1 BUCKS COUNTY COMMISSIONERS September 4, 2013 The Regular Meeting of the Bucks County Board of Commissioners was held on Wednesday, September 4, 2013, at 10:00 am, at Pennswood Village, Langhorne, Pennsylvania. In attendance were Commissioner Robert G. Loughery, Chairman; Commissioner Charles H. Martin, Vice Chairman; and Commissioner Diane M. Ellis- Marseglia. Chairman Loughery opened the meeting with a moment of silence, followed by the Pledge of Allegiance. INTRODUCTIONS Chairman Loughery thanked Pennswood Village for hosting the meeting and introduced Executive Director Ben Hoyle. Mr. Hoyle welcomed everyone and provided information on the continuing care retirement community, including the services it provides and some history of the facility and its property. The Chairman also recognized county row officer Mary Smithson, Clerk of Courts. PROCLAMATIONS The commissioners proclaimed September 8-14, 2013, as SUICIDE AWARENESS WEEK throughout the County of Bucks, and in so doing, encourage Bucks Countians to take part in the events of Suicide Awareness Week to bolster the efforts of Survivors of Suicide, Inc. and to improve the quality of life for those who have been impacted by suicide in their lives. Accepting the proclamation was Patricia Lufkin of Survivors of Suicide, who thanked everyone and provided some information on this group. Among other things, she spoke about the steering committee, newly formed under the direction of Commissioner Marseglia, as well as the annual candlelight vigil being held on Tuesday in Doylestown. COMMENDATIONS The commissioners presented a Letter of Commendation to dispatcher Colleen Sturkey from the Bucks County Emergency Communications Department in recognition of her exemplary service, in particular for her actions during a call on February 19, The caller reported that her husband/boyfriend was attempting to shoot himself in their apartment and Ms. Sturkey kept the caller on the line for more than a half hour, remaining thoroughly professional and calm in the face of obvious tragedy. The commissioners presented three additional commendations to Dennis Forsyth, Dave Hagerty and Walter Hartranft, also from the Emergency Communications Department, in recognition of their service. The commissioners acknowledge and herald their visionary actions in the line of duty that helped lead to the clearing of a criminal case, the stabbing of an elderly gentleman in Doylestown Borough, just 48 hours after the crime was committed. PUBLIC COMMENT Agenda Items None OLD BUSINESS Upon motion of Commissioner Marseglia, seconded by Commissioner Martin, with the vote being 3-0, the minutes of the regular meeting of August 14, 2013 were approved. Upon motion of Chairman Loughery, seconded by Commissioner Marseglia, with the vote being 3-0, item 7b was untabled from the August 14, 2013 meeting. After brief discussion, Chairman Loughery made a motion to approve this agenda item. It was seconded by Commissioner Marseglia, approved with a vote of 3-0, and added to this agenda as item 4c. Upon motion of Chairman Loughery, seconded by Commissioner Martin, and opposed by Commissioner Marseglia, item 4b from the July 17, 2013 meeting was untabled with a vote of 2-1. After some discussion, Chairman Loughery made a motion to re-table this item. Commissioner Marseglia seconded it and the motion passed with a vote of 3-0. DISCUSSION Agenda Items Chairman Loughery read through the agenda, clarifying information and addressing questions and comments. Item 3c Commissioner Marseglia questioned if the funds have to be spent by the end of the year. Chief Clerk Lynn Bush responded that they can be carried over but it is monitored so the funds don t accumulate. 1

2 Item 4a Commissioner Marseglia questioned if any of these products are made in the United States. Purchasing Director Maureen McIlvaine responded that this was bid by Berks County for the co-op group and they were asked to put that language in all of the co-op bids and the vender circled no. Commissioner Marseglia confirmed these are paid from inmate funds. Items 7a, b & c Commissioner Marseglia questioned how they will determine which firms get which jobs and Chairman Loughery explained how the work is to be divided up, based on ownership and lease status of the various tower sites. Item 10a a picture of the armory wall was projected to aid in the explanation of this agenda item Item 10b - General Services Director Gerald Anderson explained that this change is due to the architect s design error and he confirmed that they are keeping a list of these items. Chairman Loughery advised that they will be providing an update on the Justice Center at the next meeting. Item 10d In response to Commissioner Marseglia s inquiry, Mr. Anderson explained the type of services generally needed to keep the county fleet of 200 vehicles safe and in good running condition. He spoke about fender benders and offered that