That s right, why not come join us at Spring Conference at the newly renovated Princess Royale Hotel in Ocean City, Maryland! If you ve never attended the D/5 Spring Conference you have no idea that the event is loaded with fun, friendship, oh, and of course, some learning as well. If you have attended before, you know that Friday night is Hospitality Suite delight. Many of the D/5 squadrons decorate suites around the pool area with a boating theme and invite you in for fun and refreshments. We have to tell ya, it s one big party. Spring Conference is a combination of training squadrons incoming officers and the D/5 Change-Of-Watch. This year you ll also have an opportunity to learn what the District Bridge Departments are all about and what they do for the District s squadrons. As you ll see on the schedule posted in this issue, there are also several new sessions, including website development, which will be a series of sessions continuing at future conferences. These will certainly be can t miss programs. So save these dates; 25, 26, 27 March and be sure to sign up early, as Spring Conference is always the highest in attendance. These words have inspired us in the past four years as I laddered the District Bridge to Commander. Our choice of mottos and logos in many ways does say it all and string together truly what we believe. As we go forward in our USPS lives, no matter what we choose to do inside the organization, these slogans signify where we are, what we are about, and where we re going. As we migrate through the change in the organizational structure, as I have suggested is necessary to be successful in the future, there still remains in most of our members a strong tradition in the real mission of USPS at the National, District and Local levels. To achieve this mission, we balance among Education, Civic, and Social responsibility with every day interactions with the public and ourselves. We cast ourselves as the group that Nun Can Do it Better to march onward with our future challenges in the boating community. USPS does offer the best avenue for those interested in being totally involved in a complete and self-fulfilling boater s program. I suppose that what I m trying to say, If you believe, then nothing is ever wasted. Knowing that there may be some bumps in the road, there is always a grand feeling of satisfaction in retaining the mission and tradition in our squadrons. The hope of passing the flag with confidence that it will continue to fly is awesome. It s a little like the feeling after 30 or 40 years of marriage, where we can settle back and play with the grandchildren with the biggest of smiles on our faces. Bringing the new children, young or old, into the USPS playground is the most important thing we do, and we must continue that effort to survive. Our new unified membership program soon to be adopted everywhere in our Squadrons is a program that treats all members equally, either individually or as a family unit in a common USPS universe. This new structure resolves issues in membership complexities and simplifies the dues gathering structure. As an age old student of engineering with a slight twist of teaching talents, I particularly find that education, as the backbone in the organization, must become the strength guiding us forward. One strong belief I hold is that the teaching of safety and skills in boating becomes the bread of life Continued on Page 6 DISTRICT 5 - UNITED STATES POWER SQUADRONS -

3 Notes and News from the D/5 LAW COMMITTEE Many of our members took the First Aid/CPR course at the Fall Conference in Rockville. Among the topics that have been discussed in connection with these courses is protection from lawsuits and liability under the good Samaritan statutes in force in many states. Each state has its own set of laws on this subject, and it is important that those laws be reviewed to determine their requirements if someone acting in an emergency is to have protection from liability. For example, in Pennsylvania there are separate statutes for medically licensed personnel, for veterinarians, for individuals trained to use automated external defibrillators, for those rendering assistance to victims of a personal injury crime, for nonmedical good Samaritans, for coaches and umpires in sports programs, and on and on. You almost need a lawyer and a law library with you before you render assistance to someone in need. But the one important aspect of protection for Power Squadrons members who are not medical professionals is that a current certificate of training from the American Heart Association, the American Red Cross, or other recognized training organization is required to receive protection in Pennsylvania. So taking the training that is being offered to our members is an opportunity that should not be missed. Once you get that certificate, be sure to keep it up to date each year. In that way you not only will have the ability to help save someone s life, but you will be protecting your own as well. An added note of interest: there is a Pennsylvania statute purporting to render protection to officers, directors and trustees of nonprofit organizations recognized under 501(c)(3) of the