A motion was made by Mr. Chmiel and seconded by Mr. Adkins to enter into executive session at 9:35 a.m. with Athens County Prosecuting Attorney, Keller Blackburn, and John Haseley, Assistant Prosecutor, to discuss potential litigation. A motion was made by Mr. Chmiel and seconded by Mr. Adkins to return to regular session at 9:59 a.m. A motion was made by Mr. Adkins and seconded by Mr. Chmiel to have the Prosecuting Attorney s Office file a lawsuit on behalf of the Athens County Commissioners to recover compensation paid to former Sheriff Pat Kelly. A motion was made by Mr. Chmiel and seconded by Mr. Adkins to enter into executive session at 10:00 a.m. with 911 Director, Dan Pfeiffer, to discuss hiring. A motion was made by Mr. Chmiel and seconded by Mr. Adkins to return to regular session at 10:03 a.m. A motion was made by Mr. Chmiel and seconded by Mr. Adkins to approve the Office Assistant II position for 911. 4 99 A motion was made by Mr. Chmiel and seconded by Mr. Adkins to approve the request by Dan Pfeiffer, 911 Director, to hire a part-time clerk for the Office Assistant II position, at the rate of $10 per hour Hire Part Time Clerk A motion was made by Mr. Adkins and seconded by Mr. Chmiel approving the DJFS/ HAPCAP Athens On Demand Transit CY2015 Vendor Agreement. Contract Period: February 17, 2015 to and including December 31, 2015 unless otherwise terminated. Whereas, ACDJFS seeks to purchase transportation services through Athens On Demand Transit for eligible individuals as determined by ACDJFS. Contract Price: ACDJFS shall pay to provider (HAPCAP) the sum on the monthly invoice for transportation services. The maximum amount payable will be $22, HAPCAP/DJFS Athens On Demand Transit Agrmt. A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the following Utility Permit: From: AEP 9135 SR 682 Athens, Ohio We hereby request permission to install utility lines within public right-of-way limits. Nature of work: Performing overhead conductor work along Deep Hollow Rd., Coolville Extend and Limits of Work: One day Time Schedule of Work to Begin: Week of March 2 nd, 2015 Method of Installation: Agreed to by: /s/chris Haye Athens County Commissioners

5 100 /s/ Charlie Adkins /s/ Chris Chmiel /s/ Lenny Eliason Utility Permit - AEP ~ County Engineer, Jeff Maiden discussed the following items with the Commissioners: * The Engineer s Office received two grants on September 11, 2014, for two sign grants; --One grant for $ 49,600 to upgrade county road signs and stop signs to meet the new retro-reflectivity requirements (HIP- high intensity) --One grant for $ 50,000 to install curve warning signs at dangerous curves on county roads that have had at least two documented crashes in the last three years. * Met with ODOT District 10 Engineers to implement a safety project on County Road 19, Radford Road, the following was discussed: --performing a speed zone study on different sections of Radford Road --performing a comprehensive safety study for the entire road --performing a ball bank study to determine the safe speeds for dangerous curves on county roads --potential funding sources for grant funding for this project --discussed purchasing Radar Signs to place along CR 19- Radford Road Also discussed was the $ 5, from the General Fund which has been allocated for the purchase of Radar signs, and asked for their consideration in assisting with a portion of the local match for the sign grant. The Commissioners s stated they will have Prosecutor s Office draft an agreement with the Engineer for the $5, allocation towards this project. Engineer - Updates Re Road Signs - Safety Projects DD: A motion was made by Mr. Adkins and seconded by Mr. Chmiel approving the following Proclamation for Athens County Board of Whereas: Individuals with developmental disabilities, their families, friends, neighbors and co-workers encourage everyone to focus on the abilities of all people; and, ACBDD Proclamation - March 2015 Dev. Disabilities Awareness Month

