank s absolute discretion. If the final attempt also fails, then the shortlisted Potential Grand Prize Winner shall be disqualified and not be eligible to win the Prize. The next-in-line Potential Grand Prize Winner with the lowest Sequential Number from the list in Clauses 8.1 and 8.2 shall then be promoted to win the Grand Prize. 6 Example based on Clause 8.2: If the Eligible Participant of the 60,000 th Entry for Grand Prize is disqualified due to three (3) failed contact attempts, then the next-in-line shortlisted Potential Grand Prize Winner, which is the 120,000 th Entry for Grand Prize, shall be promoted and shortlisted instead. Process continues until one shortlisted Potential Grand Prize Winner can be contacted and has accepted the Grand Prize. 8.7 To the extent permitted by law, the Bank shall not be responsible for any telephone calls made to the shortlisted Potential Grand Prize Winner which are not completed, disconnected, not answered or proceeded with due to the unavailability of the said Eligible Participant at the appointed date and time and/or due to any other reasons whatsoever. (B) 490 Winners x Daily Prizes: RM100 Cash Back 8.8 The Bank s automated system lists all Entries, earned by all Eligible Participants during each Campaign Day based on its respective Sequential Number as explained in Clause Following the numbering as stated in clause 8.1, the total number of Entries for each Campaign Day are divided by five (5) to return the multiplier value for shortlisting five (5) Eligible Participants ( Potential Daily Prizes Winner ). Example: 1,200,000 Total Entries is divided by 5 to return the multiplier value of 240,000, which means that the Eligible Participants with the 240,000 th and its multiples:480,000 th, 720,000 th until 1,200,000 th Entry shall be the shortlisted Potential Daily Prize Winners An Eligible Participant can only be shortlisted once for the Daily Prizes. In the event the same Eligible Participant is shortlisted more than once for the Daily Prizes, the Eligible Participant shall only be shortlisted based on the Eligible Participant s lowest Sequential Number. His/her other Entry(ies) shall be disregarded and the Eligible Participant with the next-in-line Sequential Number shall be shortlisted instead, as exemplified below: - Example based on Clause 8.2: If the 240,000 th and 720,000 th Entries are from the same Eligible Participant, then he shall only be shortlisted based on the 240,000 th Entry. For the 720,000 th Entry which is not selected, the next-in-line shortlisted Potential Main Prizes Winners which is the 960,000 th Entry, shall be shortlisted instead For each Campaign Day, the five (5) shortlisted Potential Daily Prize Winners with the lowest Sequential Number shall be contacted for a question and answer session via SMS at their mobile number maintained in the Bank s system, between 8.45am until 5.45pm from Mondays to Fridays (except public holidays), within twelve (12) weeks from the end of the Campaign Period at the sole and absolute discretion of the Bank. The shortlisted Potential Daily Prize Winner shall be required to answer a question correctly via SMS reply within three (3) calendar days from the date the SMS was sent by the Bank ( SMS Q&A ) to be confirmed as the winners of the Daily Prizes ( Daily Prize Winners ). The deadline (i.e. date and time) to answer the question shall be specified in the SMS. Only one (1) attempt to answer is allowed For avoidance of doubt, all Eligible Participants shall bear the standard telecommunication charges imposed by their respective telecommunication service providers for each SMS reply. In the event of multiple SMS replies by an Eligible Participant, only the earliest SMS reply received by the Bank based on the date and time as recorded in the Bank s system shall be accepted If a shortlisted Potential Daily Prize Winner fails to answer the SMS Q&A correctly or within the stipulated deadline in Clause 8.11 then the Eligible Participant shall be disqualified and not be eligible to win the Daily Prize. The forfeited Prize shall not be given to another Participant. 9.0 Winners 9.1 The Bank shall notify the Grand Prize Winner via SMS/telephone/electronic mailer/mailer based on their contact details maintained in the Bank s system. Notwithstanding the foregoing, the Bank reserves the right to use any other mediums or methods, including the Bank s website at Terms & Conditions: AmOnline - Win a Mini Cooper Campaign Page 6

