8 Community Improvement Pln August 9, 2016 Executive Summry The City of Pembroke, strtegiclly locted within the Ottw Vlley, possesses storied history, superb nturl beuty, nd bright future. With Pembroke s recent economic nd demogrphic growth nticipted to continue, the City hs issued this Community Improvement Pln (CIP) to encourge redevelopment, privte sector investment, community beutifiction, nd ssist in directing new development. A CIP is plnning nd economic development tool tht sets out frmework to ssist in community revitliztion nd chieving economic, community plnning nd urbn development gols. This CIP covers the legisltive context, community enggement, gols nd vision, Cityinitited projects, finncil incentive progrms, mrketing strtegies, design guidelines, nd monitoring progrm. A CIP Working Group ws estblished to guide the project. This group consisted of members of City Council, City stff, developers, business owners nd other community members. In ddition, members of the public nd locl businesses were invited to contribute through surveys nd open house events. Through consulttion with the Working Group nd the public, vision sttement nd gols were developed. The finl CIP will be refined through further enggement with the public nd the Working Group. This CIP proposes severl City-initited projects. Wterfront redevelopment my be initited through public privte prtnerships. Cpitl improvements should be implemented on Pul Mrtin Drive in ddition to other locl rods. The City should lso complete the wterfront tril system envisioned in the originl wterfront pln. Vrious finncil incentives hve been developed to encourge redevelopment. These incentives include grnts for improving ccessibility, creting ffordble living ccommodtion, creting downtown housing, brownfield redevelopment, plnning nd building permit fees, nd fçde improvements. Property improvements, redevelopment nd infill re lso encourged through tx increments. These finncil incentives re tilored to promote specific types of development nd thus steer development towrds the City s overrching gols nd objectives. To fcilitte implementtion of the incentives, design guidelines were lso creted. The mrketing strtegy proposed in the CIP consists of few key components: emphsizing the City s website nd socil medi presence; production of printed mterils explining the CIP nd the incentives; promotionl webinrs to provide further eduction on the CIP nd how property owners cn mke use of it; nnul reporting on key metrics of the CIP; nd, celebrting successes. The ultimte success of the CIP will require implementing progressive mrketing strtegy, nnul review nd reporting on the uptke, identifying lessons lerned, nd cknowledging relistic priorities nd chnges in mrket nd economic conditions tht my fluctute yer to yer. 11 Community Improvement Pln August 9, Introduction The City of Pembroke, with popultion of 16,200 nd growing, is the lrgest full-service centre between the City of Ottw nd the City of North By. Its strtegic loction long the Ottw River in the County of Renfrew, in close proximity to the Province of Quebec, provides unique opportunities for economic growth nd prosperity. The City is t the intersection of the TrnsCnd Highwy 17 nd Provincil Highwy 41, which ultimtely connects to the mjor Provincil Highwy 401 corridor, providing esy nd ccessible trnsporttion connections to mjor mrkets. Figure 1-1 illustrtes Pembroke s loction within the Ottw Vlley context. Figure 1-1: Context mp showing Pembroke reltive to nerby cities nd highwys. A community once bsed on strong logging industry hs developed over time nd in recent yers hs seen thrust of mjor developments including the new Algonquin College Wterfront Cmpus, nd new hedqurters for the Ontrio Provincil Police. The City hs undertken mjor improvements long its wterfront including bordwlk, new mphithetre, gzebos nd other prk nd open spce menities. The City retined MMM Group Limited, WSP compny in December 2015 to ssist in completing of the CIP on its behlf. This Community Improvement Pln (CIP) consists of the following sections: Plnning nd Policy Context (Section 2); Community Enggement (Section 3); Vision nd Gols of the CIP (Section 4); City-Initited Projects (Section 5); Pge 1

