Texaco A seafarer has 180 days to file complaint after alleged event A violation can only be found if complaint demonstrates protected activity was a contributing fact in adverse action If employer demonstrates that same actions would have happened in the absence of protected activity, then there can be no complaint Within 60 days of receipt of complaint, the secretary must conduct an investigation If sufficient evidence is gathered, a hearing scheduled The secretary will issue a final settlement

27 Pipeline Conflicts and SNWW Background: Recent contract identified issues with existing elevations of various pipelines crossing the SNWW Safety and environmental issues should a line be hit. Result was the dredging was not conducted but waterway along centerline remains navigable. Actions: Galveston District (ACOE) are going through the appropriate justifications and legal reviews that will be coordinated with USCG.

This includes cargo transferred using hoses, conveyors or vacuum systems. New definition removed the verbiage associated with vessels.

45 To: Coast Guard City Application Review Board On behalf of the Southeast Texas Waterway Advisory Council (SETWAC), it is my pleasure to write in support of the City of Port Arthur, TX as they seek to earn the "Coast Guard City" designation. SETWAC values the presence of the United States Coast Guard (USCG) in our community and recognizes the strong partnerships that exist between the local community and the U. S. Coast Guard. These partnerships are both necessary and mutually beneficial. It is obvious from our position that the City of Port Arthur recognizes the devotion and sacrifice of the women and men of the U. S. Coast Guard. It is their desire, and those of the community at large, to both recognize and support this great organization. The City of Port Arthur's relationship with the Coast Guard began in 1942 with the creation of the Marine Safety Inspection Office and has since evolved into the present day Marine Safety Unit (MSU) Port Arthur which has an area of responsibility that includes Southeastern Texas, Southwestern Louisiana and the offshore waters up to 200 miles offshore. Designating Port Arthur as a Coast Guard City would provide even greater opportunity for our community to recognize the tremendous contributions of this great organization. 46 National Transportation Safety Board An Assessment of the Effectiveness of the U.S. Coast Guard Vessel Traffic Service System Released: 13 Sep 2016
47 Overview A Vessel Traffic Service provides active monitoring and navigational advice for vessels in particularly confined and busy waterways. The Coast Guard fully supported this study and appreciates the comprehensive work done by the NTSB. The study team visited all 12 VTS and interviewed more than 100 VTS personnel and VTS system users.
48 The Study The study contains 14 conclusions and 21 recommendations aimed at further reducing the risk of maritime accidents in VTS areas. Focus: Improved Training Standardized and Assertive Communication Establishing a Risk Assessment and Risk Management Program
49 The Study In general, the Coast Guard is supportive of the study s results, conclusions and recommendations. The Coast Guard will respond in detail to the NTSB on each of their recommendations. The Coast Guard will use the results of this study to improve the effectiveness of VTS nationwide.
