1 IMO FSI 17 Agenda Preview The 17 th session of IMO FSI 17 Sub-Committee on Flag State Implementation will be held on 20 th 24 th April th March This publication, produced by Lloyd s Register, provides an overview of the agenda for FSI 17, and summarises all the documents submitted for discussion at this meeting. It contains details of all papers submitted up to 24 th March, Synopses have only been included for each agenda item. Further update will be provided to accommodate further documents released by IMO, if any, and their further analysis. In accordance with paragraph 3.28 of the Guidelines on the organization and method of work of the Maritime Safety Committee and the Marine Environment Protection Committee and their subsidiary bodies (MSC-MEPC.1/Circ.2) the draft terms of reference of the group issued at the beginning of the session will identify items on which the group could start, if so decided, working on the morning of the first day of the meeting, without prior consideration of the related agenda items in plenary. Responsibilities of Governments and measures to encourage flag State compliance (Agenda Item 3) (Target completion date Continuous) (Reporting MSC 87) Background: The Sub-Committee will: 1. note the information on the IMO Membership and Signatories or Parties to the 1972 United Nations Convention on the Law of the Sea (UNCLOS) and/or to the Agreement relating to the implementation of Part XI of the Convention, as contained in a document (FSI 17/3) prepared by the Secretariat (see FSI 16/18, paragraph 3.22); and 2. consider the information (FSI 17/3/1) on the proposals for the completion of the study on the combination of casualty and port State control (PSC) data received from interested bodies and the datasets that might be needed for combining casualty and PSC data (see FSI 16/18, paragraph 3.15). FSI 17/3/1 (Secretariat) - Study on the combination of casualty and port State control data This document provides information on the study on the combination of casualty and port State control data, including a proposal by the World Maritime University, Old Dominion University, INRETS and the University of Nantes. FSI 17/3/2 (Iran) - Measures taken to enhance security policies and activities This document provides a description of the measures taken by the maritime administration of the Islamic Republic of Iran, as the ISPS Designated Authority, to improve its flag State control activities over maritime security issues in port facilities within Iranian territorial waters and on flagged ships. FSI 17/3/3 (Iran) - A report on the implementation of mandatory and non-mandatory rules and regulations to enhance safety and security of navigation and to fight marine pollution This document contains a brief report on implementation of mandatory and nonmandatory rules and regulations by the Islamic Republic of Iran with regard to enhancing safety and security of navigation and pollution prevention. FSI 17/3/4 (Secretariat) - Implementation of the IMO Unique Company and Registered Owner Identification Number Scheme This document contains an update on the status of implementation of the IMO Unique Company and Registered Owner Identification Number Scheme from the current managers of the Scheme (Lloyd s Register - Fairplay (LRF)) and a proposal to assist Administrations in the process of receiving the numbers to be included in the relevant ships certificates and continuous synopsis records. 12 FSI 17/INF.13 (Secretariat) - Study on the combination of casualty and port State control data This document contains information on the proposed research team and a preliminary list of references related to the proposal by the World Maritime University, Old Dominion University, INRETS and the University of Nantes for a study on the combination of casualty and port State control data. 5. Mandatory reports under MARPOL 73/78 (Agenda Item 4) Background: The Sub-Committee will consider a document prepared by the Secretariat (FSI 17/4) containing a summary on mandatory reports under MARPOL for 2007 submitted by the Parties to MARPOL in accordance with MEPC/Circ.318 (see FSI 16/18, paragraph 4.11). (Document submitted) 6. Port reception facilities-related issues (Agenda Item 5) (Target completion date 2010) (Reporting MSC 87) Background: The Sub-Committee will: 1. review the report of the Correspondence Group on Tackling the Inadequacy of Port Reception Facilities (FSI 17/5) re-established at FSI 16 (see FSI 16/18, paragraph 5.11) to progress work on the following items of the Action plan 2.1, 2.2, 2.3, 3.1, 3.2, 4.1, 4.2, 5.3 and 6.1; 2. consider a further progress report by the Secretariat (annex 1 to FSI 17/5) on the population levels of the GISIS PRFD, including an analysis of reported alleged inadequacies categorized by reception facility type and also including information on follow-up responses from port States on alleged inadequate facilities (see FSI 16/18, paragraph 5.9.3); and 3. take into account the outcome of BLG 13 on the review of relevant nonmandatory instruments as a consequence of the amended MARPOL Annex VI and the NOx Technical Code (agenda item 13) on matters related to port reception facilities and provide advice as appropriate. (Document submitted) FSI 17/5 (United States) - Report of the Correspondence Group on Tackling the Inadequacy of Port Reception Facilities This document reports on the outcome of the work of the correspondence group on tackling the inadequacies of port reception facilities. Action requested of the Sub-Committee The Sub-Committee is invited to approve the report of the correspondence group in general and, in particular, to: 1. request under work item 2.1 a further progress report to FSI 18 on the population levels of GISIS PRFD, and consequently to extend the target date for External Affairs 20/ of 30