12 Finncil Incentive Progrms (Section 6); Design Guidelines (Section 7); Mrketing Strtegy (Section 8); Monitoring nd Evlution Report (Section 9); nd, Amendments/Adjustments to the CIP (Section 10). 1.1 Wht is Community Improvement Pln? Community Improvement Pln August 9, 2016 A Community Improvement Pln (CIP) is plnning nd economic tool legislted under Section 28 of the Ontrio Plnning Act nd under Section of the Municipl Act. CIPs set out frmework to ssist in community revitliztion nd often serve s ctlyst for chieving economic, community plnning nd urbn development gols. Municiplities estblish policies in their Officil Plns to define CIP project res which cn include lrge res of municiplity or trgeted res. Typiclly, CIPs include wide rnge of finncil incentive progrms nd policies tht encourge revitliztion nd redevelopment, privte investment, nd support strtegic municipl inititives. CIPs provide severl community benefits: Stimulte privte sector investment in trgeted res through grnts nd lons from the City; Promote revitliztion nd plce-mking to ttrct tourism, business investment nd economic development opportunities; Develop ffordble housing; Promote brownfield clenup nd redevelopment; Enhnce streetscpes nd building fçdes; nd Effectively use community infrstructure. Generlly, CIPs re not used to promote greenfield development, but rther to improve conditions in existing urbn res. For exmple, the City of Pembroke hs n existing Improvement Progrm which provides grnts for fçde improvements mde to buildings in the downtown re. The new CIP will complement the existing Improvement Progrm, which will remin in effect. The most common use of CIP is to enble grnts to ssist property owners in mking improvements to privte property, including improvements to fçde, signge, lndscping nd to ssist in the costs of improving historic properties. In some cses, CIPs re used to promote the remedition nd redevelopment of brownfield sites (defined in Section 1.1.2), s well s the revitliztion of commercil, industril, institutionl nd even rurl res. Under CIP, municiplity my issue grnts nd lons to ssist with redevelopment nd infill development projects, by incentivizing txtion increses (tx increment equivlent grnts), providing grnts for plnning nd ppliction fees, or providing direct grnts or lons to help finnce redevelopment nd intensifiction projects. A key component of CIP is the eligibility criteri tht stipulte the conditions nd gols by which n ppliction for finncil incentive will be evluted. For exmple, to be eligible for fçde improvement grnt, CIP my require consistency with urbn design guidelines or criteri. By pplying eligibility criteri to the finncil incentive progrms, the CIP cn dvnce wide rnge of plnning, urbn design nd economic development objectives. The success of CIP will require strong mrketing strtegy, monitoring progrm, nd periodic reviews of the incentive progrms to determine the relevncy to current economic conditions, forecsts, nd trends. According to the City s Officil Pln policies in Section 4.2 Residentil, the City shll provide for rnge of housing types nd densities to meet the current nd future needs of residents. The Officil Pln contins policies tht define ffordble to be: in the cse of ownership housing, housing for which the purchse price is t lest 10 percent below the verge purchse price of resle unit in the regionl mrket re nd in the cse of rentl housing, unit for which the rent is t or below the verge mrket rent of unit in the regionl mrket re (Section , Policy 7 (c) (d)). It is Council s policy to estblish minimum trget of 25% of new units to be ffordble. Any plns for development of ffordble housing should consider the County of Renfrew 10 Yer Housing nd Homelessness Pln, 2013 which includes the City of Pembroke Wht re Brownfields? The term brownfield is used to describe undeveloped or previously developed properties tht my be contminted. They re usully, but not exclusively, former industril or commercil properties tht my be underutilized, derelict, or vcnt. Exmples of brownfield sites include former gs sttions, dry-clening estblishments, industril sites, which often hve some form of contmintion. These sites re often locted t strtegic loctions with good trnsporttion ccess nd visibility, municipl servicing, thus providing prime cndidte res for redevelopment. 