1 August 16, 2017 A regularly scheduled work session of the Lockport Town Board was conducted at 1: 00 p. m. on Wednesday, August 16, 2017 at the Town Hall, 6560 Dysinger Road, Lockport, New York. Present were: Deputy Supervisor: Paul W. Siejak Town Council Members: Patricia Dufour Thomas Keough Darlene DiCarlo Also present: Brian D. Seaman, Town Attorney, Robert Klavoon, and Madeline Dewey of Wendel Engineering, Dave Miller, Highway Superintendent, Brian Belson, Building Inspector and Judith Newbold, Town Clerk. Deputy Supervisor Siejak welcomed everyone.and opened the meeting with a moment of silent prayer in memoriam for former Town Supervisor J. O. Thompson at his passing on August 10, He gave a brief history of the service of Mr. Thompson who was Supervisor from 1995 to Brian Belson, Building Inspector Brian reported Gary Brockton of Custom Laser has approached the town to rezone property on the north and east of the existing Custom Laser property at 6747 Akron Road, which is currently zoned as an Industrial ( IN) Use District. He requested the Town rezone 50 x 265 feet from B- 1 to Industrial to allow for an addition to the existing building with mandatory setbacks. He plans to reposition the existing overhead door, which he believes will eliminate truck traffic on to Akron Road. It was decided the board will take time to consider this request and discuss at a future meeting. Attorney Seaman stated it would be best if Mr. Brockton redraw the proposed map to include drainage and new truck patterns to present to the board. 1A. Town Clerk The Town Clerk informed the board Matthew Roeseler from Gasport Chemical Hose Volunteer Fire Company and Timothy Glaser, Jr. from Terry' s Corners Fire Company have passed the mandatory physical and other requirements for acceptance into the fire service, and have been processed and approved through the Town of Lockport Fire Prevention Bureau. MOTION ( ) to approve Matthew Roeseler and.timothy Glaser, Jr. for volunteer fire service for the Town of Lockport was made by Councilmember Keough, seconded by Councilmember DiCarlo. The motion was APPROVED: AYES 4, NAYS 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. 2. Attorney Becker Farms/ Recreation Commission Contract MOTION ( ) to authorize the Supervisor to enter into an agreement with Becker Farms to provide discount coupons for programs at Becker Farms for Town residents for the fall season of 2017 was made by Councilmember Dufour and seconded by Councilmember DiCarlo. The motion was CARRIED: AYES-4, NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. Hartland Carriage Company/Recreation Commission Fall Festival Contract MOTION ( ) to authorize the Supervisor to enter into an agreement with Hartland Carriage Company to provide hay rides for residents at the Fall Festival on October 15, 2017 was made by Councilmember Keough and seconded by Councilmember DiCarlo. The motion was CARRIED: AYES- 4, NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo.

2 PAGE 2 Continuation of Minutes of Town Board Work Session 08/ 16/ 2017 Hartland Carriage Company/ Recreation Commission Winterfest Contract MOTION ( ) to authorize the Supervisor to enter into an agreement with Hartland Carriage Company to provide hay rides for residents at the Winterfest on November 26, 2017 was made by Councilmember Keough and seconded by Councilmember Dufour. The motion was CARRIED: AYES- 4, NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. 3. Engineer 2017 Sanitary Sewer Televising and Flushing Project( Contract 17-5) Rob requested the board set a date for bids for the TV and flushing projects for the sewer systems on Old Beattie, Robinson Rd., Strauss Rd. and Sweetwood Drive. These projects will be partially reimbursed through the Niagara County Sewer District allocation. The Attorney has reviewed the specifications, books will be available August 17th and a bid date is set for 11: 00 a. m. on Tuesday, September 12, MOTION ( ) to set bid dates for the 2017 Sanitary Sewer Televising and Flushing Project( Contract 17-5) for the sewers on Old Beattie Road, Robinson Road, Strauss Road and Sweetwood Drive for Tuesday, September 12, 2017 was made by Councilmember. Keough and seconded by Councilmember Dufour. The motion was CARRIED: AYES- 4, NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. Adoption' of Negative Declaration under SEQRA for Sidewalk project on Snyder Drive At this point he distributed parts 1 & 2 of the necessary SEQRA short form to the board for review for the Snyder Drive sidewalk project and asked the board to provide a resolution to issue a negative declaration pursuant to SEQRA and to authorize the