13 the completion of work item 2.1 to 2010, subject to endorsement by MEPC 59 (paragraph 15); 2. encourage those Member States who have not already done so, to populate GISIS with records of reception facilities in their ports and with their contact points (as a flag State and as a port State) (paragraph 16); 3. encourage also Member States to populate the new fields in the PRFD in order to improve the PRF information available to users (paragraph 23); 4. consider work items 2.2 and 2.3 as completed (paragraph 23); 5. note that technical problems have not been identified which would inhibit the ship-to-shore transfer of wastes and consequently consider work item 3.1 as completed (paragraph 26); 6..ote that it might be desirable that ISO contributes two new international standards, one for the design, construction and equipping of PRFs and the second for the management and operation of PRFs (paragraph 42); 7. consider extending the target date for the completion of work items 3.2, 4.1 and 4.2 to 2010, subject to endorsement by MEPC 59 (paragraphs 43, 48 and 52); 8. consider the finalized Guide to Good Practice for Port Reception Facilities (annex 4 to this report) with a view to proposing to MEPC that the Guide be published as a Circular. In addition, consider pursuing the following additional avenues for further dissemination of the Guide (paragraph 65):.1 place a link to download the Guide electronically from the GISIS website;.2 encourage port States to make the Guide available at PRFs; and.3 encourage flag States to make the Guide available to ship owners/masters. 9. consider work item 5.3 as completed (paragraph 66); 10. consider extending the target date for the completion of work item 6.1 to 2010, subject to endorsement by MEPC 59 (paragraph 75); and 11. consider the re-establishment of the correspondence group to continue work on the remaining work items of the Action Plan. 7. Casualty statistics and investigations (Agenda Item 6) (Target completion date Continuous) (Reporting MSC 87) Background: The Sub-Committee will review the report of the Correspondence Group on Casualty Analysis (FSI 17/6) established at FSI 16 (see FSI 16/18, paragraph 6.38) to: 1. conduct a review of the relevant casualty reports referred to the group by the Secretariat, based on the information received from Members on investigations External Affairs 20/ of 30

14 into casualties, taking into consideration the outcome of related discussion/decision of other IMO bodies; 2. identify safety issues that need further consideration; and 3. identify areas for improvement of the current casualty analysis procedure (FSI 12/22, annex 2), including the scope and the format of the information to be made available at the different steps of the process. In this context, the Sub-Committee will also consider the list of reports of investigations into casualties which have been analysed for this session of the Sub Committee (FSI 17/6/1) and the draft analyses, as reviewed by the reporting States during a one month period on GISIS. An appropriate number of copies of the draft analyses will be made available to the Working Group on Casualty Analysis to be reconvened. LR position: To note the discussion as regards to possible safety issues identified that may require further consideration Implications: none at this stage Application: N/A (Document submitted) FSI 17/6 (Norway) - Report of the Correspondence Group on Casualty Analysis This document contains the report of the Correspondence Group on Casualty Analysis in accordance with the following terms of reference: Based on the information received rom Members on investigations into casualties, to conduct review of the relevant casualty reports referred to the group by the Secretariat; To identify safety issues that need further consideration; To identify areas for improvement of the relevant casualty analysis procedure (FSI 12/22, annex 2), including the scope and the format of the information to be made available at the different steps of the process; To submit a report to FSI 17 Action requested of the Sub-Committee: The Sub-Committee is invited to approve the report of the group in general and, in particular to: 1. refer the analysts reviews of the reports of investigation into casualties, and the draft text of lessons learned for presentation to seafarers (FSI 17/6/1 and annex 1 to this document) to the Working Group on Casualty Analysis for review; 2. refer to the relevant Committees and Sub-Committees those reports reviewed by the analysts which are considered by the Working Group on Casualty Analysis and which are of interest to them. In doing so, the Working Group will submit supporting information derived from the casualty analysis procedure used for the development of recommendations for consideration by Committees and Sub- Committees; 3. refer the suggested changes to the Casualty Analysis Procedure to the Working Group on Casualty Analysis for review; and 4. continue to encourage Member States to develop further the systematic investigation method and investigation report structure in accordance with paragraph 2.12 and chapter 14 of the Code of the international standards and External Affairs 20/ of 30