1.2 Project Are In the City s Officil Pln, Policy estblishes the entire City s Community Improvement Policy Are. The study re for this CIP is in keeping with the Officil Pln policy nd is illustrted in Figure 1-2. The City encompsses pproximtely squre kilometers (1,543 hectres or 3,813 cres). Locted pproximtely 150 kilometres west of Ottw, the City is regionl service provider, economic nd commercil hub for nerby popultion centres. Its loction long the Ottw River lso provides the City with extensive wterfront lnds. The City is lso locted roughly 40 kilometres est of Algonquin Prk. The City is situted long Highwy 17 which continues westwrd to North By nd estwrd to Arnprior where it trnsitions to Highwy 417 nd continues to Ottw. Pembroke possesses severl industril prks situted ner this trnsporttion corridor, concentrted on Pul Mrtin Drive, Boundry Rod Est nd Upper Vlley Rod. A Cndin Ntionl ril line nd Cndin Pcific ril line, both inctive, trverse the City from est to west. The City s popultion hs been incresing since 2006 nd is nticipted to grow in the future with ongoing opportunities for development. Pge 3

15 2 Plnning Context nd Policy Review 2.1 Plnning Act Community Improvement Pln August 9, 2016 The Plnning Act outlines the tools, methods nd procedures tht municiplities cn use to pln for nd regulte the use of lnd nd buildings in Ontrio. The Act lso outlines the powers tht cn be exercised through Community Improvement Pln. Section 28 (1) of the Plnning Act defines community improvement s: the plnning or replnning, design or redesign, resubdivision, clernce, development or redevelopment, construction, reconstruction nd rehbilittion, improvement of energy efficiency, or ny of them, of community improvement project re, nd the provision of such residentil, commercil, industril, public, recretionl, institutionl, religious, chritble or other uses, buildings, structures, works, improvements or fcilities, or spces therefore, s my be pproprite or necessry. Section 28 of the Plnning Act llows municiplities with provisions in their Officil Plns relted to community improvement to prepre nd dopt Community Improvement Plns for designted community improvement project res (Section 28 (2)). A community improvement project re is the re to which the Community Improvement Pln pplies, nd is pssed s by-lw by Council (Section 28 (3)). The City of Pembroke currently hs Downtown Heritge Fçde CIP in plce which provides grnts for fçde improvements. The project re of the Downtown Heritge Fçde CIP is generlly bounded by Mcky Street on the est, Renfrew Street on the south, Christie Street on the west nd the Ottw River on the north. There re vriety of resons tht n re cn be designted s n re for community improvement. The criteri for designtion include: ge, dilpidtion, overcrowding, fulty rrngement, unsuitbility of buildings or for ny other environmentl, socil or community economic development resons. (Section 28 (1)) The brod nture of the definition provides municiplities with flexibility to ddress community improvement issues tht re locl in nture such s downtown revitliztion, s well s issues tht re more generlly present in the municiplity t lrge such s the presence of brownfields. Where by-lw designting community improvement project re hs been pssed, Council my dopt pln in ccordnce with selected subsections under Section 17 of the Plnning Act. Section 17 outlines the sttutory process for dopting the document, including the provision of t lest one public meeting to be held 20 dys prior to mking the Community Improvement Pln publicly vilble for review. When Community Improvement Pln comes into effect, Minister pprovl is no longer required for cquiring lnd, provided the Pln provides for the cquisition nd improvement of lnd (Section 28(3)). The Community Improvement Pln my be used by the municiplity to: Pge 5

16 nd/or: Community Improvement Pln August 9, 2016 construct, repir, rehbilitte or improve buildings on lnd cquired or held by it in the community improvement project re in conformity with the Community Improvement Pln, nd sell, lese or otherwise dispose of ny such buildings nd lnd ppurtennt thereto. (Section 28(6)) sell, lese or otherwise dispose of ny lnd cquired or held by it in the community improvement project re ny person or governmentl uthority for use in conformity with the community improvement pln. (Section 28 (6b)) This enbles the municiplity to directly intervene in mking improvements to property, or to build new buildings nd fcilities, s needed. Under Section 28(7), the municiplity my issue grnts nd lons to property owners nd tennts to