Town Supervisor to execute all the necessary forms. MOTION ( ) on a motion by Councilmember DiCarlo and seconded by Councilmember Dufour, the following resolution was CARRIED: AYES- 4, NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. RESOLUTION SEQR NEGATIVE DECLARATION SIDEWALKS ON SNYDER DRIVE WHEREAS, the Town of Lockport wishes to construct approximately 700 lineal feet of sidewalk on Snyder Drive between Shimer Drive and the proposed YMCA facility, and WHEREAS, the Lockport Town Board, in accordance with the State Environmental Quality Review Act( SEQRA) has reviewed the project, determined that it is an" unlisted action" pursuant to SEQRA, and completed a short Environmental Assessment Form ( EAF), NOW THEREFORE BE IT RESOLVED, that based on careful consideration of the information contained in the EAF and in consultation with the Town' s Engineers, the Lockport Town Board hereby determines that the proposed project it will not adversely affect the natural resources of the State and/or the health, safety and welfare of the public and is consistent with social and economic considerations, and be it further RESOLVED, that the Board hereby issues a" Negative Declaration" pursuant to SEQRA and authorizes the Town Supervisor to execute all necessary forms.

3 PAGE 3 Continuation of Minutes of Town Board Work Session 08/ 16/ 2017 Water System CIP Phase 2 ( Contract 159W) The next item was related to the Phase 2 Water line project, specifically the soil bores needed for this project. Rob distributed a budget summary sheet and requested an authorization of up to$ 12, to contract with SJB Services, Inc., the lowest responsible bidder, to perform test borings and complete a soil investigation report for the project. MOTION ( ) on a motion by Councilmember Dufour and seconded by Councilmember DiCarlo, the following resolution was CARRIED: AYES- 4, NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. RESOLUTION AUTHORIZE SOIL BORES FOR PHASE 2 WATERLINE PROJECT WHEREAS, the Town of Lockport is preparing to construct Phase 2 waterline improvements and as part of the detailed design work, soil bores are required at various locations along the proposed waterline alignment, and WHEREAS, Wendel prepared an RFP and solicited proposals from all known firms performing the specified work in this geographic area to perform test borings and complete a soil investigation report for the proposed project, and WHEREAS, only two ( 2) of four( 4) firms solicited submitted responses, and WHEREAS, Wendel has reviewed the proposals and recommends that SJB Services, Inc of Hamburg, NY be awarded the project, and WHEREAS, the fee for this work is determined on a unit price basis and is estimated to be$ 11, NOW THEREFORE BE IT RESOLVED, that the Lockport Town Board awards the contract to complete the work contained in the RFP to SJB Services, Inc. at the unit prices contained in its proposal and in the maximum amount of 12, and authorizes the Supervisor to execute a contract for the same contingent on the approval of the Town Attorney. Jennifer Drive Sanitary Sewer Repair Project At this time Madeline Dewey, Intern at Wendel Engineering discussed the three options to mitigate the choke point in the sewer system at Jennifer and Erna Drive that is occurring during severe storm events in that area. Option A- Install New Gravity Sanitary Sewer Line- which would include installation of 2500 Lineal ft. of a 10" line at Locust Street Extension. It would require a grand amount of rock excavation and would be necessary to lower the existing sewer up to 16' in some areas. The cost would be approximately 1, 500, Option B- Install New Pump Station and Force Main this would require a shorter section of replacement between O' Connor& Sherman Drive. Cost is approximately$ 900, which includes a new pump station and force main and acquisition of land where they could be installed. Option C- Replace and Upsize Gravity Sanitary Sewer Line This option would include replacing and upsizing 1800 lineal feet from 8" to 12" for maximum flow capacity. The cost is approximately$ 810,

