1 Facts & Figures on Human Rights 1. Nepal is a signatory to many international obligations related to the protection of human rights. The Royal Nepalese Army (RNA), therefore, per say has legal and binding obligations to respect and uphold the human rights and International Humanitarian Laws. Equally the RNA being a part of the Nepalese society has moral obligations to abide by the human r rights as per the old Holy Scriptures like Veda and Mahabharata. The RNA HQ has a clear and unambiguous policy of strictly adhering to the norms and principles of human rights. The RNA is committed to deliver due justice if violation of such rights occur. It is however noteworthy that given the active propaganda of the Maoist the alleged soldiers also deserves a complete investigation and court of enquiry, which is one of their fundamental human rights. 2. Contrary to the propaganda by the Maoist the RNA has been taking active steps to uphold human rights. It has been investigating the allegations of human rights violations and punishing those found guilty of such crime in accordance to the military law. Cases of particular nature have also been forwarded to the civil court as well. So far in 40 cases of such violations 44 individuals have been jailed for their offenses ranging from 6 months to 7 years imprisonment, similarly 31 individuals have been discharged from the service. Similarly in many cases compensation have also been provided to the victims family. It is expected that due cooperation from various sectors of society and human rights groups will be received by the RNA to achieve the noble objective of protecting the fundamental rights of the Nepalese people. The detail of Human Rights allegations, findings and judicial actions taken by the RNA is as per Appendix 'A'. 3. The details of information including the whereabouts of the persons alleged to be disappeared provided to those organizations at various dates are as per appendix 'B','C','D,'E' 'F' and 'G'. 4. The details of clarification on Human Rights violations allegations mentions in Amnesty International report of 7th Jan, 2005 are as per Appendix "H". 5. Royal Nepalese Army has made various efforts to cooperation with various human rights organization for interaction & seminars and also participated in human rights training. The details of trainings, interaction and Seminars on Human Rights are shown in appendix 'I'.

2 2 Appendix "A" Human Rights Violations Cases and Judicial Actions taken by the RNA 1. Manpur Tapara Case (a) Incident A RNA soldier Gyan Bahadur Tharu killed Bhoj Bahadur Karki and Top Bahadur Karki (father and son) claiming them to be Maoist, in the area of Manpur Tapara, Bardiya district, on 11 th Jan (b) Findings Investigations found that the victims were innocent and the RNA soldier had acted on personal grudge. A General court-martial (GCM) sentenced the soldier for seven years imprisonment. Another person involved in the incident, a Non-Commissioned Officer, was demoted from his rank. Since, the GCM does not have the authority to prosecute personnel from the Armed Police Force (who were also involved in the incident); action has been initiated against the Armed Police Force Commander through proper channels. (c) Status No appeal has been filed or any further events has been reported. 2. Ramechhap Case (a) Incident On August 17 th 2003, in Doramba of Ramechhap it was alleged that RNA has extra judicially executed 21 Maoist after their capture. (b) Findings Court Martial sentenced the officer for two years of imprisonment and discharged from army while JCO was demoted. A letter has been send to the concerning authority to take necessary action to the police officer as he too was involved on extra judiciary killing of the detain persons. (c) Status Convicted officer has been dismissed from the service and sentenced for 2 yrs while JCO has been demoted.

Chisapani, Diktel Case (a) Incident A news was published in some local newspaper's citing that the teachers of Chisapani High school Hari Prasad Bhatarai, Dekmani Koirala and Durga Prasad Koirala were apprehended and killed in the field on 7th Dec 2003, claiming them to be "Maoist" by security forces. An investigation team found that the incident reported was true and suggested that the culprits an officer, Warrant officer (Jamdar) Hasta Bahadur Kumal and Solider Tej Bahadur Royila should be trialed by a GCM. (b) Finding The General court martial found them guilty and sentenced them with 2 years imprisonment and discharged from the service. The officer has also been discharged from the service. (c) Status Convicted soldiers were sentenced to 2 years imprisonment and were discharged from the service and officer involved was also discharged from the service. 4. Kavrepalanchok Case (a) Incident On 14 th Dec 2003 security forces were interrogating Maya Tamang a Maoist suspect in Mahendrajyoti V.D.C. of Kavrepalanchok District, while she tried to escape, the security forces opened fire in order to stop her from fleeing. She died of a bullet injury. (b) Finding The court martial found that though Maya Tamang was a known active Maoist guerilla the incident occurred because of the use of an excessive force & recommended that a Court Martial be convened. (c) Status L/Cpl Narayan dutta Bhatta was found guilty and was sentenced to 18 months imprisonment and was discharged from the service, similarly Warrant officer Bal Bahadur Goyela was given official warning, Corporal Ananda Lamichane was demoted & the officer involved was forfeited for 13 months of promotion. An official letter has been initiated to His Majesty's Government for compensation to the Victim's family.