the drivers involved are drug-tested. Chairman Loughery clarified that it works out to about $20,000 per year and Mr. Anderson added that the cost is charged back to the individual departments. Commissioner Martin indicated that the costs sound relatively low considering the size of the fleet, type of vehicles, and the cost of repairs. Further discussion on this matter ended with former Bucks County Commissioner Andy Warren stating it would be valuable to know who is having the accidents. Item 12a - Chief Operating Officer Brian Hessenthaler highlighted some points of the arbitration award. Meredith Dolan, Human Resources Director, confirmed the wage increases, healthcare changes and favorable language changes that were agreed upon for the corrections officers. Item 13a, b & c In response to Commissioner Marseglia s questions, Human Services Director Joseph Funk explained that this provides additional money to the Area Agency on Aging to support services for the seniors in the community. Najja Orr, Director of Area Agency on Aging, clarified that these funds are typically used for those consumers on waiting lists. Item 16a In response to a question of whether this was a bid or no-bid contract, Register of Wills, Donald Petrille, Jr. responded that the original contract was by RFP and he provided some background on the case management system. Chairman Loughery clarified that the original RFP was in 2007 and this increase is for modifications to the paperless system. NEW BUSINESS Upon motion of Commissioner Martin, seconded by Commissioner Marseglia, with the vote being 3-0, the following resolutions were approved with the exception of items 4a, 9a, 10a, 10b and 10d which passed 2-1 with Commissioner Marseglia opposing. Upon motion of Chairman Loughery, seconded by Commissioner Marseglia, with the vote being 3-0, item 7b from the August 14, 2013 meeting was UNTABLED. Upon motion of Chairman Loughery, seconded by Commissioner Marseglia, with the vote being 3-0, this item was approved and added to this resolution as item 4c. MISCELLANEOUS Brian Hessenthaler, Chief Operating Officer, reported on the following: The County s 8 th Annual Pandemic Flu Drill - Will be held on September 28 th from 11:00 a.m. to 2:00 p.m. at four walk-in locations throughout the County. County Health Director Dr. David Damsker noted the drill will offer free seasonal flu shots for residents ages 3 and up. simulate emergency preparedness, they ask that no bags be brought into any of the sites. Bikers & Babes - Libertae will be holding their annual Bikers & Babes Ride on Sunday, September 15 th to benefit babies born to mothers who are seeking a healthy start for their child. The ride begins at Libertae in Bensalem and ends at Core Creek Park in Langhorne. Indian Valley H.O.G y Run - On Saturday, October 12 th, the Indian Valley H.O.G. chapter will be holding their 11 th annual toy run to benefit Children & Youth Social Services Agency. Registration will be in the Giant parking lot in Quakertown. Prescription Drug Take-Back - Another event will be held on Saturday, October 26 th at locations to be announced. 7

8 Lynn T. Bush, Chief Clerk, reported on the following: Household Hazardous Waste and Old Electronics Collection Program - There will be an electronics only collection event taking place on Saturday, September 28 th, at the Lower Makefield Corporate Center from 9:00 am to 3:00 pm. Storm Water Management - Pennswood Village has done a wonderful job with their storm water management system, and has become a regional example of good storm water management. It has reduced the amount of flooding in the area by setting aside areas where water can be re-absorbed, it is also lovely to look at, and helps purify the water before it goes into the Neshaminy Stream. COMMISSIONER COMMENTS September 11 th Ceremony - Commissioner Martin announced that next Wednesday at 8:30 am, a ceremony to recognize the 12 th anniversary of September 11 th will be held at the courthouse. PUBLIC COMMENT Ron Smollow, resident of Upper Makefield wnship and the Democratic Candidate for Prothonotary, offered suggestions on reforming the way the Prothonotary s office does business, specifically regarding the awarding of contracts. Chairman Loughery responded with an explanation of the review process that is currently in place for bids and RFPs, saying he is confident that it is competitive. Mr. Smollow referred to a contract that was approved at the last commissioner s meeting, saying it was a new no-bid contract. Mr. Hessenthaler clarified that the contract in question was an extension of a previously bid contract. Commissioners Marseglia and Martin spoke about the disclosure of political contributions made by individual employees and their companies. ANNOUNCEMENTS The next public meeting of the Bucks County Board of Commissioners will be held at 6:00 p.m. on Wednesday, September 18, 2013, at Byers Choice in Chalfont.
