Dexter, Jr., Manager rufi\/ DEPT: Public Works ~ DATE: July 20, 2015 RE: Local Mitigation Strategy Plan Recommendation of Approval Background: After Hurricane Andrew in 1992, many disaster mitigation grants were lost because of the lack of planning. Therefore, the State of Florida mandated that all county emergency management agencies develop a strategy for participation in FEMA's Hazard Mitigation Grant Program (HMGP) if funding became available after a disaster was declared by the President. The Local Mitigation Strategy Plan Is a countywide effort to be prepared for funding opportunities from FEMA should a disaster strike Indian River County or any of its municipalities. In 1998, Indian River County and all the municipalities participated in developing a Local Mitigation Strategy (LMS). The plan is updated periodically and was last adopted by the Board of County Commissioners (BCC) and municipalities in FEMA requires that the plan be reviewed and adopted every five years. City staff has been in attendance during the review process and updating of the plan. The BCC recently approved the plan (back-up attached, full plan can be viewed at.:..:..=:::...::..:..:...:..:..:;...:...:..:..:"-=c.;:;..;;...=:..:.:.;:..;~==.::..:..:...::::,:,...:._;c,:..:=:...=..;:::_:_:::;-===.:..' at their July 7, 2015 meeting. In order for the municipalities to be eligible for the HMGP they must also approve the plan by resolution. Funding: There is no funding necessary for this item.

Analysis: Strengths: Weaknesses: Opportunities: Threats: Approving the resolution will afford us the opportunity to apply for HMGP funding if it became available after a disaster. Not approving the resolution would prohibit us from applying for HMGP funding. HMGP funding, if available after a disaster, would be an additional source of funds. 3 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERO BEACH, FLORIDA, ADOPTING THE 2015 REVISED INDIAN RIVER COUNTY UNIFIED LOCAL MITIGATION STRATEGY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Vero Beach has been and is a participant in the Indian River County Unified Local Mitigation Strategy ("LMS") related to hazard mitigation and disaster recovery as part ofthe state-wide Hazard Mitigation Strategy; and WHEREAS, on September 7, 2010, the Vero Beach City Council adopted Resolution adopting the 2010 Revised LMS in furtherance ofthe City's participation; and WHEREAS, the Federal Emergency Management Agency ("FEMA") requires the LMS to be periodically updated to comply with state and Federal policies and the LMS has been revised and updated accordingly resulting in the 2015 Revised LMS; and WHEREAS, the 2015 Revised LMS has been reviewed and approved by FEMA staff as compliant with Federal standards; and WHEREAS, on July 7, 2015 the Indian River County Commission adopted Resolution adopting the 2015 Revised LMS on behalf of Indian River County as the official document for inclusion in the state-wide Hazard Mitigation Strategy; and WHEREAS, the 2015 Revised LMS has be transmitted to the City for review and the City Council finds and determines it appropriate and advantageous to approve and adopt the 2015 Revised LMS in that adoption serves a municipal and public purpose in furtherance of the public health, safety, and welfare, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERO BEACH, FLORIDA, THAT: Section 1. Adoption of "Whereas" Clauses. The foregoing "Whereas" clauses are hereby adopted and incorporated herein as forming the legislative findings, purpose, and intent ofthis Resolution. Section 2. Adoption of 2015 Revised Local Mitigation Strategy. The 2015 updated and revised Indian River County Unified Local Mitigation Strategy (a copy of which is located and available in the City Clerk's Office and on the City's website, ) is hereby adopted by the City as the official document for inclusion in the statewide Hazard Mitigation Strategy. A copy of this Resolution shall be transmitted by the City Clerk to Indian River County and each ofthe other municipalities in Indian River County. Baird, County Administrator John King, Director Department of Emergency Services Etta LoPresti, Emergency Management Coordinator Emergency Management Division June 16, 2015 Approval of Resolution Adopting the Updated 2015 Indian River County Unified Local Mitigation Strategy On July 13, 2010, Indian River County's Updated Unified Local Mitigation Strategy was adopted by Resolution No The Federal Emergency Management Agency regulations require that all hazard mitigation plans be reviewed and updated as appropriate, and resubmitted to FEMA for approval within five (5) years. In order to continue to be eligible for the following mitigation grant programs administered by FEMA: Hazard Mitigation Grant Program (HMGP), Pre-Disaster Mitigation Competitive (PDM-C), Flood Mitigation Assistance (FMA), Repetitive Flood Claims Program (RFC) and Severe Repetitive Loss Pilot Program (SRL), local governments must have a FEMA approved hazard mitigation plan in order to apply for and/or receive project grants. FEMA staff has reviewed and approved our updated plan and has determined that the Indian River County hazard mitigation plan is compliant with federal standards, subject to formal community adoption. Formal adoption of this plan by each municipality must also occur within one calendar year of receipt of FEMA's "Approval Pending Adoption." FUNDING: No funding was required to update Indian River County's Unified Local Mitigation Strategy. RECOMMENDATION: Staff recommends approval of the attached Resolution and the updated 2015 Indian River County Unified Local Mitigation Strategy. Staff also requests authority to forward the revised LMS plan to each municipality for their formal approval.

Based on our review and comments, Indian River County developed and submitted all the necessary plan revisions and our staff has reviewed and approved these revisions. We have determined that the Indian River County LMS plan is compliant with federal standards, subject to formal community adoption, for the jurisdictions below: Indian River County, Unincorporated City of Sebastian City of Vero Beach Town of Fellsmere Town of Orchid Town of Indian River Shores Upon submittal of a copy of all participating jurisdictions' documentation of their adoption resolutions to our office, we will send all necessary documentation to the Federal Emergency Management Agency (FEMA) who will issue formal approval of the Indian river County LMS. Anderson, Mitigation Bureau Chief ~, J,; '" State Hazard Mitigation Officer '\'.~\ Florida Division of Emergency Management RE: State approval of LMS plans under Program Administration by States (PAS) Florida is currently operating under PAS with regard to the review and approval of local Mitigation Strategy (LMS) plans. Under this designation, the Florida Division of Emergency Management (FDEM) will manage the approval of LMS plans with minimal Federal Emergency Management Agency (FEMA) oversight. FEMA will continue to send final approval letters to local communities for their mitigation plans. The process: Plan updates should be submitted to the state for review six (6) months prior to the plan expiration date. Once received, FDEM will complete the first review of each lms plan within 30-days of receipt whenever possible. Once the plan has been reviewed by FDEM, the county will be notified that the plan is either in need of revisions, approved pending adoption, or approved. Needs Revisions: If the plan is determined to be insufficient the FDEM Mitigation Planning Unit will provide technical assistance to the local jurisdiction until they believe that the plan adequately meets the regulations according to FEMA's standards. 8 Approved Pending Adoption (APA): After FDEM reviewers determine that the plan adequately meets all regulations according to FEMA's standards, they will notify the local jurisdiction by and letter that the plan is ready to be adopted. ~ Approved: Once a plan is adopted, FDEM will notify FEMA that the LMS plan is approved and provide a copy of the adoption resolution, the final plan, and a completed Plan Review Tool. FEMA will issue a formal approval letter for FDEM to transmit to the local community.
