PRESENT: Chairman Rolando Torres, Jr., Merit System Board Members, John Currie, Flavella Branham, Margaret E. L. Howard and Robert Long; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations. In accordance with L.1975, c.231, Chairman Rolando Torres Jr., opened the meeting with the following statement: Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 8, 2006, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey. All actions were by unanimous vote unless otherwise specified.

A-2 NICHOLAS CONDITO Nicholas Condito, County Correction Lieutenant, County of Essex, Department of Public Safety, 60-day suspension and demotion to the position of County Correction Officer effective June 8, 2004, on charges of incompetency, inability to perform duties, neglect of duty and violation of Department policies and procedures. Recommendation of the Administrative Law Judge Reverse the 60-day suspension and the demotion to the position of County Correction Officer. Recommendation of the Administrative Law Judge Reverse the 30-day suspension. The Merit System Board affirmed the recommendation of the Administrative Law Judge. A-4 DOUGLAS OKAFOR Douglas Okafor, Hospital Attendant, County of Essex, Health and Rehabilitation Department, 90-working day suspension on charges of failure to perform duties, neglect of duty and other sufficient cause. Recommendation of the Administrative Law Judge Uphold the 90-working day suspension. The Merit System Board affirmed the recommendation of the Administrative Law Judge. A-5 ILLYA RAHMING Illya Rahming, Senior Building Maintenance Worker, William Paterson University of New Jersey, removal effective October 17, 2005, on charges of conduct unbecoming a public employee: assault and/or battery, verbal threats of violence, intimidation, coercion or interference, inappropriate and/or continual use of obscene language and other sufficient cause. Recommendation of the Administrative Law Judge Modify the removal to a six-month suspension. The Merit System Board reversed the recommendation of the Administrative Law Judge to uphold the removal.

12 2 A-6 TERRELL TWIGGS Terrell Twiggs, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, removal effective April 22, 2004 on the charge of selling or possession of alcoholic beverages or controlled dangerous substance while on State property. Recommendation of the Administrative Law Judge Reverse the removal. The Merit System Board directed that this matter be held over. SECTION B MISCELLANEOUS MATTERS B-1 SANTOCHIA CALLAND Santochia Calland appeals her rejection as a County Correction Officer candidate by the County of Union and its request to remove her name from the eligible list for County Correction Officer (S9999F) on the basis of psychological unfitness to perform effectively the duties of the position. B-2 TIFFANY ANN DEANGELIS Tiffany Ann DeAngelis appeals her rejection as a County Correction Officer candidate by the County of Camden and its request to remove her name from the eligible list for County Correction Officer (S9999F) on the basis psychological unfitness to perform effectively the duties of the position. The Merit System Board directed that this appeal be granted. B-3 CHRISTOPHER DONKER Christopher Donker appeals the removal of his name from the (S9999F) eligible list for the title of Police Officer, Township of West Orange on the basis of psychological unfitness.

B-7 ROBERT NAZARIO Robert Nazario appeals his rejection as a County Correction Officer candidate by the County of Gloucester and its request to remove his name from the eligible list for County Correction Officer (S9999D) on the basis of psychological unfitness to perform effectively the duties of the position. B-8 CHRISTOPHER J. O BRIEN Christopher J. O Brien appeals the removal of his name from the (S9999F) eligible list for the title of Police Officer, City of Asbury Park on the basis of psychological unfitness.

B-17 ELIZABETH SOCKRITER Elizabeth Sockriter, an Institutional Trade Instructor 2, Cooking at South Woods State Prison, Department of Corrections, represented by Angela M. LaManna, Esq., appeals the denial of sick leave injury (SLI) benefits. B-18 ERIC REINER Eric Reiner, an Operator Refrigeration Services with Hunterdon Developmental Center, Department of Human Services, appeals the denial of sick leave injury (SLI) benefits. The Merit System Board directed that this appeal be denied but the appellant be awarded 30 minutes of additional SLI benefits.

16 6 B-19 ANGELO SAVERINO Angelo Saverino, a Senior Employment Counselor with the Department of Labor and Workforce Development, represented by David J. Connelly, Esq., appeals the determination of the Commissioner of Labor and Workforce Development, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace (State Policy). B-20 JERRY FISHER Jerry Fisher, a former Police Officer with the Township of Irvington, represented by Samuel J. Halpern, Esq., requests that the Merit System Board reinstate him to his position after a determination by the Police and Firemen s Retirement System that he is no longer disabled and is fit for duty. The Merit System Board denied the request. B-21 TERRILL P. ROBINSON Terrill P. Robinson, represented by Paul W. Bergrin, Esq., appeals the request of the City of Newark to remove his name form the eligible list for Firefighter (M2289E), City of Newark, on the basis of his failure to meet the residency requirement. B-22 JOHN A. SANTIAGO John A. Santiago, represented by Walter J. Tencza, Esq., appeals the decision of Human Resource Information Services which removed his name from the Police Officer (S9999F), City of Passaic, eligible list, based on an unsatisfactory criminal record.

