1 May 31, 2012 The regular meeting of the Town Board of the Town of Warwick was held on Thursday, May 31, 2012 at the Town Hall, 132 Kings Highway, Town of Warwick. Supervisor Sweeton called the meeting to order at 7:30 p.m. ATTENDANCE: Supervisor Michael Sweeton Councilman Floyd DeAngelo Councilman Russell Kowal Councilman James Gerstner Absent Councilman Mickey Shuback Town Attorney, John Hicks Deputy DPW Commissioner, William Roe Police Chief, Thomas McGovern, Jr. PRESENTATION BY POLICE CHIEF THOMAS F. MCGOVERN JR. Police Chief, Thomas McGovern asked for a moment of silence for police officers who have lost their lives in the line of duty and our military personnel serving including our own Captain Thomas Welch of the United States Army and also a Police Officer here who is currently in Kuwait on active duty. Lieutenant Thomas Maslanka read and presented the following commendations to Detective Gary Sisco, Sergeant James Barnett and Officer Brett Lukach with a citation to be worn on their uniforms and a commendation will be placed in their files for assisting with the return of a three year child from across the Canadian border back to Warwick. Officer Felix Oresto and Officer Amy Thonus were presented with a citation to be worn on their uniforms and a commendation placed in their files for apprehending two suspects with contraband in their possession. Officer Felix Oresto was presented with a commendation and a citation to be worn on his uniform for issuing 330 moving violations and arresting 11 persons for driving while intoxicated or impaired in the Town of Warwick for Sergeant Alton Morley, Officer Vincent Cosstantino, Officer Kevin Halsey, Dispatcher Bernadette Hine and Dispatcher Madeline Stockman were presented with a citation to be worn on their uniforms and a commendation placed in their files for assisting a young victim of a suicide attempt in the Village of Warwick in February of Supervisor Sweeton Chief and Lieutenant thank you and members of the department, again on behalf of the Town Board and all of our residents. These are small snippets of things that you deal with every single day that most of the public never knows about but you do it diligently day in and day out and we certainly are proud of the job that you do; thank you. We have a list of Police Officers and Dispatchers who did not use any sick time during 2011 which should be recognized; Officer Harter, Lukach, Sergeant Rader and Dispatcher Kelly Pikul. 2. On Saturday, June 9 th rain or shine the Warwick Valley Humane Society is having their Who Let the Dogs Out at the Applewood Winery on Four Corners Road in Warwick. Registration is $10 for an adult and $1 for kids and they will have contests for the best costume, best kisser, best tail wager, best tricks, vendors, pet photos and so forth. 3. On Sunday, June 10 th the Warwick Valley Humane Society is holding a 1 year rabies vaccination clinic at Orchard Grove Animal Hospital from 10:00 a.m. until 12 noon and it s $15 cash per pet. There are no appointments and all pets must be restrained on leashes. 4. There is a 5K 4 Paws run for the Warwick Valley Humane Society in the Village of Florida on October 20 th and the registration fee is $20 on or before September 20 th and $25 the day of the event. There is also a 1K walk open to everyone and dogs too. COUNCILMAN KOWAL REPORT 1. DPW as usual is doing a very good job maintaining the parks and the weather is cooperating; we re getting some rain as we need it. The crossing has been made under Union Corners Road and the piping continues so that water will be available when necessary. The Greenwood Lake ball field is getting underway. The screening machine is gone and the soccer field I wouldn t say is finished; there s a lot more to do and that continues. 2. I was at the Greenwood Farms event where there were two outstanding citizens being honored that afternoon, one was Cedric Glasper and our Town Supervisor were the honorees at the Greenwood Farms event. It was great to see them being honored and I think he well deserves it. COUNCILMAN GERSTNER REPORT Absent COUNCILMAN SHUBACK REPORT 1. We are redoing the Town Park in the Village of Greenwood Lake with in house help and saving a lot of money. Credit goes to Mike and also to the three Commissioners they are getting everything done very efficiently. ATTORNEY S REPORT TOWN CLERK S REPORT 3
