This publication can be viewed on line at Shooting on Private Property (Yes this again) Facts: You respond to a shots fired call and find a resident shooting at a target with a.22 caliber rifle in his fenced in back yard. What can you do? Law: A shots fired report may justify entry, where the facts and circumstances create a reasonable concern there might be someone injured and/or in need of help inside. In this case, however, the person is obviously shooting at a target, and there is no reason to believe anyone is injured. A consensual encounter is likely your best course of action. If your investigation does not reveal any additional facts, you should determine if the subject is violating Florida Statute Discharging Firearm in Public or on Residential Property. This statute was amended again this legislative session and is effective as of February 24, (4) Any person who recreationally discharges a firearm outdoors, including target shooting, in an area that the person knows or reasonably should know is primarily residential in nature and that has a residential density of one or more dwelling units per acre, commits a misdemeanor of the first degree, punishable as provided in s or s This subsection does not apply: (a) To a person lawfully defending life or property or performing official duties requiring the discharge of a firearm; (b) If, under the circumstances, the discharge does not pose a reasonably foreseeable risk to life, safety, or property; or (c) To a person who accidentally discharges a firearm. It is important you note the exclusions, in particular (4)(b). These exclusions must be factored into your probable cause determination. Therefore, you must determine if the following elements exist: (1) The subject recreationally discharged a firearm outdoors, (2) The discharge occurred in an area the person knew or should have known is primarily residential and has a residential density of one or more dwelling units per acre; and (3) The discharge poses a reasonably foreseeable risk to life, safety, or property. Bottom Line: I strongly recommend you call me and/or the State Attorney s Office if you encounter this situation. The issue of what poses a reasonably foreseeable risk to life, safety, or property will need to be determined on a case by case basis. 2 Employees of the year honored at special ceremony in Marathon Sheriff s Office employees of the year were honored at a ceremony in Marathon on Friday. Dr. Gerry Diethelm presented a commendation to Sgt. Spenser Bryan, Dispatcher Amanda Robinson and Trooper Christine Gracy. The group was responsible for saving a dog s life; the family of the dog was stuck in a lengthy traffic delay due to an accident; the dog was dying and needed to get to the Marathon Veterinary Clinic ASAP. They worked together and made it happen. Great job!!!! 3 New employee Cory Snider wanted to introduce himself. He is now working at the Key West Airport as an AST. Welcome aboard, Cory! Deputy Nelson Sanchez is The Big Kahuna. He took part in a competition to raise money for the Good Health Clinic in Tavernier and raised over $6,000 to claim the title. Here he is being dunked in icy water as part of his dedication to the cause! Citizen Police Academies in all three areas of the Keys are underway. 4 Lt. Nancy Alvarez and others from the Sheriff s Office helped out with a cleanup organized by a 14 year old named Izabella. Called Help End All Litter (HEAL), she has made it her mission to clean up litter and educate others her age about the environment. This event was in Islamorada and Indian Key on February 27th. Deputies Spencer Curry, Boyd Williams, Daren Jensen, Jorge Prince, Todd Jones and Freddy Rodriguez taking care of graffiti in the Lower Keys. 5 Post 905 Explorers practice building searches in preparation for a state competition later in the year. Able teachers were SRO Deputies Larry O Neill, Dave Stark and Will Schlegelmilch. The Key Largo Children s play group visited at the Roth Building and met Lt. Al Ramirez, Capt. Don Fanelli and McGruff the Crime Dog. Monroe County Special Olympics games were held in Key West this weekend. Regional games will be held next weekend in Key West, in the Higgs Beach area beginning at 9am. Pictured are Olympians and volunteers Captain Lee Ann Holroyd and local student volunteer, Caber Bausmith, wearing white shirts. In red, Upper Keys team members Heyden Finney (left) who took three first place ribbons and Matthew Dalton who took two first place ribbons and one second place ribbon. Our own law enforcement family provides a great deal of financial support for Special Olympics in Monroe County, through the law enforcement torch run.
