He began his legal career in 1966 with the U.S. Treasury Department, Office of Chief Counsel, Internal Revenue Service where he served for 14 years. In that position, he handled primarily U.S. Tax Court cases in litigation. He also did review work for collection cases as well as reviewing criminal enforcement matters prior to referral to the Department of Justice for prosecution. In 1980 he accepted an appointment as an Administrative Law Judge with the U.S. Department of Labor. In that position, he handled cases involving approximately 90 different federal labor statutes as well as serving as a Mediator and Special Trial Judge for various cases involving laws administered by other federal agencies. Judge Jansen is a member of the State of Indiana Bar, and has also been admitted to practice in various U.S. District Courts, the 6 th Circuit Court of Appeals, and the U.S. Tax Court. Upon his retirement from the bench about 10 years ago, he engaged in a variety of endeavors including parish related activities and also began a 10 year association with numerous primarily WWII veterans to prepare their documents and oral histories for submission to the Veterans History Project of the Library of Congress. Files have also been submitted to the WWII Museum in New Orleans and the 8 th Air Force Museum in Savannah, Georgia. He earned his Bachelor degree from Marian University and a Juris Doctor from Indiana University, Indianapolis, School of Law. Contact CAPT Steve Drefahl if you are interested at sdrefahl@fuse.net or call (513) Where Things Stand with the National Defense Authorization Act We'll have to wait at least another six weeks before Congress makes final decisions on the force levels, pay raise, TRICARE fees, and other changes in the FY 2017 Defense Authorization Act. But we can be pretty sure of at least some of the new changes because they were included in both of the bill versions passed by the House and Senate. Based on the above, here is what we expect the new defense bill will require. TRICARE: TRICARE Standard will have a new name (possibly TRICARE Preferred) and be reconstituted as a preferred provider network, which means some charges will be higher for visits with doctors who aren't in the new TRICARE network. The new version of TRICARE Standard/Preferred will have an annual enrollment requirement. If you're under 65 and in TRICARE Standard now, you've never had to explicitly enroll. If you didn't enroll in the HMO-style TRICARE Prime, you were automatically covered under Standard. No more. This is important: starting in 2017, retirees and family members under 65 will have to sign a document to enroll in either the version of Standard/Preferred or TRICARE Prime. If you don't actively enroll in one or the other, you and your family won't be covered by TRICARE. So you'll need to pay attention to notices about the annual enrollment period, starting next year. No later than January 2020, retired enrollees in the new version of TRICARE Standard/Preferred will have an annual enrollment fee. Again, this will be new, as Standard currently has no enrollment fee. If the House plan prevails in the final bill, the annual enrollment fee for 2020 will be $100/$200 for single/ family. There is a possibility it could be more, depending on continuing negotiations between the House and Senate. Military medical facilities will be implementing a variety of initiatives to improve access to and quality of care, including a standardized appointment system, more use of telehealth services, adoption of common quality/performance measures, and displays of emergency room wait times. SBP-DIC Survivors: We fully expect the current Special Survivor Indemnity Allowance (SSIA) - $310 per month as of this month - won't be allowed to expire next year. It will be extended for at least one year, which gives us another shot at seeking a further extension and continued increases in the SSIA amount to make more progress toward eliminating the SBP-DIC offset, which is our ultimate goal. Commissaries: The commissary system will be testing house brands and a variable pricing system. This means shoppers at some locations might see increases and others might see decreases, although Congress still requires commissaries maintain the same overall levels of beneficiary savings and satisfaction. Reimbursement for Drill-Related Travel: Both bills give service secretaries more flexibility to pay higher reimbursements, on a case-by-case basis, to members traveling beyond normal commuting distance. 3
4 SURVIVING SPOUSE CORNER Being Thankful (By Sharon DeVaney, member, Surviving Spouse Advisory Committee) We will celebrate Thanksgiving the fourth Thursday in November. But did you know this was not always the case? Here s a little history: The first Thanksgiving was celebrated by the Pilgrims in 1621 after their first harvest in the New World, and the feast lasted three days, with 90 Native Americans and 53 Pilgrims in attendance. On Oct. 3, 1979, President George Washington proclaimed the first official Thanksgiving to be held Nov. 26 of that year. In 1863, President Abraham Lincoln proclaimed a national Thanksgiving Day should be observed the last Thursday in November. This again changed Dec. 26, 1941, when President Franklin Roosevelt signed a bill into law declaring that Thanksgiving should fall on the fourth Thursday of November. Everyone has different Thanksgiving traditions. Maybe you will begin the day with a church service. You might spend the day helping to cook and serve a meal at a charitable organization or on a military post or base. Maybe you will celebrate at home with family and friends. Or perhaps you ll spend the day making a plan for your Black Friday shopping excursion. However you spend your time, if you have loved ones serving overseas, I am sure your thoughts will be with them and their fellow servicemembers. For me, this day always has been about finding my recipes for favorite dishes, shopping for groceries, and planning how to prepare all the foods. My husband's agenda for the day included a run followed by turkey dinner and watching football games. When we were overseas and living on the economy, we went to the mess hall for Thanksgiving. There were several benefits: 1) The mess hall was decorated; 2) the meal was wonderful and someone else had done the work; and 3) you could visit with all your friends without having to cook, serve, and clean up after the feast. I want to thank all the dining hall chefs and staff everywhere for making Thanksgiving so enjoyable for families far away from home. However you spend your day, remember to give thanks for our servicemembers all over the world. I hope you have a happy holiday. On Tuesday, officials from the Social Security Administration announced the small raise, the third consecutive year the benefits adjustment will be under 0.5 percent. Since 2009, the cost-of-living hike has been more than 2 percent only once, when it reached 3.6 percent in Veterans benefits are not automatically tied to the Social Security increase, but in July lawmakers passed legislation linking the two benefits for In the last few decades, veterans have seen their annual adjustment differ from the Social Security COLA only one time, and then only due to minor rounding differences. The Social Security COLA is calculated by the Bureau of Labor Statistics periodic Consumer Price Index, a statistical estimate of the anticipated price of a variety household goods and services. This year, officials are estimating only small increases in those costs, identical to the rise seen in expenses heading into The Social Security, military retiree and veterans benefits changes affect more than 70 million Americans, about 22 percent of the country s population. According to the Associated Press, the 0.3 percent adjustment will mean less than $4 more a month for a Social Security recipient who sees the average payout of $1,238. The adjustment will go into effect for beneficiaries starting Dec. 30. Veterans using Medicare for health coverage may not see anything at all once those medical costs come into play. The Associated Press reports that Medical Part B premiums, which are usually deducted from Social Security payments, are expected to increase this year, effectively wiping out the COLA hike.
