1 Kutztown Police Department Core Values Statement The Professional Purpose of the Kutztown Borough Police Department is to create a community environment where the quality of life for both residents and business is enhanced. The foundation of the Police department will be based on the highest moral and ethical standards as well as a trained, professional, and progressive Police Force. In order to accomplish this, the Kutztown Police Department will strive to ensure that: We will safeguard lives and protect property, We will uphold and enforce the laws of the United States of America, the Commonwealth of Pennsylvania, and the Borough of Kutztown, We will make an unparalleled commitment to the Community by providing the best possible service, We will treat all person with respect and courtesy, We will actively promote an atmosphere of mutual respect for each other's differences, We will strive to be recognized as an organization of the highest ethical standards and unquestioned integrity and recognize that no one is above the law, We will maintain an internal environment where the free flow of information will be encouraged and exceptional performance will be the norm, We will operate as a team characterized by trust and mutual respect for each other's responsibilities, functions, skills and experience, We will recognize exceptional contributions to the Community and to the Police Department, We will strive to develop and maintain professionalism, skills, knowledge attainment, and technological advancement within our police department to the highest degree possible.

13 Kutztown Borough Code Chapter 158 Peace & Good Order Prohibited Acts. A. It shall be unlawful for any person or person, firm, corporation, company or association within the borough limits of Kutztown, Berks County, Pennsylvania: To willfully make or cause to be made, or, being the owner of any premises or having control thereof, to permit within or on said premises, any loud, boisterous, or unseemly noise or disturbances May be supported by a complaint from the general public and must be independently verified and observed by a police officer, in a legal position to observe. Must fit the definition of loud, boisterous, or unseemly noise. Person making the complaint may be asked to testify if the citation is appealed. Applies to all housing (rented or owned), offices, public places within the borough of Kutztown. Property owners as well as tenants may be cited. Summary criminal offense

It shall be unlawful for any person or person, firm, corporation, company or association within the borough limits of Kutztown, Berks County, Pennsylvania: To loaf, loiter, lounge, stand or congregate on or otherwise occupy any of the sidewalks, streets, corners, bridge, highway, or alleys in front of or about any place of business or other public place within the Borough of Kutztown Can be supported by a complaint of the general public or observations of a Police Officer. Current case law restricts enforcement of loitering laws to cases where public passage or vehicular traffic is obstructed.* Ordinances only loitering have been found to be unconstitutionally Vague ** Public assembly is protected under the US 1st amendment and Section 7 of the PA Constitution. 15 Kutztown Borough Code Chapter Allows for the issuance of Disruptive Conduct Reports (DCR s) to Tenants of Properties where disruptive conduct is reported, and sanctions for property owners who fail to comply with the Chapter Section applies to ALL tenant housing. Can be issued upon a verified complaint of the general public or in conjunction with a Police Officer initiated contact during the investigation of a criminal offense. Processing of the DCR is handled by the code enforcement office. Can be issued in singly or in addition to any criminal charges. Can be issued in person or by mail or posting if the tenant refuses to come forward.