Internal Revenue Code, which includes USPS, its districts and squadrons. But the wording is such that the degree of protection is questionable. We will explore that in a future edition of Notes and News. D/1 st /Lt M. 5 Educational Department News The Brunswick Pilot is alive and well in District 5. During 2010, USPS agreed with Brunswick Boat Group (BBG) to partner in offering USPS University courses, seminars and hands-on training at Brunswick s local dealerships. Since the dealerships are actually customers of Brunswick, rather than operating under its direction, Brunswick offers the program to dealers much like a new product for the dealer to carry. Then it s up to us to approach dealers individually to sell our services, and hopefully get them to buy into the program. For the pilot program, BBG identified target dealerships nationwide to get involved first. BBG s list included selected District 5 showrooms of Florida-based Marine Max, as well as six locally owned showrooms of Riverside Marine, Prince William Marine, and Lynnhaven Marine. When I approached them, the respective managements of these dealers had disparate reactions. The most interest was expressed by Riverside and Marine Max; where we will schedule classes in early The other two will require more attention; both are currently using other providers of boating safety education. Otherwise in District 5, squadrons have existing relationships with Peters Marine, Clews and Strawbridge, and Stolzfus RV and Marine, all in Pennsylvania. These were not targeted by BBG, but are to be adopted in the pilot program based on the existing relationship. If your squadron offers classes at a dealer of Brunswick boats, let me know and I ll add it to the list. The pilot from the USPS University side includes the ABC3 course and four seminars: Using GPS, Using VHF and DSC Radio, Anchoring, and Trailering. Squadrons may draw upon them to deliver seminars in the pilot program and elsewhere as needed. The dealers benefit through enhanced goodwill and recognition of dealer service, as well as increased showroom traffic. Both organizations will make a commitment to promoting events together, and will enjoy greater visibility to the public. This program allows us to work the storefront concept. Being seen in a bricksand-mortar setting with a posted class schedule will confer presence and permanence to USPS educational offering. Hopefully the implied endorsement of one another will bear fruit for both squadron and dealer. There are over sixty showrooms for Brunswick products in District 5, which are listed on the various manufacturers websites. Please support this program as it reaches a Brunswick dealership near you! 6 District 5 Ship s Store! The District 5 Ship s Store is an extension of the USPS Ship s Store that is located at National Headquarters in Raleigh, NC. Being able to bring this extension store to District 5 Conferences offers the District membership a unique opportunity to view and purchase USPS items and clothing. However, this doesn t happen by itself. It requires a team of individuals that are willing to coordinate the operation of the Ship s Store. Remember the first time you visited the Ship s Store and how excited you were at being able to readily select and purchase USPS items? How your friends inquired as to where you were able to buy the great polo shirt? Well, District 5 would like to be able to continue to offer this experience to its membership. If you are interested in helping to keep the Ship s Store a viable part of the District 5 Conference Program contact our Assistant Treasurer, Chip Yost, at either or chasy@verizon.net. The National Boating Federation has reported that... NMMA, Engine Manufacturers File Suit on E15 Decision: The National Marine Manufacturers Assc. (NMMA) filed suit in the U.S. Court of Appeals for the D.C. Circuit, challenging the October 13, 2010 decision by the EPA to partially approve E15 for a subset of on-highway motor vehicles. NMMA has joined with several other manufacturing groups in a newly formed coalition the Engine Products Group (EPG) in pursuing this legal challenge. NMMA expressed regret in having to pursue litigation, but stated that the EPA has not fulfilled its statutory obligations to ensure the safe introduction of E15. NMMA has urged full scientific testing on marine engines and equipment, as required by law, and the rational evaluation of policy mechanisms to protect consumers from misfueling and product failures caused by E15. In the meantime Congress is considering a bill that would shield retailers from liability suits for mis-fueled engines. NBF Letter to US Coast Guard: We have sent a letter to the Commandant of the USCG and the Chief of the Office of Boating Safety, informing them of our concerns for the safety of the boating public with the presence of ethanol in marine fuel. While out on the water at night, in a storm or in a fog, engine failure could have disastrous consequences. To date the USCG does not appear to view ethanol as a safety issue. in the organization. The satisfaction of doing this is fun achieved by repeated new experiences with children, teenagers, and adults. Practice and execute what you believe, whether