7 as it deems fit in its sole and absolute discretion, for the purpose of announcing the Winners. 9.2 The Grand Prize Winner of the Campaign shall be required to attend the prize presentation ceremony and/or other publicity programmes at their own costs and expenses as and when required as notified by the Bank via telephone call and/or electronic mailer with regards to the date, time and venue of the prize presentation ceremony and/or other publicity programmes. The Bank shall make three (3) attempts to contact the Winner. If a Winner fails to be contacted after these attempts, the Bank shall make no further attempts or if the Winner is successfully contacted but fails to attend such ceremony and/or programs without any valid reason(s), the Bank reserves the right to forfeit the said Winner s Prize and to select the next Shortlisted Potential Grand Prize Winner via Phone Q&A as the Winner. 9.3 The Daily Prizes shall be credited into the respective Winner s AmBank/AmBank Islamic Bank current or savings account within twelve (12) weeks from the end of the Campaign Period. The Winners are required to have an AmBank/AmBank Islamic Current or Savings Account/-i to claim the Daily Prizes. 9.4 The Bank will issue a notification letter to the Grand Prize Winner within twelve (12) weeks after the end of the Campaign Period. 9.5 The Grand Prize shall be available for collection after twelve (12) weeks from the end of Campaign Period. The Grand Prize Winner shall be solely responsible for the payment of all taxes and/or other miscellaneous charges relating to the Grand Prize and the Bank shall not bear the cost or be responsible for cost of transportation of the vehicle to the Grand Prize Winner or any other incidental costs whatsoever. 9.6 The Bank s liability with regards to Prizes, except Daily Prizes, is only to pay the purchase price for the same to the vendor. The Prizes are given on an as is basis, which is non-transferable and non-exchangeable for cash or other kinds, whether in part or in full. The Bank reserves the right to select the color of the Prizes, where applicable. Visual(s) of the Prizes used in any advertisement, promotional, publicity and other materials relating to or in connection with the Campaign is/are only for illustration purposes and may not depict the actual color of the Prizes and excludes any optional accessories. No changes are to be made on the model or color of the Prizes.In the event the vendor is unable to supply the same model of the Prizes as described herein to the Bank due to the reasons which include, but are not limited to manufacturer s recall or damage, lost or stolen during storage and/or delivery, the Bank reserves the right to substitute the Prizes with another model of like or similar value at its sole and absolute discretion with Prior Notice of at least three (3) calendar days on the Bank s website at However, the Bank bears no responsibility to replace any Prizes, damaged or stolen after delivery to the Winner. 9.7 The inclusion of all Prizes in this Campaign cannot be construed as any endorsement or recommendation of the Prizes by the Bank. For any dispute in relation to quality or warranty of the Prizes or any Terms and Conditions in respect thereof, the Winner shall deal with the authorised dealer or supplier directly without any recourse to the Bank. The Bank shall not be held liable for any breach of quality or warranty of the Prizes or any Terms and Conditions in respect thereof and shall not entertain any complaints whatsoever in relation with the Prizes. 