1 CHAPTER DUTIES AND RULES OF CONDUCT Ordinance : Police Officers shall be conservators of the peace and shall be active and vigilant in the preservation of good order within the City. They shall have the power at all times to make arrests with proper process, for any offense against the laws of the City or State, and to arrest without process in all cases where any such offense shall be committed or attempted in their presence, and it shall be their duty to bring every person so arrested by them to trial before the proper officers of the City, and until such trial be had to keep the offender in the city jail or other proper place, to prevent his escape until such offender shall give in the manner required by law, a good and sufficient bond for his appearance by trial...it shall also be their duty to execute all orders and process arising under the ordinances of the City. It shall be the duty of the police department to keep the Mayor and the Board of Aldermen constantly advised as to the condition of the streets, bridges, culverts, and sidewalks within the City, and to perform such other duties as the Board of Aldermen may from time to time by ordinance, resolution or order require Job Description 1. Crime Prevention and Investigation A. Performs preventive patrol in assigned areas; B. Continually observes for criminal activity, safety hazards, traffic violations, persons needing assistance, etc; C. Becomes and remains familiar with the City of Glendale and surrounding areas, geographic locations, known offenders, neighborhood routines, potential problem areas; D. Conducts security inspections and surveys of buildings, businesses, schools and churches and makes recommendations regarding security, etc; E. Makes presentations to groups and individuals on subjects related to the job's tasks and functions; F. Handles complaints made by the public; G. Observes, detects and investigates violations of laws and ordinances and documents those actions for future use; H. Conducts interviews and interrogations of victims, witnesses, suspects and offenders; 7-1

2 I. Conducts preliminary and follow-up investigations; J. Identifies, collects, processes, packages and logs physical evidence; K. Collects information and either acts upon it if within the scope of his authority or routes it to the proper authority or agency; L. Conducts frisks and searches of persons, vehicles, places and things; M. Identifies and arrests offenders, including using the necessary application of force for resistive arrestees; N. Seeks and serves arrest warrants, search warrants and other court documents; O. Appears and testifies in court, juvenile hearings, at deposition sessions and similar proceedings; P. Enforces traffic and parking laws, including driving under the influence detection and apprehension; Q. Controls, regulates and directs vehicular and pedestrian traffic; R. Investigates traffic accidents, including protecting the scene, aiding the injured, controlling traffic, clearing the scene, determining the cause, preparing reports and diagrams; S. Deals with children of all ages in a variety of situations, such as delinquents, minors requiring authoritative intervention, neglected, abused, runaways, lost, found, victims of crimes, public relations, department tours, instructional functions and informants; T. Checks the security of businesses, schools and churches during non-business hours; U. Assist other police agencies as necessary (i.e. mutual aid, code 1000, etc.). 2. Miscellaneous Order Maintenance A. Deals with domestic disputes and other interpersonal and business contacts; B. Recognizes and corrects or reports public hazards and inconveniences, as gas leaks, traffic signals out of service, traffic obstructions and other safety hazards; C. Responds to specific requests for ambulance or fire service and assists as needed; 7-2

3 D. Responds to requests for assistance by invalids; E. Administers first aid, to sick and injured persons; F. Investigates incidents involving dead persons resulting from criminal, suicidal and natural causes, including determination of the circumstances and handling/removal of the body and dealing with the family, relatives, friends, witnesses, etc; G. Investigates reports of lost and found property; H. Investigates reports of missing and found persons; I. Investigates animal complaints, including dogs barking, picking up dogs running at large, or the humane disposition of severely injured animals; J. Directs and/or supervises civilian employees and the public at the scenes of crimes, arrests, accidents, disasters, assemblies, severe weather, etc; K. Generally assists persons in distress; L. Assists motorists with disabled vehicles; M. Assists motorists locked out of their vehicles; N. Assists residents locked out of their homes; O. Checks the homes of residents who are on vacation; P. Delivers documents to City officials; 3. Organizational Support A. May perform desk duties, including telecommunications, telephone, computer terminal, radio, alcohol breath testing, fingerprinting, typewriter, fax, computer operator, TDD/TTY, fire and police dispatching, audio-visual, court matters, prisoner processing and security, assisting individuals in person or on the telephone, processing reports, etc; B. Conducts background investigations for prospective City employees; C. Attends training as assigned; 7-3

Develops and maintains required skills and licenses/permits/certifications associated with areas of special instruction, expertise, etc. (i.e. firearms qualification, alcohol breath testing operation, juvenile law, criminal law); E. Trains new officers, reserve officers and other officers in areas of special skill or expertise; F. Prepares clear, accurate and complete reports on any and all activities engaged in; Work Characteristics/Conditions 1. Scheduling Police officer positions involve regular and irregular shift work and shift rotations necessary to provide police services twenty-four (24) hours a day, seven (7) days a week, fifty-two (52) weeks a year (weekends and holidays included). Work shifts are normally eight (8) hours in duration, but may be extended in the event of emergency, disaster, manpower shortage, workload or work-in-progress. Police officers may also be required to return to duty at any time. 2. Environmental Factors Police officer positions involve exposure requiring the officer to function in the presence of the following: A. Inclement weather, to include extreme heat or cold, rain, snow, wind, etc; B. Light conditions associated with day and night; C. Fire, smoke, chemical leaks/spills - as close proximity as necessary to provide emergency services; D. Personal danger, including but not limited to: 1) Armed and/or dangerous persons/animals; 2) Persons and/or articles with contagious or communicable diseases; 3) Hazards associated with emergency driving, traffic control and working in and around traffic; 4) Hazards associated with natural and man-made disasters. 7-4

5 3. Infectious/Communicable Diseases Because police officers may be called upon in adverse conditions to come into physical contact with others, the City will not knowingly expose citizens or other employees to an employee infected with a contagious/communicable disease that poses a direct threat to others. Decisions regarding infectious diseases will be based on reasonable medical judgments given the state of medical knowledge about: A. The nature of the risk (how the disease is transmitted); B. The duration of the risk (how long the carrier is infectious); C. The severity of the risk (what is the potential harm to third parties); D. The probability that the disease would be transmitted and will cause varying degrees of harm (School Board of Nassau County v. Arline, 480 U.S. 273, 107 s. Ct. 1123, 1987) Physical Abilities 1. Motor Skills/Flexibility The police officer position requires the employee to have and maintain the physical and mental ability to: A. React and move rapidly from a sedentary to active condition in response to environmental situations or events; B. Assume a variety of bodily positions and postures necessary to employ available "cover and concealment" during a deadly force encounter; C. Respond to a physical attack and possess the ability to control the attacker, escape the attacker and/or summon aid; D. Operate and qualify with Department-issued firearms, utilizing both hands, as well as each hand individually; E. Operate office equipment, such as computers, fax machines, telephones, breath test machines, calculators and security locking systems; F. Operate all equipment necessary for performing daily assignments, apprehending and processing criminals and conducting both criminal and traffic-related investigations; 7-5

