Recommendation THAT Skydive Bay of Islands, subject to undertaking Iwi/Hapu, community consultation and an approved Health and Safety Plan, be granted approval to undertake tandem parachute landings in Paihia at only the two locations outlined in their application: a) Waitangi Beach opposite the Puketona Road roundabout; b) Paihia Beach opposite Anchorage Motel. 1) Background Skydive Bay of Islands (SBOI) made application in late December 2016 to apply for dispensation from Section 1712 of The Reserves Bylaw (Attachment 1). The application (Attachment 2) outlines the purpose to allow SBOI permission to occasionally land parachutes on two beaches in Paihia. Their objective as a Tourism provider in the Paihia area is to show that skydiving is a visible and available option to visitors to the Bay of Islands. This has been difficult to achieve from its current base at the Kerikeri Airport. In 2012 a parachute operator was refused permission to undertake parachute landings in Paihia because of concerns expressed by members of the public, who were concerned about the safety of all beach users. 2) Discussion and options In its application, SBOI has outlined under various headings, its intentions and they are summarised as follows: # Limiting Factors * Ensuring minimal disruption to, and the safety of the beach going public. # Frequency of Use * Frequency would be dependant on demand from several times a week to a few times per day. # Times * Most common times would be early morning before 11am and late afternoon early evening. 2 # Procedures * A drop zone safety officer will assess whether the conditions for landing on the Beaches are acceptable. The assessment will include: a) A physical inspection of the landing site to ensure the beach is clear of obstacles b) To ensure the beach is not crowded with people and that no disruption will be caused to anyone while the landings are taking place c) To ensure that the tide is at an acceptable level d) To ensure weather conditions are favourable for parachutes on the beach. The application clearly outlines its Hazard Risk Register specific to Paihia beach landings as well as internal beach landing procedures. SBOI has received the appropriate approvals from the Northland Regional Council (NRC) (Attachment 3) and the Civil Aviation Authority of NZ (CAA) (Attachment 4). The two proposed landing zones are indicated on Attachment 5: a) Waitangi Beach opposite the Puketona Road roundabout b) Paihia Beach opposite Anchorage Motel. The appropriate approval would be granted in the form of a licence and in its initial instance should be for a period of one calendar year and can be revoked by Council at 12 hours notice and subject to Council s Health and Safety Officer approval. At the time of writing there has been no confirmation from the applicant that they have undertaken Iwi/Hapu consultation. 3) Financial implications and budgetary provision There are currently no financial implications but an annual fee will be charged. 4) Reason for the recommendation That the applicant has received all the required approvals, NRC and CAA, and it is recommended that they receive approval, subject to community Iwi/Hapu consultation, and that all Health and Safety requirements are met. A Local authority must, in the course of the decision-making process, a) Seek to identify all reasonably practicable options for the achievement of the objective of a decision; and b) Assess the options in terms of their advantages and disadvantages; and c) If any of the options identified under paragraph (a) involves a significant decision in relation to land or a body of water, take into account the relationship of Māori and their culture and traditions with their ancestral land, water sites, waahi tapu, valued flora and fauna and other taonga 2. This section is subject to Section 79 - Compliance with procedures in relation to decisions. Relationship with existing policies and Community outcomes. Possible implications for the relationship of Māori and their culture and traditions with their ancestral land, water, site, waahi tapu, valued flora and fauna, and other taonga. Views or preferences of persons likely to be affected by, or to have an interest in the matter, including persons with disabilities, children and older persons. Does the issue, proposal, decision or other matter have a high degree of significance or engagement as determined under the Council's Policy #2124? If the matter has a Community rather than a District wide relevance has the Community Board's views been sought? Financial Implications and Budgetary Provision. Chief Financial Officer review. Reserve Bylaw is attached Iwi/Hapu must be consulted prior to permission being granted. Appropriate authorities have granted approval. Community Boards view being sought.