4 PAGE#4 1. A new TV series called Dogs in the City débuted last night staring Justin Silver who is described as a master at resolving issues between dogs and their owners. A film crew was here a couple of weeks ago at Town Hall filming an episode staring our own Officer Kevin Halsey and his K9 dog Riley who I believe is set to retire in July from service. That episode is going to air on June 5 th on channel 2 at 8:00p.m and if you can t see it set your DVR s because I think you ll enjoy it. 2. The registration forms for the Pine Island Rec Program are available. They can be found online at townofwarwick.org or in the Clerk s office. Registration will be in person on June 18 th at the Pine Island Park at 6:00 p.m. The first 250 campers will be accepted. SUPERVISOR S REPORT 1. We are holding the first of two Electronic Recycling Days here in the Town. Last year it was wildly successful so there is one coming up on Friday, June 8 th from 1:00 p.m. to 4:00 p.m. for businesses. If you are a business you need to preregister by calling and for residents it will be Saturday, June 9 th for 10:00 a.m. until 2:00 p.m. at the recycling center. You can bring your old electronics, computer equipment, TV s and it will be recycled by Advanced Recovery Inc. It is free to residents and businesses; we just want the businesses to preregister so they have a sense of how much is being brought in. The items accepted are CPU s, laptops, monitors, printers, keyboards, VCR s, batteries, cell phones, terminals, cables, fax machines, radios, modems, CRT s, telephones, TV s, copiers, typewriters and stereo equipment. It s a great way to get rid of all that stuff that s collecting dust and we re happy to be able to do that for our residents once again. 2. Appalachian Trail Community Celebration - I just want to continue to remind people that it is going to be Saturday, June 30 th starting at 8:00 a.m. until 10:00 a.m. with an outdoor pancake breakfast at Lions Field in the Village of Greenwood Lake and then from 9:00 a.m. until 11:00 a.m. a series of guided hikes for families led by Appalachian Trail members. There will be locations on a website which I will give you in a moment. From 11:30 a.m. until 12:30 p.m. will be the actual dedication at the top of the mountain across from the Bellvale Creamery. It will be the designation naming the Town of Warwick as the first Appalachian Trail Community in New York State and I believe we re the only one between Massachusetts and Virginia so it s pretty prestigious and then from 1:00 p.m. to 3:00 p.m. there will be additional guided hikes available. I think they have a series of eight or nine hikes planned and then later on in the evening Greenwood Lake will be having a jazz festival in the Village and the Warwick Firemen s Carnival will be wrapping up with fireworks. During the day there will be vendors at the top of the mountain on the little horseshoe of Continental Road at the trail head, outdoor outfitters and things that if you re interested you can take a look at. You can register for the event or check it out online at and if you go to their event section there s a thing on the Warwick event and it s June 30 th which is Saturday. Please come out for that; it will be very exciting for us and for our community. 3. I want to bring everyone up to date, the Board included and the public, on the continuing effort to redevelop the Mid Orange Correctional Facility site. We continue to work with the State of New York and three or four different agencies there to help bring a business into that property that has shown an interest in a portion of it. Attorney Hicks and I met today with two different components of that and various agencies to continue to give the information they required to help this prospect make a decision to come to Warwick or not. Our efforts and again our efforts that have been supported by the Mid Orange 4
5 PAGE#5 Correctional Facility Citizens Committee report seemed to be at least still moving in the right direction. As soon as we have more information to share we ll share it with the public because it is an important site potentially for the Town in terms of creating some jobs and getting some tax revenue back on that parcel. 4. The West of Hudson Regional Transit Access Study for those of you who may be commuters, the MTA Metro North is announcing that phase one of that West of the Hudson Regional Transit Access study is complete. During the course of phase one the team evaluated transit alternatives with the goal of recommending the most effective options for improving transit mobility and accessibility in the west of the Hudson region. They are going to have a public open house on Tuesday, June 12 th at 4:00 p.m. until 8:00 p.m. at the Hilton Garden in Newburgh which is located at 15 Crossroads Court near Stewart International Airport. If you would like more information you can go to the website at and you will find it. 5. I have been doing journal entries the past week. We re making the final touches on our filing of our report with the State that was due this month. That should be submitted to them tomorrow by Steve Brown so we ve been working with him and I ve included all those journal entries which were in order. 