6 G. Operate/utilize all Department vehicle mounted equipment whether in a mobile or stationary mode (including radar); H. Administer first aid; I. Perform required duties for extended periods of time while exposed to adverse conditions, to include time worked in excess of the normal daily shift and rotating shift work; J. Apprehend suspects to the extent of engaging in foot pursuits while summoning assistance and/or engaging in the necessary use of force; K. Perform searches on foot through difficult terrain or people and evidence; L. Miss meals during emergency or unusual situations; M. Discern colors as they are applied to traffic safety situations (electric signals, signing, hazardous materials placards, vehicle and clothing descriptions, etc; N. Adequately judge distances and estimate speed; O. See, read and recognize obstacles in a variety of normal and/or emergency environments. Have vision that is correctable to Department vision Standards; P. Determine or estimate the point of origin of noise; Q. Recognize/relate sound to situations based on frequencies or voice inflection within the normal range of human hearing; R. Employ the normal senses of touch and smell; S. Render aid to invalids to include but not limited to assisting them after they have fallen; T. Picking up supplies or equipment for the City. 2. Communicative Skills The police officer position further requires the employee to have and maintain the physical and mental condition needed to: A. Speak, read and write the English language in a clear, understandable fashion; 7-6

7 B. Reasonably identify and display basic non-verbal communications (body language); C. Effectively relate to or communicate with a variety of personality types during interpersonal contacts. 3. Judgment/Decision Making Ability The police officer position requires the employee have the ability to: A. Comprehend and implement verbal and written instructions; B. Apply reasoning skills when confronted with circumstances requiring discretionary decisions; C. Establish priorities and construct subsequent plans when investigating incidents or events; D. Formulate and carry out an appropriate course of action for a given situation for which no specific rule or procedure has been established; E. Apply theory based instruction or training to actual incidents/situations; F. Handle situations firmly, courteously, tactfully and impartially; G. Retrieve and retain information furnished in the form of bulletins, verbal reports, training, etc; H. Be capable of receiving and giving instructions. 4. Emotional/Psychological Stability The police officer position requires the employee to have the emotional and psychological stability to: A. Cope with and perform day-to-day duties under the principles of discipline; B. Maintain self-control when receiving criticism and/or being ridiculed; C. Continue performing all required tasks at a professional level when faced with unpleasant circumstances; D. Perform police duties without dependence on alcohol or narcotics; 7-7

8 E. Deal effectively with the morbid, the macabre, the repugnant, the abnormal, the morose, the psychotic, the neurotic and the otherwise unpleasant or unusual facets of human behavior Acceptable Experience and Training Completion of a standard high school curriculum preferably supplemented by some additional college level course work at the time of examination and possession of a valid Missouri drivers license and twenty-one (21) years of age. Shall meet State Of Missouri Peace Officer Standards and Training (P.O.S.T.) requirements Equipment Used to Perform the Job The position of police officer requires the ability to use many types of equipment effectively. They include, but are not limited to the following: radios, computers, telephones, fax machines, current alcohol breath testing machine, typewriters, fingerprint equipment, audiovisual equipment, police vehicles, emergency warning equipment, pistols, shotguns, tasers, calculators, handcuffs, fire extinguisher, cameras, camcorders, TDD/TTY, radar, etc Performance of Basic Duties Officers will perform their basic duties, preserve the public peace, prevent crime, detect and arrest law violators, protect life and property, and enforce the laws of the City of Glendale, the State of Missouri, and the United States, to the best of their ability and in accordance with the directives of this manual Performance of Basic Duties in a Competent Manner Officers shall maintain sufficient competency to properly perform their duties and assume the responsibilities of their positions. Officers shall perform their duties in a manner, which will maintain the highest standards of efficiency in carrying out the functions and objectives of the department Unsatisfactory Performance Unsatisfactory performance may be demonstrated by lack of knowledge of the application of the laws required to be enforced; an unwillingness or inability to perform assigned tasks; the failure to conform to work standards established with officer's rank, grade, or position; the failure to take appropriate action on the occasion of a crime, disorder, or other condition deserving police attention; or absence without leave. In addition to other indicia of unsatisfactory performance: repeated poor evaluations or a written record of repeated infractions of rules, regulations, directives or orders of the department will be considered unsatisfactory performance and will be grounds for disciplinary action. 7-8

9 Violation of Rules Officers shall not commit any acts or omit any acts, which constitute a violation of any of the rules, regulations, directives, or orders of the department, whether stated in this general order or elsewhere Reporting for Duty Personnel shall report for duty on time and at the place required by assignment or orders and shall be physically and mentally fit to perform their duties. They shall be properly equipped and cognizant of information required for the proper performance of duty so that they may immediately assume their duties. Judicial subpoenas shall constitute an order to report for duty under this section Identification Officers shall carry their badges and identification cards on their persons at all times while in the City of Glendale, except when impractical or dangerous to their safety or to an investigation. They shall furnish their name and D.S.N. to any person requesting that information when they are on duty or while holding themselves out as having an official capacity, except when the withholding of such information is necessary for the performance of police duties or is authorized by proper authority Contact with the Public Personnel will, at all times, be courteous to the public. They will be orderly, attentive, and will exercise patience and discretion in dealing with the public Compliance with Orders Personnel will promptly obey any lawful orders of a superior officer. Anyone who refuses to obey a lawful order will be considered insubordinate and will be subject to disciplinary action. This will include orders relayed from a superior by an officer of the same or lesser rank Conflicting or Illegal Orders 1. Officers who are given an otherwise proper order, which is in conflict with a previous order, rule, regulation or directive shall respectfully inform the superior issuing the order of the conflict. If the superior issuing the order does not alter or retract the conflicting order, the order shall stand. Under these circumstances, the responsibility for the conflict shall be upon the superior officer. Officers shall obey the conflicting order and shall not be held responsible for disobedience of the order, rule, regulation or directive previously issued. 7-9

10 2. Officers shall not obey any order which they know or should know would require them to commit any illegal act. If in doubt as to the legality of an order, officers shall request the issuing officer to clarify the order or to confer with higher authority. 3. Officers shall refuse to carry out improper orders and/or requests from superior officer or subordinates. If this occurs, the incident shall be documented and brought to the attention of a supervisor or the Chief of Police Political Activity On-Duty Involvement in partisan political activities will not be permitted during an officer's on duty time. Political activities include soliciting or receiving any assessment, subscription or contribution for any political party or cause or storing, posting, carrying, or distributing political literature of any nature will not be permitted Political Activity 1. Officers shall be permitted to: A. Register and vote in any election; B. Express opinions as individuals privately and publicly on political issues and candidates; C. Attend political conventions, rallies, fund-raising functions and similar political gatherings; D. Actively engage in any nonpartisan political functions; E. Sign political petitions as individuals; F. Make financial contributions to political organizations; G. Serve as election judges or clerks or in a similar position to perform nonpartisan duties as prescribed by state or local laws; H. Hold membership in a political party and participate in its functions to the extent consistent with the law and consistent with this section; I. Otherwise participate fully in public affairs, except as provided by law, to the extent that such endeavors do not impair the neutral and efficient performance of official duties, or create real or apparent conflicts of interest. 7-10

