2 ETPA Officers President: Mike Reeves, CPPO, CPPB Purchasing Coordinator Knox County Mike has been with Knox County since 1998 in the Purchasing Division. He has held positions of Purchasing Agent and most recently Purchasing Coordinator. Prior to Knox County, Mike spent thirty-two (32) years in the retail business holding several management positions. J.C. Penney (16) years as a General Merchandising Manager, Store Manager and Buyer, Goody s Family Clothing (1) year as a Buyer for all Denim for the chain and Ira A. Watson Company (15) years as both a Store Manager and Buyer. Mike has been married to Nancy Hegidio Reeves for forty-three (43) years with two married children and five (5) grandchildren. Mike enjoys time with his wife, grandchildren and all UT Sports. He is a deacon at Central Baptist Church. He has held all positions with ETPA as President, Vice-President, Secretary, Membership, minating and Program Chair. He was served as the Chair of the NIGP National Marketing Committee and a previous member of the NIGP Chapter Development. Vice President: Steve Hillis City of Alcoa SHillis@cityofalcoa-tn.gov Steve Hillis is married with two grown children and 3 grandchildren. He is currently Support Services Manager for the City of Alcoa Tennessee. For the last 12 years his responsibilities for the city have included Fleet Management, Purchasing & Warehousing, and Buildings & Grounds. Mr. Hillis received his BS in Education in 1969 and Master's of Public Administration in 1986, both from The University of Tennessee, Knoxville. He has been a longstanding member of both the National Association of Fleet Administrators (NAFA) and National Institute of Governmental Purchasing (NIGP) and he is the only administrator nationally to carry both their top professional certifications. He served as Purchasing Agent for the City of Alcoa for 12 years and served as fleet manager to two cities, Knoxville & Alcoa. He also served as a municipal fleet consultant with the University of Tennessee for 10 years, where he split time as an Assistant Director University of Tennessee Transportation Center (UTTC) and Director of the Institute of Technology Management where he oversaw $20 million research initiatives for the DOD and DOE. With UTTC, he managed several transportation related research projects while on loan to the Oak Ridge National Laboratory. At ORNL his primary responsibility was operational management of three alternatively fueled national research fleets for the Congressionally mandated Federal Methanol Fleet Project. This 1980 s based 1.5 million-mile initiative served as a test bed for many alternative fuel related OEM and retrofit technologies used today. He was recently appointed by Governor Haslam to a 4 year term to his Advisory Council for State Procurement. As the leader of a volunteer project associated with the Blount County Sister City Organization, he is known for sending 2 large nonprofit private libraries to both Penza Russia in 2005 and Tbilisi Georgia in 2012 as people to people humanitarian projects. Secretary: Valerie Cunningham (Picture Coming Soon!) Blount County vcunningham@blounttn.org Valerie has been married to her husband, Greg, for 21 years. They have one daughter, Ashley, who is 18 and attends Heritage High School. Valerie and her family moved to Blount County in 2008, from Cleveland, TN, when a job transfer was given to her husband. They reside in Seymour with their beloved fur babies Sadie and Smokey (dogs), Stuart and Pollyanna (cats). Valerie and her family have fallen in love with Blount County and its beauty and are very proud to be part of the community. Valerie is active in church and attends Rio Revolution Church. She works with their annual Helping Hands outreach and various other mission works in Blount and surrounding counties. Valerie began working in Blount County at the Blount County Trustee Office in August of She held that position for one year when she applied for the Buyer position in the Purchasing Department. She began working with the Blount County Purchasing Department in August of She was then promoted to Contract Administrator in 2010 and has served in that capacity for the past three years. She feels she is just getting started in the procurement arena and is eager to learn and grow. Valerie attended college at Cleveland State Community College and graduated in 2008 with Highest Honors and an Associates of Applied Science in Office Administration.
3 3 Treasurer: Lynn Farnham, Roane County Purchasing Agent Roane County Lynn has been the Purchasing Agent for Roane County for eighteen years. Prior to going to work for Roane County, Lynn was the Assistant to the Materials Manager at Baptist Hospital of Roane County (formerly Chamberlain Memorial) where she began her Purchasing Career. Lynn was in hospital procurement for twelve years. Lynn is active in church and community activities in Roane County. She attends Saint Andrews Episcopal Church, she sits on the Board of the Roane County Chamber of Commerce and works with the Roane County Industrial Development Board as a Core Team Member. One of her favorite committee activities is serving on the Roane Alliance Gala Committee which plans the annual fund raiser for the Alliance. Lynn resides in Harriman with her husband Bill and their daughter Katy, a student at Tennessee Tech University. Other members of the family include Lynn s dog, George (a Shih Tzu) and the newest member of the family, the grand-dog Tipsy (a Maltese). 