6. My friend Uncle Buck from WTBQ Radio here in Warwick is hosting a benefit to benefit the American Legion Post. This one happens to be in Chester Legion Post 1167 but it s a good event. It will benefit the Veterans of Orange County, not just that Post; it s being hosted by that Post. It s going to be at the Colonial Lanes in Chester on 78 Brookside Avenue on Saturday, June 16 th from 6:00 p.m. to 8:00 p.m. If you re interested you can call Uncle Buck at Supervisors Corner is published each week in the Warwick Dispatch, with excerpts printed in the Warwick Advertiser. It was not moved by the Blooming Grove operation in a timely fashion which was in their garage and their garage was under water. 7 PAGE#7 Discussion: Supervisor Sweeton stated that this is when the Town of New Windsor decided last budget year to get out of the Dial-A-Bus business and they had three buses. 8 PAGE#8 #R AMEND #R ACCEPT BID FOR PROPOSAL FOR PURCHASE OF SHED TO HOUSE BEACH MANAGEMENT OPERATIONS Motion Councilman Kowal seconded Councilman Shuback to adopt a resolution to amend #R changing the cost to purchase the shed not to exceed $4, instead of $4, Discussion: Supervisor Sweeton stated that this is the shed of the temporary home of the beach operation now that we ve removed the old building. The bid that came in with this increase of $600 still keeps this as the lowest bid and the $600 difference was the addition of the porch with the door on the front instead of flat across which is what we had anticipated or what we had thought we wanted or knew we wanted and thought we were getting but it turned out it wasn t. It still remained the lowest bid so we re adjusting that resolution. #R ACCEPT AMENDMENT TO BLOOMING GROVE DIAL-A-BUS SERVICE Motion Councilman Kowal seconded Councilman DeAngelo to adopt a resolution to accept an amendment to the Blooming Grove Dial-A-Bus reducing service provided by the Town of Warwick with a prorated reduction in cost. Discussion: Supervisor Sweeton stated that we have an agreement to provide Dial-A-Bus service and manage it for the Town of Blooming Grove. Last year during budget time they had requested a reduction in service with a commensurate reduction in what they wanted to pay us. We never actually amended the agreement at the time we agreed to it and they passed a formal resolution and they would like us to acknowledge that we have accepted that. #R DEVELOP AN INTEGRATED AND COMPREHENSIVE ALL HAZARD MITIGATION PLAN HAZARDOUS GRANT PROGRAM HMGP Motion Supervisor Sweeton, seconded Councilman Kowal to adopt a resolution to develop an integrated and comprehensive all hazard mitigation plan for the town and its villages and apply to the Hazardous Grant Program HMGP Discussion: Supervisor Sweeton stated that this is a necessity for a community to reach any of the FEMA hazardous mitigation grants that are available. You can not get those grants unless you have a plan. Previously FEMA used to allow the individual municipalities to do their own plan. They no longer do that and they suggest that you join with a county plan and 8
9 PAGE#9 that was their policy up until hurricane Irene. In Orange County which has a plan, Orange County specifically, only included damage to county owned property excluding all of their municipalities from their plan and they have no desire to amend their plan to include municipalities. After Irene and the FEMA response and the recognition that many individual municipalities had the need to reach the FEMA hazardous mitigation grant funding. FEMA has opened it to say that you have multiple jurisdictions that will do a plan and you will be eligible. We have joined with our villages to submit an application for that plan and our engineers, Tectonic Engineering, are providing the application gratis at no cost to us or the taxpayers. We are pleased about that and we are happy to join with the three mayors of our villages to include our application and develop such a plan. #R APPOINTMENT OF WATERFRONT PARK LABORERS FOR 2012 BEACH SEASON Motion Councilman DeAngelo, seconded Councilman Kowal to adopt a resolution to appoint the following as laborers at the Thomas P. Morahan Waterfront Park for the 2012 beach season. Joseph Astorino Vincent Buccafuri $8.25/ hour $8.25/hour BILLS: Motion Councilman DeAngelo, seconded Councilman Kowal to pay the bills as audited.
