20 Counting MWBE Participation In order to count the participation of a certified MWBE firm(s), the MWBE must have a place of business inside the Airport s Relevant Market Area. Place of Business is defined as an establishment independently and distinctly owned, where business is conducted, goods are made or store or processed or where services are rendered. Not acceptable: P.O. Box or virtual offices and staffing services. MWBE Primes can count their self-performance toward meeting the MWBE goal, but only for the scope of work and at the percentage level they will self-perform. A DBE-certified firm cannot be counted towards the MWBE goal. 13

21 Counting Supplier Participation Supplier Participation Options: Manufacturer If the materials or supplies are obtained from a MWBE manufacturer, count one hundred percent (100%) of the cost of the materials or supplies towards the MWBE goal. Regular Dealer If the materials or supplies are purchased from a MWBE regular dealer, count sixty percent (60%) of the cost of the materials or supplies towards the MWBE goal. Broker If the MWBE firm is acting as an intermediary between two or more firms for the acquisition of supplies, materials or equipment for a fee, count only the fees and commissions at 100%. Manufacturer s Representative If the MWBE firm is representing a manufacturer for a fee or commission, count only the fees and commissions at 100%. 14

22 Questionnaire Form This form will be used for counting suppliers, brokers, manufacturing and manufacturing representatives. 15

23 MWBE Certification Not required to do business with DFW. CERTIFICATION AGENCIES HOWEVER, if claiming MWBE credit, must be certified by an approved certification agency at the time of proposal submission in order to be credited. Certification certificates must be included with proposal submission. Certificates must be current and not expired. Commodity codes noted on certificate must be relevant to the proposed services. State of Texas, HUB, DBE, SBE and out of state certificates are not acceptable. 16

28 MWBE Evaluation Criteria (20 Points) Affirmative Action Plan. Respondent s Affirmative Action Plan and/or policy statement, including goals with respect to hiring staff for the Agreement and any Delivery Orders that may be issued under it. Such plan must include, but not be limited to: goals for women and minorities for management and non-management positions. Description of Commitment. How will the Respondent manage expectations and commitment to firms that have been identified in the Qualifications Statement that will be utilized to fulfill Respondent s MWBE requirements? In addition, explain the selection of Respondent s team composition, including diversity within the team and any opportunities given to team members that may be new to Respondent s team and why they were selected. Description of Business Development, Technical Assistance, and/or Capacity Building Initiatives: Description of Respondent s commitment to programs, assistance or support to enhance the capacity or facilitate the participation of MWBE s under the Agreement and any Delivery Orders issued pursuant to it, including outreach and a proposed mentoring program. Private Sector Participation: Describe Respondent s ability to demonstrate MWBE participation on private sector work or on contracts that require no goals. How is the overall effectiveness of Respondent s diversity and inclusion initiatives measured? Is it tied to a goal or metric? If so, what is the goal/metric and how was Respondent performed in relation to the goal historically? Assurance: What steps will Respondent take to ensure it meets the MWBE participation goal and does Respondent have a dispute resolution/mediation plan in place for modification, elimination or termination of a MWBE. In addition, Who will oversee Respondent s MWBE program and at what level are they within Respondent s organization. What systems does Respondent have in place to reach its MWBE participation and is Respondent familiar with Board s B2GNOW system and, if not, what steps will Respondent take to learn the system? 21

29 Good Faith Effort (GFE) Plan Proposers that are non-certified firms must meet the applicable goals or demonstrate good faith efforts to achieve the goals. GFE required only if the MWBE goal is not achieved or partially achieved. A GFE Plan is not a checklist! Proposers are required to meet ALL factors outlined and provide support documentation. Factors should not be considered as a template, checklist or some quantitative formula. Submitting the form without support documentation, as a GFE, will automatically deem the Proposer non-responsive. DFW will evaluate the GFE on quality, quantity, and intensity of the different kinds of efforts that the bidder/proposer has made. Mere pro forma efforts are not good faith efforts 22

30 Common Proposal Submission Errors Failure to respond to all RFP Evaluation Criteria questions. Failure to sign all required documents. Failure to submit required MWBE certificates for all identified MWBE firms. Failure to submit correct MWBE certificates; instead submitted a HUB, DBE or SBE certificate. Failure to submit a current MWBE certificate; instead submitted an MWBE certificate with expired dates. Failure to propose with MWBE firms that have a place of business within the Airports Relevant Market Area. Providing certificates for firms that are not listed on the Schedule of Subcontractors or Not providing certificates for firms that are listed on the Schedule of Subcontractors. Use of TBD on a Schedule of Subs instead of dollars & percentages. Using the Good Faith Effort plan as a checklist and not submitting support documentation. 23

38 Groundwater Gauging and Sampling DFW has approximately 400 groundwater monitoring wells Require to be gauged and/or sampled either quarterly, semiannually, or annually Low flow groundwater sampling Majority of sampling and gauging equipment supplied by DFW Environmental Affairs staff performs as much of the work as possible 31

39 Groundwater Gauging and Sampling Outside assistance needed for certain events Assistance of four (4) people is needed for 2 full weeks each June and December. This will eventually be required 4 times per year. Other sampling assistance may be required in February, August, and other times during the year. One or two people. DFW has a stand alone lab contract (ALS of Houston). 32

40 Phase I and II ESAs Phase I and II ESAs may be requested on properties to be developed by DFW or others, or on properties being returned to DFW. Drilling services is required for this contract (concrete coring and third party utility locating services). Over past 2 years 11 Phase I ESAs and 4 Phase II ESAs were performed. Unknown how many will be required in the next three years. 33

41 Deicing Support Services During large and long winter weather events, additional personal may be needed to meet environmental requirements. Outfall sampling and deicing activity observation. Deicing season is from October 15 to April 15. Most severe storms and longer cold spells occur from mid December to late February. Holidays, weekends, and overnight might be required. Additional deicing weather training and certification is required. Majority of deicing locations are within the Aircraft Movement Area. This will require driver training and movement area certification. 34 Assistance has not been required during the last two deicing seasons due to lack of severe or prolonged events.

42 Remediation Design and Implementation DFW Airport has two Voluntary Cleanup Program Areas. The Northwest Cargo and Northeast Cargo Areas. Northeast Cargo is in Post Response Action and monitored natural attenuation is the current remediation strategy. Northwest Cargo s Area of Concern B1 is the primary area that requires remediation design and implementation support. Contaminants of concern are PCE and the daughter products. Class 2 groundwater, low permeability clays, multiple utilities, and source areas under aircraft pavement. Concentrations in groundwater at source areas > 50 mg/l. 35

44 Remediation Design and Implementation Requesting five (5) specific examples of remediation and design experience. In situ remediation is preferred approach to avoid or limit impacts to current tenants. Cost effective and sustainable approaches. Currently time is on our side as this area will always be an airport. 37

45 Sustainability, Air, and Noise Programs Support of DFW s sustainability campaigns to advance the objective of the Airport s strategic plan. Air quality dispersion modeling analyses and air emissions inventory studies utilizing Environmental Protection Agency (EPA) Motor Vehicle Emission Simulator (MOVES2014a or newer version) and Federal Aviation Administration (FAA) Aviation Environmental Design Tool (AEDT 2d or newer version). Support of DFW s Aircraft Noise Program. 38