9.8 By receipt of the Prizes, the Winners agree not to hold the Bank liable from any action, claim, damage, expense, judgment, liability or proceeding suffered in relation with their participation in the Campaign or receipt, redemption or usage of the Prizes. 9.9 The Grand Prize Winner agree and authorise the Bank to disclose their details (including but not limited to name, NRIC number, telephone number and address) to the vendor who would be contacting the winners regarding the delivery or redemption of the Grand Prize. 8 10.0 Disqualification 10.1 The Bank reserves the absolute right to disqualify the participation of any Eligible Participants for the purpose of this Campaign without having to alert him or her in the event: a) the Eligible Participant s Current Account and/or Savings Account is in default of facilities granted at any time during the Campaign Period; or b) the Eligible Participant s Current Account and/or Savings Account is closed within twelve (12) weeks from the expiry of the Campaign Period; or c) the Eligible Participant and/or Eligible Customer has provided untrue information or acted fraudulently in any manner during the Campaign Period; or d) the Eligible Participant and/or Eligible Customer breaches any of the Terms and Conditions stipulated herein General 11.1 The Bank s decision on all matters relating to the Campaign is binding and final and no further correspondence or appeal shall be entertained. All Terms and Conditions stipulated herein are governed by and construed in accordance to the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur All Eligible Participants and Eligible Customers have read and understood all the Terms and Conditions specified herein and the Bank shall have the absolute right to suspend, terminate or cancel the Campaign at any time without assigning any reason by giving Prior Notice on the Bank s website at The Bank shall have the right and absolute discretion to vary, amend, delete or add to any of the Terms and Conditions specifically set out herein, in whole or in any part from time to time, including varying the Promotion Period as it deems fit and appropriate with Prior Notice. No compensation in cash or any kind shall be given to the Eligible Participants or Eligible Customers for any losses or damages suffered or incurred by the Eligible Participants or Eligible Customers as a direct or an indirect result of such amendment, variation, deletion, addition or alteration of the Terms and Conditions herein unless the same is solely due to the gross negligence and/or default of the Bank For avoidance of doubt, cancellation, termination or suspension of this Campaign by the Bank shall not entitle the Eligible Participant(s) or Eligible Customer(s) to any claim or compensation against the Bank for any and all losses or damages suffered or incurred by the Eligible Participant(s) or Eligible Customer(s) as a direct or indirect result of the act of cancellation, termination or suspension To the extent permitted by law, the Bank shall not be liable to the Eligible Participant(s) or Eligible Customer(s) for any losses or costs (including loss of business opportunities or profits) caused by abnormal and unforeseeable circumstances outside the Bank s reasonable control which is unavoidable, including but not limited to any accident, act of terrorist, breakdown of machinery, civil commotion, fire, industrial dispute, labour unrest, lock-out, natural disaster, riot, strike, war (whether declared or undeclared), or data processing system, electrical, telecommunication system or transmission link failure For any assistance and/or feedback relating to this Campaign, Eligible Participants and Eligible Customers can contact the Bank s 24-hour Contact Centre by calling or via e- mail to customercare@ambankgroup.com. 9 Terma dan Syarat Kempen Menangi sebuah Mini Cooper AmOnline 1.0 Definisi 1.1 Untuk tujuan Terma dan Syarat ini, perkataan dan ungkapan berikut hendaklah mempunyai makna yang ditentukan baginya melainkan sekiranya konteks memerlukan sebaliknya: Kumpulan AmBank bermaksud semua syarikat dan syarikat bersekutu yang berkaitan dengan