11 2. Officers are prohibited from: A. Using their official capacity to influence, interfere with or affect the results of an election. B. Assuming active roles in the management, organization, or financial activities of partisan political clubs, campaigns, or parties; C. Serving as officers of partisan political parties or clubs; D. Becoming candidates for or campaigning for a partisan elective public office; E. Soliciting votes in support of, or in opposition to, any partisan candidates; F. Serving as delegates to a political party convention; G. Endorsing or opposing a partisan candidate for public office in a political advertisement, broadcast, or campaign literature; H. Initiating or circulating a partisan nominating petition; I. Organizing, selling tickets to, or actively participating in a fund-raising function for a partisan political party or candidate; J. Addressing political gatherings in support of, or in opposition to a partisan candidate; K. Otherwise engaging in prohibited partisan activities on the federal, state, county or municipal level Labor Activity 1. Employees shall have the right to join labor organizations, but nothing shall compel the department to recognize or to engage in collective bargaining with any such labor organizations except as provided by law. 2. Employees shall not engage in any strike. Strike includes the concerted failure to report for duty, willful absence from one's position, unauthorized holidays, sickness unsubstantiated by a physician's statement, the stoppage of work, or the abstinence in whole or in part from the full, faithful and proper performance of the duties of employment for the purposes of inducing, influencing or coercing a change in conditions, compensation, rights, privileges or obligations of employment. 7-11

12 Public Statements Employees will not make statements on behalf of the department for publication or broadcast concerning the plans, policies, or administration of the department unless authorized to do so. Employees who plan to deliver an address at any public gathering concerning the work of the department will notify their commanding officer prior to speaking. Any public statement concerning department policy will accurately represent that policy. Any statement about the department or its function, which reflects an employee s personal opinion, will be clearly presented as such Inter-Departmental Relations No police department employee shall enter any other city department unless directly related to an assignment, or accompanied by a present employee of that department. Violation of this policy may result in disciplinary action Notify Public Works During Inclement Weather Any member of the police department who believes the public works department should respond to clean streets, salt streets, put up emergency barricades, etc., shall notify the Public Works Superintendent or his designate as soon as possible, to allow them as much time as possible to take care of the situation Personal Appearance All personnel will employ standard, daily hygiene. 1. Male Employees: A. Hair must be clean, neat and combed. Hair shall not be worn longer than the top of the shirt collar at the back of the neck when standing with the head in a normal posture. The bulk or length of the hair shall not interfere with the normal wearing of all standard headgear. The bulk or length of hair shall be groomed so that it does not bush out or curl up while wearing the standard police cap or helmet. Hair in front will not fall below the eyebrows. B. Wigs or hairpieces are permitted if they conform to the above standards for natural hair. C. Sideburns shall be neatly trimmed and rectangular in shape, and shall not extend in length below the ear. D. Facial hair, with the exception of a neatly trimmed mustache, is unacceptable. Employees will be clean-shaven upon their arrival for duty. 7-12

13 E. Earrings and other visible body piercings are not permitted. F. Visible tattoos are not permitted. 2. Female Employees: A. Hair must be clean, neat and combed or brushed. B. Police officers shall wear their hair in a manner, which promotes safety to the officer. C. Wigs or hairpieces are permitted if they conform to the above standards for natural hair. D. One pair of small earrings is permitted, but other visible body piercings are not. E. Visible tattoos are not permitted General Duties - All Officers 1. Officers shall exercise authority consistent with the obligations imposed by his oath of office and be directly accountable to his assigned superior, promptly obeying all legitimate orders. 2. Officers shall maintain harmonious relationships with his associates by courteous and considerate demeanor, guarding himself against envy, jealousy, or unfriendly feeling, and refraining from all careless communications to their discredit. 3. Officers shall coordinate his efforts with those of other members of the department so that their teamwork may insure continuity of purpose and optimum achievement of service program objectives. 4. Officers shall communicate to his co-workers all information, which is pertinent to the achievement of common objectives. 5. Officers shall be responsible for: A. Protection of life and property, B. Prevention and suppression of criminal activity and disturbances, C. Recovery and return of stolen and/or lost property, D. Apprehension and assistance in the prosecution of offenders, 7-13

14 E. Prevention of accidents and regulation of traffic, F. Preservation of the peace, and G. Other service to the public as requested or necessary. 6. He shall enforce traffic laws and ordinances and seek to eliminate conditions interfering with the safe and expeditious movement of vehicles and pedestrians. He shall be alert to the need for improvement in traffic control, report defective traffic signals, signs and devices or other safety hazards. 7. When directing the movement of vehicular traffic, he shall take a conspicuous and safe position, making his signals clear and positive, utilizing the normally accepted hand signals. Orange safety vest and orange flashlight cone (night-time use) shall be utilized, as soon as feasible, when directing traffic. 8. He shall become familiar with the geography of the city and surrounding areas, including public transportation routes, locations of streets and highways, prominent buildings and locations, and other information, which will enable him to render assistance when requested. 9. He shall, by continual study and research, be familiar with techniques and ideas designed to improve police performance. 10. He shall acquire and record information concerning events that have taken place since his last briefing and be attentive to instructions. 11. He shall assist in the department program for: A. Improving efficiency and cooperation in areas of common responsibility. B. Helping earn community confidence and support. C. Properly and economically using departmental property and equipment. 12. He shall be aware of places and activities within the City and enforce all laws, ordinances, and regulations concerning their operation. 13. He shall devote the maximum possible time to the performance of his basic duties, remaining in the station or other police facilities only when necessary. 14. He shall complete and submit reports of crimes, motor vehicle accidents, and other incidents in conformity with established procedures. 7-14