17 7 B-23 KELLY TAYLOR Kelly Taylor appeals the decision of Human Resource Information Services which upheld the removal of her name form the eligible list for Correction Officer Recruit (S9999D), Department of Corrections, on the basis of an unsatisfactory criminal record. The Merit System Board directed that this appeal be granted but the appellant s name be reflected on the certification as being bypassed. B-24 SHEILA RICHARDSON Sheila Richardson appeals her bypass on the May 19, 2004 certification of the eligible list for Juvenile Detention Officer (C2077E), Union County. B-25 SUSAN VANDY Susan Vandy appeals the bypass of her name on a certification of the Human Services Specialist 3 (PC1100G), Burlington County Board of Social Services, eligible list. B-26 DR. ROBERT ZAMBRANO Dr. Robert Zambrano, a former Clinical Psychologist with the County of Hudson, represented by Arnold Shep Cohen, Esq., appeals his resignation in good standing effective September 1, B-27 MALIKA Y. HALE Malika Y. Hale petitions the Merit System Board for reconsideration of the decision rendered on September 6, 2006 which found that the Customer Service Information Specialist 1 (PS56243T) and Records Technician 2, Motor Vehicles (PS5627T), Motor Vehicle Commission promotional examinations were properly administered and valid examination instruments. The Merit System Board denied the request.

18 8 B-28 CHRISTINA MONGON Christina Mongon requests reconsideration of the decision rendered on December 6, 2006, which upheld the determination of the Division of Selection Services that she did not meet the experience requirements for the promotional examination for Manager 1, Human Resources (P0471K), Department of Human Services. The Merit System Board denied the request for reconsideration. B-29 HOUSING INSPECTOR (M6477H), TOWN OF PHILLIPSBURG The Town of Phillipsburg requests permission not to make an appointment from the December 11, 2006 certification for Housing Inspector (M6477H). The Merit System Board granted the request for appointment waiver and assessed no selection costs. B-30 PRINCIPAL CASHIER (M1230H), CITY OF PERTH AMBOY The City of Perth Amboy requests permission not to make an appointment from the September 6, 2006 certification for Principal Cashier (M1230H). The Merit System Board granted the request for appointment waiver and waived the selection costs. B-31 SUPERVISING ADMINISTRATIVE ANALYST (PS1837I), DEPARTMENT OF CORRECTIONS In In the Matter of Supervising Administrative Analyst (PS1837I), Department of Corrections (MSB, decided March 22, 2006) the Merit System Board granted the Department of Corrections request for an appointment waiver from the December 1, 2004 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration. The Merit System Board assessed selection costs in the amount of $1,602.

19 9 B-32 JANICE BENNETT-JOHNSON Janice Bennett-Johnson appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for County Representative Human Services (PS7358K), Division of Prevention and Community Partnership, Department of Human Services. B-33 ELIZABETH BROKER Elizabeth Broker appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the promotional examination for Program Assistant, Corrections (PS8857I), Department of Corrections. B-34 EDWARD CAHILL Edward Cahill appeals the determination of the Division of Selection Services which found that he did not meet the experience requirements, per the substitution clause for education, for the promotional examination for Executive Assistant (PM0333H), Jersey City. B-35 JOYCE CREA Joyce Crea appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the qualifying examination for Governmental Relations Specialist 2, Department of Labor and Workforce Development. B-36 AVA DAVENPORT AND JEANETTE SMALLS Ava Davenport challenges the determination that Jeanette Smalls met the experience requirements for the promotional examination for Office Supervisor (PM1550G), Atlantic City.

