Get ready for the 2015 International Building Codes coming to a city near you. Wayne Gregan Well, it s time for me to put pen to paper once again. First of all, I would like to thank everyone that participated in the 2015 SACA Home and Garden show. Although the show was not attended as well as I had hoped it would have been, most venders came away with enough sales to make it worthwhile. We are already planning next years show and welcome help and ideas from anyone with an interested in the SACA Home Show. As usual, I cannot resist giving my opinion on what makes the world work, or not work, and this month is no different. Cochise County has adopted the 2012 IRC International Residential Code; it will take effect in June It was nice to see that the County deleted Chapter 11 of the 2012 IRC and reverted to the provisions of the President continued on page 4 April 2015 Member Profile: Mr. Fix It of Sierra Vista, LLC under Sierra Vista Contracting, Inc. Plenty of changes are occurring here at Mr. Fix It of Sierra Vista, LLC, a General Contractor servicing Sierra Vista and other Cochise County communities. Mr. Fix It began in 2009 with owner Bill Goethe and has since flourished, now employing over twenty men and women. Two different office spaces have been outgrown since opening for business less than six years ago. Just this past summer we moved into our newest location off of Fry Boulevard in Sierra Vista, a large office and warehouse space we renovated. One of the biggest changes to happen to Mr. Fix It will become official this April. Mr. Fix It will soon operate under Sierra Vista Contracting, Inc. along with Mr. Fix It Plumbers, Mr. Fix It Electric, and Sierra Vista Water Damage Repair and Mold Removal. This change comes as a result of our pursuit of a KB-2 General Contractor s License, allowing for larger projects. All facets of Sierra Vista Contracting, Inc. operate under their own contractor s licenses, as we hold licenses in general remodeling and repair; carpentry, remodeling, and repair, more recently plumbing and soon to be electrical. The company also holds Institute of Inspection Cleaning and Restoration Certification in mold and water mitigation and restoration. Many don t know that we have plumbing, and very soon electrical, licenses, explains Bill, The name Mr. Fix It may mislead our customers into thinking we re just a handyman, but we have a lot more to offer and we re eager to continue expanding our scope of work with our newest KB-2 license. That expansive scope of work will now include everything from leaky pipe repairs to large commercial business renovations and build-outs. At Sierra Vista Contracting, Inc., we will not discontinue our smaller residential and commercial services. We will always provide the services that helped us achieve our first customers. Our company is committed to loyalty and consistency in the services we provide, as well maintaining high quality work, states Office Manager, Sandra Nash, Sierra Vista Contracting and our new license simply gives us room to grow. Sandra is just one of six office staff who aid in day-to-day management of our busy company. The rest of Sierra Vista Contracting s employees work out in the field. Our team of drywall experts and flooring technicians, electricians, plumbers, carpenters, tile-setters, roofers and laborers are what has made the company so successful. With over 250 years of combined experience, the workforce is able to execute any project quickly and efficiently. Sierra Vista Contracting, Inc. is likely to continue to expand in the coming years. 3 Meet our speaker for the April General Membership Meeting: Cochise County Sheriff Mark Dannels Sheriff Mark J. Dannels Mark J. Dannels Sheriff for All the People On November 6, 2012, Mark J. Dannels was elected by the citizens of Cochise County to serve as their 26th Sheriff. Sheriff Mark J. Dannels is a 29 year veteran of law enforcement. He holds a Master s Degree in Criminal Justice Management from Aspen University and is a Certified Public Manager from Arizona State University. He has over 3000 hours of law enforcement training in his portfolio. He attended Disney s Leadership and Executive Training programs and is a graduate of the Rural Executive Management Institute. He began his law enforcement career in 1984 after serving a successful tour in the U.S. Army. Sheriff s Office to the position of Deputy Commander after working numerous specialty assignments and leadership roles. He was instrumental in the creation of the Southeastern Arizona D.U.I. Task Force and the Special Operations Unit. He was instrumental in proposing and being awarded over 1 million dollars in grant funding to assist the Sheriff s Office. He was appointed by former Arizona Governor Janet Napolitano to the D.U.I. Oversight Commission and later elected to the position of Chairman. In 2008, he retired from Arizona law enforcement to accept an opportunity to serve as the Police Chief for the City of Coquille in Oregon to build upon his leadership base. During his tenure as police chief, Sheriff Dannels was instrumental in solving a decade old murder case involving a local teenager that help restore community trust. Additionally, he revitalized professionalism and standardization within the department. During Sheriff Dannels time in Oregon, he volunteered every 3 months and worked as a reserve deputy sheriff for the Cochise County Sheriff s Office by flying back to Arizona to fulfill his commitment and required hours. After a successful endeavor as Police Chief, Sheriff Dannels moved back to Arizona in 2011 to rejoin the Cochise County Sheriff s Office to pursue his goal of being sheriff. A bona fide employee is covered by workman s comp and has social security, state and federal taxes withheld. This employee is covered under the employers ROC license. Employees may submit bids as part of their job on behalf of employer on the employer s letterhead and all payments are made to the employer and the job is supervised by the employer. A 1099 employee if covered under employer s workman s comp, and if supervised by the employer may also be covered by the employers ROC license. Employees have I-9 s and other paperwork on file with the employer. A 1099 worker or Independent Contractor who supervises their own work, has payments made to them directly, are their own entity, and are not covered under employer s workman s comp or taxes are not withheld is an unlicensed entity. They are required to operate within the Handyman Exemption requirements. Terminology switch: Unlicensed entities were known for many years as unlicensed contractors, however they are not contractors. To be considered a contractor, you must earn that title. Arizona law requires contractors to be licensed. If someone is unlicensed, they have not earned the title of contractor therefore the term unlicensed contractor is a misnomer. 