ssist in pying for eligible costs. Eligible costs is brodly defined to include costs relted to environmentl site ssessment, environmentl remedition, development, redevelopment, construction nd reconstruction of lnds nd buildings for rehbilittion purposes or for the provision of energy efficient uses, buildings, structures, works, improvements or fcilities (Section 28(7.1)). Under no circumstnce cn the mount of grnt or lon mde in respect of prticulr lnds nd buildings exceed the eligible cost of the community improvement pln with respect to those lnds nd buildings (Section 28(7.3). The Plnning Act lso contins provisions which llow the municiplity to enter into greements concerning ny issued grnts or lons, nd llow the municiplity to register the greement ginst the title of the lnd (Section 28(11)). Once Council is stisfied tht Community Improvement Pln hs been crried out, Council my pss by-lw to dissolve the community improvement project re, which renders ny previously effected Community Improvement Plns non-pplicble(section 28(13)). In ddition to Section 28, Section 69 of the Plnning Act llows municiplities to reduce or wive the mount of fee in respect of plnning ppliction where it feels pyment is unresonble. Mny Community Improvement Plns offer ppliction fee refunds s finncil incentive. 2.2 Municipl Act The Municipl Act prohibits municiplities from directly or indirectly ssisting ny mnufcturing business or other industril or commercil enterprise through the grnting of bonuses (Section 106(1)). Prohibited ctions include (Section 106(2)): ) giving or lending ny property of the municiplity, including money; b) gurnteeing borrowing; c) lesing or selling ny property of the municiplity t below fir mrket vlue; or d) giving totl or prtil exemption from ny levy, chrge or fee. 17 Community Improvement Pln August 9, 2016 Section 106(3) of the Municipl Act provides n exception to the bove, where municiplity my exercise powers under Section 28(6), (7) or (7.2) of the Plnning Act or Section of the Municipl Act. By llowing n exception to the Section 106(1), the Municipl Act provides municiplity with power nd tools for community improvement. This includes tools relted to the remedition nd redevelopment of brownfield properties. Brownfield properties re considered to be properties tht re (or re perceived to be) environmentlly contminted s result of prior lnd use (i.e. phse two environmentl site ssessment hs been conducted nd which did not meet the stndrds specified under Section 168.4(1) of the Environmentl Protection Act). Section of the Municipl Act llows municiplities to provide property tx ssistnce to eligible properties to offset ll or portion of remedition costs. The Municipl Act provides municiplities with the uthority to cncel or defer the municipl portion of property txes on eligible properties. It is noted tht this section of the Municipl Act does not specificlly ddress opportunities for providing finncil ssistnce to residentil properties. Typiclly, however, Community Improvement Plns re intended to focus on commercil properties, but there re exmples of Community Improvement Plns tht provide limited funding opportunities for specified types of residentil properties (e.g., funding for historic residentil properties or funding to crete new residentil units). Municiplities my lso pply to the Province to mtch the municipl tx rebte with the eduction portion of the property tx through its Brownfields Finncil Tx Incentive Progrm (BFTIP). Under the progrm, the province cn cncel ll or portion of the eduction property txes of property for up to three yers. However, pplicnts to this progrm must obtin pprovl from the Minister of Finnce. To be ble to pply for the BFTIP, Community Improvement Pln must be in plce. It should be noted tht the experience with the BFTIP on the prt of other municiplities hs demonstrted tht the ppliction process cn be complex nd the turnround time for decision from the Province cn be considerble. However, considertion should be mde to enble the progrm in the Community Improvement Pln. The City my choose to pursue BFTIP on behlf of lndowner in tril run nd, if the process is too onerous, the City my cese to utilize the progrm. Section 107 of the Municipl Act outlines the powers municiplity hs to mke grnts, including the power to provide grnt in the form of lon or by gurnteeing lon, subject to criteri outlined in