As discussed, one of the activities (R544, Activity 10) on the original Application Form (delivered to your offices 07/03/2014) was regarding power lines and as such should have resulted in the application being lodged with the DEA instead. You had suggested that we request a Letter of Delegation from the DEA in order to transfer the authority of the project to MDEDET. However on phoning the DEA to discuss the project, they said that because the proposed power line is 33kV exactly, it does not trigger Activity 10 of R544 at all. The Activity states: The construction of facilities or infrastructure for the transmission and distribution of electricity - (i) outside urban areas or industrial complexes with a capacity of more than 33 but less than 275 kilovolts; or (ii) inside urban areas or industrial complexes with a capacity of 275 kilovolts or more. The client confirmed that the power line will not ever exceed 33kV and will most likely be less than 33kV. As a result of this, DEA was of the opinion that MDEDET could carry on with reviewing the application form. On correspondence with your offices, Charity asked that we send through an amended copy of pages 4 and 5 of the application form, which has the table of Activities Applied for to be Authorised with Activity 10 removed from it. This was done eon 12/03/2014 via . We received the Application Acceptance Letter on 13/03/2014, with the project reference number given as 17/2/3N-349. This letter serves to state that pages 4 and 5 of the amended Application Form are hereby included in hard copy, for your records. In the process of Scoping phase of the project it was established that an area to the north of the study area be included in the area to be assessed by the specialists during the EIA phase. It was also identified that additional activities may form part of the proposed project and that the potential impact of the project may extend beyond the boundaries of the properties listed in the original application. It was recognised that, under listed activity No. 11 of R544 of 18 June 2010, structures may be required for the diversion of a tributary of the Spookspruit around the proposed mining area and that a bridge across the Spookspruit may be required for the construction of a proposed haul road. It is therefore required that the project area be expanded to include an additional four (4) properties and that these properties be included in the application. The inclusion of these properties will enable the specialist assessments, during the EIA phase, to assess the potential impacts of the project on the extended area. As per the protocol employed for a previous amendment of the application form, for the exclusion of one listed activity dated 26 March 2014, please find attached the amended page (page 5) and appendices of the application form. The amended description of listed activity No. 11 is contained on page 5. The Surveyor General reference numbers, landowner details, property details, locality map and proof of landowner notifications have been included in the applicable appendices. This letter serves as notification that a hard copy of page 5 and Appendices A to E of the amended Application Form are included herewith for your records.
