6 CHAPTER 1 - INTRODUCTION The Disaster Mitigation Act of 2000 (DMA2K), commonly known as the 2000 Stafford Act, was approved by Congress on October 10, On October 30, 2000 the President signed the bill into law, creating Public Law This new legislation reinforces the importance of pre-disaster mitigation planning to reduce disaster losses nationwide, and is aimed primarily at the control and streamlining of the administration of federal disaster relief and programs to promote mitigation activities. DMA2K established a pre-disaster hazard mitigation program and new requirements for the National Hazard Mitigation Grant Program (HMGP). Section 322 of the Act specifically addresses mitigation planning at the local level and establishes specific criteria for local planning. The Portage County Natural Hazard Mitigation Plan, approved by FEMA May 8, 2007, conformed to the local requirements of the Code of Federal Regulations 206 Hazard Mitigation Planning, the Hazard Mitigation Grant Program and the Disaster Mitigation Action of Development of this "Portage County All Hazard Mitigation Plan" was based on planning requirements from FEMA and Wisconsin Emergency Management Resource Guide. This is the first update to the 2007 Portage County Hazard Mitigation Plan, and was accomplished by the receipt of a Federal Emergency Management Agency (FEMA) Planning Grant ($42,027.00) through the Hazard Mitigation Grant Program (HMGP) under Federal disaster declaration FEMA-1933-DR 1933 HMGP. SECTION A: PURPOSE OF THE PLAN In recent years, Portage County has experienced structural damage to roadways, bridges, and other public and private property due to storms and flooding. In addition, storms have caused contamination of private water sources, power outages and communication disruptions. According to the Federal Emergency Management Agency (FEMA), Portage County has been included in nine Presidential Disaster Declarations, totaling $2,944, in public and individual assistance, since The purpose of the Portage County All Hazard Mitigation Plan is to identify those hazards (natural and technological) that have occurred or could occur in Portage County, and to recommend strategies to minimize their impacts on human safety and public and private property. This Plan includes a description of each hazard, frequency of occurrences, and recommended actions to mitigate the hazard. 7 Mitigation activities will be emphasized in this plan as a major component of overall emergency management. Mitigation or prevention activities reduce the degree of the long term risk to human life and property from natural and technological hazards. The cooperation of government, private entities, and voluntary agencies is essential in mitigation efforts. SECTIONB: PIANNING PROCESS In 2011, Portage County Department of Emergency Management, applied for and received a grant for the update of the Portage County Natural Hazard Mitigation Plan under Federal Emergency Management Agency Guidelines. Portage County had undertaken the creation of its initial Hazard Mitigation plan pursuant to Section of the Disaster Mitigation Act of 2000 which states that after November 1, 2004, hazard mitigation grant projects (HMGP) will not be awarded unless the local government had a completed and approved Hazard Mitigation Plan. The lead agencies in formulation and supporting this updated All Hazard Mitigation Plan are Portage County Emergency Management Department and the Portage County Planning and Zoning Department. The Portage County All Hazard Mitigation Plan is a multi-jurisdictional plan under Federal guidelines, and includes all incorporated and unincorporated jurisdictions within Portage County, as was the case with the County's Natural Hazard Mitigation Plan of The following jurisdictions actively participated and adopted Portage County Natural Hazard Mitigation Plan by Resolution: - -- Villages I City Alban Carson Lanark Stockton Almond Park Ridge Stevens Almond Dewey Linwood Sharon Amherst Plover Point Amherst Eau Pleine New Hope Amherst Jct. Rosholt Belmont Grant Pine Grove Junction Ci Whiting Buena Vista Hull Plover Nelsonville Beginning in July of 2011, all municipal Clerks were sent a letter updating them on the project, the need for their municipal participation in the planning process, and when that participation could be expected, along with identifying the overall process for the entire County update. In addition to the Clerks memo, a number of individuals from across government, business, and community organizations were identified to be part of the Hazard Mitigation Work Group (see acknowledgments at the beginning of this document for a listing of members and titles). The Work Group would participate in and direct the drafting of the overall plan, and provide recommendations to the Portage County Public Safety /Emergency Management Committee for approval and recommendation for adoption by the County Board. 