15 recommended practices for a safety investigation into a marine casualty or marine incident (Casualty Investigation Code), annexed to resolution MSC.255(84). FSI 17/6/1 (Secretariat) - Review of reports of investigation into casualties This document contains the list of reports of investigation into casualties which have been reviewed by the Correspondence Group on Casualty Analysis for this session of the Sub-Committee. 8. Harmonization of Port State Control Activities (Agenda Item 7) (Target completion date Continuous) (Reporting MSC 86) Background: The Sub-Committee will consider the relevant parts of the report of the Correspondence Group on the Harmonization of Port State Control Activities and Development of Guidelines on Port State Control under the 2004 BWM Convention (FSI 17/7) which was established at FSI 16 (see FSI 16/18, paragraph 7.51) to: 1. develop a format and associated text containing the information provided by PSC regimes, in order to summarize the outcome of PSC activities at a global level and to:.1 identify the possible reasons for the differences on detention rates contained in the annual reports of the PSC regimes and suggest how the issue could be addressed;.2 propose new procedures in order to provide the PSC annual reports to the Sub Committee containing the most recent data; and.3 propose a common methodology and format of PSC annual data that will facilitate the global analysis of the PSC information provided; As reported by the Correspondence Group there was no progress made on BWMsampling related issue. 2. develop a draft consolidated text of Revised Procedures for port State control (resolution A.787(19), as amended by resolution A.882(21)), using document FSI 16/7 as the basis, and to:.1 consider the inclusion of the Code of good practice for port State control officers (MSC-MEPC.4/Circ.2) in the draft revised procedures;.2 develop proposals for simplified procedures for keeping the Procedures updated and to analyse the possibility of introducing new instruments;.3 take into account amendments to IMO mandatory instruments, which have entered into force, including amended Annexes I, II, IV and VI of MARPOL, while taking into account the draft amendments contained in documents FSI 13/12/1, FSI 14/WP.3 (annexes 2 and 4), FSI 14/11/3, FSI 15/12/1, FSI 16/INF.2 and FSI 16/INF.5; and.4 incorporate the Guidelines for inspection of Anti-fouling Systems on Ships (resolution MEPC.105(49)); and External Affairs 20/ of 30

FSI 17/7/3 (Black Sea MoU) - Report of the Black Sea MoU Concentrated Inspection Campaign (CIC) on ISM Compliance in 2007 This document provides the report of the Concentrated Inspection Campaign on the ISM Code carried out by the Black Sea MoU during the period 1 September and 30 November Conclusions General cargo ships and bulk carriers requires attention on ISM requirements during standard PSC inspection as their ISM performance appeared to be poorer than at other ship types. The most problematic issues with ISM proved to be effective maintenance of SMS, failure of ship masters in SMS reviewing, and SMS routine maintenance. The most number of deficiencies during the CIC on ISM in the Black Sea region was identified at the ships flying the flags of Sierra Leone, Panama, Cambodia and the Syrian Arabic Republic. FSI 17/7/5 (Paris MoU) - Results of the 2007 Paris MoU Concentrated Inspection Campaign (CIC) on ISM Compliance This document provides the results on the Paris MoU Concentrated Inspection Campaign on the International Safety Management (ISM) Code carried out between 1 September 2007 and 30 November Outcome of the CIC A matter of serious concern is that one out of five inspections showed ISM deficiencies (non-conformities), corresponding with 1,031 inspections. In total 1,868 ISM non conformities were recorded during the inspections. Most commonly found were more major non-conformities issued against effective maintenance of the ship and equipment, emergency preparedness and reports of non-conformities and accident occurrences. All three are key areas with regard to the safety of the ship and its crew. FSI 17/7/6 (Paris MoU) - Preliminary findings of the 2008 Paris MoU Concentrated Inspection Campaign (CIC) on SOLAS chapter V Safety of Navigation This document provides the preliminary findings on the Paris MoU Concentrated Inspection Campaign on SOLAS chapter V Safety of Navigation carried out between 1 September 2008 and 30 November Outcome of the CIC During the period from 1 September to 30 November 2008 a total of 6,331 inspections were carried out within the Paris MoU on 5,470 ships. Several ships were inspected more than once. 522 inspections were done without CICquestionnaires and the results of these inspections are not included in the statistical analysis because of insufficient data. A matter of serious concern is that one out of five inspections showed safety of navigation deficiencies (non-conformities), corresponding with 1,308 inspections. In total 1,872 Safety of navigation-related non-conformities were recorded External Affairs 20/ of 30