Mudvara Case 4 (a) Incident On 13th Oct 2003, upon taking action against armed Maoist who were carrying out unlawful indoctrination program in the premises of Shree Sharda High School, Mudvara, Doti district, 4 innocent school students were accidentally killed in the crossfire. An investigation team was formed to find the facts & circumstances leading the incident. (b) Finding The investigation team found out that the security forces had done their utmost in dealing with the Maoist. They firstly separated the students and teachers, and put them to a safe distance then they used minimum possible force against the armed Maoist group. Although they manage to save lives of many teacher and students, unfortunately 4 students were killed in the crossfire. The investigation team has suggested to provide compensation of Rs.2,00,000 to each victim's family. (c) Status An official letter has been sent to the Government for compensation to the Victim's family and the RNA is pursuing the government for the provision of speedy compensation. 6. Accident (Balaju, Kathmandu Case) (a) Incident On 16th Nov 2003, a taxi driven by Rajiv Shrestha suddenly collided with an army school bus near Balaju Dhungedhara, aboard soldier Dil Bahadur Bista, the security guard on the bus mistook the action as an intended Maoist attack on the school children hence opened fire in order to secure the school children's. A court Martial was convened to prosecute the incident. (b) Finding The court martial convicted the Soldier of using excessive force and sentenced 4 months imprisonment and was discharged from the service. The victim Rajiv Shrestha's family received Rs.2, 00,000 as compensation from the Home Ministry. (c) Status Convicted soldier was sentenced 4 months imprisonment & was discharged from the service and Victim's family was provided Rs. 2, 00,000 as compensation from the Government.

5 7. Shooting (Tokha Case) 5 (a) Incident On 15th March 2002, Kanchha Kaji Dangol, was being escorted by a patrol and he tried to escape. The guards in the patrol opened fire in order to stop him. He died of a bullet injury. (b) Finding The court found that human rights were violated and the guilty were sentenced three months imprisonment. The commander of the escort patrol was discharged from the army. 8. Chitwan Case (a) Incident On 7th May 2002, one GTZ staff was questioned by the SF in suspicion of providing monitory support to Maoist. (b) Findings Investigation team found that the officer involved in the incident illtreated the GTZ staff and given serious warning. 9. Sanfe Bagar Case (a) Incident On 12 th May 2002 while conducting military operations, some people were arrested at Sanfe Bagar. When asked to produce document of their identification, they refused to produce it. Additionally they could not provide any evidence about being staffs of the NGO. An allegation was made that they were manhandled and beaten by rifle butts while in military custody. (b) Findings RNA conducted an investigation on reported human rights violations against the workers of GTZ staff by the RNA soldiers. The investigation team did not find any evidence of human rights violations. 10. Accident (Kaule, Nuwakot Case) (a) Incidents. Security Forces killed five people during an operation in Kaule on the night of 28th Nov Because of reliable information of an impending Maoist attack on that day security force were in the state of high alert. While taking harbor,

6 6 the security forces saw some people approaching towards their harbor area with lighted torches. Security forces asked them to halt but instead, the people threw the torches and tried to flee. The security force opened fire on them as per the standard operating procedure. (b) Findings. An investigation team was formed to investigate about this incident. The investigation team found that the deceased personnel were innocent. As such the incident was a tragic accident. The RNA has recommended the Government for compensation to the victims' families. 11. Shooting Incident (Sunachari, Makawanpur Case) (a) Incident On 14th Dec 2003, in Sunachari of Makwanpur district while on a routine checking in a check post, army personnel opened fire killing a bus helper Bhim Bahadur Giri. (b) Finding The General court martial found them guilty and charged 4 Months of imprisonment and forfeited 2 years grade of his salary. An official letter has been initiated to the Home Ministry for the compensation to the victim families through Defense Ministry. 12. Accident (Baglung Case) (a) Incident On 13 th March 2003, RNA soldier Surya Bahadur Khatri, while on duty at a checkpoint at Banglung, accidentally discharged his weapon, injuring a civilian girl. Instead of helping the victim he tried to hide the victim and tried to flee from the incident site. The victim was immediately rescued and taken to Military Hospital. (b) Findings The General Court Martial found that the incident occurred because of the negligence of the army personnel. GCM found that the accused was guilty hence was sentenced for 9 months of imprisonment; Rs was fined and given to the victim as compensation and dismissed from the service.