5 Introduction to OSHA Many people hear the word OSHA and cringe, complain about the standards or the price to enforce standards, or say, call me if OSHA is in town so I can get off the job site. Other people embrace the word OSHA and think about safety standards, keeping their work area and themselves safe. Some people wonder how OSHA came to be. OSHA standards were created for a safer work environment and health protection for workers, so there are fewer hazards, more protection from hazards which cannot be eliminated, education about chemicals used by employees, creating an overall safer working environment. OSHA Standards are living documents and are changing industry practices and awareness all of the time. On December 29, 1970 President Nixon signed the OSH, Occupational Safety and Health Act which created OSHA the agency which has been in operation since April OSHA has a mission statement to ensure safe and healthful working conditions for working men and women by setting and enforcing standards and by providing training, outreach, education, and assistance. Other items OSHA provides is developing job safety and health standards and enforcing them through worksite inspections and providing training programs to increase knowledge about occupational safety and health. A little history of the effectiveness of OSHA and its mission is a proven record of reduced fatalities, injuries, and illnesses. In 2013, 4405 workers were killed, this averages to 12 deaths on the job per day - in all employment facets, not just construction. When OSHA started in 1970, there were averages of 38 worker deaths per day. In 2012 nearly 3 million serious injuries or illnesses were reported by private industries in the United States, this number correlates to 3.0 injuries per 100 workers. In the onset of OSHA, the accident rate was 10.9 workers per 100. Deaths and injuries have reduced 66% on the average since the inception of the OSHA standards. OSHA campaigns, laws and standards about employee rights include: A safe and Healthful workplace Knowledge of chemical hazards Report injury to employer Complain or request hazard correction from employer Training Hazard exposure and medical records File a complaint with OSHA Participate in an OSHA inspection Be free from retaliation for exercising safety and health rights Standards OSHA Standards are rules that describe the methods employers must use to protect employees from hazards. They are also designed to protect workers from a wide range of hazards. The standards limit the amount of hazardous chemicals, substances, or noise that workers can be exposed to in a time weighted average and/or and personal exposure average. The standards require employers to provide safe work practices and training of the practices to employees and the training of equipment. Employers must monitor hazards and keep records of all workplace injuries or illnesses. Inspections The OSH Act authorizes OSHA compliances safety and health officers to conduct workplace inspections at reasonable times. The compliances officers may conduct inspections without advanced notice. Early alerts to an employer about an OSHA inspection in advance may result in fines and/or jail time. Types of inspections include: imminent danger, fatality or hospitalizations, worker complaints, targeted inspections, and follow up inspections. Citations and Penalties OSHA standards when violated result in citations and penalties. The chart at right explains the violation type and the possible penalties. Violation Type Willful A violation that the employer intentionally and knowingly commits or a violation that the employer commits with plain indifference to the law Serious A violation where there is a substantial probability that death or serious physical harm could result and that the employer knew, or should have known, of the hazard Other-Than-Serious A violation that has a direct relationship to safety and health, but probably would not cause death or serious physical harm Repeated A violation that is the same or similar to a previous violation Penalty OSHA may propose penalties of up to $70,000 for each willful violation, with a minimum of $5,000 for each willful violation. There is a mandatory penalty for serious violations which may be up to $7,000 OSHA may propose a penalty of up to $7,000 for each other-than-serious violation OSHA may propose penalties of up to $70,000 for each repeated violation Page 5 Construction News & Views April 2015

Throughout the state, communities and citizens are making a special effort to recognize a valuable resource we often take for granted water. Without good, clean water, humans would not exist and our planet would be a very different place. Although 71% of the Earth is covered in water, less than 1% is available for our use. Imagine all of the earth s water fitting into a one-gallon container. Less than one teaspoon of all that water represents water available to the world s human population of over 7.2 billion, and to share with other non-human living organisms. Not only is the quantity of water important, poor quality water further reduces the amount of clean water available for use. We can t live long without water. In humans, about 60% of an adult s body is water. The brain contains about 78% water and the skeletal muscles contain about 75% water. For those of us living in a dry climate and working outside, we know all too well what it feels like