1 Summary of Proposed A&M System Member Campus Carry Rules Each Texas A&M System university and agency CEO has established these rules after consulting with the entity s students, staff, and faculty concerning the nature of the student population, specific safety considerations, and the uniqueness of the campus environment. These rules have been reviewed by the A&M System Office of General Counsel, approved by the Chancellor for submission to the Board, and will be reviewed by the A&M System Board of Regents on April 27, 2016 as required by law. The rules generally address the right of a license holder to carry a concealed handgun on the land and buildings owned or leased by the Texas A&M System university or agency. Also, each rule has an appendix summarizing and listing the pertinent state statutes which potentially prohibit the possession of firearms in certain campus locations. None of the university rules prohibit a license holder from carrying a concealed handgun in classrooms or residential facilities owned and operated, or leased and operated, by the institution. Three Texas A&M System universities (Prairie View A&M University, Texas A&M International University and Texas A&M University-Corpus Christi) have residential facilities that are leased and operated by a third-party management company, and these institutions do not oppose licensed concealed carry in campus residential facilities. However, their rules acknowledge the property rights of the management company, which include the company s right to determine restrictions on the possession and storage of weapons in those facilities. All A&M System agencies having premises located on the campus of Texas A&M University will follow the university s rule with respect to those premises. All Texas A&M System member rules authorize the university or agency CEO to prohibit concealed carry in that member s premises, as necessary for institutional safety, on a temporary basis pursuant to Section 30.06(b), Penal Code. Most Texas A&M System rules address situations in which the member is leasing premises to a third party. In these situations, the member will defer to the property rights of the lessee concerning whether concealed handguns, carried by license holders, are prohibited on the premises. The rules proposed by Texas A&M System CEOs will prohibit licensed carry of concealed handguns in certain campus locations, and effective notice under Tex. Penal Code section will be provided in such locations. Below is a listing, by category of facility, of the facilities or areas where licensed concealed carry would be prohibited, and the specific universities and agencies which propose each restriction. 1

Scientific laboratories in which: the presence of strong magnets requires the prohibition of metallic objects, including firearms, in such facilities; or the negligent discharge of a firearm will create the risk of serious physical injury or illness because of the nature of the materials present in the facility (ex. pathogenic materials, highpressure/cryogenic/flammable gases) System Offices of the A&M System A&M System Universities Texas A&M University - High hazard research areas and laboratories where the presence of high hazard materials or operations creates a significant risk of catastrophic harm due to a negligent discharge - Research areas and laboratories in which research subjects are high risk (e.g., binge drinkers, subjects with diagnosed psychological disorders, subjects diagnosed with Post-Traumatic Stress Disorder), or where the integrity of psychological research could be compromised - A university procedure will contain a process for review and approval of locations by the president Prairie View A&M University Tarleton State University Texas A&M International University - Science laboratories CNS 212, LBV 119, and LBV 394 Texas A&M University-Corpus Christi - Specified rooms within six campus facilities meeting the above criteria Texas A&M University-Kingsville - Campus laboratories that have, in their bounds, compressed gas cylinders, flammable organic solvents, flammable liquids, or unstable (reactive) chemicals - Third (3 rd ) floor, Irma Rangel College of Pharmacy building - TAMUK Citrus Center in Weslaco: 1) Research labs and open central lab; 2) Two Chemical Storage buildings located East of greenhouses and North of main building; 3) Auto repair shop; 4) Post harvest shed & workshop West Texas A&M University Texas A&M University-Commerce - Nuclear Storage, Room 115, Keith D. McFarland Science Building (B34) - Nuclear Magnetic Resonance Laboratory, Room 314, Keith D. McFarland Science Building (B34) 2

3 Texas A&M University-Texarkana - Laboratories that have, in their bounds, flammable organic solvents, flammable liquids, or unstable (reactive chemicals) Texas A&M University-Central Texas Texas A&M University-San Antonio A&M System Agencies Texas A&M AgriLife Research - High hazard research areas and laboratories where the presence of high hazard materials or operations creates a significant risk of catastrophic harm due to a negligent discharge, including, but not limited to, BioSafety Level 3 laboratories, animal research and care/use facilities, and areas having high magnetic fields, such as MRI research facilities -Joint facilities with USDA will follow USDA regulations Texas A&M Engineering Experiment Station Texas A&M AgriLife Extension Service Texas A&M Forest Service Texas A&M Engineering Extension Service Texas A&M Transportation Institute Texas A&M Veterinary Medical Diagnostic Laboratory - High hazard research areas and laboratories where the presence of high hazard materials or operations creates a significant risk of catastrophic harm due to a negligent discharge, including, but not limited to, BioSafety Level 3 laboratories and areas having high magnetic fields, such as MRI research facilities. 3

8 IV. Facilities in which interscholastic and collegiate sporting events are taking place. Note: Some university rules do not specifically address interscholastic (including UIL) sporting events, but state law prohibits carrying a concealed handgun on the premises in which an interscholastic event is taking place. See Tex. Penal Code (b)(2). Effective notice pursuant to Tex. Penal Code 30.06(b) is not required for this prohibition System Offices of the A&M System. 9 Texas A&M University-Kingsville - Premises on which UIL and Interscholastic events are hosted by the University and where minors are the primary attendees/audience (band camp, sports camps, engineering day, leadership conferences, etc.) - On the premises of the stadium, ballpark, gymnasium, court area, golf course, or track and field facility where the following is taking place: interscholastic sporting event; intercollegiate sporting event; or professional sporting event West Texas A&M University - Facilities used for intercollegiate or interscholastic competitions, one hour prior to and one hour following the competition - Facilities include, but may not be limited to, the following: -- First United Bank Center -- West Texas A&M University Fieldhouse, The Box -- Kimbrough Memorial Stadium -- West Texas A&M University rodeo arena -- Wilder Baseball Field -- Schaeffer Softball Park -- The Pitch West Texas A&M University Track and Field/Soccer Complex Texas A&M University-Commerce. Assigned employee offices for which the employee has demonstrated that the carrying of a concealed handgun by a license holder in the office presents a significant risk of substantial harm due to a negligent discharge of the handgun, and the president/ceo has approved the employee s request that the office be designated as an area where licensed concealed carry of a handgun is not permitted. TEEX will abide by System guidelines for that portion of the TEEX Campus located on System Property where the System gives effective notice pursuant to.