Section 106. Additionl powers include: selling or lesing lnd for nominl considertion or grnting lnd; providing lnd owned nd occupied by the municiplity for use by nyone upon terms estblished by council; nd selling, lesing or disposing of ny municipl property t nominl price, or by wy of grnt, to provide for the use of the property on terms estblished by council. Additionlly, the Municipl Act lso llows municiplities to provide tx relief to owners of eligible heritge properties (Section 365.2). Municiplities my pss by-lw to estblish locl progrm to provide tx reductions or refunds to owners of eligible heritge properties. To be eligible, properties must be designted under Prt IV of the Ontrio Heritge Act, or prt of Heritge Pge 7

18 Community Improvement Pln August 9, 2016 Conservtion District designted under Prt V of the Ontrio Heritge Act, or subject to seprte heritge conservtion greement between the owner nd the municiplity. The ppliction of such progrm my be delt with s municipl ledership strtegy through Community Improvement Pln. 2.3 Ontrio Heritge Act The Ontrio Heritge Act hs relevnce to the preprtion of Community Improvement Pln, since the CIP my contemplte heritge conservtion through finncil incentives or municipl ledership progrms. Under Section 39(1) of the Ontrio Heritge Act, municiplities my pss by-lws to implement seprte grnt or lon progrms to ssist owners of heritge properties designted under Prt IV of the Act, in pying for ltertions to the property, in line with the terms estblished by the by-lws. There re 4 designted heritge properties, identified in Tble 2-1, which re owned by the City. Currently, the City does not mintin municipl heritge register or dminister ny incentive progrms for heritge properties. This hs been used by some municiplities s the bsis for finncil incentive in CIP. The City hs recently dopted new Development Chrges (DC) By-lw (By-lw ) Development Chrges By-lw The City s Development Chrges By-lw ( ) imposes chrges ginst lnd where its development would increse the need for municipl services (e.g. fire services, trnsporttion services, environmentl services, recretion nd culturl services, nd other services such s the Development Chrges Bckground Study) nd requires one of the following: pssing of zoning bylw or zoning by-lw mendment, pprovl of minor vrince, conveynce of lnd, pprovl of pln of subdivision, consent, pprovl of description under Section 50 of the Condominium Act, or the issunce of permit under the Ontrio Building Code. The chrges pply to ll residentil nd non-residentil uses (mening purposes other thn dwelling unit including commercil, institutionl nd industril) within the City s limits. The City reserves the right to exempt lnd, buildings or structures from the chrges imposed by the By-lw. For residentil uses, the chrge depends upon the proposed density. The new DCs per unit re s follows: $3, for low density, $3, for medium density nd $2, for high density. Pge 8

19 Community Improvement Pln August 9, 2016 For non-residentil uses, the chrge is determined by squre footge of the proposed development. The new DC for non-residentil is $0.89 per squre foot. An understnding of the Development Chrges By-lw is relevnt becuse some CIPs incorporte incentive progrms to offset the cost of development chrges. Such n incentive cn help reduce the cost of development nd promote prticulr type of development or redevelopment in trgeted re. 2.5 Accessibility for Ontrins with Disbilities Act The Accessibility for Ontrins with Disbilities Act (AODA) estblishes the frmework for the development of province-wide mndtory stndrds on ccessibility in ll res of dily life. It guides the design of buildings through mendments to the Ontrio Building Code, s well s public spces tht re considered to be new construction or undergo mjor chnges to existing fetures. Revitliztion nd redevelopment efforts supported by the CIP will need to consider AODA stndrds. 