Pokhari Chauri Village Kavrepalanchok District Case 7 (a) Incident On 13 th Feb 2004 while security forces were conducting cordon & search operations, Reena Rasaili, Subhadra Chaulagai and Maina Sunwar attempted to escape despite repeated warning and was killed at Pokharichauri V.D.C. in Kavrepalanchok District. (b) Status The case of Maina Sunuwar, and in another incident, the killing of Reena Rasaili and Subhadra Chaulagain in Kavreplanchowk district, investigation reports from concerned unit as well as brigade level were received at RNA HQs; however, having found them unsatisfactory, the RNA HQs formed higher level board to reinvestigate into the alleged cases & convened a court martial in the case of Maina Sunuwar,which is ongoing. While in the case of Reena Rasaili and Subhadra Chaulagai the reinvestigation is in the process. 14. Alleged Rape (Bardiya Chisapani Case) (a) Incidents There were very serious allegations of rape and illegal activities against the Captain of the company deployed at Chisapani on 14 th April He was accused of raping two women inside barrack premises. When investigating, the so-called victims denied the fact that they were raped. (b) Findings He was acquitted of rape charges but has been found guilty on unlawful arrests of innocent civilian girls. He was forfeited for 10 months of promotion. 15. Sunsari Case (a) Incident On 10 th Nov 2004, while security forces were conducting cordon & search operations, 16 Year Sumitra Majhi was gang raped by security forces at Bharol V.D.C. in Sunsari District. (b) Findings Court of inquiry was conducted to investigate about the incident. The court of inquiry found that the incident took place. The Military Law does not deal with the rape cases

8 8 hence the case has been forwarded to the civil authority for prosecution. 16. Banke Case (a) Incident On 13th May 2002, 6 army personnel and some civilians threatened and demanded Rs 1,25,000 from Samsuddin Darji residence of Kamdi VDC, Banke district acting as Maoist, using the army weapons. (b) Findings The court charged them in attempt of robbery looting and sentenced 4 persons to 2 years to 3 years of imprisonment and were discharged from the army and 1 person was forfeited for 3 yrs of promotion. While another person was forfeited for 2 years of grade of his salary. The officer involved in the incident was forced to resign from the service 17. Anamnagar, Kathmandu (a) Incident On 29th May 2002, four RNA soldiers namely Nawaraj Karki, Lal Bahadur Shrestha, Bhishnu Pandey and Uttam Silwal dressed in combat fatigue demanded money from Raj Kumar Sharma, a businessman, residence of Anamnagar, Kathmandu. (b) Findings On conducting investigation over this incident, General Court -Martial convicted these army personnel as guilty and sentenced the accused Nawaraj Karki for 3 years, Lal Bahadur Shrestha for 4 years, Bhishnu Pandey and Uttam Silwal for 6 months of imprisonment and all of them were discharge from service. 18. Buddhanagar, Kathmandu (a) Incident On 22nd Aug 2002, 3 army personnel namely Nar Bahadur Khatri, Shiva Giri and Badri Mahat tried to kidnap civilian personnel on monetary matter. The person succeeded in escaping from them and reported about the incident. The investigation found out that these people were involved in the incident. (b) Finding The court martial convicted them as guilty and sentenced Nar Bahadur Khatri and Badri Mahat for 4 months of imprisonment and both were discharged from the service. One of the accused (Shiva Giri) was found innocent.

Royal Alina's Bakery café, Katmandu Case (a) Incident On 7th Jan 2003 RNA personnel Deepak Jung Thapa along with a civilian Surendra Bhandari, owner of Lali Guras Finance, demanded Rs 2,00,000 from Arjun Bhandari, the owner of Royal Alina's Bakery Café with a fake letter on behalf of the Maoist leader Prachanda. (b) Findings Summary Court-Martial (SCM) was convened to investigate the incident. SCM found that the accused was guilty hence was sentenced for 4 months of imprisonment and forfeited 2 years grade of his salary. 20. Dhalku, Kathmandu Case (a) Incident On 1st Dec 2003, 2 army personnel Corporal Nirhari Shrestha and Solider Gun Bahadur Yonjan, using the army weapons and fake pad of Maoist threatened and demanded Rs.3, 00,000 from Sonam Lama residence of Dhalku Kathmandu. (b) Finding The General court martial charged them in attempt of dacoit and sentenced 3 years of imprisonment and were discharged from the army. 21. Achham Safebagar Case (a) Incident On 12 Aug 2002, Corporal Dani Chand, L/Cop Narayan Singh Karki and 3 policemen, while searching civilian Bhaire Rawal found IC 27,000/- with him. They took IC 2,000/- each and return IC 17,500/- to Bhaire Rawal. (b) Finding The convened Court Martial found the incident took place and sentenced them to 17 days imprisonment and were demoted. 22. Gongabu Kathmandu Case (a) Incident On 22 May 2004, Sergeant Lila Bahadur Karki and Ganesh Rawat demanded Rs 50,000/- from civilian Chatra Bhadur Shrestha residence of Gongabu Kathmandu.