15 15. He shall receive, serve, and prepare returns on citations, writs, and documents, providing information to enable subsequent service if unable to service. 16. He shall exert every effort to satisfy the needs of the citizens requesting service, assistance, or information, and courteously explain any instance where jurisdiction does not lie with this department, suggesting procedures to be followed, and assisting further if the citizen is ill, confused, illiterate, or unable to do so for a good reason. 17. He shall be accountable for securing, recording, and properly transporting all evidence and property coming into his custody. 18. He shall be sensitive to the conduct of youths and young adults and the existence of hazards affecting them and participate in the delinquency control effort. 19. He shall be alert to community tensions of various types, notifying his superiors of potentially dangerous or undesirable situations and preventing disorder. 20. He shall stop and interview any person whom he reasonably and justifiably believes to be engaged unlawful conduct, and request the reason for his presence, and record his identity as prescribed. If he receives answers indicating a reasonable probability that a crime has been committed by the person, is refused answer, or is met with resistance not warranted by the inquiry, he shall make an arrest, provided there is legal basis for the arrest, or shall include the suspicious circumstances in a report so appropriate follow-up action may be taken. 21. In dealing with citizens the following four terms should be used in reports to describe an officer s interaction with a citizen: A. "Contact" - the officer is merely conversing with a citizen and the citizen is free to leave. An officer needs no "authority" to converse with a citizen. B. "Detention" - during this stage of investigation the citizen is not "free to leave" while he is being talked to or investigated. Reasonable Suspicion is needed and a "frisk" of the citizen or a vehicle for weapons is within bounds. C. "Technical Arrest" - During any "traffic stop", the officer can ask for a "consent" search of the vehicle (probable cause is the traffic violation). Use "consent to search" forms or tape recorder if possible. D. "Custodial Arrest" - A full custodial arrest requires probable cause and the subject is not free to leave. If the officer wishes to interrogate after "custodial arrest", Miranda rights are necessary. 22. He shall note and record the license numbers and descriptions of vehicles seen under questionable circumstances and make an investigation. 7-15

16 23. He shall familiarize himself with all areas of the city and conduct a diligent patrol, accentuating prevention rather than apprehension, giving particular attention to locations most susceptible to the occurrence of crime or traffic accidents. 24. He shall confine his patrol efforts to the City of Glendale. If required to leave for any reason, he shall request the permission of his superior prior to the time he leaves, or as soon as possible if in an emergency situation. 25. Upon discovery of a crime, he shall move promptly to apprehend the offender, either through individual effort or by the full utilization of departmental resources. When pursuit or apprehension is not feasible, he shall make a thorough investigation and quickly relay information to other units or agencies (through the dispatcher) to enlist their aid. 26. He shall conduct a thorough investigation of all offenses within the City that occur while he is assigned to patrol. He shall collect evidence and record data, which will aid in identification apprehension and prosecution of offenders and the recovery of property. 27. He shall be alert to the City's responsibilities to keep public highways, streets, avenues, alleys, sidewalks, lights and signals, public grounds, bridges and viaducts open and/or operable, in good repair, and free from nuisance and shall advise the proper agency concerning unsafe or improper conditions. 28. He shall promptly report street lights out and defective fixtures. 29. He shall inspect places or activities where permits or licenses are required and shall take appropriate action in all instances where necessary authority has not been procured. 30. He shall note conditions, which adversely affect the appearance, safety and health of the City, enforcing applicable laws, ordinances, and regulations and/or making referrals to agencies having primary responsibility. 31. He shall take necessary and appropriate action whenever circumstances dictate, whether in or out of the City or on or off duty. 32. He shall carry and use weapons in a careful and prudent manner in accordance with the laws and departmental procedures. 33. He shall be acquainted with basic first aid procedures in order that he may be prepared to apply first aid promptly and properly in any case coming to his attention. 34. He shall record his activity during his tour of duty in the prescribed manner. 35. He shall insure the civil treatment and observance of legal rights of persons coming within his scope of authority. 7-16

17 36. He shall conduct himself in accordance with ethical standards both on and off duty. 37. He shall perform such other duties as may be assigned Specific Duties: Day Shift 1. The hours for Day Shift are 0700 hours to 1500 hours. Officers shall report for duty ten minutes prior to the hour for shift change. If an officer's lack of punctuality becomes frequent, it is to be brought to the attention of the Shift Commander and the Chief of Police. 2. Shift change will include advising the oncoming shift of the following: A. "Daily Run Sheet" activities. B. Special assignments, follow-up assignments or continuing assignments to be handled by the oncoming shift. C. Each officer shall check his mail slot, chalkboard, bulletin board, and interdepartment memo board, for any special information concerning his duties. D. Each officer shall inspect his assigned vehicle and equipment for damage or inoperability and advise his Shift Commander of any problems. E. Each officer shall place his personal equipment in his assigned vehicle and prepare for duty. F. Each officer shall complete all work from his previous shift, reports, tickets, etc. G. Each officer shall begin his tour of duty after shift change, unless he has an office assignment. H. If possible, near the end of his shift each officer shall make sure his vehicle has been filled with gas, oil checked and any other necessary maintenance performed, so that his vehicle is ready for the oncoming shift. 3. It will be the responsibility of all on duty officers to make sure school crossing guards are on duty at the proper time and at their assigned posts. If the crossing guard is absent, then an officer shall take care of the assignment at the discretion of the Shift Commander. If only one officer is on duty and working the crossing guard post and he receives an assignment, it will be the responsibility of the officer to determine if the assignment has precedence and take the necessary action. It will be the responsibility of the Shift Commander of the Day Shift to advise the Shift Commander of the Afternoon Shift that it is necessary for an officer to work a school crossing. 7-17

18 4. It will be the responsibility of all officers to inspect the "out of town/vacation" file to insure that all houses have been checked and the file is up to date. In times of excessive vacancies, the Day Shift Commander may call upon the Afternoon Shift for assistance, but the primary responsibility shall rest with the Day Shift. 5. During the course of the shift, each officer shall patrol the streets of the City noting any problems that occur in the nature of traffic hazards, damaged city property, street obstructions, and weather conditions. Any information the officer may deem necessary for the smooth, normal functioning of the City shall be passed on to the proper personnel. 6. Traffic and parking violations will be noted and citations will be issued at the discretion of each officer. Verbal or written warnings may be issued. Officers should stop the more serious violators and at least advise them of their violation. 7. It will be the responsibility of all officers to insure that any maintenance, hand deliveries, radar or similar assignments are promptly carried out and the appropriate personnel notified upon completion of the assigned tasks. 8. It is the responsibility of the Shift Commander to see to the smooth functioning of his shift and that all tasks or assignments have been carried out, prior to shift change. It is the responsibility of the Day Shift Commander to advise the Afternoon Shift Commander of any assignments or information that may pertain to the accomplishments of his duties, prior to being relieved of duty. 9. Records of these calls are utilized as a means of keeping each officer advised of occurrences, which took place while that officer was not on duty. Each officer is responsible for reading the daily run sheet and familiarizing himself with the calls logged by other officers Specific Duties: Afternoon Shift 1. The hours of the Afternoon Shift are from 1500 hours to 2300 hours. Officers shall report for duty ten minutes prior to the hour for shift change. If an officer's lack of punctuality becomes frequent, this is to be brought to the attention of the Shift Commander and Chief of Police. 7-18