Bank sama ada diperbadankan di dalam atau di luar Malaysia, sudah wujud pada masa ini atau pada masa akan datang dan rujukan kepada Kumpulan AmBank dalam Terma dan Syarat ini akan merangkumi semua atau mana-mana entiti dalam Kumpulan AmBank. Bank merujuk kepada AmBank (M) Berhad (No. Syarikat: 8515-D) atau AmBank Islamic Berhad (No. Syarikat: U), dan mempunyai alamat berdaftar di Tingkat 22, Bangunan AmBank Group, No. 55 Jalan Raja Chulan, Kuala Lumpur. Kempen bermaksud Kempen Mini Cooper AmOnline yang dianjurkan oleh Bank menurut Terma dan Syarat yang ditetapkan di sini. AmOnline bermaksud perkhidmatan Perbankan Internet AmBank yang ditawarkan oleh Kumpulan AmBank kepada pelanggan-pelanggannya untuk melaksanakan urus niaga perbankan melalui internet menurut Terma dan Syarat di altnc_ pdf. Istilah "syarikat-syarikat bersekutu" hendaklah mempunyai maksud yang sama seperti yang ditetapkan di bawah Seksyen 2(1) Akta Perkhidmatan Kewangan Istilah "syarikatsyarikat berkaitan" pula hendaklah mempunyai maksud yang sama seperti yang ditetapkan di bawah Seksyen 6 Akta Syarikat Peserta Yang Layak bermaksud pelanggan AmBank dan/atau AmBank Islamic, seperti yang dikehendaki menurut konteks, yang layak di bawah Klausa 3.0. Penyertaan bermaksud penyertaan yang layak yang diperolehi dengan memenuhi kriteria dalan klausa 6.1 yang membenarkan Peserta Yang Layak untuk berhak mendapat hadiah kempen. Notis Terdahulu bermaksud notis oleh Bank berkenaan fakta tertentu atau berkenaan sesuatu keadaan yang tertentu dalam tempoh sekurang-kurangnya tiga (3) hari kalendar. Perbankan Runcit merujuk kepada perbankan pengguna yang memenuhi keperluan pelanggan individu dan bukan individu. Pelanggan Runcit Individu merujuk kepada pelanggan individu AmBank/AmBank Islamic di bawah Perbankan Runcit. 1.2 Perkataan yang merujuk kepada orang hendaklah termasuk orang yang hidup dan, jika dan di mana berkaitan, badan atau orang yang diperbadankan atau tidak diperbadankan. Perkataan yang merujuk kepada kata tunggal hendaklah juga termasuk bentuk jamak dan sebaliknya. Perkataan yang merujuk kepada jantina lelaki hendaklah termasuk jantina perempuan dan neuter. 2.0 Tempoh Kempen 2.1 Kempen ini akan berlangsung dari 8 Januari 2018 hingga 15 April 2018 (termasuk kedua-dua tarikh dan akan dirujuk sebagai Tempoh Kempen ). 10 3.0 Kelayakan 3.1 Kategori-kategori orang yang berikut adalah layak untuk mengambil bahagian dalam Kempen ini: c) Pelanggan-pelanggan Bank tanpa AmOnline d) Pelanggan-pelanggan Bank dengan AmOnline 3.2 Kategori orang yang berikut TIDAK layak untuk mengambil bahagian di dalam Kempen ini: e) Individu di bawah umur lapan belas (18) tahun (kecuali Produk Yang Layak dipegang oleh pemegang amanah); f) Pelanggan bukan individu yang termasuk: (i) Pemilikan Tunggal/Perkongsian; dan/atau (ii) PKS (Perusahaan Kecil Sederhana dengan jumlah perolehan tahunan sehingga RM25 juta); dan/atau (iii) Organisasi Bukan Berasaskan Keuntungan/Badan Kebajikan/Persatuan g) Kakitangan tetap dan/atau kontrak Kumpulan AmBank (termasuk anak syarikatnya dan syarikat berkaitan) dan ahli keluarga terdekat mereka (pasangan, anak-anak dan ibu bapa); dan/atau h) Wakil, vendor dan/atau ejen (termasuk ejen periklanan dan promosi) Kumpulan AmBank (termasuk anak syarikatnya dan syarikat yang berkaitan) dan ahli keluarga mereka yang terdekat (pasangan, anak-anak dan ibu bapa). 4.0 Pendaftaran 4.1 Peserta Yang Layak hendaklah terlebih dahulu mendaftarkan penyertaan mereka dalam Kempen ini dengan: e) membalas SMS yang dihantar dari oleh Bank ke nombor telefon mudah alih mereka yang disenggara dalam sistem Bank dengan cara menghantar SMS; atau f) menghantar satu SMS ke dengan menaip MINI1 atau MINI2 atau MINI3 atau MINI5 atau MINI6<jarak>nombor KP Peserta Yang Layak: MINI1<jarak>12-digit nombor Kad Pengenalan (KP) baharu Contoh: MINI g) mendaftar di laman sesawang Kempen di atau h) melalui pendaftaran automatik melalui SMS yang dihantar oleh Bank ke nombor telefon mudah alih mereka yang disenggara dalam rekod Bank menyatakan bahawa mereka telah didaftarkan secara automatik