Background information on the proposed Amendment Application process as well as an overview of the Public Participation Process that will be undertaken as part of the Amendment Application Process Environmental Authorisation On the 16 February 2009, Agni Steels SA (Pty) Ltd (formerly Afro Asia Steels), was issued an Environmental Authorisation for the construction and operation of a Steel Recycling and Processing Facility in Zone 6 of the Coega Industrial Development Zone, Nelson Mandela Bay Municipality. In May 2010, Agni India, agreed to jointly set up the proposed steel recycling and processing plant with the SA partners. In order to carry the benefits of the brand name, Agni India are proposing the name Afro Asia Steels is changed to Agni Steels SA Pty Ltd. The Final Environmental Impact Assessment and Environmental Authorisation have been checked in order to ensure Agni s plant and machinery equipment design complies with the conditions of the Environmental Authorisation. Discussions between Agni Steels SA and the Provincial Department of Economic Development and Environmental Affairs (DEDEA) have established that Agni Steels Public Process Consultants C.1

2 SA is not expected to go through another full EIA process and obtain a new Environmental Authorisation, given that a comprehensive Environmental Impact Report (EIR) and Environmental Authorisation have already been prepared for the project. Instead, Agni Steels SA can use the condition in the current Environmental Authorisation (condition ), which states that the project applicant must apply in writing to DEDEA in order to effect and gain approval for Any changes to, or deviations from, the project description set out in this Environmental Authorisation.. It must also be noted that Agni Steels, has applied to DEDEA for an extension to their Environmental Authorisation, to be extended to February Amendment Application Process Agni Steels SA is in the process of submitting an Amendment Application to DEDEA for their decision making, and have appointed Public Process Consultants as the independent Environmental Assessment Practitioner to undertake the Amendment Application. To facilitate your participation in this process included with this correspondence is a Background Information Document on the Amendment Application Process and a comment form. I&APs are required to register their interest in the project and raise concerns with regards to the amendment application within 14 days of the date of this notification. To reach the consultants, contact details above, by no later than 16 February Information on the project can be downloaded through the website The next stage in the process will entail the release of a Draft Amendment Application Report to I&APs for a further 14 day review period. As a registered I&AP on the project database you will be notified of this comment period in writing.