6 101 Whereas: the most effective way to increase this awareness is through everyone's active participation in community activities and the openness to learn and acknowledge each individual's contribution; and, Whereas: opportunities for citizens with developmental disabilities to function as independently and productively as possible must be fostered in our community; and, Whereas: we encourage all citizens to support opportunities for individuals with developmental disabilities in our community that include full access to education, housing, employment, and recreational activities; and, Now, therefore, We the Board of Athens County Commissioners do hereby proclaim March, 2015 as Developmental Disabilities Awareness Month and recognize that our communities are stronger when everyone participates. Signed this 26th day of February, A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the following Professional Service Agreement for Engineering/Architectural Services as presented by Jessie Powers, HAPCAP: This Agreement is made this 24 th day of February, 2015 between the Athens County Commissioners (Owner) and Stantec Consulting Services Inc., (Engineer), to provide professional services as described herein: Project Name: Village of Glouster Street Improvements Project Number: B-F-14-1AE-1, Activity #3 Project Consists of replacing 819 Linear Feet of roadway along Sycamore Street in the Village of Glouster. Project is expected to be fully designed and ready to bid out no later than sixty days after the award of the design contract. All work, including construction, must be completed by December 31, The Total project budget is $34, which includes engineering fees A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the following Professional Service Agreement for Engineering/Architectural Services as presented by Jessie Powers, HAPCAP: HAPCAP - B-F-14-1AE-1 - Vlg. 7 102 This Agreement is made this 24 th day of February, 2015 between the Athens County Commissioners (Owner) and Stantec Consulting Services Inc., (Engineer), to provide professional services as described herein: Project Name: Village of Jacksonville Water Facility Improvements Project Number: B-F-14-1AE-1, Activity #2 Project consists of installing 1 water valve and 1 piece of telemetry equipment in the Village of Jacksonville. Project is expected to be fully designed and ready to bid out no later than sixty days after the award of the design contract. All work, including construction, must be completed by December 31, The Total project budget is $32, which includes engineering fees. A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the following Professional Service Agreement for Engineering/Architectural Services as presented by Jessie Powers, HAPCAP: This Agreement is made this 24 th day of February, 2015 between the Athens County Commissioners (Owner) and Stantec Consulting Services Inc., (Engineer), to provide professional services as described herein: Project Name: Trimble Township Street Improvements Project Number: B-F-14-1AE-1, Activity #1 Project consists of resurfacing approximately 1,200 linear feet of roadway along in Red Rock Road in Trimble Township.. Project is expected to be fully designed and ready to bid out no later than sixty days after the award of the design contract. All work, including construction, must be completed by December 31, The Total project budget is $36, which includes engineering fees. ~ HDR -Kyle Schwieterman - US 50 Sanitary Sewer Improvement Project Update and Schedule. Project Update - The City has approved an ordinance to enter into an agreement with Athens County to provide sanitary sewer service to the US 50 area. Plans are approaching 20% complete and they will be sending them out to utilities for review next week. They will continue work on 30% design plans and costs. 8 103 A motion was made by Mr. Chmiel and seconded by Mr. Adkins to enter into executive session at 11:00 with ACEMS Chief Rick Callebs, and Assistant Chief, Amber Pyle, to discuss employee discipline. ACEMS - Executive Session - Employee Discipline A motion was made by Mr. Adkins and seconded by Mr. Chmiel to return to regular session at 11:07. Return To Regular Session A motion was made by Mr. And seconded by Mr. Authorize Rick to administer verbal and written discipline issues and address them on his own, without bringing to the Commissioners.. A motion was made by Mr. Adkins and seconded by Mr. Chmiel approving the purchase request by Rick Callebs, ACEMS Chief, for a King Vision Intubation Kit, which will fully stock their third Ambulance, in the amount of $1, ~ Sheriff Rodney Smith - Discussion - He has been told by the Attorney General s Office that the records that were sent to the landfill by former Sheriff Pat Kelly, are currently being housed in a storage facility in Hocking County. The Commissioners and Sheriff Smith feel they need to be looked at to confirm that they have been microfilmed and documented properly, however, they and the Prosecuting Attorney s Office are in the process of contacting a cleaning company to have the contaminated records cleaned, making sure they are not toxic before any employees come in contact with them. A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the contract with Arcadis, U.S, Inc. for the Athens County 691 Landfill Groundwater Monitoring Program for (Copied to page 96). ACEMS - Authorize Chief Callebs To Administer Verbal & Written Discipline Issues ACEMS - Purchase Ambulance Equipment - Approved Sheriff - Discussion re: Records / Landfill 691 Landfill - Arcadis 2015 Contract

9 104 A motion was made by Mr. Adkins and seconded by Mr. Eliason approving the contract between the Board of Washington County Jail Contract / Sheriff County Commissioners of Washington County, Ohio, and the Sheriff of Washington County and the County of Athens. Whereas, Athens County wants to use the Washington County Jail to house as prisoners those persons who have been lawfully committed to custody by arrest or court order for any reason, and/or who are awaiting a trial and have not otherwise posted bail or been released by court order, and/or who serving a jail sentence after conviction. Washington County Sheriff s office shall provide an itemized statement of the amount due each month for housing Athens County prisoners. Payment shall be made by Athens County to the Washington County the sum of $60.00 per day for each person incarcerated in the Washington County Jail. The Washington County Sheriff may refuse to accept Athens County prisoners if timely payment is not made. (Copied to page 97). A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the recommendation by Interim County Planner, Bob Eichenberg, to formally withdraw the RTP Grant Application for the CR24A Bikeway Extension. The RTP application was relying on a Clean Ohio Trails Fund (COTF) grant in order to be viable and the state of Ohio said that the RTP grant must stand alone and not depend on the COTF grant as was initially proposed. 10 105 A motion was made by Mr. Adkins and seconded by Mr. Chmiel authorizing a credit of $10.00 to the ACWSD Buchtel, account of John Woodson, Euclid Ave., Buchtel, Ohio. A motion was made by Mr. Chmiel and seconded by Mr. Adkins ratifying the signature of Commissioner Adkins and authorizing a payment plan for D. Slisher, A. Bond for monies owed the Athens County Water and Sewer District for water and sewer service, the total amount past due is $ minus a payment of $ requiring a monthly minimum payment of $ plus the regular monthly bill, for three (3) months. Customer must pay payment amount, plus the current bill, failure to do so breaks the agreement and payment is due in full. Should at any time D. Slisher, A. A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the Athens County Dog Shelter agreement release of Auditor - Letter of Engagement - Julian Grube Dog Shelter Volunteers

