5 Operations Division: Overview Enforcement The largest division in the Ministry of Labour. Role: to set, communicate and enforce fair employment practices and occupational health and safety standards in Ontario workplaces. Responsible for the enforcement of the Occupational Health and Safety Act and the Employment Standards Act, Comprised of three branches and five regions, including district offices, with over 1,000 staff. The MOL has 445 Health and Safety Inspectors & currently 271 Employment Standards Officers. There are more than 450,000 registered workplaces in Ontario.

6 Operations Division: OHS at a Glance For the fiscal year the ministry s OHS field staff: Conducted over 82,300 field visits to almost 36,000 workplaces, issuing over 125,300 orders/requirements. Inspectors issued 1,832 tickets to employers, 10% less than In the construction sector, 67% (893) of tickets were issued for workers not being adequately protected by fall protection In the industrial program, 13% of tickets were issued for supervisors failing to ensure no work is done near live exposed parts of electrical installations, equipment or conductors without the power supply being disconnected, locked out and tagged under subsection 42(1) of Reg 851. and 9% were for workers working near live exposed parts of electrical installations,.

8 Safe at Work Ontario (SAWO) It is designed to: Improve the health and safety culture of workplaces, Increase compliance = reduction in workplace injuries and illness, Lessen the burden on the health care system, Provide a level playing field for compliant employers, and, Ensure inspectors are at the right workplace at the right time with the right tools. The strategy is built on what the Ministry has learned through past experiences and through consultation with our stakeholders and system partners. 8 June 12, 2018

9 SAWO Stakeholder Consultations 2018 marked the 10th year Consultations were held from January to March 2018 A total of 18 SAWO Consultation sessions were held across the province. Over 280 individuals attended the consultations New this year: a consultation paper was released on the web before the sessions; stakeholders were free to review the paper beforehand and give feedback in person at the consultation sessions or send in their responses by . the industrial program sessions were also used as an opportunity to get feedback on the Industrial regulations a cross-program web session was held Health and Safety Associations kindly provided facilitators for the sessions Feedback from the consultation has been incorporated into the upcoming enforcement plans, and will continue to inform the content of initiatives and blitzes in the future 9 June 12, 2018 Thank you to all participants!

10 Feedback from Stakeholder Consultations For many stakeholders, the most valuable takeaway from the consultation sessions was the opportunity to interact with the ministry and other stakeholders. Stakeholders offered many suggestions for how the ministry can continue to support compliance, including: sharing industry best practices offering easily accessible resources in plain language and multiple languages publishing clear templates/checklists Like previous years, many stakeholders continue to be concerned about mental/psychological health issues in the workplace, the use of substances that affect fitness for work, and technological distractions. Emergent major themes this year include concerns about: modern work arrangements (e.g. understaffing, workers working remotely, piecework in industries that traditionally didn t have that) musculoskeletal disorders and repetitive strain injuries the impact of an aging working workforce and new workers entering the industry 10 June 12, 2018

13 It s Never Okay: An Action Plan to Stop Sexual Violence and Harassment Bill 132 Sexual Violence and Harassment Action Plan Act amended the Occupational Health and Safety Act (OHSA) to enhance employer duties with respect to workplace harassment Came into force: September 8, 2016 Bill 132 implementation key deliverables: Developed Code of Practice for workplace harassment Dedicated enforcement team of inspectors up and running to address workplace harassment complaints and enforce OHSA Three new fact sheets published on Ministry website 13 June 12, 2018

14 Workplace Violence in Schools The Ministry of Labour, the Ministry of Education and the Provincial Working Group on Health and Safety, developed and posted a new guide, Workplace Violence in School Boards: A Guide to the Law. Outlines the workplace violence requirements under the OHSA, and includes some leading practices and helpful tools. School boards should engage health and safety committees to communicate and implement the information in the guide. 14 June 12, 2018