2.6 Provincil Policy Sttement The 2014 Provincil Policy Sttement (PPS) outlines the Province s policies with respect to community plnning in Ontrio. Though the PPS does not explicitly reference Community Improvement Plns, it generlly supports the revitliztion of Ontrio s urbn res through specific policies. Policy promotes the regenertion of settlement res. Policy sttes tht plnning uthorities re to identify loctions nd promote opportunities for intensifiction nd redevelopment including brownfield redevelopment. The PPS defines brownfield sites s: Undeveloped or previously developed properties tht my be contminted. They re usully, but not exclusively, former industril or commercil properties tht my be underutilized, derelict or vcnt. Helthy, livble nd sfe communities should be promoted through vrious mens including the improvement of ccessibility for persons with disbilities nd older persons, by identifying, preventing nd removing lnd use brriers which restrict their full prticiption (Policy 1.1.1(f)). The long term economic prosperity is promoted by Policy 1.7, which is to be supported by, mong other mens, the revitliztion of downtowns nd min streets is promoted by Policy 1.7.1(c), nd through the promotion of brownfield site redevelopment (Policy (e)). The PPS lso promotes the provision of ffordble housing. Policy requires tht plnning uthorities provide n pproprite rnge nd mix of housing types nd densities to meet current nd future demnd by estblishing nd implementing minimum trgets for the provision of housing which is ffordble to low nd moderte income households. Through Policy 2.6, the PPS requires the conservtion of culturl heritge resources. Specificlly, Policy sttes tht Significnt built heritge resources nd significnt culturl heritge lndscpes re to be conserved. Pge 9

20 Community Improvement Pln August 9, 2016 Further, the proponent of development nd site ltertion on lnds djcent to protected heritge resources must demonstrte tht the heritge ttributes of the protected property will be conserved (Policy 2.6.3). The 2016 OP is reltively minor updte to the 2008 OP nd it focuses on second units, wildlnd fire hzrds, nturl heritge fetures nd policies regrding the former Cndin Pcific ril line. The 2016 OP is intended to guide development within the City to the yer Section 2.3 of the OP estblishes numerous objectives to direct the City s development. Objective 11 expresses support for housing diversity for City residents: To provide for full rnge of housing types nd densities to meet demogrphic nd mrket requirements of current nd future residents of the City while mintining t ll times t lest ten yer supply of lnd designted nd vilble for new residentil development nd residentil intensifiction. The OP estblishes generl policies for numerous spects of city plnning including: nturl nd culturl heritge; brownfield sites; energy nd ir qulity; climte chnge mitigtion nd dpttion; stormwter mngement; nd, infrstructure. In terms of lnd use, the OP contins diversity of designtions including open spce, residentil, centrl commercil, shopping centre commercil, highwy commercil, industril, economic enterprise, mixed use re, institutionl nd hzrd lnds s illustrted in Figure 2-1. Closures of the rilwy corridor nd wterfront snow dump hve lso been implemented. Algonquin College s recently constructed wterfront cmpus conforms to the generl recommendtions of the study. Extension of the wterfront pthwy long Muskrt River to Pnsy Ptch Prk to fulfill the intent of the study remins Council priority. Council is lso committed to continued privte sector investment long the wterfront. 2.9 Zoning By-lw The City of Pembroke Zoning By-lw ws dopted by Council in It estblishes: How lnd my be used; Where buildings nd other structures cn be locted; The types of buildings tht re permitted nd how they my be used; nd The lot sizes nd dimensions, prking requirements, building heights nd setbcks from the street. As of Jnury, 2016, 36 grnts totlling $149, hve been pproved by the City under this CIP; totl construction vlue s result of those grnts hs been $855,084. 30 3 Community Enggement 3.1 CIP Working Group Community Improvement Pln August 9, 2016 A CIP Working Group ws estblished in Jnury, 2016 to guide nd review the project s it progresses. The Working Group includes the Myor, two Council members, City stff, developers, business owners nd other community members. A Visioning Workshop with the CIP Working Group, fcilitted by MMM/WSP, occurred on Februry 4, 2016 nd provided the foundtion for the CIP. An online version ws posted on the City s website nd hrd copies were vilble t City Hll, Pembroke Public Librry nd the City of Pembroke Recretion Deprtment office t the PMC Aren. A totl of 35 community members completed the survey; 34 completed the survey online while one respondent submitted hrdcopy. The survey provided