5 Project History Consultant Louis Berger was contracted in early 2013 to design and permit the wetland mitigation bank. This approximately 68-acre, city-owned site is littered with waste from illegal dumping, former wetlands have been filled, tidal flows are obstructed, and substantial areas of the site are overrun by invasive weeds. Poor conditions impede a healthy ecosystem and limit the types of fish, birds, and mammals that inhabit the area. At the current time, there are no wetland mitigation bank credits available within New York City. The restoration of this site is intended to pilot the federal mitigation banking rule in NYC. 6 Mitigation Banking Nationally, over 960,000 acres have been restored and preserved through 1,000 similar projects in 28 states. 11 Summary of Scope & Tasks The Consultant will be tasked with providing construction management services associated with the pre-construction, construction, and post-construction periods of the Pilot Project. 14 M/WBE Goals and Subcontractors Participation Plan M/WBE Participation Goal: 30% (as percentage of total contract value) Firms must be certified as MWBE by the State in order to count toward goal Respondents must also submit a Narrative demonstrating how they will meet the M/WBE Participation Goal. The Narrative should: Speak to respondent s commitment to M/WBE participation, including any pertinent programming run by respondent Outline specific tactics for ensuring M/WBE Participation Goal is met Include any other info that demonstrates the likelihood that the M/WBE Participation Goal will be met or exceeded % of proprietary prequalified list that is State-certified M/WBE overall and for specific trades key to this project List members of respondent team that are M/WBE Narrative will be rated and factor into selection 15% of selection criteria corresponds to the quality of the M/WBE Subcontractors Participation Plan Final M/WBE Goals will be incorporated into the Consultant Contract Selected Respondents will be required to meet the stated M/WBE goals or demonstrate good faith efforts NEW YORK CITY ECONOMIC DEVELOPMENT CORPORATION 14

17 Section 3 Goals Overview: This project is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended (12 U.S.C. 1701), which requires to the greatest extent feasible: Opportunities for training and employment be given to low- and very low-income individuals of the metropolitan area (Section 3 residents); and Contracts for work in connection with the project be awarded to Section 3 businesses. Section 3 goals: 30% of new hires will be Section 3 individuals 10% of the dollar value of construction contracts will be awarded to Section 3 businesses 3% of the dollar amount of non-construction contracts will be awarded to Section 3 businesses Section 3 Residents: Are public housing residents; or Reside in the five boroughs, and Have an individual or household income that does not exceed the local income criteria of low- or very low-income (<80% of the average median income). 18 Section 3 Qualifications Section 3 Business Concerns: Are 51% or more owned by low- and very low-income residents; or Employ full-time persons, at least 30% of whom are low- and very low-income residents, or, within three years of the date of first employment with the firm become Section 3 residents; or Provide evidence of commitment to sub-contract in excess of 25% of the dollar award of all sub-contracts to Section 3 business concerns. Contractor Requirements: Contractors for Section 3 covered projects must make every effort to meet Section 3 requirements.
