1 AGENDA ITEM NO..d REPORT TO MAYOR AND COUNCIL TO THE HONORABLE MAYOR AND COUNCIL: DATE: July, SUBJECT: ADOPT RESOLUTION NOS. -, -, -, - AND -0 OF LOCAL SUPPORT AUTHORIZING THE FILING OF APPLICATIONS FOR DISCRETIONARY FUNDING ASSIGNED TO THE METROPOLITAN TRANSPORTATION COMMISSION AND COMMITTING THE NECESSARY MATCHING FUNDS AND STATING THE ASSURANCE TO COMPLETE FOUR PROJECTS IN THE CITY OF CONCORD UNDER THE ONEBAYAREA GRANT PROGRAM AND THE SAFE ROUTES TO SCHOOL PROGRAM Report in Brief In April, City staff submitted grant applications to the Contra Costa Transportation Authority (CCTA) under the OneBayArea Grant (OBAG) program to fund pedestrian and bicycle improvements on Detroit Avenue and in downtown Concord. The OBAG applications also included funding of pavement rehabilitation improvements on Concord Boulevard and on Arnold Industrial Way. Additionally, in May, staff submitted a project proposal to Transportation Partnership and Cooperation (TRANSPAC) to fund the installation of a new traffic signal at the intersection of Oak Grove Road and Sierra Road under the Safe Routes to School (SRS) program. The City s OBAG applications were recently reviewed by the CCTA Board and recommended to the Metropolitan Transportation Commission for final approval. The SRS project proposal was recommended by TRANSPAC in May and will be reviewed by the CCTA Board on July 1, and forwarded to Metropolitan Transportation Commission (MTC) shortly thereafter. If approved by MTC, the City will receive a total of $,,00 in federal funds to implement these projects under the OBAG and SRS programs. Staff recommends that the City Council adopt Resolution Nos. -, -, -, - and -0 of Local Support authorizing the filing of applications for discretionary funding assigned to MTC and committing the recommended matching funds of $1,0,1 in Local Measure J and Gas Tax funds and stating the assurance to complete four projects in the City of Concord under the OneBayArea Grant program and the Safe Routes to School program. Background In May,, the Metropolitan Transportation Commission (MTC) adopted Resolution 0 outlining how improvements in the Bay Area will be funded with federal transportation funds expected through 1. The OneBayArea Grant (OBAG) was identified in Resolution 0 as a new funding approach that better integrates the region s federal transportation program with California s climate

Under OBAG, funding distribution to the Bay Area counties was prioritized to encourage land-use and housing policies that support the production of affordable housing and focus transportation investments in Priority Development Areas (PDAs). Resolution 0 gives the responsibility for carrying out the OBAG program to the congestion management agencies (CMAs) in the Bay Area. As one of the Bay Area CMAs, the Contra Costa Transportation Authority (CCTA) will be responsible for programming $. million in federal funds available through OBAG for Contra Costa County jurisdictions. CCTA previously agreed to divide the $. million in OBAG funds into three parts: $. million for CMA planning; $1. million for Local Streets and Roads Preservation (LSRP), allocated by formula to the Contra Costa jurisdictions (primarily based on population and road miles); and $. million to be allocated through a competitive process for Transportation for Livable Communities (TLC), bicycle/pedestrian, and Safe Routes to School (SRS) projects. In response to a call for projects released by CCTA in March, local jurisdictions and transit agencies operating in Contra Costa County submitted applications totaling $. million for competitive funds, as well as applications for $1. million in formula-based LSRP funds. The competitive applications were reviewed and scored by CCTA staff based on scoring criteria previously developed and approved by CCTA committees. Subsequently, the CCTA Board reviewed the project scores and rankings and recommended the top eight ranked projects to MTC for funding through OBAG. The recommended list of competitive projects included two projects from the City of Concord to implement Complete Streets improvements on Detroit Avenue and in the downtown area near the BART station (see project descriptions below). The City will also receive OBAG funding for a pavement rehabilitation project on Concord Boulevard and on Arnold Industrial Way, and SRS funding for a new traffic signal at the intersection of Oak Grove Road/Sierra Road (see discussion below). Discussion The CCTA Board has recommended to MTC the following projects from the City of Concord to be funded with federal transportation funds through the OBAG and SRS programs, as specified below. It should be noted that OBAG and SRS are two separate and distinct programs provided by MTC for federal funding of transportation projects in the Bay Area with different evaluation criteria and eligibility requirements. Detroit Avenue Complete Streets Project (OBAG Project) This project was tied for second place on the list of competitive OBAG projects submitted in Contra Costa County. If approved by MTC, this project will receive $.1 million in federal funds to install Complete Streets improvements on Detroit Avenue, between Clayton Road and Monument Boulevard. Additional local match funds of $1,000 (in Local Measure J funds) will be provided as required for federal funding. The proposed improvements include installation of Class bike lanes (to be used exclusively for bicycles) and sidewalk improvements along this segment of Detroit Avenue,