Special assignments, follow-up assignments or continuing assignments to be handled by the oncoming shift. C. Each officer shall check his mail slot, chalkboard, bulletin board, and interdepartment memo board, for any special information concerning his duties. D. Each officer shall inspect his assigned vehicle and equipment for damage or inoperability and advise his Shift Commander of any problems. E. Each officer shall place his personal equipment in his assigned vehicle and prepare for duty. F. Each officer shall complete all work from his previous shift, reports, tickets, etc. G. Each officer shall begin his tour of duty after shift change, unless he has an office assignment. H. If possible near the end of his shift, each officer shall make sure his vehicle has been filled with gas, oil checked and any other necessary maintenance performed, so that his vehicle is ready for the oncoming shift. 3. It is the responsibility of all on-duty officers to make sure that school crossing guards are on duty at the proper time and at their assigned posts. If the crossing guard is absent, then an officer shall take care of the assignment as outlined under #3, Day Shift. 4. It is the responsibility of officers on the Afternoon Shift to periodically check the schools, churches, and business establishments after closing hours to insure that they are secure and have not been tampered with. 5. Citations or written warnings may be issued at the discretion of each officer. 7. It will be the responsibility of each officer to insure that any radar, "Close Patrol" or similar assignments given him during the course of his shift are promptly handled and the appropriate personnel notified of the completion of the assigned task. 8. It is the responsibility of the Shift Commander to see to the smooth functioning of his shift and that all tasks or assignments have been carried out, prior to shift change. It is the responsibility of the Midnight Shift Commander to advise the Day Shift Commander of any information or assignments that may pertain to the accomplishment of his duties, prior to being relieved of duty. 9. The Chief of Police, under the supervision of the City Administrator, shall control, supervise and regulate the personnel, equipment and operation of the Police Department in all aspects of police protection and regulations within the jurisdiction of the City. In this capacity, the Chief shall have the authority to prescribe, promulgate and enforce the rules and regulations for the operation of the department. These rules and regulations shall not be in conflict with either Missouri State Statute or Glendale City Ordinances. 2. He shall have the power to appoint, subject to the rules of the personnel manual, and shall have the power to promote, discipline, suspend and relieve from duty any Police Department employee. A report of all such actions taken shall be submitted to the City Administrator. 3. He shall be required to prepare and submit to the City Administrator and the Board of Aldermen, on or before March 31st of each year, a complete report on the administrative and law enforcement activities of the department for the preceding calendar year, and such report shall show complete statistics of all police work in accordance with generally recognized standards. 4. He shall be required to prepare and submit to the City Administrator and the Board of Aldermen a monthly report of department activities by the 5th of each month. 5. He shall prepare and submit to the City Administrator, during the month of March, a complete report on the financial requirements of the department for the ensuing fiscal year. 6. He shall perform such other duties as may be prescribed elsewhere in the ordinances of the City of Glendale or required of him by the Board of Aldermen, not inconsistent with local, state or federal law. 7. He shall have control of the assignments and schedules of all police department personnel. 8. He shall promptly execute all directives of the Board of Aldermen and issue such orders to the department personnel as may be required for their proper execution. 7-22

He shall organize, direct and control all resources of the department for the most efficient discharge of its duty to preserve the peace, protect persons and property, obey and enforce all ordinances of the City of Glendale, all laws of the State of Missouri and the United States of America. 10. He shall develop the organizational structure of the department in accordance with professional standards, and by consideration of sound management techniques and principles, integrate related activities under the control of intermediate supervisors. He shall hold them accountable for effective conduct of such activities. 11. He shall plan and execute a police service program designed to prevent and quell crime, apprehend and prosecute offenders, recover and return property, and regulate certain noncriminal conduct. He shall modify the program to combat current trends as revealed by analysis of records and reports. 12. He shall see that the department has acceptable standards and procedures for recruitment, selection and promotion of department employees. 13. He shall work for the enactment and strengthening of laws and ordinances for the restraint of criminal activities. 14. He shall cause an adequate and progressive program of employee continuing education and training to be organized and conducted. 15. He shall work for the enactment and strengthening of laws and ordinances improving traffic safety and control. 16. He shall formulate techniques for recognizing and rewarding outstanding performance by department personnel. 17. He shall continually strive to improve employee-working conditions in order to achieve maximum efficiency and morale. 18. He shall establish and maintain high ethical standards for himself and department personnel and exercise vigilance necessary to sustain observance of such standards. 19. He shall at all times keep himself apprised of the affairs of the department and be assured that the duties of his subordinates are properly discharged. 20. He shall at irregular and unannounced times inspect the department for efficiency and effectiveness of operation. When unsatisfactory conditions are found, he shall take corrective action. 21. He shall exercise general supervision and inspection of all public places within the city and cause the laws and ordinances concerning them to be obeyed. 7-23

24 22. He shall maintain suitable, productive relationships between the department and other governmental agencies and with private organizations. 23. He shall submit required reports to the City Administrator and Board of Aldermen in such form and detail as to clearly depict conditions and police action, including the annual report, which adequately presents the problems, services, and activities of the department. 24. He shall insure prompt reporting to other City agencies of any important matter falling within their jurisdiction. 25. He shall conduct periodic meetings with his supervisors to discuss and resolve any problems, establish policy and disseminate information. 26. He shall maintain an active alliance with professional police agencies and participate in programs for the mutual improvement of proficiency in combating crime and traffic problems. 27. He shall develop or adopt new techniques to improve the department's effectiveness in the discharge of primary police obligations. 28. He shall administer the department's fiscal affairs in a manner calculated to convert available resources into optimum effective police service, economically employed, in areas of demonstrable need. 29. He shall cause an inventory of all department property to be established and maintained. 30. He shall predict the nature of probable emergencies and formulate procedures to be used in the event such emergencies occur. He shall formulate plans to meet both immediate and future needs of the police department. 31. Delegate to his command officers an authority commensurate with their responsibilities. He shall give them full authority, within the restrictions imposed upon him by higher authority to direct and discipline the subordinates under their command. 32. Confer with the City Administrator before taking the following action: A. Making important changes in the duties of key positions. B. Making important changes in the organization of the police force. C. Making important changes in operating procedures. 7-24

25 33. Report immediately to the City Administrator any of the following incidents: A. The suspension of a member of the Police Department. B. The death of any member of the Police Department. C. The injury in line of duty of any member. D. The injury of any person as a result of any police action. E. Damage to police vehicles or other police property in excess of $ F. The damage of public or private property inconsequence of any police action. G. Unusual occurrences or crimes. H. Offenses committed by City employees. I. Serious complaints by private persons or subordinate officers, against members of the department or its operation, and the results of the operation thereof Duties and Responsibilities: Captain 1. He shall be responsible to the Chief of Police for direction, planning and coordination of all functions of the department under his command. 2. He shall serve as acting Chief of Police, when designated by competent authority. 3. He shall supervise activities of the department at an operational level, under direction of the Chief of Police. 4. He shall be responsible for good order, conduct and discipline of his subordinates; for their compliance with department policies and procedures; and for enforcement of all rules, regulations and orders of the department. 5. A Captain who observes, or is informed of, neglect of duty or misconduct shall immediately take whatever action is necessary and shall bring the matter to the attention of the Chief of Police, if necessary. He shall make an impartial written report to the Chief of Police in every case of serious misconduct, incompetence, neglect of duty, or violations of the rules, regulations or department orders on the part of a subordinate. 6. He shall exercise his authority without bias or prejudice and shall make an order to a subordinate in clear, understandable language, civil in tone and issued in pursuit of department business. 7-25

