10 FY09 Continuing Resolution Authority (CRA) Current CRA Policy Resourcing under a CRA is intentionally constrained to marginal levels by law. The intent is to finance continuing operations at levels of obligation and expenditure that are not detrimental to Congressional prerogatives. In general, projects that received funding in 08 and have amounts provided for in the House or Senate Reports are eligible to have CRA funds allotted to them during the CRA not to exceed the lower of the House or Senate amounts. No allotment of CRA funds will be made to any new start reconnaissance studies or new start construction projects. New contracts may be awarded on projects receiving allotments. Current CRA Duration Current CRA lasts until March 06, 2009 or until the enactment into law of the applicable appropriations Act. 31 October
11 FY09 Continuing Resolution Authority (CRA) Possible Outcomes Congress may pass some Appropriation bills in Nov/Dec. Congress may wrap all the remaining bills into an Omnibus package. Congress may pass a year long joint resolution as happened in FY07. Projected Consequences of Possible Outcomes Congress may pass some Appropriation bills in Nov/Dec. New Missouri River Basin Study (Sec. 108) New Parshall, ND Project (Sec 594) Funding for construction of Rural Health Care Facility Congress may wrap all the remaining bills into an Omnibus package. Additional new projects beyond the three mentioned above may be added Congress may pass a year long joint resolution as in FY07. New starts mentioned above could not happen until FY10 Continuing projects would likely benefit with additional funding 11

13 Civil Works Methods of Execution Planning, engineering, and design work is primarily performed with in-house staff (67%), supplemented by specialized indefinite-delivery type contracts. All construction work is performed by contract (most thru the IFB process). Contract procurement decisions are made on a case-by-case basis considering project scope, schedule, and complexity/pasb. 13