insight into community members priorities for the CIP. The highest priorities were: encourging nd supporting privte-sector reinvestment in the downtown nd throughout the City, redevelopment of the wterfront, creting innovting incentive progrms nd enhncing streetscpes. Preserving heritge building fetures nd chrcter, improving building fçdes in other res of the City in ddition to the downtown re grnered reltively high levels of importnce mong respondents. Furthermore, the City cn demonstrte municipl ledership by improving existing municipllyowned buildings nd through lnd cquisition to enble improvements to n re. 5.2 Infrstructure Improvements to Pul Mrtin Drive In April 2016, the Province of Ontrio nnounced tht the City of Pembroke will receive $3 million through its Connecting Links progrm which provides funding for the design, construction, renewl, rehbilittion nd replcement of connecting link infrstructure. This project includes reconstruction of 1.7 kilometres of Pul Mrtin Drive from Interntionl Drive to Town Line Rod nd repirs to the Olympic Bridge on the City s Highwy 41 connecting link. Improvements to Locl Streets Bsed on the results of the community enggement events to dte, severl streets were identified s potentil cndidtes for streetscping improvements. The suggested streets included Nelson Street for streetscping, nd repving on Lke Street, Mry Street, Angus Cmpbell Drive, nd Pembroke Street. When these streets re being considered for rod work construction, the City should consider implementing streetscpe improvements in conjunction with the construction such plnting street trees, instlltion of street furniture, nd bnners. 5.3 Gtewy Signge Explore opportunities to increse nd implement Tourist-Oriented Directionl Signge long Highwy 17 with the Ministry of Tourism, Culture nd Sport nd Cndin TODS Limited, privte, third-prty compny tht opertes, mnges, mintins nd finnces this progrm on behlf of the Ministry. Signge long Highwy 17 would be intended to provide wyfinding for visitors nd to encourge through trffic to stop in Pembroke. The finncil incentive progrms hve been creted to encourge privte sector redevelopment in Pembroke. Applicnts my use individul incentive progrms, or combine multiple progrms for single site or development. This section outlines the purpose, description, nd eligibility requirements for ech finncil incentive progrm. Eligible projects my lso be ugmented with other federl nd provincil funding progrms. All progrms re subject to funding llocted by City Council on n nnul bsis. This section presents potentil options nd does not represent the finl recommended Finncil Incentive Progrms. 6.1 Generl Progrm Requirements All of the finncil incentive progrms contined in this CIP re subject to the following generl requirements, s well s the individul requirements specified under ech progrm. The generl nd progrm-specific requirements contined in this CIP re not necessrily exhustive nd the City reserves the right to include other requirements nd conditions s deemed necessry:. Eligible Costs 1. Environmentl remedition costs, including ny ction tken to reduce the concentrtion of contminnts on, in or under the property to permit Record of Site Condition (RSC) to be filed in the Environmentl Site Registry under Section of the Environmentl Protection Act; 2. Plcing clen fill nd relted grding; nd, 3. Environmentl insurnce premiums. Progrm Detils 1. Municipl Tx Assistnce:. The City my pss bylws to provide deferrl or cncelltion of ll or prt of the municipl txes on brownfield site during the Rehbilittion Period nd Development Period, s defined in Section 365.1(1) of the Municipl Act. b. The totl vlue of the tx ssistnce will not exceed the totl eligible costs, which re defined in the eligibility requirements bove. The level nd durtion of the tx ssistnce will be considered on cse-by-cse bsis. c. Prior to pssing the by-lw pproving the tx ssistnce, the City will be required to notify the Ministry of Finnce. Within 30 dys of pssing the by-lw, the City will lso be required to notify the Minister of Municipl Affirs nd Housing nd the Minister of Finnce. 2. Provincil Tx Assistnce: Pyment Detils. The City my pply for provincil Brownfields Finncil Tx Incentive Progrm, on behlf of the owner, to cncel or freeze ll or portion of the eduction component of property txes. b. The ppliction will need to be pproved by the Minister of Finnce, nd my be subject to different timeline thn the pproved Municipl Tx Assistnce. c. The City must be offering municipl tx ssistnce in order for the owner to be eligible for Provincil tx ssistnce. 