Last-Mile Bike and Pedestrian Access to BART (OBAG Project) This project received fourth place on the list of competitive projects. If approved by MTC, this project will receive $1.1 million in federal funds to install bike lanes and pedestrian circulation improvements on Clayton Road and on Concord Boulevard between Sutter Street and Grant Street, bike lanes and sidewalk improvements on Grant Street between Oak Street (downtown BART station) and Willow Pass Road, and bike lanes on Oakland Avenue between Clayton Road and Mt. Diablo Street. Additional local match funds of $,000 (in Local Measure J funds) will be provided by the City. These improvements have been reviewed by City staff and traffic consultant Fehr & Peers to ensure that they can be implemented without negatively impacting traffic flow or levels of service on downtown streets during the weekday peak periods. City of Concord Pavement Rehabilitation (OBAG Project) This project will be funded on a non-competitive basis and in proportion to the City s population and road miles as compared to the rest of the County. If approved by MTC, this project will receive $,000 in federal funds to implement pavement rehabilitation improvements within the City, including grinding and replacing the top." of asphalt concrete along a,000-foot segment of Concord Boulevard (between Port Chicago Highway and Sixth Street) and a,0-foot segment of Arnold Industrial Way (between Port Chicago Highway and Pike Lane). The project will also include sidewalk and ADA curb ramp improvements as appropriate. Additional local match funds of $,000 (in Local Measure J funds) will be provided by the City. Traffic Signal at Oak Grove Road/Sierra Road (SRS Project) This is a SRS project and is subject to a different review process than the OBAG projects. As part of the SRS process, City staff submitted a project proposal to TRANSPAC in May for review and consideration. TRANSPAC reviewed the project proposal and forwarded a recommendation to the CCTA Board to fund this project using funds allocated for qualified SRS projects in Central Contra Costa County. The CCTA Board will review this project and other SRS projects proposed from all four sub-regions of the County on July 1, and will forward the list to MTC for final approval. If approved by MTC, Concord s project will receive $0,00 in federal funds to signalize the intersection of Oak Grove Road and Sierra Road to provide a signal-actuated crosswalk for school children and adults to cross Oak Grove Road on foot or on bicycle safely. Additional local match funds of $,1 (in Gas Tax funds) will be provided by the City. This traffic signal is warranted based on traffic volumes per California Manual on Uniform Traffic Control Devices (MUTCD) guidelines. The signal installation will include an advance SIGNAL AHEAD warning system with flashing beacons in both directions of Oak Grove Road to account for a sharp S-curve in the road.

However, as a condition for receiving these funds, MTC requires that the City Council adopt a resolution of Local Support for each individual project. The resolutions of Local Support for Concord s projects will also allow the City to incorporate these projects into the Federal Transportation Improvement Program (TIP) to make them eligible for federal funding. All four projects will be included as part of the FY - CIP/TIP program, with project completions anticipated in FY 1-1. Fiscal Impact Implementation of the above cited OBAG and SRS projects will require the City to provide $1,0,1 in local match funds. A portion of these funds ($,000) was allocated as part of the FY - CIP/TIP Program for the Detroit Avenue Complete Streets and the Last-Mile Bike and Pedestrian Access to BART projects. No funds were allocated for the City of Concord Pavement Rehabilitation and Traffic Signal at Oak Grove Road/Sierra Road projects. Staff recommends that the Council appropriate the necessary funds, $,1, to provide the local match for the OBAG and SRS grants related to the City of Concord Pavement Rehabilitation and Traffic Signal at Oak Grove Road/Sierra Road projects. Staff has analyzed the allocation of the additional funds and finds that it will not adversely impact the -year capital improvement program. Table 1 below illustrates the local matching contributions for the Detroit Avenue Complete Streets and the Last-Mile Bike and Pedestrian Access to BART projects (which were funded as a part of the FY - CIP/TIP Program), as well as the local matching contributions for the City of Concord Pavement Rehabilitation and Traffic Signal at Oak Grove Road/Sierra Road projects (which are recommended for Council adoption at this time via Resolution No. -0). 