2 T he unique nature of military service poses challenges for our legal system. The attention focused on men and women returning from Iraq and Afghanistan has highlighted problems faced by veterans and servicemembers who find themselves in court. An unacceptable number of veterans end up in the criminal justice system. Across the country, specialty courts are being established to handle challenges presented by a criminal defendant who is a veteran. Many veterans, having endured the horrors of war, return scarred by that experience, either from inchoate injuries such as Post Traumatic Stress Disorder, or physical injuries such as Traumatic Brain Injury. In many cases, these conditions are not properly diagnosed or treated. Left untreated, these conditions can cause veterans to self-medicate, which may result in behaviors that lead to their arrest. In the civil context, issues of divorce, custody, foreclosure, and employment rights become particularly difficult for those who have deployed overseas. Legislative responses to these issues, such as the Servicemembers Civil Relief Act and the Uniformed Services Employment and Reemployment Rights Act, have created additional protections for servicemembers, but in some cases, enforcement of these statutes has been difficult. The John Marshall Law School Veterans Legal Support Center & Clinic is proud to present a two-day program featuring experts from the legal and military professions who will discuss the nature of military service and its interaction with our legal system.
3 Address by The Honorable William P. Greene, Jr., Chief Judge of the US Court for Veterans Claims Chief Judge Greene, Jr. has sat on the United States Court of Appeals for Veterans Claims (CAVC) since The CAVC, an Article I court, has exclusive jurisdiction to provide judicial review of final decisions by the Board of Veterans Appeals. Judge Greene assumed the responsibilities of the Chief Judge of the Court on August 8, Presentation by Army Brigadier General Clyde Butch Tate II Brigadier General Tate assumed his current position as the Deputy Judge Advocate General for the US Army on October 1, 2009, and is currently promotable to Major General. Prior to assuming his current position, Brigadier General Tate commanded the US Army Legal Services Agency and served as the Chief Judge, US Army Court of Criminal Appeals from Panel discussion featuring judges who have been integral in establishing veterans courts and veterans programs Panel discussion on the due process rights of veterans who have made a claim for VA benefits In Cushman v. Shinseki, the Federal Circuit, in a case of first impression, held that a veteran alleging a service-connected disability has a due process right to fair adjudication of his claim for benefits. Panelists include Kevin Calia, the attorney who argued the case on behalf of the veteran. Panel discussion on the criminal intervention and diversion programs available to veterans Leading the discussion will be Major General William L. Enyart, The Adjutant General of the Illinois National Guard. Panels on the Uniformed Services Employment and Reemployment Rights Act (USERRA) and the Servicemembers Civil Relief Act (SCRA) Panels will be comprised of leading experts, including senior attorneys in the United States Department of Justice. 7 T he John Marshall Law School Veterans Legal Support Center & Clinic (VLSC) began serving veterans in January of The VLSC is unique in that it was established as an initiative of students enrolled at the law school. Students continue to lead the clinic in its mission to serve our nation s veterans. In less than two years, the VLSC has responded to over 750 requests for assistance from veterans, their families and friends, has resolved more than 350 cases in house, and obtained pro bono representation for 60 veterans. In addition, the VLSC has hosted two national conferences on the legal issues facing veterans, has trained over 200 attorneys in veterans benefits law, and VLSC attorneys and students have participated in numerous legal education seminars. Currently, the VLSC is expanding its scope to assist veterans and their families in the areas of family law, criminal law, and alternative dispute resolution.