He shall promote harmony among the personnel of his command and is responsible for the cooperation and coordination of his command with all other units of the police department and the other departments within the city. 8. He shall be responsible for the prompt service of all official notices, summonses, subpoenas or hand deliveries, which may be sent to him by proper authority. 9. He shall be responsible for punctual attendance in court and for proper preparation of cases by members of his command. He shall assist subordinates in the preparation of their cases. 10. He shall be responsible for properly preparing, transmitting, and preserving all official records, reports, forms and correspondence originating with or forwarded to his command. 11. He shall be responsible for assigning particular duties to individuals within the command, prescribing standard operating procedures for the command with the approval of the Chief of Police, and keeping the Chief of Police informed of all pertinent information. 12. He shall establish the required details and assignments necessary to carry out the functions of the department. 13. He shall inspect all personnel and equipment under his command at announced or unannounced times. 14. He shall prepare performance rating and the Chief of Police may require evaluation reports on personnel at such intervals and upon such forms as. 15. He shall organize and conduct personnel training. 16. He shall improve working conditions and morale. 17. He shall recognize outstanding personnel performance. 18. He shall advance the public relations program. 19. He shall insure the proper and economical use of property and equipment under his command. 20. He shall promote personnel and fleet safety. 21. He shall set an example for subordinates. 22. He shall oversee and direct the work of the shift. 7-26

27 23. He shall supervise and direct the activities of personnel assigned to him and inspect work of subordinates for effectiveness, efficiency and adherence to established policies and procedures. He shall instruct and advise subordinates in the performance of their duties. 24. He shall brief, interpret and enforce policies and plans within their shifts and act as a liaison in transmitting information from top to bottom and vice versa. 25. He shall develop long and short-range objectives for the department. 26. He shall establish, maintain and administer procedures necessary for the efficient operation of his assignment. 27. He shall review and forward all reports and other documents prepared by subordinates. 28. He shall evaluate the performance of immediate subordinates and review evaluations of other subordinates. He shall initiate commendations or disciplinary action for subordinates, subject to review by the Chief of Police. 29. He shall administer and control expenditures of manpower, materials and other cost elements, which could materially affect the operation of this department. 30. He shall promptly advise the Chief of Police in the event of any irregularity or deviation from legal and/or departmental procedures in the affecting of any arrest or the detention of persons so arrested. 31. He shall perform other duties as necessary or assigned. 32. He shall advise and consult with the Chief of Police on all incidents which are of a magnitude requiring department level command decisions or which have a special significance to the Chief of Police. Immediate notification is required in the following instances: A. Upon learning of the death or injury to an employee of the Police Department. B. Upon learning of an incident, whether intentional or accidental, in which an officer has seriously injured or killed a person. C. Upon learning of a serious infraction of law or departmental policy or procedure by personnel of the department that may receive public attention. D. Upon learning of incidents, which appear to be developing into large-scale disturbances or incidents, which would be considered as natural or man-made disasters. E. Any other situation the Chief of Police deems appropriate. 7-27

28 33. The Captain may relieve from duty, pending formal charges, any subordinate personnel of the department, pursuant to the procedures described in this manual. He shall investigate all complaints and reports of any biased conduct, incompetence, neglect of duty or any violation of department rules or regulations on the part of any subordinate and report to the Chief of Police Duties and Responsibilities: Sergeants 1. He shall be responsible to the Captain for direction, planning and coordination of all functions of the department under his command. 2. He may serve as acting Chief of Police, when designated by competent authority. 3. He shall supervise activities for the department at an operational level under the direction of the Captain. 4. He shall be responsible for good order, conduct and discipline of his subordinates; for compliance with department policies and procedures; and for enforcement of all rules, regulations, orders and procedures of the department. 5. The supervisor should be contacted regarding situations out of the ordinary, or beyond the scope of an officer's responsibility. 7-30

31 Duties and Responsibilities: Shift Leader If no supervisor is on duty, a Police Officer shall be the Shift Leader. 1. The shift leader shall be a full-time Police Officer designated by the squad/shift Sergeant. 2. He is responsible for the security and condition of Officers and Dispatchers, vehicles, equipment, and the department in general. 3. He shall guide other employees regarding their general appearance, bearing, and behavior during the shift. 4. He shall guide and assist other employees in the proper execution of department policy and procedures. 5. He shall be responsible for the completion of duties and assignments of the shift. 6. He shall be responsible for advising the oncoming shift of assignments or information. 7. He shall notify the Supervisor On-Call regarding situations or events beyond his scope of responsibility (an off-duty supervisor in the station may be notified in place of the On- Call Supervisor). 8. He shall make an impartial written report to his Sergeant regarding any serious infraction of law or departmental policy or procedure by an employee during the shift Duties and Responsibilities: Detective 1. He shall investigate all crimes or criminal activity occurring within the City of Glendale. 2. He shall follow up all investigations and contact the victim keeping him apprised of any developments. 3. He shall maintain a close rapport with surrounding municipalities and develop an intelligence network to help reduce crime within the City. 4. He shall investigate all juvenile crimes as necessary. 5. He shall join the Major Case Squad and assist when called. 6. He shall attend appropriate criminal investigation meetings, assisting neighboring police departments as necessary and as time allows. 7-31

32 7. He shall apply for warrants at the Prosecuting Attorney s Office and assist in the prosecution of crimes occurring within the City. In some cases he may do this at the request of the arresting officer. 8. He shall maintain close communication with all officers and advise the Captain of any special cases. 9. He shall maintain all records, reports and documents necessary for the presentation and prosecution of cases. 10. He shall maintain evidence in the evidence locker keeping necessary records and destroying contraband after prosecution Duties and Responsibilities: Juvenile Officer 1. He shall investigate all crimes or criminal activity within the City of Glendale, involving juveniles. 2. He shall investigate all cases of Child Abuse and Neglect. 3. He shall conduct follow up investigations with cases involving juveniles as suspects. 4. He shall have a working knowledge of the Glendale Police Department Juvenile Procedure Manual. 5. He shall maintain and update the Glendale Police Department Juvenile Procedure Manual and keep members of the department up to date concerning juvenile procedures. 6. He shall maintain records, reports and documents involving juveniles. 7. He shall use discretion concerning the dispositions of juvenile cases. 8. He shall maintain close communications with all officers and advise the Juvenile Supervisor of special cases Duties and Responsibilities: Crisis Intervention Team The department s Crisis Intervention Team (CIT) shall be composed of specially trained officers whose function is to respond to incidents, which involve a mental health crisis, where the officer s specialized skills may be used to successfully conclude such an incident, and to provide future assistance as may be necessary. The long-range objectives of the program shall be to identify individuals suffering from extended bouts of mental health problems and to initiate measures to reduce the frequency of police contacts. Information will be channeled back to the field to promote increased safety for both police personnel and 7-32

