3 Time for a very important installment of Ask A Legal Eagle brought to you by Sheriff Rick Ramsay and MCSO General Counsel Patrick McCullah Q: What is The Marjory Stoneman Douglas High School Public Safety Act and what does it mean for the MCSO? A: That is a very good question! Sheriff Rick Ramsay and Mr. McCullah ask that everyone read the flyer below! Please read it immediately if you have not already!

4 LEGAL UPDATE March 2018-Senate Bill 7026, the Marjory Stoneman Douglas High School Public Safety Act On March 9, 2018, Governor Rick Scott signed Senate Bill 7026, the Marjory Stoneman Douglas High School Public Safety Act into law. This act made significant changes to Florida law. However there three changes you should be aware of immediately. First, law enforcement has been provided additional authority and responsibilities when taking an individual into custody under the Baker Act. Second, law enforcement now has authority to petition the circuit court for a risk protection order to remove firearms from individuals that present a significant danger. Finally, Florida Statute was amended to cover threats of a mass shooting or an act of terrorism. An involuntary examination under the Baker Act may be initiated by a court, a law enforcement officer, or a physician, clinical psychologist, psychiatric nurse, mental health counselor, marriage and family therapist, or clinical social worker. When the involuntary examination is initiated by a court order, Florida Statute (2)(c) now allows a law enforcement officer to use reasonable force to gain entry to the premises and take custody of a person who is the subject of the order. This statute also now provides authority to a law enforcement officer who is taking a person into custody for an involuntary examination under the Baker Act to seize and hold firearms or ammunition the person possesses if the person poses a potential danger to himself or herself or others; and has made a credible threat of violence against another person. If the person is being taken into custody at the person's residence and the above criteria have been met the officer may seek the voluntary surrender of firearms or ammunition kept in the residence which have not already been seized. If such firearms or ammunition are not voluntarily surrendered, or if the person has other firearms or ammunition that were not seized or voluntarily surrendered when he or she was taken into custody, the officer must seek a risk protection order. Risk protection orders (RPO) are entirely new to Florida law. Florida Statute now provides authority for law enforcement to file a petition to seize firearms from an individual who poses a significant danger of causing personal injury to himself or herself or others by having a firearm or any ammunition in his or her custody or control or by purchasing, possessing, or receiving a firearm or any ammunition. The law also provides for a temporary ex parte risk protection order (TRPO) to be granted without notice to the respondent or a hearing if there is reasonable cause that, based on personal knowledge, the respondent poses a significant danger of causing personal injury to themselves or others in the near future by having custody, control, possession, purchase or receiving a firearm. Any person who has in his or her possession, purchases, or receives a firearm or ammunition when he or she is prohibited by a RPO commits a third degree felony. Emergency procedures, including the necessary forms, are in place to seek a RPO and/or TRPO in appropriate cases. It is imperative that all members notify their chain of command immediately of any case that might be appropriate for such action. Florida Statute , Written Threats to Kill or Do Bodily Harm or Conduct a Mass Shooting or an Act of Terrorism, was also amended. The previous version addressed threats to specific individuals. The new statute includes any person who makes, posts, transmits a threat in writing or other record, including electronic record, to conduct a mass shooting or an act of terrorism, in any manner that would allow a person to view the threat. Thus, a threat to conduct a mass shooting or an act of terrorism is unlawful if it is made, posted, or transmitted in a manner that would allow another person to view it. Such cases should be immediately investigated and acted upon. Page 1 of 2

And now for a special Easter on the Farm message from Farmer Jeanne: This Sunday is Easter on the Farm from 1 p.m. to 3 p.m. Due to the trailers in the parking lot, parking will be extremely limited. If you are helping out with the event, please arrive by 12:30 p.m. and Please Park Under The Building In The Secured Parking Lot. Farmer Jeanne and Thumper the Rabbit recently visited the children at The Basilica School of St. Mary Star of the Sea! Rock on Thumper! Good job, Jeanne! The photo in last week s Weekly Rap Up was an archived photo of Mohawk the Rabbit, who is now hopping and sniffing up in the great meadow in the sky! Mohawk, gone but never forgotten! Hop on Mohawk! 11 Semper Paratus! Happy St. Patrick s Day, Kosta! Traffic Enforcement Deputy Darren Jensen (also with the Coast Guard Reserve) was activated by the Coast Guard in support of Hurricane Maria recovery efforts. He is stationed at St. Croix and the U.S. Virgin Islands. Deputy Jensen and his crew helped raise funds to purchase school supplies and donating them to local school. They were also featured in a Caribbean newspaper article for their good work! Way to go, Deputy Jensen! (Note: Semper Paratus is the Coast Guard motto. It is Latin for, Always Ready. ) Sheriff Rick Ramsay, Middle Keys Det. Sgt. Spenser Bryan and Bryan s daughter, Kosta, enjoy the St. Patty s Day Parade in Marathon!