untuk mengambil bahagian dalam Kempen. Melalui kaedah ini, Peserta Yang Layak tidak perlu lagi mendaftarkan diri dalam Kempen ini. 4.2 Penyedia perkhidmatan telekomunikasi yang membenarkan pendaftaran SMS ialah Celcom, DiGi, Maxis, U Mobile, XOX, Tune Talk dan Webe. Peserta Yang Layak akan menanggung caj telekomunikasi standard yang dikenakan oleh penyedia perkhidmatan telekomunikasi mereka untuk setiap pendaftaran SMS menurut Klausa 4.1. Peserta Yang Layak dengan nombor telefon mudah alih daripada penyedia perkhidmatan telekomunikasi yang tidak membenarkan pendaftaran SMS atau tanpa nombor MYKAD mereka disimpan di dalam sistem Bank hendaklah menghubungi Bank menurut Klausa 12.7 untuk mendaftarkan penyertaan mereka semasa Tempoh Kempen. 4.3 Penghantaran SMS oleh Peserta Yang Layak bukan bukti bahawa pendaftaran tersebut telah berjaya. Selepas melengkapkan semua langkah yang dinyatakan dalam Klausa 4.1, satu Terms & Conditions: AmOnline - Win a Mini Cooper Campaign Page 10

11 pengesahan SMS akan dihantar daripada nombor oleh Bank ke nombor telefon mudah alih yang sama yang digunakan untuk pendaftaran SMS tanpa sebarang kos kepada Peserta Yang Layak. Sekiranya pendaftaran tidak berjaya, satu pemberitahuan SMS akan dihantar daripada nombor oleh Bank ke nombor telefon mudah alih yang sama yang digunakan untuk pendaftaran tanpa sebarang kos kepada Peserta Yang Layak untuk memberitahunya supaya mendaftar semula menurut format seperti yang dinyatakan dalam Klausa 4.1. Sekiranya Peserta Yang Layak tidak menerima sebarang pengesahan SMS apa juapun, Peserta Yang Layak hendaklah menghubungi Bank selaras dengan Klausa 12.7 yang dinyatakan di sini untuk bantuan. 4.4 Selepas pendaftaran, satu perakuan SMS akan dihantar oleh Bank kepada Peserta Yang Layak ke nombor telefon mudah alih yang digunakan untuk pendaftaran. Bukti SMS yang dihantar oleh seorang Peserta Yang Layak tidak menunjukkan bukti bahawa SMS tersebut telah diterima oleh Bank. 4.5 Peserta Yang Layak bertanggungjawab untuk memastikan yang nombor telefon mudah alih dan nombor MYKAD baharu mereka yang digunakan untuk mendaftarkan penyertaan mereka di dalam Kempen ini adalah sama dengan yang disimpan di dalam sistem Bank. Bank tidak bertanggungjawab ke atas sebarang butiran pendaftaran yang tidak lengkap atau tidak tepat. 4.6 Bank tidak bertanggungjawab dan tidak mempunyai kawalan apa juapun ke atas trafik SMS, kegagalan rangkaian dan/atau gangguan kepada penyedia perkhidmatan telekomunikasi masing-masing atau vendor SMS Bank bagi sebarang sebab lain apa juapun yang menyebabkan kelewatan SMS semasa Tempoh Kempen. 4.7 Setakat yang dibenarkan oleh undang-undang dan Bank tidak melanggar peraturan Kempen atau bersikap cuai, Bank tidak boleh dipertanggungjawabkan dan berhak secara mutlak untuk membatalkan sebarang pendaftaran atas sebab-sebab, termasuk tetapi tidak terhad kepada, penyertaan SMS yang tidak lengkap/tidak tepat, mesej ralat, pendaftaran tidak berjaya disebabkan kegagalan rangkaian dan/atau gangguan yang dialami oleh penyedia perkhidmatan telekomunikasi atau atas sebarang sebab apa juapun yang dianggap wajar oleh Bank menurut budi bicara mutlaknya. 4.8 Selepas pendaftaran berjaya, Peserta Yang Layak akan berhak untuk mengambil bahagian di dalam Kempen ini menurut Terma dan Syarat di sini. 5.0 Kriteria Penyertaan 5.1 Bagi tujuan Kempen, jam 00:00 hingga jam 23:59 berdasarkan waktu Malaysia seperti yang direkodkan dalam sistem Bank akan dianggap satu (1) hari ( Hari Kempen ). 12 5.3 Semua Peserta Yang Layak bersetuju dan memberi kuasa kepada Bank untuk mendedahkan butiran peribadi mereka (termasuk tetapi tidak terhad kepada nama, nombor KP baharu bagi rakyat Malaysia/nombor pasport untuk bukan rakyat Malaysia, nombor telefon mudah alih/telefon dan alamat surat-menyurat) hanya setakat yang diperlukan oleh penyedia perkhidmatan Bank bagi tujuan Kempen ini. Semua Peserta Yang Layak juga bersetuju dan membenarkan Bank untuk memaparkan dan/atau menerbitkan maklumat dan/atau bahan, termasuk tetapi tidak terhad kepada nama dan gambar bagi tujuan pengiklanan dan publisiti dalam sebarang cara yang difikirkan sesuai oleh Bank. Dengan mengambil bahagian di dalam Kempen ini, Peserta Yang Layak dengan ini bersetuju dengan dan akan patuh kepada semua Terma dan Syarat ini dan telah membaca, memahami dan bersetuju dengan Notis Privasi yang boleh dilayari di [ ]. 