1 04/02/13 Page 1 Item #: 12 CITY OF DANA POINT AGENDA REPORT Reviewed By: DH X CM X CA X DATE: APRIL 2, 2013 TO: CITY MANAGER/CITY COUNCIL FROM BRAD FOWLER, DIRECTOR OF PUBLIC WORKS AND ENGINEERING SERVICES SUBJECT: ADOPTION OF A RESOLUTION OF THE CITY COUNCIL AUTHORIZING APPLICATION FOR FUNDS FOR THE PILOT SUMMER WEEKEND PCH TROLLEY, DHHS/HARBOR SHUTTLE AND MISCELLANEOUS SPECIAL EVENT SHUTTLES UNDER THE ORANGE COUNTY TRANSPORTATION AGENCY PROJECT V FUNDING PROGRAM RECOMMENDED ACTION: That City Council 1) adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANA POINT, CALIFORNIA, AUTHORIZING AN APPLICATION FOR PROJECT V GRANT FUNDS TO INITIATE A SUMMER WEEKEND PIOLOT PACIFIC COAST HIGHWAY (PCH) TROLLEY AND DHHS/HARBOR SHUTTLE AND A SPECIAL EVENTS SHUTTLE PROGRAM; 2) authorize the City Manager or his Designee to sign grant documents; and 3) authorize the Mayor to sign the Resolution on behalf of the City. BACKGROUND: In 2006, OCTA developed a Go Local Transit/Trolley Program to encourage cities to work together to achieve regional transportation goals, including increased resident and visitor use of the Metrolink Rail Line. The City participated jointly with the cities of San Juan Capistrano and San Clemente in developing a Tri-City Trolley proposal to provide transit between Metrolink and various locations in each city. The City Council approved submission of an application for this subsequent OCTA Project S Program on March 4, However, the program parameters, oriented toward home to work train commuters, was not suited to the City s visitor serving needs identified in the Tri- City Trolley application. Neither was any significant operations and maintenance (O&M) funding provided in that grant program.

2 04/02/13 Page 2 Item #: 12 DISCUSSION: Subsequently, OCTA has advanced a new competitive Transit Support Grant Program, Project V, which addresses the City s visitor serving requirements more directly. Staff believes the City will be much more competitive in this Program, which is oriented toward community-based transit/circulators within the City. Although neither San Juan Capistrano nor San Clemente intend to participate in this Program, Staff believes the City can begin to accomplish much of what was hoped for in the original Tri-City Trolley, at least as it pertains to Dana Point. The OCTA Project V Grant pays for up to 90% of infrastructure and O&M costs to a maximum of $525,000 annually per City (5-year Program with likely extension). However, restrictions apply, i.e. a maximum of $8/boarding is reimburseable and the City must average a minimum of ten (10) boardings per hour to retain the Grant. The detailed program requirements are attached as Supporting Document B. To prepare this Grant Proposal, staff has worked with the City s transit consultant, Dan Boyle, who developed the original transit Tri-City Trolley Program with our stakeholders. Staff has also worked with the Harbor Master and reviewed the proposal with the Destiny Committee. Generally, the proposal provides for 1) a City PCH Trolley on summer weekends; 2) a Dana Hills High School (DHHS) to Harbor parking shuttle on summer weekends (subject to Capistrano Unified School District parking lot use); and 3) year-round event shuttles from DHHS. Route maps with additional details are attached as Supporting Document C and will be presented at the Council Meeting. Events included are the Festival of Whales, Bicycle Grand Prix Street Faire, Summer Concerts at Lantern Bay Park and Sea Terrace Park, Turkey Trot, OC Dana Point Harbor Boat Show, Ocean Institute Tall Ships Festival, Concours d Elegance, Chili Cook-Off, Celtic Classic, BBQ Championship and the 4 th of July. Doheny State Park events are excluded, per their request. Shuttles/Trolleys would run on a 15-minute schedule. Hopefully OCTA will approve the proposed routes with no fares, assuming they agree these routes do not reduce fare paying riders on their current fixed bus service routes. The Program can be expanded in future years if the City is successful in meeting the minimum 10 boardings per hour average in the first year. OCTA Grantee selection and approval is not anticipated until next Fiscal Year; the Summer Trolley Shuttle would begin in This request before the City Council is not a project as defined in Section of the California Environmental Quality Act (CEQA).

3 04/02/13 Page 3 Item #: 12 Staff requests the City Council approve subject Resolution, as required by OCTA, to submit a grant application for this program. FISCAL IMPACT: Overall, the estimated costs for this proposal for the First Year would include an estimated $120,000 in one-time Capital Costs for 15 bus stops (trash can, ADA Access, bench and sign), $260,000 for shuttle Operations and Maintenance, and an estimated $75,000 for start-up marketing/advertising, schedules, promotions, etc. Marketing costs in future years should be much less. The OCTA Grant will pay up to 90%, on a maximum of $8 per boarding, less fare receipts, for Capital and Operations costs. For targeting it is estimated this will more likely mean an 85% recovery rate. Furthermore, the County would contribute their fair share of the costs for the Harbor and Boat Show shuttles, which is approximately one-third of the proposed program Capital and O&M costs. The City would have to pay for the start-up marketing costs. On the revenue side, the Program would defray current City event General Fund shuttle costs of approximately $15,000. Further, the City has Coastal Transit Program funds of approximately $1 Million that can be spent at a rate of $100,000 per year that can be used to offset transit costs. Therefore, no City General Funds would likely be required in the initial 5-Year Program effort (and beyond). No funds are being requested at this time. Fund requests would be subject to the City s normal budget/funding approval process at a later date. However, cost estimates have been provided because OCTA requires the City identify match funding sources and seriously contemplate program execution, should funds be granted, per the attached Resolution. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANA POINT, CALIFORNIA, APPROVING THE SUBMITTAL OF TROLLEY AND EVENT SHUTTLE IMPROVEMENT PROJECTS TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR FUNDING UNDER PROJECT V COMMUNITY BASED TRANSIT/CIRCULATORS THE CITY COUNCIL OF THE CITY OF DANA POINT, CALIFORNIA DOES HEREBY RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS THAT: WHEREAS, the City of Dana Point desires to implement the transportation improvements listed below; and WHEREAS, the City of Dana Point has been declared by the Orange County Transportation Authority to meet the eligibility requirements to receive Measure M fair share funds; and WHEREAS, the City s Circulation Element is consistent with the County of Orange Master Plan of Arterial Highways; and WHEREAS, the City of Dana Point will provide matching funds for each project as required by the Orange County Project V Community Based Transit/Circulators and Program Guidelines; and WHEREAS, the Orange County Transportation Authority intends to allocate funds for the Dana Point Trolley and Event Shuttles within the incorporated City and the County; and WHEREAS, the City of Dana Point will not use Measure M funds to supplant Developer Fees and other commitments; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dana Point: That the Orange County Transportation Authority allocate funds in the amount specified in the City s application to said City from the Project V Program. Said funds shall be matched by funds from said City as required and shall be used as supplemental funding to aid the City in the improvement of the following projects: PCH Trolley, Harbor Shuttle and Event Shuttles.
