1 STAFF REPORT MEETING DATE: August 25, 2015 TO: FROM: City Council James Berg, Chief of Police Oliver Collins, Acting Captain, Operations Division 922 Machin Avenue Novato, CA (415) FAX (415) PRESENTER: Oliver Collins, Patrol Lieutenant SUBJECT: FY 15/16 CALIFORNIA OFFICE OF TRAFFIC SAFETY, DEPARTMENT OF ALCOHOLIC BEVERAGE GRANT REQUEST Consider adopting resolution to submit a FY15/16 California Office of Traffic Safety, Department of Alcoholic Beverage Control (ABC) grant for $12, The grant proposal would authorize the Novato Police Department to utilize the grant to continue its Minor Alcohol Access Prevention program and revise revenues and appropriations upon award of the grant. Most of the funding will be directed toward staff costs associated with operations, all of which will be performed in the City of Novato. RECOMMENDATION Adopt resolution. DISCUSSION The project goal of this grant is to allow the Novato Police Department to identify and reduce problems associated with licenses alcohol beverage establishments in the City. The City of Novato has a total of 174 ABC Licensees, including 132 active retail establishments and 42 active non-retail. Within a.50 mile radius of the downtown Novato area, there are five bars, two liquor stores and several on-sale restaurants. This area generated 123 calls for service in These calls ranges from intoxicated subjects, to physical fights, narcotics and other public offenses. The Novato Police Department has had a 24% increase in DUI offenses from 2013 to The Novato community and police department have a growing concern with minors accessing alcohol. Several community groups are attempting solutions to this growing problem of youth access to alcohol. The Novato City Council, Marin County Board of Supervisors, Marin Institute, Bay Area Community Resources, Blue Ribbon Coalition and other community groups all work in partnership with the Police Department to find solutions to this issue. Education, cc15_
2 prevention and targeted enforcement are common themes that the community groups encourage and endorse to combat youth access to alcohol. Local news media outlets publish alcohol related violations involving decoy and shoulder tap operations. We garner support and encouragement from residents and merchants alike in our efforts to reduce youth access to alcohol. The Novato Police Department has established partnerships with community groups in Novato that are working to reduce youth access to alcohol. Some of those groups include the Novato City Council, the Marin County Board of Supervisors, Marin Institute, Bay Area Community Resources, Marin County Youth Court, Juvenile Probation and the Novato Blue Ribbon Coalition. The police department works with these groups at prevention education, targeted enforcement reduced recidivism and peer guidance in an effort to reduce juvenile alcohol and drug related offences. Another component of the education is through local news media outlets who frequently received media releases on upcoming and past alcohol related operations. The police Department also garners support from residents and merchants throughout the city. Given all of the factors within Novato: high density of liquor outlets, data that states Novato (Marin) youth are more vulnerable and abuse alcohol than others in the state, an increase in DUI arrested by 24% between 2013 and 2104, and the increase in furnishing alcohol to minor casesthere is a clear and demonstrated need for continued targeted education and enforcement within the City. The following goals and objectives have been identified: 1 LEADS training (two officers) 4 Minor Decoy Operations (one supervisor and two officers) 4 Shoulder Tap Operations (one supervisor and two officers) 2 IMPACT Inspections (one supervisor and two officers) This funding will allow targeted prevention, education and enforcement efforts to youth in the community and identified establishments. The majority of these funds will go towards overtime for the officers/supervisors to conduct trainings and work enforcement operations. A portion of the funds will be used for buy money which will be used during the undercover operations, printing/duplication material for educational material and a handheld ID verifier. FISCAL IMPACT There will be no fiscal impact to the City, with the exception of the initial expenditure of the overtime costs to implement the project, given the grant operates on a reimbursement basis. Some police staff time will be required to administer the awarded grant; this staff time is considered part of their normal duties. ATTACHMENTS 1. Resolution 2. Grant Proposal 2 2

RESOLUTION TO SUBMIT A $12, GRANT PROPOSAL TO THE CALIFORNIA ALCOHOLIC BEVERAGE CONTROL AND AUTHORIZE THE POLICE DEPARTMENT TO UTILIZE THE GRANT TO CONTINUE ITS MINOR ALCOHOL ACCESS PREVENTION PROGRAM AND UPON AWARD OF THE GRANT INCLUDE THE APPROPRIATIONS AND REVENUE PROVIDED BY THE GRANT IN THE FY 2015/16 BUDGET. WHEREAS, The City Council of the City of Novato desires to undertake a certain project designated as the Minor Alcohol Access Prevention program to be funded in part from funds made available through the California Office of Traffic Safety administered by the Department of Alcoholic Beverage Control (hereafter referred to as ABC). NOW, THEREFORE, BE IT RESOLVED that the City Manager of the City of Novato is authorized to execute on behalf of the City Council the contract attached hereto as Exhibit A, including any extensions or amendments thereof and any subsequent contract with the State in relation thereto. IT IS AGREED that any liability arising out of the performance of this contract, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and ABC disclaim responsibility for any such liability. BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to supplant expenditures controlled by this body.