6 Attachment BEFORE THE CITY COUNCIL OF THE CITY OF CONCORD COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA A Resolution of Local Support Authorizing the Filing of an Application for Discretionary Funding Assigned to MTC and Committing any Necessary Matching Funds and Stating the Assurance to Complete the Project (Detroit Avenue Complete Streets Project) Resolution No. - / WHEREAS, the City of Concord (herein referred to as APPLICANT) is submitting an application to the Metropolitan Transportation Commission (MTC) for $,1,000 in funding assigned to MTC for programming discretion, including but not limited to federal funding administered by the Federal Highway Administration (FHWA) such as Surface Transportation Program (STP) funding, Congestion Mitigation and Air Quality Improvement (CMAQ) funding and/or Transportation Alternatives (TA) funding (herein collectively referred to as REGIONAL DISCRETIONARY FUNDING) for the Detroit Avenue Complete Streets Project (herein referred to as PROJECT) for the OneBayArea Grant program (herein referred to as PROGRAM); and WHEREAS, the Moving Ahead for Progress in the st Century Act (Public Law -1, July, ) and any extensions or successor legislation for continued funding (collectively, MAP ) authorize various federal funding programs including, but not limited to the Surface Transportation Program (STP) ( U.S.C. ), the Congestion Mitigation and Air Quality Improvement Program (CMAQ) ( U.S.C. ) and the Transportation Alternatives Program (TA) ( U.S.C. ); and WHEREAS, state statutes, including California Streets and Highways Code 1. and 1. provide various funding programs for the programming discretion of the Metropolitan Planning Organization (MPO) and the Regional Transportation Planning Agency (RTPA); and WHEREAS, pursuant to MAP-, and any regulations promulgated thereunder, eligible project sponsors wishing to receive federal funds for a project shall submit an application first with the appropriate MPO for review and inclusion in the MPO's Transportation Improvement Program (TIP); and WHEREAS, MTC is the MPO and RTPA for the nine counties of the San Francisco Bay region; and WHEREAS, MTC has adopted a Regional Project Funding Delivery Policy (MTC Resolution No. 0, revised) that sets out procedures governing the application and use of federal funds; and WHEREAS, APPLICANT is an eligible sponsor for REGIONAL DISCRETIONARY FUNDING; and WHEREAS, as part of the application for REGIONAL DISCRETIONARY FUNDING, MTC requires a resolution adopted by the responsible implementing agency stating the following: Res. 7 the commitment of any required matching funds; and. that the sponsor understands that the REGIONAL DISCRETIONARY FUNDING is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional REGIONAL DISCRETIONARY FUNDING; and. that the project will comply with the procedures, delivery milestones and funding deadlines specified in the Regional Project Funding Delivery Policy (MTC Resolution No. 0, revised); and. the assurance of the sponsor to complete the project as described in the application, subject to environmental clearance, and if approved, as included in MTC's federal Transportation Improvement Program (TIP); and. that the project will comply with all project-specific requirements as set forth in the PROGRAM; and. that the project (transit only) will comply with MTC Resolution No., revised, which sets forth the requirements of MTC s Transit Coordination Implementation Plan to more efficiently deliver transit projects in the region. NOW, THEREFORE, BE IT RESOLVED that the APPLICANT is authorized to execute and file an application for funding for the PROJECT for REGIONAL DISCRETIONARY FUNDING under MAP- for continued funding; and be it further RESOLVED that the APPLICANT by adopting this resolution does hereby state that: 1. APPLICANT will provide any required matching funds; and. APPLICANT understands that the REGIONAL DISCRETIONARY FUNDING for the project is fixed at the MTC approved programmed amount, and that any cost increases must be funded by the APPLICANT from other funds, and that APPLICANT does not expect any cost increases to be funded with additional REGIONAL DISCRETIONARY FUNDING; and. APPLICANT understands the funding deadlines associated with these funds and will comply with the provisions and requirements of the Regional Project Funding Delivery Policy (MTC Resolution No. 0, revised) and APPLICANT has, and will retain the expertise, knowledge and resources necessary to deliver federally-funded transportation projects, and has assigned, and will maintain a single point of contact for all FHWAfunded transportation projects to coordinate within the agency and with the respective Congestion Management Agency (CMA), MTC, Caltrans and FHWA on all communications, inquires or issues that may arise during the federal programming and delivery process for all FHWA-funded transportation projects implemented by APPLICANT; and. PROJECT will be implemented as described in the complete application and in this resolution, subject to environmental clearance, and, if approved, for the amount approved by MTC and programmed in the federal TIP; and. APPLICANT and the PROJECT will comply with the requirements as set forth in MTC programming guidelines and project selection procedures for the PROGRAM; and.