to become dehydrated. We become tired, lethargic, can t think clearly, develop a headache either that day or the next and can have back issues (spinal disks are especially sensitive to water loss). In extreme cases, heat exhaustion and stroke can be deadly. Dannels continued from page 3 Sheriff Dannels is a long time member of the Fraternal Order of Police, current member of the International Association of Chiefs of Police (IACP) and serves on several community service groups; San Pedro Kiwanis, Just Kids Inc., CASA, Sierra Vista Elks, the Boys and Girls Club of Sierra Vista, the varsity wrestling coach at Buena High School, and instructs at Wayland Baptist University. Sheriff Dannels participates in many community outreach programs such as Project Graduation, Sizzle, Stocking Stuffers, Community Haunted House, and Shop with a Cop. : WAM! It s Water Awareness Month Sheriff Dannels has received numerous awards during his tenure that include the Medal of Valor, National Lifesaving award, American Police Hall of Fame Commendation, Deputy of the Year, MADD Recognition for Outstanding Efforts in Drunk Driving Enforcement, Fraternal Order of Police Member of the Year, Distinguished Service Award, Unit Citation Award, Sheriff s Medal, League of United Latin American Citizens and F.B.I. Community Service Award, National Highway Traffic Safety Administration and Governor s Office of Highway Safety Outstanding Deputy of the Year, Chamber of Commerce Positivity Award, and the Rotary Club Community Service Award. Sheriff Dannels is married to Nickie, who is a Registered Nurse. They have three sons, Justin, a police officer with the City of Sierra Vista, Ryan who works as a firefighter with the Fry Fire District, and Corey, a high school student who is enjoying the life of a teenager. Sheriff Dannels has 3 primary objectives: Organizational Development, Border Security and Community Outreach. I Believe the Citizens of Cochise County Deserve the Best Possible Sheriff s Office It is easy to become dehydrated, especially if caffeinated drinks such as iced tea are substituted for water. Beverages containing caffeine and alcohol are diuretics and cause more water loss than the liquids ingested. Drinking iced tea all day on the job and chasing it with a beer or two at the end of the day creates the illusion of sufficient fluid intake when in fact they contribute to dehydration. The commonly recommended intake of water per day varies depending on the day s activities, temperature, and humidity but ranges around eight 8 ounce glasses a day. The lingering drought in the western U.S. broadens our awareness of the importance of water loss beyond the day to day necessity of water for individuals. Agriculture, the environment, and economies are feeling the squeeze for more water. In the Sunsites area near Willcox, AZ, California production farmers are planting orchards of high water use pecan (one pound of pecans uses about 700 gallons of water to grow and a mature pecan tree can use up to 34,000 gallons a year) and pistachio trees. Agriculture water is becoming more difficult and expensive to use in California, so farmers are scouting around for new growing locations and have discovered Cochise County. This greater irrigation demand in the Willcox Basin has led community members (already some residential wells have gone dry due to the nearby agriculture pumping), ranchers, farmers and state water regulators to draft a new water regulation called the Willcox Basin Groundwater Conservation Area to protect existing water and restrict future water use by commercial irrigation production wells. The WBGCA has yet to be promulgated but is well on its way to becoming the new water law of the land. As we know here in the Sierra Vista Subwatershed, residents share a common groundwater aquifer with each other as well as the San Pedro River. The need to share water has resulted in the community working together to protect the San Pedro s water which ultimately protects Ft. Huachuca, the major economic driver in the area. Fortunately much has been done. Whether it be water for drinking, for food, for goods and services or for the environment, how we use water is important. Water is worthy of taking pause to think about its value, to appreciate the life it gives us, and do our small part to use it as efficiently as we can. After all, remember what the water cycle taught us in fourth grade: water goes round and round, it goes up and it goes down, what we have is what we ve got, cause the earth s done with making enough. 7 Two vacancies on the City of Sierra Vista Planning and Zoning Commission On July 1, two members will end their terms on the City s Planning and Zoning commission. Doors open at 11 a.m.; program begins at 11:30 a.m. and concludes at 1:30 p.m. Registration deadline is Thursday, April 23. The program will include a presentation by Chuck Potucek, Sierra Vista City Manager, who will discuss current and upcoming projects in the city. Dr. Robert Carreira, Director of the CER, will provide a review of the Sierra Vista economy over the past year and the economic outlook for the coming year. Price is $50 per person or $450 for a reserved table for 10 and includes lunch and a copy of the Sierra Vista Economic Outlook, a CER publication on the local economy. We believe the people that took her drive a white truck but have no other information on them, If you see her or think you have, please call Tom at or Cathy at Water Wise programs for Water Awareness Month Cochise County adopts 2012 I-Codes On January 27, 2015 the Cochise County Board of Supervisors unanimously voted to adopt the 2012 International Building Codes, various Appendices and Amendments, and the 2011 National Electric Code. Adoption of the 2012 codes updates the current 2003 codes and helps standardize the Building codes used by builders and developers in the County and surrounding areas. A complete list of the adopted Codes, Appendices and Amendments can be found on the Cochise County web site at The new Codes become effective on Monday, June 1, 2015; plans submitted for review prior to May 29 th will be reviewed using the 2003 Building Codes.