4 PAGE 4 Continuation of Minutes of Town Board Work Session 08/ 16/2017 The Board members noted that the cost estimates were three times those previously discussed. After much discussion, it was decided the Town Board members will consider the information and contemplate the possibility of addressing the problem through improvements to road drainage and or I & I issues in the area. Niagara County Water District Transmission Main, Phase 2( PCCP) Rob then informed the board the crew is currently replacing water lines on Robinson at Hillman' s Automotive. They will be closing the intersection at Robinson and Old Beattie in the near future with posted detour signs. They have requested use of the Town Hall lawn to weld the casing pipe. All police and fire agencies have been made aware of the closure. Water System CIP Phase 2( Contract 159W) Deputy Supervisor Siejak reminded everyone about the public information meeting which is scheduled for 7: 00 p. m. on August 21, Letters have been sent to all affected residents on Lockport-Junction Road, Wicks Road and Slayton Settlement Road. 4. Town Board Councilmember Keough informed everyone that Spring Lake Winery is having a concert on Rochester Road on August 18, All attendees will be bussed from the fairgrounds parking lot. Brian Belson, Building Inspector commented they have met all required conditions and he will be inspecting at the event. Fireworks must be finished by 10: 30 p. m., and the event starts at 11: 00 p. m. He reported receiving an regarding an issue with the Emergency Medical Services and ambulance services in the town. The lack of available EMTs in the county has become an issue and the sender urged the Town officials to contact Jonathan Schultz, Niagara County Director of Emergency Services to try to alleviate the problem. The sender offered some options for correcting the problem. Councilmember Keough has researched some of these options and requested the other board members consider them, including the Town of Lockport charging the insurance companies for this service. Councilmember Dufour requested a report from the five fire companies that service the Town of Lockport. He then questioned the necessity of passing a moratorium on miniature cell towers until the Town Board can acquire more information on the companies considering these options. He stated other communities are passing them, and he is contemplating the restrictions these products would require. Attorney Seaman confirmed this is an emerging issue and stated there may be some Federal regulations going into effect soon. He also advised that preemptive passing of moratoriums may be problematic as there may be time limits involved. Councilmember Keough also suggested the board members consider attending the an upcoming Planning Board meeting to listen to William Johnson, the contracted consultant on cell towers. He also asked the board members to consider the growing issue of drone restrictions on public gatherings, Councilmember Dufour reminded all the Dale Association will be holding a mini health fair at the Town Hall from 10: 00 a. m. to 12: 00 p. m. on Wednesday, August 23, She urged everyone to call and schedule an appointment for the memory testing as the appointments are limited. Dave Miller, Director of Operations reported the highway crew is currently paving Murphy Road, which is scheduled for striping and shoulder work. They have finished Wilson Road and will finish the paving with Keck Road at the end of August. It will be recycled and repaved.

5 PAGE 5 Continuation of Minutes of Town Board Work Session 08/ 16/ Deputy Supervisor Siejak The Deputy Supervisor thanked Dave for all the great work the Town Highway crew has done this summer, and also the work completed at Day Road Park. Councilmember Dufour thanked them for the work on the Veteran' s memorial bench and flagpole. He also reported that the New York State Troopers will be holding a Centennial Celebration from 1: 00-5: 00 p. m. at the barracks on Dysinger Road. It will include demonstrations of police equipment including: explosive detection robots, response gear, K- 9 patrol, aviation demonstrations, armored vehicles and classic patrol cars. He has spoken to David Christopher, the engineer for the NYS DOT Robinson Road sidewalk project and wished to inform the board that the bid has not been awarded at this time as there is a ( DBE) Disadvantaged Business Enterprise compliance issue. 6. Executive Session MOTION ( ) to enter executive session at 2: 06 p. m. for the purpose of consulting with the Town Attorney was made by Councilmember DiCarlo, seconded by Councilmember Keough. The motion was APPROVED. AYES 4, NAYS 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. Executive Session ended, Work Session reconvened MOTION ( ) to resume the work session and regular business meeting at 2: 26 p. m. was made by Councilmember Dufour, seconded by Councilmember Keough. The motion was APPROVED. AYES 4, NAYS 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo. No action was taken during Executive Session. 7. Adjournment MOTION ( ) to adjourn at 2: 26 p. m. was made by Councilmember DiCarlo, seconded by Councilmember Keough. The motion was APPROVED. AYES 4, NAYS 0.