18 during the inspections. The average CIC-related detention rate during the campaign was 1.39%. 81 inspections resulted in a detention where one or more SOLAS chapter V- related detainable deficiencies were found. Most commonly found detainable deficiencies were issued against charts, nautical publications and Voyage Data Recorder. All three are key areas with regard to the safety of navigation. Although some serious problems were encountered, it can be said that, in general, the CIC showed that the safety of navigation is well organized on board ships. The Paris MoU will keep monitoring the performance on the safety of navigation to ensure that the requirements contained in SOLAS chapter V Safety of Navigation are complied with. The complete report will be presented by the Paris MoU Technical Evaluation Group to the forty-second session of the Paris MoU Port State Control Committee in Reykjavik (Iceland) in May FSI 17/7/7 (Paris MoU) - Preliminary guidelines for port State control officers on control of anti-fouling systems (AFS) on ships Annexed to this document are the preliminary guidelines for control and management of anti-fouling systems (AFS) on ships. FSI 17/7/8 (Paris MoU) - Procedures for conducting operational fire, abandon ship and damage control drills during a port State control inspection Annexed to this document are the procedures for conducting operational fire, abandon ship and damage control drills during a port State control inspection. FSI 17/7/9 (Tokyo MoU) Report of the Tokyo MoU Concentrated Inspection Campaign (CIC) on ISM Compliance in 2007 This document provides the report of the Concentrated Inspection Campaign on the ISM Code carried out by the Tokyo MoU during the period 1 September to 30 November Conclusions: Effective maintenance of the ship and equipment continues to be a significant issue. Whilst this element of the ISM Code has shown improvement since the first ISM CIC, it continues to be the aspect causing most unsatisfactory answers leading to deficiencies and detentions. A marked increase in deficiencies and detentions arose from ineffective induction and familiarization of crew. Review of the safety management system by the master, and reporting of non conformities and hazardous occurrences are areas of concern after maintenance and inductions. These elements are very important in ensuring that the safety management system (SMS) is implemented effectively and is more than a paperwork exercise. Whilst this aspect did show an increase in detentions over the CIC period, it appears to have had a larger influence in increasing deficiencies. General Cargo/Multi-purpose ships in both Tokyo and Paris MoU regions are the ship types with the highest detention rate. It should also be noted that this category of ship also features predominately in normal PSC detention statistics. Flag States with vessels with low ISM performance are Cambodia, Democratic People s Republic of Korea, Thailand, Indonesia and Mongolia (table 8 and 16). Considering this CIC and past data, the recognized organizations associated with Thailand, Democratic People s Republic of Korea and Indonesia (BKI) also indicate poor performance (tables 11 and 15). It is also noted that China External Affairs 20/ of 30

19 Corporation Register of Shipping (CCRS) has a pattern of above average detention. The APCIS target factor appears to be appropriate with the average target factor for detained ships being 83. The detention rate across MoU members varied widely. This is similar to the results within the Paris MoU region. Regional shipping factors may influence this and whilst this could be analysed further, it is probably likely that this was a result of the actual CIC topic, as ISM is not very prescriptive by nature and hence, different interpretations by PSCOs is possible. Some recognized organizations have shown a marked improvement since the first ISM CIC as have some flags (see section 4.4). The questionnaire and guidelines appeared well set out as the responses between Tokyo and Paris MoUs appeared relatively consistent, apart from question 12 which was worded poorly for the available responses. FSI 17/7/10 (Secretariat) Outcome of BLG 13 This document provides the outcome of BLG 13 regarding the amendments to the guidelines for port State control under MARPOL Annex VI. FSI 17/INF.3 (Paris MoU) - Paris MoU Annual Report 2007 This document contains the Paris MoU Annual Report Summary: The trend in the number of inspections is