33 the population at large. The policies contained in this order shall not supersede the guidelines promulgated in general orders involving the Use of Force or the notification process required to request assistance from specialized units (e.g. TACT, hostage negotiation, etc.). 1. Definitions: CIT Council A committee comprised of law enforcement officials, court officials, and mental health advocates, responsible for training and policy concerning various Crisis Intervention Teams. The council also serves as a review board that meets to discuss individual cases and formulate recommendations. Crisis Intervention Team Sworn officers specially trained and designated to handle crisis situations involving the mental ill. Mental Health Crisis A situation where an individual s normal coping mechanisms have become overwhelmed causing that individual to pose an immediate and significant risk to self or others. Consumer A term commonly used by the mental health community when referring to an individual with a suspected mental illness or who is involved in a perceived mental health crisis and utilizes mental health services. Mental Illness A range of conditions, each with its own specific characteristics to include, but not be limited to: Schizophrenia Major Depression Bipolar Disorder (Manic depressive) Panic Disorder Schizo-affective Disorder Personality Disorder Obsessive-Compulsive Personality Disorder Other mental Illnesses that can cause disturbances with others or the environment. 2. Selection of CIT Officers Members of the Crisis Intervention Team (CIT) will preferably be volunteers with at least one years police experience with the Glendale Police Department. It is the goal of this department to have every qualified officer participate in the CIT training. CIT Coordinator A CIT Coordinator shall be appointed by the Chief of Police and this supervisor will then be responsible to: Ensure that all CIT slots are appropriately filled. That members of the unit receive required training. Forward required reports and/or other information through the established chain of 7-33

34 command. Prepare an annual statistical report to be submitted to the Chief of Police. Serve as a liaison with mental health and justice services personnel. 3. Operations Procedures CIT officers will function in a generalist role, responding to routine calls for service when not acting in a CIT or other specialist-type capacity. CIT assignment criteria shall include, but not limited to: Attempt suicide calls. Disturbance calls involving an individual known or suspected to suffer from mental illness or disability. Assault calls involving an individual know or suspected to suffer from mental illness or disability. Voluntary and involuntary commitment calls where a police presence is required. Check the welfare calls involving an individual or family member where mental illness is known to be present in the household. An incident where an individual, known or suspected of suffering from mental illness or disability, is reported to be making threats against themselves or others. OBS calls of an undefined nature. A. Dispatch Procedures When communications personnel receive a report of a situation known to involve a mental health crisis, the dispatcher will immediately dispatch two officers to the incident (if manpower allows). The assist officer position shall be filled by a CIT officer whenever possible. Upon the officer s arrival at the scene, a supervisor and/or additional assist units may be dispatched contingent upon initial reports from the first responders. If communications personnel receive a report of a situation that is not immediately recognized as a mental health crisis, once the first arriving officer determines that a CIT officer is needed, their presence will be requested at the scene. 7-34

35 In the event an adjoining municipality requests a CIT officer assist them with a mental health crisis, the on-duty Glendale supervisor or commander must give prior approval before any Glendale personnel are committed to another jurisdiction. Should manpower levels be such that the deployment of a CIT officer would cause a hardship, the request for assistance will be denied. Dispatch will document CIT calls in accordance with established procedures. B. Control of Incident Scene The on-scene CIT officer shall have primary responsibility for the incident scene on any mental health crisis call unless a supervisor is present. In those cases where a supervisor or commander is present at the scene, the ranking officer shall have primary control over the scene. The CIT officer will then be relegated to the use of his/her specialized skills to successfully conclude the incident. Officers who respond to an incident where a CIT officer was not dispatched, and determine the call involves a mentally ill or disturbed individual, will request a CIT officer assist at the scene. On the CIT officer s arrival, he/she shall assume control of the scene, contingent upon the above guidelines. C. Responsibilities of CIT Officer Upon arrival at the scene of a mental health crisis, the CIT officer will determine the circumstances and be responsible for the initiation of the appropriate response. Should the CIT officer determine that the individual involved poses a threat to himself or others, the CIT officer shall be responsible to arrange for transportation. Officers should try to arrange for a relative or other responsible adult to meet them at the facility to sign an affidavit or request admission. Upon arrival at a treatment facility, the CIT officer will arrange admission, if feasible, and complete any affidavits that may be required. Admission to a treatment facility should be arranged by the CIT officer and may be in cooperation with emergency medical personnel assisting with the crisis. This may include affidavits required by either the individual s family members or other witnesses. In the event an individual is not taken into custody, the CIT officer will be responsible for supplying information on mental health resources or making notifications to mental health professionals for further care of the individual (e.g. Behavioral Health Response). The CIT officer shall also notify Justice Services of any mental health concerns when an 7-35

36 individual is lodged at the Justice Center for a crime. The CIT officer will complete all appropriate reports and paperwork. D. Responsibilities of CIT Coordinator The CIT Coordinator will monitor the activities of the officers assigned to the CIT unit. This shall include, but not limited to: Ensuring that CIT officers complete the Crisis Intervention Team Report when applicable. Making certain that CIT officers conduct follow-up investigations on cases investigated by them, as necessary. Ensuring that CIT officers make warrant applications, as necessary. Overseeing the assignment of CIT officers to attend CIT Council-Review Board meetings, as requested. In addition to the preceding, the CIT Coordinator shall be responsible to establish and maintain a central file containing all CIT Reports. These shall be indexed by year and case number, and maintained in accordance with Missouri State Statutes governing records. E. Transportation Procedures Whenever possible, the best method of transportation to a facility is by ambulance. If necessary, sworn personnel will transport individuals suffering from a mental health crisis in accordance with department guidelines for transporting prisoners. F. Report Procedures The officer initially assigned the call shall routinely be responsible to complete the original incident report in regard to the assignment. A report shall be written anytime an officer takes into custody or is in any other way involved in having an individual transported and/or examined for evaluation and treatment. The CIT officer shall generally be responsible for the completion of a CIT report through Mobilenet, a supplemental report, and any and all forms associated with the admission of the individual into a treatment facility (if required). CIT officers shall also have primary responsibility for any notifications made to mental health professionals. Should a warrant application be required, the CIT officer will be responsible to perform same, except in cases where the detective has taken over the investigation. 7-36