4 4 SPECIAL NOTES FROM CHAIR & COMMITTEE MEMBERS We had a very good first meeting and I thank all of you for participating in the roundtable discussion. We shared a lot of good ideas with each other and spurred ourselves to think about certain issues. We have the program in place for May and I think that you will really like it. Brent Maas from NIGP will be in Knoxville to discuss Cooperative Procurement-its impact and pitfalls. Brent is very, very knowledgeable about cooperative procurement and several of our members indicated an interest in having a speaker discuss it so we think this is a great combination. Please greet Brent warmly and ask all of the questions that you wish-he has agreed to a Q&A session. We listen to you when you mention topics of interest so please feel free to contact me with ideas. We are still planning out August meeting as well as the fall joint meeting with TAPP and we need your input. What do you want to learn about? What can you share? So please contact me with ideas or to volunteer! Terry McKee, Program Chair IS & Procurement Director, KCDC On a recent ETPA sponsored Leadership Symposium to WDC I was impressed by an educational project that I thought was unique and could be beneficial to our profession, if implemented here in East Tennessee. In fact, I believe that such a program would not only help our profession but would also offer significant benefits to others that might be persuaded to enter into the procurement arena as a profession. The idea was simple enough - work with a local College to create an accredited / degreed and transferable program in PROCURE- MENT. This could be government or private sector, or both. It could include but not be limited to warehousing, marketing, materials management, ethics, and law. We have a major ace up our sleeve in that Rebecca Kee, CPPB, who is the Contract Manager for the Division of Youth Services / State of Arkansas Department of Human Services. She has agreed to assist us on such a project. Under the banner of the Arkansas Purchasing Association and within the last two years, Rebecca has sold this same idea to Arkansas State University, technically designed the curriculum, and is currently teaching its first Introduction to Public Procurement class. During last month's ETPA meeting a motion was made and seconded with an all-inclusive vote by the membership to also support such a program. It was about that time that our own Lynn Farnham, a staunch Roane Countian I might add, got us a meeting with Dr. Diane Ward, VP of Student Learning, Roane State Community College (RSCC). As a result of a very productive meeting, Dr. Ward informed us that she will immediately begin working to create such a Procurement Curriculum at RSCC with a targeted roll-out date of January At a minimum, such an educational offering should create a procurement driven core for degreed courses available to those generally interested in advancing their professional skill set. At most, it may even allow students the opportunity to obtain a concentration of Procurement discipline within existing degreed programs like Political Science, Business, and Public Administration (BS and or a BA). Membership In the past year, we have added some new agencies to our ETPA membership, including Roane State Community College, Union County, Hamilton County and the Chattanooga Housing Authority, as well as welcoming back the Knoxville Utilities Board. If you know of agencies in your area that would benefit from membership, please let me know and I will send the an invite to our next meeting. Also, one of the key benefits of membership in ETPA is the free education we offer at Fall Conference. As the saying goes, nothing in life is free. The money we raise at the Business Matchmaking & Tradeshow Event and from sponsorships cover the costs for Fall Conference. Please help us spread the word about the event by spreading the word to your vendors. We are also proud of the accomplishments achieved by ETPA this past year and are submitting an application for NIGP Small Chapter of the Year. CPPB/CPPO Prep Resource David Nash, a retired NIGP member from Fort Lauderdale, offers a free service for members studying for the CPPB or CPPO exam called the Question of the Day. Every week day, he will you a question and will let you know if your response is correct. You must answer at least one question per week to stay on his distribution list. He does not use actual questions used on the exams but does use questions either saved from practice exams available to him as an NIGP certified instructor or ones that he has written himself based on the Prep Guides and the LEAP series textbooks. 6 6 S T A T E O F T E N N E S S E E OFFICE OF THE ATTORNEY GENERAL PO BOX NASHVILLE, TENNESSEE vember 25, 2013 Opinion Granting Preferences for Local Businesses Under Municipal Purchasing Law of 1983 QUESTION May a municipality that is subject to the Municipal Purchasing Law of 1983 implement a policy that grants a preference to local businesses bidding on municipal contracts? OPINION. ANALYSIS The Municipal Purchasing Law of 1983, codified at Tenn. Code Ann to -307, applies to all purchases by authorized officials in all municipalities using or encumbering municipal funds, with certain exceptions set forth at Tenn. Code Ann Under the Purchasing Law, municipal officials must make most purchases only after public advertisement and competitive bid. See Tenn. Code Ann The purpose of such a competitive bidding statute is to provide bidders with a fair opportunity to compete for public contracts and to promote the public interest by guarding against favoritism and fraud. Metropolitan Air Research Testing Auth. v. Metropolitan Gov t of Nashville, 842 S.W.2d 611, (Tenn. Ct. App. 1992). A participating bidder has the right to have its bid considered honestly and fairly, competing on the same footing as all other bidders. Computer Shoppe, Inc. v. State, 780 S.W.2d 729, 737 (Tenn. Ct. App. 1989). Competitive bidding requires that all bidders be placed upon the same plane of equality and that they each bid upon the same terms and conditions involved in all the items and parts of the contract, and that the proposal specify as to all bids the same, or substantially similar specifications. State ex rel. Leech v. Wright, 622 S.W.2d 807, 815 (Tenn. 1981). When a policy gives a preference to certain bidders, the policy violates the competitive bidding principles set forth above. In short, such a policy does not place all bidders on the same plane of equality. Accordingly, this Office has opined that a policy by a local board of education giving preference to purchases from minority businesses would violate the competitive bidding provisions of Tenn. Code Ann (a)(4). Tenn. Att y Gen. Op (May 5, 1987). This Office has also opined that a Buy American policy would violate competitive bidding requirements. Tenn. Att y Gen. Op A (July 26, 1978). Similarly, a municipal policy that gives a preference to local businesses bidding on municipal contracts would violate the competitive bidding provisions of Tenn. Code Ann Due to this conflict, a municipality lacks the authority to adopt such a policy. See Crawley v. Hamilton County, 193 S.W.3d 453, 456 (Tenn. 2006) ( Municipal ordinances in conflict with and repugnant to a State law of a general character and state-wide application are universally held to be invalid. ).
