Many of us take for granted our right to vote, especially in a non-presidential election year. Time and again, a minority of the eligible voters in the state will decide who gets voted into office. This is because most people find some excuse not to get to the polls. I have always felt that it is not only my right, but my obligation, to make an effort to find out about the candidates and make an informed decision on who to vote for. This is a very important election year for all of us. People in our industry need to get to the polls and vote for the candidates that support our businesses. Our industry is over governed and over regulated. The average citizen does not seem to care, until he goes to buy a new home and wants to know why it is so expensive. The laws created by the politicians add much to the cost of new housing. We need to speak up. We need to show the politicians that we will not continue to accept new laws aimed at putting us out of business. Whether it is by what we pay in income taxes, employees salaries, and materials from our suppliers or even the money spent at the local businesses in the towns where we build, our economy is driven by the construction industry. Can you imagine what would happen to the economy in the State of New Jersey if all of us had to stay home because we have no work? It is important to donate to BPAC. Those monies are used to support the campaigns of the candidates that support out industry. But, all of the money that we donate to BPAC is useless if we do not go out and vote. It is time for us to reward those politicians that have helped us, and vote out those that have hurt us. I urge all of you to educate yourselves about which politicians believe in our industry and are pro-housing. NJBA has studied the candidates and can help you decide who to vote for. 4 T s Korner Alphabet Soup Have you ever wondered what the point is of all those letters after someone s name? In today s world of Tweets, Electronic Signatures and more, those designation letters are what set you apart. Picture a customer looking at 2 identical proposals. One is done by someone with no letters (designations) the other by one with at least one designation. Who is most likely to win? If you said the one with, you are right! Those little letters are your mini resume. They say I am a trained professional. It doesn t matter if your customer doesn t know what they stand for, they will ask. Hey KT, what does CMP stand for? When you take the courses offered by NAHB and can add a designation certification to your business card, your resume on a card starts. You set yourself apart. Your competition may know just as much but YOU are the one stating you have that knowledge. Many of our designations and courses benefit both Builders and Associates. Sometimes a name of a course can lead you to pass it over. Take the time to call Sharon in the office or Bill Asdal who is our in-house instructor and find out what courses might be beneficial to you. 13 Yes - It s That Time Again! The 2015 Awards of Excellence committee convened their first meeting to discuss the planning of our annual awards competition. The committee is in the process of choosing a theme for the event and the Call for Entries booklet will be ready for mailing to the membership in the November/December and January 2015 issues of OnSite magazine. If you are new to Metro, this competition is open to all Builder, Remodeler and Associate members. 15 construction focus four Module The Construction Focus Four Module was developed in support of the Occupational Safety and Health Administration (OSHA) Construction Outreach Program s effort to help workers in the construction industry understand the hazards they face and know what their employer s responsibilities are regarding protecting workers from workplace hazards. This training module is required to be used in both the 10- and 30-hour OSHA Construction Outreach Training Program classes. Construction safety is one of OSHA's top concerns. The four areas that will be covered are: Falls Electrocution Struck By s Caught-In or Between Construction is among the most dangerous industries in the country and construction inspections comprise 60% of OSHA's total inspections. In 2009, preliminary data from the Bureau of Labor Statistics indicate that there were 816 fatal on-the-job injuries to construction workers more than in any other single industry sector and nearly one out of every five work-related deaths in the U.S. that year. Also in 2009, private industry construction workers had a fatal occupational injury rate nearly three times that of all workers in the United States: 9.7 per 100,000 fulltime equivalent construction workers vs. 3.3 for all workers. 16 Historic Fill (HF) is often encountered on development projects in New Jersey. Historic Fill, by NJDEP definition, is non-native material, deposited to raise grades, that was contaminated prior to placement, and is not connected with the operations of the site on which it is found. A Municipal Solid Waste landfill, as an exception, is not considered Historic Fill. The NJDEP's "Historic Fill Material Technical Guidance" (the Guidance) published in April 2013, defines what must be done when Historic Fill is suspected. If HF is suspected, the first step the investigator (a term used by NJDEP to describe anyone using the Guidance to remediate a contaminated site on behalf of a remediating party, including the remediating party itself) must take is to evaluate whether, indeed, HF is present. This can be done by way of a Preliminary Assessment and Site Investigation in accordance with the Technical Requirements for Site Remediation (Tech Req's/NJAC 7:26E). It is notable that the Site Remediation Reform Act (SRRA) exempts the Licensed Site Remediation Professional (LSRP) from having to contact the NJDEP Hotline upon the determination that HF is present (NJSA 58:10C-16k). In other words, it is not a reportable discharge; however, the person responsible for conducting the remediation must still investigate and remediate the HF in accordance with the Tech Req's and the Guidance. The Guidance provides the remediating party the option of assuming that the suspected HF is contaminated above the applicable Soil Remediation Standards (NJAC 7:26D-4.) There is no need to delineate the contaminants in this case, but rather, simply delineate the extent of the HF. This delineation can be completed with a few test pits and bore holes and does not require analytical testing. Then, a presumptive remedy of engineering controls (capping), institutional controls (deed notice), and biennial inspections may be implemented. The cost of the cap and associated biennial inspections can be readily calculated and included in a project's proforma. The Guidance also details how to delineate and characterize the HF to determine if the soil is not contaminated above the applicable standards, in which case no remedy is required. Additionally, if contamination is found, surgical excavations can be completed and the soil would not require further remediation. 16. historic fill: overcoming the challenge to Land Development (Overcoming the Challenge to Land Development continues on page 18)

The Guidance provides similar options in that it can be assumed to be contaminated, in which case a Classification Exception Area (CEA) must be designated and filed. Optionally, the Guidance defines the investigation needed to prove that groundwater is not contaminated. Thus, the Guidance is a valuable tool for determining the impact of HF by defining the necessary investigative steps, and eliminating much of the uncertainty regarding the potential cost of remediation.