20 0 B-37 BRIAN DUCKWORTH The Managing Director, State and Local Government Operations, on behalf of Warren County, requests that Brian Duckworth s out-of-title work experience be accepted to qualify him for a prospective promotional examination for Maintenance Supervisor, Warren County. The Merit System Board granted the request. B-38 VINCENZO GIACCHETTI Vincenzo Giacchetti appeals the determination of the Division of Selection Services, which found that he did not meet the experience requirements for the open-competitive examination for Mechanic (M1107H), Paterson. B-39 NELLIE GOMEZ-HEWITT Nellie Gomez-Hewitt appeals the determination of the Division of Selection Services which found that, per the substitution clause for education, she did not meet the experience requirement for the Classification Officer 1 (PS1288I) promotional examination. The Merit System Board directed that this appeal be granted. B-40 KRISTEN LONGYHORE Kristen Longyhore appeals the determination of the Division of Selection Services that found that, per the substitution clause for education, she did not meet the experience requirements for the open competitive examination for Social Worker (C1552H), Warren County. B-41 ANTHONY LOPEZ Anthony Lopez appeals the determination of the Division of Selection Services which found that he did not meet the experience requirements for the open competitive examination for Director of Special Transportation Services (C4119H), Hudson County.

21 1 B-42 JOHN MERCER John Mercer appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the qualifying examination for Assistant Business Administrator, City of Jersey City. B-43 FREDERICK NUBER AND MICHAEL SANCHELLI Morris County, on behalf of Frederick Nuber, Jr., and Michael Sanchelli, appeals the determinations of the Division of Selection Services which found that they were below the minimum requirements in experience for the qualifying examination for Public Works Inspector, Morris County. The Merit System Board directed that these appeals be denied. B-44 PATRICIA SCACCETTI AND AUDREY WEINHOFER Patricia Scaccetti and Audrey Weinhofer appeal the determination of the Division of Selection Services which found that Patricia Scaccetti did not meet the experience requirements, and Audrey Weinhofer did not meet the experience requirements, per the substitution clause for education, for the promotional examination for Administrative Analyst 2, Data Processing (PS9755N), Department of Labor and Workforce Development. The Merit System Board directed that these appeals be granted. B-45 JULIA WRIGHT Julian Wright appeals the decision of the appointing authority to remove her from the list, and the decision of the Division of Selection Services that she did not meet the experience requirements for the open-competitive examination for Human Services Specialist 1 (C0937G), Salem County.

22 2 B-46 MICHAEL LYNCH Michael Lynch appeals his score for the oral portion of the examination for Police Captain (PM3570G), Camden. B-47 TARALYN BYRITER, ET AL. Taralyn Byriter, Harlan Dredge, Richard Handberry, Harry Lee and Mary Elena Moran appeal the determination of the Division of Selection Services which found them ineligible for the Entry Level Law Enforcement (S9999H) examination for various titles due to untimely applications. The Merit System Board directed that these appeals be denied. B-48 KENNETH JANESK Kenneth Janesk appeals the denial of his request for a make-up examination for Fire Fighter (M9999H). B-49 JOHN PANACEK John Panacek appeals the determination of the Division of Selection Services that denied his admittance to the promotional examination for Deputy Fire Chief (PM3602H), Trenton. B-50 HEAVY EQUIPMENT OPERATOR (PM0487H), LACEY TOWNSHIP Teamsters Local 97, represented by Kevin P. McGovern, Esq., appeals the validity of the promotional examination for Heavy Equipment Operator (PM0487H), Lacey Township. William Rule appeals his score on the promotional examination for Heavy Equipment Operator (PM0487H), Lacey Township. The Merit System Board directed that these appeals be denied.

PURKETT The Managing Director, State and Local Government Operations, on behalf of the City of Burling5ton, requests relaxation of N.J.A.C. 4A:4-7.1A(c) so as to permit the intergovernmental transfer of Jeffrey R. Purkett from the title of Sheriff s Officer, Essex County Sheriff s Office, to the title of Police Officer, City of Burlington. The Merit System Board granted the request. B-52 COUNTY POLICE OFFICER, ESSEX COUNTY The Managing Director, State and Local Government Operations, Department of Personnel, requests that the provisions of N.J.A.C. 4A:4-7.6 be relaxed in order to effectuate the lateral title change, with retention of seniority, for employees in the County Police Officer title series to the Sheriff s Officer title series. The Merit System Board granted the request. B-53 RECENT COURT DECISIONS Submitted for the Merit System Board s review are summaries of recent court decisions involving Merit System Board and Department of Personnel determinations In the Matter of Police Sergeant (PM3213S), City of Camden (Appellate Division, decided 1/9/07); In the Matter of Angelo Rivera, Police Department, City of Camden (Appellate Division, decided 1/17/07; In the Matter of Donald Matlock, City of Trenton (Appellate Division, decided 1/30/07). The Merit System Board noted the decisions.