37 In each case where a felony offense has been committed by an individual in a mental health crisis, warrant application will be made. In those instances where a misdemeanor offense has been committed by an individual in a mental health crisis, warrant application will be made. Yet contingent upon the type of offense, the officer responsible for the warrant application will, contingent upon a presentation of the facts, request the prosecuting attorney consider the diversion of the suspect into a treatment or alternate mental health program. This diversionary approach may also apply to City ordinance violations. In those instances where a CIT officer is unavailable during a mental health crisis assignment, responding officers will be responsible to complete the original incident report, the CIT report, and provide any immediate assistance available to the individual involved. The responding officer will notify their supervisor of the incident, who will ensure that the appropriate CIT officer is apprised of the event at the earliest possible time. The CIT officer will then assume responsibility for the incident and make such contacts, and complete those supplemental reports that may be required Duties and Responsibilities: Media Relations Officer 1. He shall establish and maintain liaison with news media representatives through direct contact. 2. He shall assist the news media on an on-call basis. 3. He shall prepare and distribute news releases. 4. He shall arrange for and assist at news conferences. 5. He shall coordinate and authorize the release of information about victims, witnesses, and suspects. 6. He shall coordinate the release of authorized information concerning confidential agency investigations and operations when directed by the Chief of Police. 7. He shall attend Media Relations training. 8. He shall be familiar with the Missouri Sunshine Law pertaining to release of information. 7-37

38 Communicating with the Hearing Impaired It is the policy of this department to ensure that a consistently high level of Service is provided to all community members, including those who are deaf or hard of Hearing. The Glendale Police Department has specific legal obligations under the Americans with Disabilities Act and the Rehabilitation Act to communicate effectively with people who are deaf or hard of hearing. To carry out these policies and legal obligatons, The Glendale Police Department instructs its officers and employees as follows: 1. General A. People who are deaf or hard of hearing are entitled to a level of service equivalent to that provided to other persons. B. This department will make every effort to ensure that its officers and employees communicate effectively with people who are deaf or hard of hearing. C. Effective communication with a person who is deaf or hard of hearing involved in an incident whether as a victim, witness, suspect, or arrestee is essential in ascertaining what actually occurred, the urgency of the matter, and the type of situation. D. Various types of communication aids known as auxiliary aids and services are used to communicate with people who are deaf or hard of hearing. These include use of gestures or visual aids to supplement oral communication; use of a notepad and pen or pencil to exchange written notes; use of an assistive listening system or device to amplify sound for persons who are hard of hearing; or use of a qualified oral or sign language interpreter. E. The type of aid that will be required for effective communication will depend on the individual s usual method of communication, and the nature, importance, and duration of the communication at issue. F. In many circumstances, oral communication supplemented by gestures and visual aids or an exchange of written notes will be an effective means of communicating with people who are deaf or hard of hearing. In other circumstances, a qualified sign language or oral interpreter may be needed to communicate effectively with persons who are deaf or hard of hearing. The more lengthy, complex, and important the communication, the more likely it is that a qualified interpreter will be required for effective communication. 7-38

39 G. To serve each individual effectively, primary consideration should be given to providing the type of communication aid or service requested by the individual. Officers should find out from the person who is deaf or hard of hearing what type of auxiliary aid or service he or she needs. Officers should defer to those expressed choices, unless: There is another equally effective way of communicating, given the circumstances, length, complexity, and importance of the communication, as well as the communication skills of the person who is deaf or hard of hearing; or Doing so would fundamentally alter the nature of the law enforcement activity in question or would cause an undue administrative or financial burden; only the Chief of Police or his designee may make this determination. H. The input of people who are deaf or hard of hearing who are involved in incidents is just as important to the law enforcement process as the input of others. Officers must not draw conclusions about incidents unless they fully understand and are understood by all those involved, including people who are deaf or hard of hearing. I. People who are deaf or hard of hearing must not be charged for the cost of an auxiliary aid or service needed for effective communication. 2. On-Call Interpretive Services A. A qualified sign language or oral interpreter is one who is able to interpret effectively, accurately, and impartially, both receptively and expressively, using any necessary specialized vocabulary. Accordingly, and interpreter must be able to sign to the deaf individual (or interpret orally to the person who who speech reads) what is being said by the officer and be able to voice to the officer what is being signed or said by the deaf individual. The interpreter must be able to interpret in the language the deaf person uses (e.g., American Sign Language or Signed English) and must be familiar with law enforcement terms and phrases. Because a qualified interpreter must be able to interpret impartially, a family member, child, or friend of the individual who is deaf may not be qualified to render the necessary interpretation because of factors such as professional, emotional, or personal involvement, or considerations of confidentiality. Additionally, although a qualified interpreter may be certified, a certified interpreter is not necessarily qualified, if he or she is not a good communications match for the deaf person (e.g., where the deaf person uses Signed English and the interpreter uses American Sign Language) or for the situation (e.g., where the interpreter 7-39

40 is unfamiliar with law enforcement vocabulary). B. This department will use Deaf Way Interpreting Services for on-call 24 hours per day interpreting services ( or ). This service charges an hourly rate and requires a two hour minimum charge. 3. TTY and Relay Services In situations when a nondisabled person would have access to a telephone officers must provide persons who are deaf or hard of hearing the opportunity to place calls using a teletypewriter (TTY, also known as telecommunications device for deaf people, or TDD). Officers must also accept telephone calls placed by persons who are deaf or hard of hearing through the Telecommunications Relay Service. 4. Techniques for Officers to Communicate Effectively A. Officers may utilize the following auxiliary aids, when available, to communicate effectively: Use of gestures; Use of visual aids; Use of a notepad and pen or pencil; Use of a computer or typewriter; Use of an assistive listening system or device; Use of a teletypewriter (TTY); Use of a qualified oral or sign language interpreter. 41 Communicating with People Who Are Deaf or Hard of Hearing ADA Guide for Law Enforcement Officers As a law enforcement officer, you can expect to come into contact with people who are deaf or hard of hearing. It is estimated that up to nine percent of the population has some degree of hearing loss, and this percentage will increase as the population ages. Under the Americans with Disabilities Act (ADA), people who are deaf or hard of hearing are entitled to the same services law enforcement provides to anyone else. They may not be excluded or segregated from services, be denied services, or otherwise be treated differently than other people. Law enforcement agencies must make efforts to ensure that their personnel communicate effectively with people whose disability affects hearing. This applies to both sworn and civilian personnel. A driver who is deaf writes on a pad of paper to communicate with an officer. The Glendale Police Department has adopted this specific policy regarding communicating with people who are deaf or hard of hearing. It is important to become familiar with this policy. Requirements for Effective Communication The ADA requires that... Law enforcement agencies must provide the communication aids and services needed to communicate effectively with people who are deaf or hard of hearing, except when a particular aid or service would result in an undue burden or a fundamental change in the nature of the law enforcement services being provided. 7-41