1. Municipl Tx Assistnce:. Eligible Costs 1. Cretion of new residentil units in the upper storey(s) of mixed-use building in the Pembroke Business Improvement Are (PBIA); nd/or 2. Significnt improvement in the qulity of one or more existing residentil units in the PBIA which improve the qulity of life for the occupnts, increse the vlue of the unit(s), or mke the unit(s) hbitble where the unit(s) re currently considered to be inhbitble, or mke the unit ttrctive to wider rnge of income groups. This my include projects which re relted to the helth nd sfety of the residentil unit, nd required to bring the building or unit into complince with the current Ontrio Building Code, will be eligible for the grnt. This my include, but is not limited to, improvements to electricl systems nd wiring, structurl improvements or other helth nd sfety relted improvements. Progrm Detils Grnts for the rehbilittion of residentil spce or the conversion of non-residentil spce to residentil spce will be vilble to eligible pplicnts in order to provide improvements to existing residentil units. Grnts will be equl to 1/2 (50%) of the construction cost of ech unit to mximum of $5,000 per unit, to mximum of two (2) units per eligible ddress. Conversion of upper-storey spce in mixed-use or commercil building to residentil units, or mjor renovtions or improvements to upper storey residentil spce; 6. Grnts will be equl to percentge of the municipl tx increse resulting from the improvements of over $50,001 of eligible costs, nd will be pid to the owner ech yer for mximum of 10 yers t the sole discretion of the City. In order to determine the suitbility of the Tx Increment Equivlent Grnt, prior to submitting n ppliction for the progrm, eligible pplicnts my be required to estimte the totl potentil vlue of the tx increment, bsed on current ssessment vlues nd nticipted investment. 7. If the totl vlue of the Tx Increment Equivlent Grnt is significntly less thn the pplicnt s estimted vlue, t the sole discretion of the City, the pplicnt my be given the opportunity to withdrw their ppliction for the Tx Increment Equivlent Grnt progrm, nd submit n ppliction for one or more of the other incentive progrms in this Pln s my be pplicble to the project. 8. Should n eligible pplicnt be pproved for the Tx Increment Equivlent Grnt, nd if the subject property is sold, in whole or in prt, before the originl grnt period lpses, the originl owner my not be entitled to receive the remining grnt pyments, in ccordnce with the terms of the progrm greement. The pyments re lso non-trnsferrble to the new owner unless specificlly stipulted s prt of the Finncil Incentive Progrm Agreement executed between the owner nd the City. 9. If the property is sold, in whole or in prt, before the originl grnt period lpses, the originl owner is not entitled to receive the remining grnt pyments under the originl greement. Other members of the City s Review Committee my prticipte in the meeting. 2. Applicnts shll submit completed ppliction form nd ll supporting mterils s confirmed t the pre-ppliction consulttion meeting. The supporting mterils my include but shll not be limited to:. Photogrphs of the existing building or property condition; b. Historicl photogrphs or documenttion; c. Professionl or conceptul drwings nd/or plns, including drwings or plns prepred by professionl rchitect, plnner, engineer or lndscpe rchitect licensed in the Province of Ontrio; d. A site pln or lndscpe pln; e. Specifictions of the proposed works, including work pln for the improvements; f. Two (2) cost estimtes for eligible work nd/or mterils; nd/or g. Any other mterils s my be required for specific progrms, s indicted in Section Upon receipt of the ppliction nd supporting mterils, the Administrtor nd/or City s Review Committee shll complete preliminry screening of the ppliction to determine whether the ppliction is complete. The ppliction will be rejected if the ppliction is not considered complete, or if the ppliction clerly does not comply with the eligibility criteri. 4. The Administrtor my visit the subject property. 5. The City will communicte their decision to ccept or reject the ppliction to the pplicnt. 6.