11 106 liability for volunteers, as recommended by Jeff Koons, Athens County Dog Warden. A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the following Resolution of Support for Buckeye Hills - HVRDD - ODSA: Resolution of Support for the Ohio Development Services Agency (ODSA) Appalachian Assistance Line Item WHEREAS, Athens County is served by the Buckeye Hills-Hocking Valley Regional Development District (BH-HVRDD) (including the counties of Athens, Hocking, Meigs, Monroe, Morgan, Noble, Perry & Washington) as its Local Development District (LDD) for the Appalachian Regional Commission (ARC); Municipal Court 2014 Annual Report Buckeye Hills HVRDD - ODSA Resolution WHEREAS, the ARC is a model for federal economic and community development programs and has assisted the Buckeye Hills region to improve the social and economic climate and improve critical infrastructure; WHEREAS, the Ohio Development Services Agency (ODSA) Appalachian Assistance funding provides much needed economic development project funding in the region, improves the social and economic climate of local communities, and improves critical infrastructure; WHEREAS, the ARC and ODSA Appalachian Assistance funding provide resources for business development, education and job training, telecommunications, infrastructure, community development, housing, and transportation projects creating new jobs; improvements to local water and sewer systems; increasing workforce readiness; expanding access to health care; assisting local communities with strategic planning; and providing

12 107 technical and managerial assistance to emerging businesses; WHEREAS, in 2014, Ohio's LDDs administered 63 ARC and ODSA Appalachian Assistance funded projects totaling over $72,140,914 in total project costs and resulting in 750 new jobs and another 2,025 jobs retained in the region with funding provided by the ODSA Appalachian Assistance funding and the federal ARC; WHEREAS, governance of the Governor's Office of Appalachia is addressed in Ohio Revised Code Section ; WHEREAS, the LDDs have developed a comprehensive and competitive process for the selection and recommendation for projects to receive funding through ODSA and ARC and that this locally initiated process should continue; and WHEREAS, we support full restoration of funding for the Community Facilities program and encourage administration by the LDDs to continue meeting the community needs of the Appalachian Region. NOW THEREFORE BE IT RESOLVED: that the Board of Athens County Commissioners supports continued funding of the ODSA Appalachian Assistance line item with the following statement explicitly included: Funding allocated for administration to the Buckeye-Hills Hocking Valley Regional Development District, Ohio Mid-Eastern Governments Association, and Ohio Valley Regional Development Commission be no less than $150,000 and funding allocated to Eastgate Regional Council of Governments be no less than $50,000. Commissioner Eliason stated that the Commissioners do not make donations and referred them to HAPCAP and possible CDBG funding. 14 109 * COAD/DJFS RSVP Agreement A motion was made by Mr. Chmiel and seconded by Mr. Adkins approving the RSVP Net SFY 14.15, Amendment #1 Vendor Agreement between ACDFJS and COAD as the sponsor of Retired Seniors Volunteer Program (RSVP). Whereas, ACDJFS seeks to purchase Non Emergency Transportation Services (previously Enhanced Medicaid Transportation Services) to eligible individuals as determined by ACDJFS, and Provider (COAD/ RSVP) seeks to provide such services, and Whereas the parties seek to amend paragraph 3.1 Contract Price so that it reads as follows: 3.1 Contract Price: ACDJFS shall pay to Provider the sum on the monthly Title XIX Medicaid Transportation Report for services rendered by Provider pursuant to Article 2 of this Contract, subject to the terms and conditions specified elsewhere in the Contract. The maximum amount payable under this contract will be $949, All other terms and agreements of the original Contract as amended remaining-place and unchanged. (Copied to page 98). DJFS / RSVP Agreement Amendment ~ Meeting Recessed until 9:00 a.m. Friday, February 27, 2015 Meeting Recessed ~ Estimate for cleaning of Sheriff s Documents in Landfill is too high. The Commissioners will contact Arcadis US, Inc., and ask them to submit a quote for initial air quality testing of the documents for toxins, that are currently in storage in Hocking County. A motion was made by Mr. Adkins and seconded by Mr. Chmiel to enter into executive session at 9:05 a.m. to discuss the hiring of a County Employee.
