1 The Builders Exchange of Santa Clara County is pleased to announce the availability of scholarships totaling $5,000 through the June Simmons Memorial Scholarship Competition. The children and grand children and employees of member firms of the Builders Exchange of Santa Clara County who are pursuing a career as a college or university undergraduate, are eligible to enter the competition. Applications are available in person, by calling the Exchange at (408) or by the website in the benefits section. Applications are due April 7, 2014

2 The Exchange has 2 offices for rent! We have a 120 sq. ft. and a 140 sq. ft. office available for rent as of March 1. Garbage, electric and nightly cleaning service included. Call Michael Miller or Mary Fortin at the Exchange at (408) to arrange an appointment to view the office.

Instructions for setting Java Security to Medium are as follows: Find the Java Control Panel Windows 8 Use search to find the Control Panel Press Windows logo key + W to open the Search charm to search settings OR Drag the Mouse pointer to the bottom-right corner of the screen, then click on the Search icon. In the search box enter Java Control Panel Click on Java icon to open the Java Control Panel. Windows 7, Vista Click on the Start button and then click on the Control Panel option. In the Control Panel Search enter Java Control Panel. Click on the Java icon to open the Java Control Panel. Windows XP Click on the Start button and then click on the Control Panel option. 39 NEWSLETTER: EMPLOYEE VS. INDEPENDENT CONTRACTOR Over the last few years, the IRS and State tax agencies have been targeting businesses that use independent contractors. The government agencies attempt to make a case that the individual should be considered an employee, rather than an independent contractor. If they are successful in reclassifying the worker(s), there are far more costs to the business. The additional costs include federal and state unemployment insurance, FICA, workers compensation insurance, and the requirement to comply with federal and state labor laws. Below are a few factors to help distinguish an independent contractor from an employee. KEY FACTS When determining whether a worker is an independent contractor or an employee, you must consider the degree of control that the business has over the worker. Once the company and the worker agree to the end result of the project, answer this question: does the business direct the worker or does the worker direct the business? The following factors should be considered: Does the business direct how the work is done? Does the worker have an investment in tools used in performing services? Does the worker perform independent services for others? Is the worker paid for time or for the job? Can the worker realize a profit or incur a loss? What type of relationship does your business have with the worker? Is there a written contract? Does the worker get benefits? What is the permanency of the relationship? Is the work performed a key aspect of the regular business of the company? 42 SURETY DIVISION PERFORMANCE BOND MISINFORMATION By John Page, President of Surety Solutions Insurance Services, Inc. an independent, surety bond only agency based in Rancho Cordova, CA The town of Holiday Island, Arkansas had a small roof project out to bid. According to Carrollconews.com, Holiday Island District Manager, Gerald Hartley stated, no qualified bids were returned. The reason given was because of the performance bond requirements the city has on all jobs over $20,000. He goes on to state that financial reporting and the cost of $2,500 to $3,500 was just too much for small contractors to qualify for. I cannot help but to think he got this information from small contractors that were not qualified to do a $20,000 roof job without putting the taxpayers at risk. The job in question was just over $20,000 in size. The cost of a bond of that size would be well less than $1,000 (probably in the $ range). As far as the financial reporting goes, for a job of that size, all it would take would be an owner of the construction company to have good credit and to complete an application of a couple of pages to get the surety bond. There are several surety companies that now offer short form performance bond programs specifically to service small and emerging contractors. The city is considering waiving or changing the bond requirement which is short sighted. If all it takes is a contractor with good credit to get the bond, why would the city want to risk the taxpayer s money? Without the bond, the city would potentially have to pay for materials twice and have no guarantee of the workmanship. The surety bond is a bargain for the city and the city s tax payers. 47 OSHA 10 Hour Construction Safety and Health Outreach Program April 3 and April 4 This course is ideal for supervisors with safety and health responsibilities, and for employee safety and health awareness. Students will be introduced to OSHA policies, procedures, and standards as well as construction safety and health principles. The course will review the scope and application of the OSHA Act and General Duty Clause, as well as examine areas that are most hazardous.