still upwards. In 2007, 22,877 inspections were carried out on 14,182 individual foreign flagships, The overall detention rate rose slightly to 5.46% of inspections, the second rise since 2005, 38 flag Administrations are on the white list, including four new entries. There are 19 flag Administrations on the black list, of which five are in the category of very high risk for targeting purposes, From 1 September to 30 November 2007 a Concentrated Inspection Campaigns (CIC) on ISM was carried out. This CIC resulted in 5,427 inspections, of which 176 resulted in a detention. In total 66 (6.03%) ships were detained during the campaign period and the rate of the inspections with deficiencies was 69.01%. The highest number of inspections was conducted over the ships flying the flags of Malta (13.71%), Panama (13.62%) and Turkey (11.79%). In regard to the CIC-related detentions by flag, subject to more than 10 inspections, the four flags with the highest detention number were Sierra Leone with six (17.65%) detentions, Cambodia with four (7.69%) detentions, Saint Kitts and Nevis with two (15.38%) detentions and the Comoros with two (9.09%) detentions. Considering the total of detentions, Sierra Leone leads the way with six detentions out of 34 inspections (17.65%), followed by Cambodia with four detentions from 52 inspections (7.69%) and Panama with four detentions from 149 inspections (2.68%). In general, 44% of all inspected ships were of general cargo/multi-purpose ship type, 30% - bulk carriers and 12% - oil tankers. Accordingly, maximum deficiency percentage recorded on general cargo/multi-purpose ships was (54.47%), then bulk curriers (27.57%) and oil tankers (6.21%). External Affairs 20/ of 30

21 Total detentions belonged to general cargo/multi-purpose ships with 20 (95.24%) detentions, and bulk carriers with one (4.76%) detention. The most problematic areas on board the ships inspected during the campaign were the lack of adequate and up-to-date nautical charts and publications, necessary for the voyage (34.75%) and obstruction of the horizontal view with cargo loaded on deck (19.94%). Review of the Code for the Implementation of Mandatory IMO Instruments (Agenda Item 13) (Target completion date Continuous) (Reporting MSC 86) Background: The Sub-Committee will consider the relevant parts of the report of the Correspondence Group on the Review of the Survey Guidelines under HSSC, the Code for the Implementation of Mandatory IMO Instruments and the Consolidated Audit Summary Reports which was instructed (see FSI 16/18, paragraph 14.36) to :.1 develop a methodology for the analysis of consolidated audit summary reports in order to meet the following objectives: External Affairs 20/ of 30

26 .1 provide feedback to Member States and the Organization of recurrent areas of findings, including the identification of possible underlying causes and best practices;.2 provide feedback to the Organization on the effectiveness of the implementation by Member States of mandatory instruments falling within the scope of the audit scheme; and.3 identify areas where specific technical co-operation activities would benefit Member States; and.2 using the first consolidated audit summary report (document A 25/8/2) and any subsequent consolidated report issued before FSI 17, to conduct a trial with the methodology, summarize the outcome, and make recommendations as appropriate. In this context, the Sub-Committee will further consider the second consolidated audit summary report (C 101/6/2), as referred by MEPC 58 and MSC 85. The Sub-Committee will be also be invited, as instructed by MSC 85 (see MSC 85/26, paragraph 10.27), to prepare a draft MSC-MEPC circular on the establishment of an effective safety management system for floating production, storage and offloading facilities (FPSOs) and floating storage units (FSUs) and integration of the marine staff, taking into account the information contained in the annex to document MSC 85/10/1. Measures to protect the safety of persons rescued at sea (Agenda Item 15) (Target completion date 2010) (Reporting MSC 87) Background: As instructed by MSC 84 (see MSC 84/24, paragraph 22.19), the Sub-Committee will examine, taking into account the relevant outcome of the consideration of this item by COMSAR 13, the situation facing the crews of the ships that rescue persons at sea, with the aim of finding a satisfactory solution for the ships and providing adequate arrangements for those rescued at sea to ensure that they are disembarked at a safe place within a reasonable time. In this context, the Sub-Committee will also consider a note (FSI 17/15) prepared by the Secretariat giving the detailed list of mandatory and non-mandatory instruments which may be relevant to the consideration of this item. In reviewing this list of instruments, the Sub-Committee may wish to consider whether they could be looked at in the context of the Code for Implementation of Mandatory IMO Instruments and the list of instruments which might be relevant in the context of the collection of information on the implementation of non mandatory instruments (see FSI 16/18, paragraph 15.5).