it is in education or civic endeavors, have fun doing it; then, nothing will ever be wasted. Any feelings of apathy will diminish. Meet new friends in the process and share excitement and experiences together. Believe, do what you believe, continue to volunteer, and Nun Can Be Really Any Better! So now we turn to 2011 and ask if the first string is getting tired? The first string exists in the current bridges of our squadrons, our District and our National ranks. As we watch and enjoy the Super Bowl in the new year, we ask whether the old USPS Bridge will get through and will the new USPS Bridge be ready. But in reality, where else does the first string play so hard over and over again to make sure the goals of a successful organization are achieved, and where else than from the sidelines do replacements move in and take over when there is a need? We are USPS and will remain so for decades to come. A new District 5 Bridge will take command at Spring Conference. It will be another great bridge to sustain the efforts, give them your support. Come and be part of the mission and tradition, the learning, and the continuing fun of it all! As always, I am inspired, I hope you are too! 9 Reprinted from The Manifest Colonial Sail and Power Squadron Seems like every month I come back to the basics of blocking and tackling in Recreational Boating Safety and that s the Life Jackets and the Wear It! Campaign. In my own experience, their use and wear is becoming more prevalent even as states amend their regulatory requirements such as Maryland has done for children. On a recent delivery of a 53 Eagle Trawler from St. Thomas USVI, 600 miles south, to St Lucia, the owner provided comfortable waist belt inflatables for inshore and harbor use while offshore vests were available for the four blue water channel passages. While recently attending JWorlds, the premier performance sailing school in Annapolis for a 5 day Racing Course it was a mandatory requirement for the crews to wear Life Jackets. Both power and sail communities, private and professionals, are embracing and requiring their use! So with that said, Welcome to the 2011 North American Safe Boating Campaign! As National Safe Boating Week (May 21 27, 2011) and the season approaches, we are preparing for another campaign to spread the message of safe and responsible boating. This year, we will continue to educate the boating community about life jacket wear and the options that are available when it comes to comfortable and lightweight life jackets. With Rock fish and waterfowl season in full swing, let s look at Life Jackets for Angling and Hunting: Today s life jackets may not be what you think many are made specifically for anglers and hunters: they re BOATING IS FUN... WE LL SHOW YOU HOW! lightweight, easy to move in, have multiple pockets for bait or ammunition, and even come in camouflage. Outdoor sports enthusiasts can even be sure their trusty companions are safe on the water, as there are even life jackets for hunting dogs! Much like a helmet to a biker or skate boarder, life jackets are an essential part of your boating safety equipment and should be worn at all times while on the water. In 2008, of the 709 recreational boating fatalities, over 89% of those victims were not wearing their life jackets. Life jackets are now lighter, less obtrusive, and more attractive than ever before. The new inflatable life jackets allow the mobility and flexibility that you need when boating, fishing, paddling, or hunting and are much cooler in the warmer weather. There are many different varieties of inflatable jackets ranging from those that inflate instantly when you hit the water to those that are manually inflated. All are designed to be more comfortable and wearable than the traditional life jacket. Accidents can happen at an alarming speed anyplace or anytime you are on the water. Although many boaters stow life jackets on their boat, very few choose to wear them. There just isn t time to grab a life jacket and put it on properly before you are in the water. If you are faced with a strong current or unfavorable weather conditions you will not only have trouble making sure you are safe and secure in your life jacket, but you will be unable to help your friends, relatives, children or passengers who have accompanied you in your boat. Wearing your life jacket will allow you to be safe in case of an accident and will also allow you the ability to assist others that may be in danger! You should all feel a great sense of accomplishment in being recognized by your squadron as an excellent teacher. The teaching credentials, which, as submitted by the squadron, have been reviewed by a panel in the District 5 Educational Department. That panel selects one instructor as the District 5 Charles F. Chapman award winning instructor. The 2010 winner was M. Kiplinger (Kip) Hine, AP, from Patuxent River. The D/5 winner now represents the District at the Annual Meeting in February 2011 as candidate for the national award. We congratulate Kip and wish him well at the National level; we will await the results. District 5 will repeat the process in Now is the time to prepare your new candidate for submission.