6.0 Penyertaan Masuk 6.1 Tertakluk kepada Terma dan Syarat yang akan dinyatakan selepas ini, semua Peserta Yang Layak yang memenuhi kriteria kelayakan yang berikut semasa Tempoh Kempen akan berhak memperolehi bilangan Penyertaan Masuk seperti yang disenaraikan di bawah: Kriteria Kelayakan Penyertaan Masuk Kempen (yang layak untuk semua kategori Hadiah) Mendaftar untuk AmOnline (Tidak terpakai untuk Peserta Yang Layak yang telah mendaftar untuk AmOnline sebelum Tempoh Kempen) atau Melaksanakan urus niaga Bayaran Bil melalui AmOnline* atau Melaksanakan urus niaga Tambah Nilai Prabayar melalui AmOnline Bilangan Penyertaan Masuk 10 Nota: * Penyertaan masuk yang diperolehi daripada urus niaga Bayaran Bil melalui AmOnline hanya terhad kepada satu nombor akaun bil sahaja dan akan disegarkan semula pada bulan yang berikutnya. Contoh seperti di bawah: Senario 1: Sekiranya pelanggan A melaksanakan satu urus niaga untuk nombor akaun bil 1234, pelanggan A akan memperolehi 10 penyertaan masuk. Jika pelanggan melaksanakan urus niaga yang lain untuk nombor akaun bil yang sama pada bulan yang sama, beliau tidak akan diberi penyertaan masuk. Penyertaan masuk hanya akan diberikan jika beliau melaksanakan urus niaga bayaran bil untuk nombor akaun bil yang sama pada bulan yang berikutnya. Senario 2: Sekiranya pelanggan B melaksanakan berbilang urus niaga untuk nombor akaun bil 5678, pelanggan B akan memperolehi 10 penyertaan masuk. Senario 3: Sekiranya pelanggan C melaksanakan satu urus niaga untuk nombor akaun bil 2468, diikuti dengan satu urus niaga lain untuk nombor akaun bil yang sama (kerana urus niaga yang pertama tidak membayar bil sepenuhnya), maka pelanggan C akan memperolehi 10 penyertaan masuk. Pelanggan hanya boleh memperolehi 10 penyertaan masuk bagi setiap nombor akaun bil bagi setiap bulan. 6.2 Penyertaan masuk yang diperolehi semasa Tempoh Kempen akan hanya sah sekiranya Peserta Yang Layak mendaftar seperti kriteria yang dinyatakan dalam Klausa 4.1. Apabila Peserta Yang Layak telah berdaftar, semua Penyertaan Masuk yang diperolehi semasa Tempoh Kempen akan diambil kira untuk Kempen ini. 13 7.0 Hadiah 7.1 Berikut ialah ( Hadiah ) untuk dimenangi, tertakluk pada had maksimum seperti yang dinyatakan di bawah bagi setiap kategori Hadiah: Tier Kategori Hadiah Bilangan Pemenang 1 Hadiah Utama Mini Cooper S (Auto 2.0) Hadiah Harian RM Wang Tunai 5 setiap Hari Kempen untuk 98 Hari Jumlah Bilangan Pemenenang 7.2 Peserta Yang Layak yang telah memenangi Hadiah Harian masih boleh memenangi Hadiah Utama. 7.3 Bilangan maksimum hadiah yang boleh dimenangi oleh seorang Peserta Yang Layak di sepanjang Tempoh Kempen ialah hanya satu (1) bagi setiap kempen yang dianjurkan oleh Bank. Sekiranya Peserta Yang Layak disenaraipendekkan untuk memenangi berbilang hadiah daripada berbilang kempen yang dianjurkan oleh Bank, Peserta Yang Layak akan berhak untuk memenangi hanya satu (1) hadiah mengikut budi bicara mutlak Bank. 7.4 Hadiah tidak boleh dipindah milik kepada mana-mana pihak ketiga dan tidak boleh ditukar dengan wang tunai, kredit atau sebarang bentuk lain. 8.0 Pemilihan Pemenang 490 (A) Hadiah Utama 1 Pemenang x Hadiah Utama: Mini Cooper S (Auto 2.0) 8.1 Sistem automatik Bank akan memberikan setiap Penyertaan Masuk yang diperolehi oleh semua Peserta Yang Layak semasa Tempoh Kempen nombor siri uniknya masing-masing, yang kemudiannya digunakan untuk menyusun semua Penyertaan Masuk dalam susunan angka menaik. Susulan kepada penyusunan ini, setiap Penyertaan Masuk diberi nombor jujukan bermula dari 1 untuk nombor siri dengan nilai terendah ( Nombor Jujukan ). 