64 ACDBE Airport Concessions Disadvantaged Business Enterprise U.S. Department of Transportation 49 CFR Part 23 ACDBE program is regulated by U.S. Department of Transportation (USDOT) under Title 49 Code of Federal Regulations Part 23. Create a level playing field on which ACDBEs can compete fairly for opportunities in concessions. Ensure the ACDBE program is narrowly tailored in accordance with applicable law. Help remove barriers to the participation of ACDBEs in opportunities for concessions at airports. Ensure that only firms that fully meet eligibility standards are permitted to participate as ACDBEs. 64
65 ACDBE Goal Overall Goal for FY FY2017 (Non- Rental Car) ACDBE regulations require establishment of overall ACDBE goals to cover a three year period. The Authority s overall FY15-17 (Oct. 1, 2014 Sept. 30, 2017) ACDBE goal for non-car rental concessions is as follows: FY % The Authority s overall goal will cover the following types of concessions: Food and Beverage Retail Passenger Services Duty Free 65
66 Florida Unified Certification Program Implemented July 1, U.S. Department of Transportation (USDOT) required that all recipients of FAA, FTA and FHWA Federal funds participate in a Unified Certification Program (UCP) within their respective states. One-stop shopping for firms seeking DBE and ACDBE certification which eliminates duplication of certification for all state UCP members. ACDBE certification accepted by all USDOT recipients in Florida. 66

68 Aviation Authority UCP - Certifying Area ACDBE certification applications will be accepted by Aviation Authority if your business is located in the following counties: Citrus Hardee Hillsborough Hernando Levy Pasco Pinellas Manatee Sumter 68
69 Determining ACDBE Certification Eligibility To be eligible for ACDBE certification, as defined in USDOT 49 CFR Part 23 : Must be at least 51% owned and controlled by one or more socially and economically disadvantaged individual owner(s) must control the firm s management and daily operations. Must be a U.S. citizen and legally considered to be a disadvantaged minority as defined by the SBA, i.e. African American, Hispanic American, Native American, Asian-Pacific American, Subcontinent Asian American, or Woman. Personal Net Worth (PNW) cannot exceed $1,320,000, excluding the equity in the primary residence and business. Gross receipts cannot exceed $ 56,420,000 averaged over 3 years. 69
70 ACDBE Certification Presumed Socially Disadvantaged Individuals : Black Americans Hispanic Americans Native Americans/Alaska Natives Asian-Pacific Americans Subcontinent Asian Americans Women Any other group classified as disadvantaged by the SBA in the future 70
71 ACDBE Application Process Regulations allows up to 90 days to process a new ACDBE application, which includes the on-site review. Processing time begins once a complete application (incl. supporting documents) is received by the Authority. If you are currently certified as an ACDBE outside of the state of Florida: Must be certified in home state before submitting ACDBE application documents for FLUCP certification. Regulations allows up to 60 days to process applications which are currently certified as ACDBEs outside the state of Florida. ACDBE certification documents can be forwarded to any of the FLUCP certifying members, with the exception of FDOT. Site visits will be conducted if business is located in Aviation Authority s certifying county jurisdiction and if company is certified outside of Florida, site visit report will be requested from home state certifying agency. 71