10 10 (b) Finding The Court Martial convicted them as guilty and sentenced for 4 and 3 yrs of imprisonment and both discharge from service. 23. Kalimati Case (a) Incident On 30 th September 2004 RNA Major and Cpl. Krishna Bahadur k.c, dressed in combat and involved in civilian monetary matter. (b) Finding The Court Martial found them as guilty and sentenced Major for 35 days imprisonment and forfeited 3 yrs promotion and cpl. Krishna Bahadur k.c. for 2 month imprisonment and discharged from service. 24. Nawalparasi Case (a) Incident On 5th Nov 2002, RNA personnel Dev Bahadur Chetri with three civilian friends were apprehended while trying to flee after looting money from Ganesh Prasad Khanal, a resident of Nawalparasi. (b) Finding The Court-Martial upon finding the accused guilty sentenced Dev Bahadur Chetri for 3 years of imprisonment and dismissed him from the service. The civilian court was prosecuting the other three civilian accomplices. 25. Rasuwagadhi Case (a) Incident On 22nd Jan 2003, Sergeant Bhim Bahadur Karki got involved in fight with civilians near China boarder Rasuwagadhi. (b) Finding Court Martial was convened to investigate about the incident. The court found that the accused was guilty hence was sentenced to 30 days imprisonment. 26. Kings Way Royal Disco, Kathmandu (a) Incident. On 18th Dec 2002, at Royal Disco, Darbar Marga Kathmandu, Corporal Tek Bahadur Gurung,

11 11 Corporal Ram Bahadur Rana Bhat, L/Cop Ishwor Thapa, L/Cop Ishwor Basnyat and Private Tanka Bahadur Shrestha tried to misbehave with girl employee. When other people stopped them they got involved in the fight. (b) Finding The Court Martial was convened to investigate into the incident. The Court found that these people were involved therefore sentenced them 20 days imprisonment and were demoted while Private Tanka Bahadur Shrestha was sentenced to 20 days imprisonment and forfeited 2 years promotion. 27. Newroad, Kathmandu Case (a) Incident On 16 June 2002, Soldier Bala Ram Sanghel got drunk and tried to misbehave a foreigner at Newroad Gate Kathmandu. (b) Finding The Court found him guilty and sentenced him 3 months imprisonment and forfeited 2 years grade of his salary. 28. Panchkhal Case) (a) Incident On 12 Dec 2002, on their way to their post Sergeant Fatya Bahadur Mahat, Corporal Prem Bahadur Khatri got drunk at Panchkhal and fought with civilian people inside the bus. (b) Finding Court Martial was convened to investigate about the incident. The court found the accused guilty hence sentenced them to 37 days imprisonment and discharged from the service. 29. Daraudi Dohari Restaurant, Kathmandu (a) Incident On 30 May 2003, Sergeant Shiv Bahadur Basnyat, Sergeant Lav Kumar KC, Sergeant Devendra Kumar Poudyal and Corporal Raju KC got drunk at Daraudi Dohari Shanj Restaurant Kathmandu and got involved in fight with civilians. (b) Finding The convened Court Martial upon finding guilty demoted all of them.

12 Maharajgunj, Kathamndu Case (a) Incident On 29 May 2003, fire was discharge accidentally by Private Khem Bahadur Chetri injuring a civilian person sitting next to him. The injured civilian got treatment from the Army hospital. (b) Finding The convened Court Martial found that fire was discharge accidentally and he had no intention on injuring the person thus sentenced to 54 days imprisonment and forfeited 2 years grade of his salary. 31. Lalitpur Case (a) Incident On 16 Oct 2003, Private Bhisnu Bahadur Karki got involved in fighting incident with civilians. (b) Finding Upon finding guilty, convened Court Martial forfeited 2 years grade to his salary. 32. Kathmandu Case (a) Incident On 25 Dec 2003, Gunner Ram Bahadur Basnyat and Ramesh Kumar Raya tried to misbehave with foreigner. (b) Finding The convened Court Martial upon finding guilty, forfeited 2 years grade of his salary. 33. Nepalgunj Case (a) Incident On 22 Aug 2002, a Second Lieutenant while on the patrol ill-treated policemen who were on their duty at Kohalpur Nepalgunj. (b) Finding The convened Court Martial found him guilty and warned him.