8.2 Susulan pernomboran seperti yang dinyatakan dalam Klausa 8.1, jumlah bilangan Penyertaan Masuk akan dibahagi dengan dua puluh (20) untuk mendapat nilai pendarab bagi menyenarai pendek dua puluh (20) Peserta Yang Layak ( Pemenang Hadiah Utama Berpotensi ). Contoh: 1,200,000 Jumlah Penyertaan Masuk dibahagi dengan 20 untuk mendapat nilai pendarab 60,000, yang bermakna Peserta Yang Layak dengan Penyertaan Masuk ke60,000 dan darabannya: Penyertaan Masuk ke120,000, ke180,000 sehingga ke1,200,000 ialah Pemenang Hadiah Utama Berpotensi yang disenarai pendek. 8.3 Seorang Peserta Yang Layak hanya boleh disenarai pendek sekali sahaja untuk Hadiah Utama. Sekiranya Peserta Yang Layak yang sama disenarai pendek lebih daripada sekali untuk Hadiah Utama, Peserta Yang Layak tersebut akan hanya disenarai pendek berdasarkan Nombor Jujukan terendah beliau. Penyertaan Masuk beliau yang lain akan diabaikan dan Peserta Yang Layak dengan Nombor Jujukan yang berikutnya akan disenarai pendek, seperti contoh di bawah: Contoh berdasarkan Klausa 8.2: Jika Penyertaan Masuk ke60,000 dan ke180,000 ialah daripada Peserta Yang Layak yang sama, maka beliau akan hanya disenarai pendek berdasarkan Penyertaan Masuk ke60,000. Bagi Penyertaan Masuk ke180,000 yang tidak terpilih, Pemenang Hadiah Utama Berpotensi yang disenarai pendek berikutnya, iaitu Penyertaan Masuk ke240,000 akan disenarai pendek. 14 8.4 Pemenang Hadiah Utama Berpotensi yang disenarai pendek dengan Nombor Jujukan terendah akan dihubungi untuk sesi soal jawab yang dirakam melalui panggilan telefon ke nombor telefon mudah alih mereka yang disenggara dalam sistem Bank, antara pukul 8.45pagi hingga 5.45ptg dari Isnin hingga Khamis dan antara pukul 8.45pagi hingga 4.45ptg pada hari Jumaat (kecuali cuti umum), dalam masa dua belas (12) minggu dari tarikh tamat Tempoh Kempen, mengikut budi bicara mutlak Bank. 8.5 Pemenang Hadiah Utama Berpotensi yang disenarai pendek akan dikehendaki menjawab sehingga tiga (3) soalan dengan betul ("Soal jawab Telefon") untuk disahkan sebagai pemenang Hadiah Utama ("Pemenang Hadiah Utama ). 8.6 Bank akan membuat tiga (3) percubaan untuk menghubungi Pemenang Hadiah Utama Berpotensi. Jika percubaan pertama gagal atas sebab-sebab seperti tiada jawapan, nombor telefon tiada dalam perkhidmatan, tiada hubungan atau sebarang sebab lain apa jua pun, maka Bank akan membuat dua (2) lagi percubaan dalam masa dua (2) hari kalendar pada waktu berikutnya yang tersedia menurut budi bicara mutlak Bank. Jika percubaan terakhir juga tidak berjaya, maka Pemenang Hadiah Utama Berpotensi yang disenarai pendek tersebut akan tersingkir dan tidak layak untuk memenangi Hadiah. Pemenang Hadiah Utama Berpotensi berikutnya dengan Nombor Jujukan terendah daripada senarai dalam Klausa 8.1 dan 8.2 akan dinaikkan untuk memenangi Hadiah Utama. Contoh berdasarkan Klausa 8.2: Jika Peserta Yang Layak dengan Penyertaan Masuk yang ke60,000 untuk Hadiah Utama tersingkir kerana tiga (3) percubaan untuk menghubungi beliau gagal, maka Pemenang Hadiah Utama Berpotensi yang disenarai pendek berikutnya, iaitu Penyertaan Masuk ke120,000 untuk Hadiah Utama, akan dinaikkan dan disenarai pendek. Proses ini akan berterusan sehingga seorang Pemenang Hadiah Utama Berpotensi dapat dihubungi dan menerima Hadiah Utama. 8.7 Setakat yang dibenarkan oleh undang-undang, Bank tidak akan bertanggungjawab ke atas sebarang panggilan telefon yang dibuat kepada Pemenang Hadiah Utama Berpotensi yang tidak disudahkan, terputus, tidak dijawab atau diteruskan disebabkan Peserta Yang Layak tersebut tidak dapat menerima panggilan pada tarikh dan masa yang ditetapkan dan/atau kerana apa-apa sebab lain apa jua pun. (B) 490 Pemenang x Hadiah Harian: RM100 Wang Balik 8.8 Sistem automatik Bank menyenaraikan semua Penyertaan Masuk, yang diperolehi oleh semua Peserta Yang Layak semasa setiap Hari Kempen berdasarkan Nombor Jujukannya masingmasing seperti yang diterangkan dalam Klausa Susulan pernomboran seperti yang dinyatakan dalam Klausa 8.1, jumlah bilangan Penyertaan Masuk untuk setiap Hari Kempen akan dibahagi dengan lima (5) untuk mendapat nilai pendarab bagi menyenarai pendek lima (5) Peserta Yang Layak ( Pemenang Hadiah Harian Berpotensi ). Contoh: 1,200,000 Jumlah