8 On July 25, 2011 the Portage County Emergency Management Director and Associate Planner from the Portage County Planning and Zoning Department made a presentation to local government officials at the Portage County Chapter of the Wisconsin Towns Association meeting held in Town of Pine Grove, Town Hall. The presentation provided additional information to communities and answered questions related to the need to update the Hazard Mitigation Plan, their role in the update process and other aspects of the Plan. As previously described, the Hazard Mitigation Work Group was created to serve as the oversight committee and to guide the development of the Plan. The Work Group consists of representatives from County Board, Town Chairpersons, Village Presidents, County Departments, area emergency service providers, the private sector, Wisconsin Department of Natural Resources, and Wisconsin Public Service Corporation. In addition to the Work Group, County staff met with and discussed the addition of technological hazards with the County Local Emergency Planning Committee (LEPC), with the LEPC's recommendations going to the Work Group for review and recommendation. (See acknowledgments section for members of the LEPC.) During late summer and early fall of 2011, Portage County staff proceeded with the initial review of the 2007 Hazard Mitigation Plan, met with the LEPC (September 8, 2011) to review and discuss the need to add technological hazards to the County's All Hazard Mitigation Plan. The LEPC recommended to the Hazard Mitigation Work Group that we add hazards associated with railroads (such as technological disasters large chemical spill in a rail yard), pipeline leak, and dam failure. At the first Work Group meeting on October 5, 2011, the Group was given an overview of the planning project, description of expectations for the planning process, along with review and discussion of natural hazards previously identified, and the recommendations from LEPC to include technological hazards. The Work Group also started the review of progress made on the mitigations strategies from the 2007 County's Hazard Mitigation Plan. The Work Group ultimately recommended that the plan include: 1. Hazardous Materials, 2. Dam Failure, and 3. Mass Casualty. After discussions with the Wisconsin Emergency Management (WEM), it was recommended we not include Mass Casualty, due to it being a result of a disaster and we "can't mitigate it". It was recommended that this be included in the County's preparedness or response plan rather than a mitigation plan. The LEPC met again on December 6, 2011 to review the draft information for the two new technological hazards: hazardous materials and dam failure. The Committee helped direct staff to appropriate information needed to best assess the individual hazard, identify past occurrences to help understand possible vulnerability, and create assumptions on likelihood of an event, along with starting the discussion to create mitigation strategies for each hazard. 9 The Work Group met again on December 20, 2011 to continue the review of existing mitigation strategies and to discuss the updated information for technological hazards from the LEPC. In early December 2011, all Portage County municipalities were sent a second letter updating them on the planning process, and asking them to identify meeting times and dates where County staff could attend and facilitate discussions on the identified hazards at the local level. In January and February 2012, County staff met individually with all 27 municipalities to discuss specifics for unique hazard related issues, community specific mitigation strategies, and other community specifics related to the Hazard Mitigation Plan. Appendix A is a complete list of information documenting each community's participation, including memo, agenda, attendance list, and minutes from each meeting. The comments and recommendations from those 27 individual meetings have been incorporated throughout this planning document. The Work Group met again on February 24, 2012 to review the first complete Plan draft and make final recommendations for the updated mitigation strategies. County staff incorporated recommendations from the meeting to complete the second Plan draft, which was sent out to all municipalities and all surrounding County Emergency Management Directors for review and comment in the middle of May, 2012 (see Appendix B for a complete list of comments). After review and comments from municipalities and directors, the final draft document was approved by the Work Group at their June 14, 2012 meeting for recommendation to the Portage County Public Safety Emergency Management Committee (PSEM). PSEM met on June 27, 2012 to review and recommended approval of the draft Plan by Resolution. The Final approved plan was approved at the July 17, 2012 County Board meeting, Resolution XXXXXX. General Public Involvement All Work Group Meetings, LEPC, and Municipal Meeting were posted and open to the public. The draft plan was also posted on the Potage County website, and all public comments were directed to the Planning and Zoning Department. No public comments, outside of direct municipal and elected official comments, were received. Incorporate Plans, Studies, Reports, and Technical Data Many different plans, reports, data sources, and studies were reviewed throughout the planning process and drafting of this document. Several Portage County municipalities and organizations have also previously adopted Emergency Response Plans or other related plans that give guidance when such an event would occur. Those Response Plans and other related plans have been reviewed as part of the Hazard Mitigation planning process.