13 34. Daman case 13 (a) Incident On 30 April 2003, a Captain went to Panorama Hotel at Daman and got involved in fight with civilian creating hazard at the hotel. (b) Finding The Court Martial was convened to find out about the incident. Upon finding guilty officer was sentenced to 60 days imprisonment and forfeited 3 years promotion. 35. Grand Guest House Kathmandu case (a) Incident On 13 Oct 2003, a Captain got involved in fight after being drunk at Grand Guest House Kathmandu. (b) Finding The Court Martial was convened to find out about the incident. Upon finding guilty, officer was forfeited of 3 years seniority. 36. Bharatpur case (a) Incident On 12 th June 2003, a Army Major after being drunk went to a store near Paras bus park Bharatpur and terrorized the owner Ram Pratap Khadka. (b) Finding The Court Martial was convened to find out about the incident. Upon finding guilty the officer was given necessary warning. 37. Myagdi Case (a) Incident On 26 May 2004, RNA Cpl. Surya Bahadur Basnet, Private Gurung Damai, Private Sher Bahadur Malla and Private Raj Kumar Bohora after getting drunk, opened fire indiscriminately and killed a civilian person Devi Prasad Updhaya. (b) Finding The enquiry board found all those army personnel guilty, and a court martial was convened to prosecute them and the accused cpl. Surya Bahadur was demoted, Private Gurung Damai, Sher Bahadur Malla and Raj Kumar Bohora were sentenced for 4 month, 6 month

14 14 and 2 yrs imprisonment respectively and all off them were discharged from service. 38. Killing of Ex MP Hemnarayan Yadab Case (a) Incident It was alleged that Mr Hemnarayan Yadab was killed by the RNA. (b) Finding: It was found by the enquiry board that the RNA had no insolvent whatsoever in the incident. 39. Death of Mr Ulhash Vaidya Case (a) Incident Mr Ulhass Vaidya was killed in the process of rounding up Maoists who were extorting money from him. (b) Finding: It was found by the enquiry board that the RNA had no insolvent whatsoever in the incident. 40. Holding incommunicado of a minor (a) Incident It was alleged that a girl named Renu Ale Magar was being held incommunicado in Army Barracks. (b) Finding: It was found by the enquiry board that she was already released after completion of the interrogation.

15 Bardiya Rambhapur Looting Case (a) Incident Private Shiva Prasad Acharya of the Pioneer (construction) Battalion was involved in a case of breaking into a private home and looting cash and other valuables as part of a civilian group of five in Rambhapur area of Bardiya district on 6 th june (b) Finding The court found him guilty, relieved him of military service, declared him unfit for any further government service and sentenced him to two years in prison in addition to fining him Rs.16, 000(which was his share of the loot) 42. Extortion Case (a) Incident Sgt Indra Narayan Giri was caught red handed trying to extort money from local civilians in the guise of being a Maoist Terrorist. (b) Finding The court found him guilty, relieved him of military service, declared him unfit for any further government service and sentenced him for 10 years in prison on 2061/11/15 (26 Feb 2005). 43. Extortion Case (a) Incident Pvt Ratna Thapa was caught trying to extort money from local civilians while being Absent without Leave in the guise of being a Maoist Terrorist. (b) Finding The court found him guilty, relieved him of military service, declared him unfit for any further government service and sentenced him for 10 years in prison on 2061/9/1 (16 Dec 2004). 44. Kanchanpur Mahendranagar Case (a) Incident On 2062/1/16 troops reacting to a tip that a suspiciuous group of possible Maoist terrorists were meeting in secret in the premises of the Janjyoti Campus in Kanchanpur, very close to the Kanchanpur Jail and the Zonal Administrator's Residence observed four individuals fleeing the scene as they approached. They were forced to chase and apprehend the individuals. (b) Finding. The troops did follow the Rules of Engagement. When the fleeing individuals did not heed repeated warnings, troops used a graduated response and minimum force, ultimately firing only below the hips. However, in the action that followed, one soldier, Pvt Dilip Tumbahamphe was found to have used excessive force and has been sentenced to three months in prison and has been forfieted 2 years in pay grade.