Penyertaan Masuk akan dibahagi dengan 5 untuk mendapat nilai pendarab 240,000, yang bermakna Peserta Yang Layak dengan Penyertaan Masuk ke240,000 dan darabannya: Penyertaan Masuk ke480,000, ke720,000 sehingga ke1,200,000 ialah Pemenang Hadiah Harian Berpotensi yang disenarai pendek Seorang Peserta Yang Layak hanya boleh disenarai pendek sekali sahaja untuk Hadiah Harian. Sekiranya Peserta Yang Layak yang sama disenarai pendek lebih daripada sekali untuk Hadiah Harian, beliau akan hanya disenarai pendek berdasarkan Nombor Jujukan terendah beliau. Penyertaan Masuk beliau yang lain akan diabaikan dan Peserta Yang Layak dengan Nombor Jujukan berikutnya pula akan disenarai pendek, seperti contoh di bawah: - Contoh berdasarkan Klausa 8.2: Jika Penyertaan Masuk ke240,000 dan ke720,000 ialah daripada Peserta Yang Layak yang sama, maka beliau akan hanya disenarai pendek berdasarkan Penyertaan Masuk ke240,000. 15 terpilih, Pemenang Hadiah Harian Berpotensi yang disenarai pendek berikutnya, iaitu Penyertaan Masuk ke960,000 akan disenarai pendek Untuk setiap Hari Kempen, lima (5) Pemenang Hadiah Harian Berpotensi yang disenarai pendek dengan Nombor Jujukan terendah akan dihubungi untuk sesi soal jawab melalui SMS ke nombor telefon mudah alih mereka yang disenggara dalam sistem Bank, antara pukul 8.45pagi hingga 5.45ptg dari Isnin hingga Jumaat (kecuali cuti umum), dalam masa dua belas (12) minggu dari tarikh tamat Tempoh Kempen, mengikut budi bicara mutlak Bank. Pemenang Hadiah Harian Berpotensi yang disenarai pendek akan dikehendaki menjawab satu soalan dengan betul melalui jawapan SMS dalam masa tiga (3) hari kalendar dari tarikh SMS dihantar oleh Bank ("Soal Jawab SMS") untuk disahkan sebagai pemenang Hadiah Harian ("Pemenang Hadiah Harian"). Tarikh akhir (iaitu tarikh dan masa) untuk menjawab soalan akan dinyatakan dalam SMS tersebut. Hanya satu (1) percubaan untuk menjawab soalan dibenarkan Untuk mengelakkan sebarang keraguan, semua Peserta Yang Layak akan menanggung cajcaj telekomunikasi standard yang dikenakan oleh penyedia perkhidmatan telekomunikasi masing-masing untuk setiap jawapan SMS. Sekiranya terdapat berbilang jawapan SMS daripada Peserta Yang Layak, hanya jawapan SMS terawal yang diterima oleh Bank berdasarkan tarikh dan masa seperti yang direkodkan oleh sistem Bank akan diterima Sekiranya Pemenang Hadiah Harian Berpotensi yang disenarai pendek gagal menjawab Soal Jawab SMS dengan betul atau sebelum tarikh akhir yang telah ditetapkan dalam Klausa 8.11, maka Peserta Yang Layak tersebut akan tersingkir dan tidak layak untuk memenangi Hadiah Harian. Hadiah tersebut akan diberikan kepada Peserta lain. 9.0 Pemenang 9.1 Bank akan memaklumkan kepada semua Pemenang melalui SMS/telefon/kiriman mel elektronik/mel berdasarkan butiran perhubungan mereka yang terdapat dalam sistem Bank. Walaupun setelah menyatakan kaedah sebelum ini, Bank berhak menggunakan sebarang saluran atau kaedah lain, termasuk laman web Bank di yang difikirkan wajar menurut budi bicara mutlaknya bagi tujuan mengumumkan para Pemenang. 9.2 Pemenang Kempen akan dikehendaki untuk menghadiri majlis penyampaian hadiah dan/atau lain-lain program publisiti dengan menanggung sendiri kos dan perbelanjaan pada dan bila dikehendaki seperti yang dimaklumkan oleh Bank melalui panggilan telefon dan/atau mel elektronik tentang tarikh, masa dan tempat majlis penyampaian hadiah dan/atau lain-lain program publisiti tersebut. Bank akan membuat tiga (3) percubaan untuk menghubungi para Pemenang. Jika seseorang Pemenang gagal untuk dihubungi selepas semua percubaan ini, Bank tidak akan membuat percubaan selanjutnya atau jika Pemenang berjaya dihubungi tetapi gagal menghadiri majlis dan/atau program yang sedemikian tanpa sebarang alasan yang sah, Bank berhak untuk mengambil semula Hadiah Pemenang tersebut dan memilih Peserta Hadiah Yang Disenarai Pendek seterusnya melalui S&J sebagai Pemenang. 9.3 Hadiah-hadiah Harian akan dikreditkan ke dalam akaun semasa atau simpanan AmBank/AmBank Islamic Pemenang dalam masa dua belas (12) minggu dari Tempoh Kempen berakhir.
