11 Chairman s Report This past year has been busy for the Trust in that we the Trustees continue to move forward with our strategic plan and continue to look for opportunities that will benefit the Hapu. The Trust also continues to look at forging closer working relationships with the other Eastern Affiliates, the goal being that we work together on common projects. One thing I must point out, is that we are not looking at becoming one entity but it s about working smarter, cost effective and efficiently so that we give and get value for money. One favourable outcome from working together was the Shareholders Agreement and TAGH Constitution of which we were able to effect change to a point where all affiliates benefited. Another area where we have come together is that our TPT Reps meet and discuss issues before their scheduled meeting. The reasoning behind this, is to go into their meetings with a united front on issues that concern our three entities, thus putting our entities on equal footing with Pikiao and Tuhourangi entities who have three Representatives for their Affiliates on the TPT Board. One thing that I have seen come to light is that our Affiliate representative is having to constantly agree or sign off on resolutions that were resolved by past committees of the TPT Board. If the resolutions were passed in 2009 why was it not actioned then and why should our representative be aligned with these resolutions when clearly she had no input into. This issue must stay with our Representative to address with fellow Affiliate Representatives but I believe any support we give our Rep can only be good. I have challenged the effectiveness of the TPT Executive Administration at the last AGM and for myself the question that keeps coming to mind, is there a need for a different set of skills or qualifications to take TPT into the future? I have every respect for those that have gotten us to this point so far and that the work they have put in over the Settlement Negotiations for our Hapu has been valuable but it seems TPT Executive Administration are falling short of what we would expect of a corporate organisation. I keep asking our Eastern Affiliate Reps, Who is in charge here, the Trustees or the Executive Admin? Our Trustees should be advocating restructuring within the Executive Admin, to take control of TPT, so that the decisions are made at Board level and that they are actioned. They too must realise that the Executive Admin and TAGH work for the Trustees not the other way round. I do know that our Eastern Affiliate Reps agree with some of my sentiments but it s also about how do we effect that change is the challenge. Last but not least I must mention Uncle John who was awarded the Queen Service Medal in recognition of his service to the Police and Community. I take pride in congratulating Uncle John on behalf of the Trustees in receiving this prestigious award and deservedly so. The wisdom and knowledge you take with you will be missed from our Board meetings but on behalf of the Trustees and beneficiaries I wish you well and hope that your desire to recruit people all over the Motu to do mountain safety work for their own people in their own areas is a smooth and hassle free road. It was explained more in the financial report, where the book value of the computer depreciated so much, it was not considered worthwhile following through by the trustees. b/ Strategic Plan: To ensure inclusion of the Two Marae - Pikirangi and Ruamata Marae. This is now covered in the new mission statement as read by the Chairperson, which incorporates both Marae. Kaumatua: Where do they sit in the Mission Statement? They sit in each portfolio of the Strategic Plan. c/ Arama pleased with the cover on the panui and wanted the korero associated with the photo. Nireaha explained this photo was given by Johnny Woods. He was supposed to get back to Nireaha with the names, but hasn t. As explained by Aunty Kathy, there is Te Raumawhitu and Manuhiri - the father of Hare Wikingi. The other two are so far unknown. 15 A lot of the strategic plan has been achieved in a short time, with very little cash flow and not having to touch the principal sum. The Trust has never been in overdraft $30,000 is a one off grant (the $15,000 per marae) totally a grant, not to be confused with the $100,000 agreement promised to each marae over a 5 year period. Pikirangi is very happy with their grant which has enabled them to connect the sewerage Treasurer has a copy for Blanche of the last financials for , which she requested at the last AGM. Environmental 3 Year Plan: Discussion A/ Under the Resource Management Act, through the Ministry for the Environment, Hera sent in a tono to NUIT asking the Trust to sponsor her to do the Making Good Decisions Programme, from which if successful, she becomes an independent commissioner for the Environment. An application was sent through to the Regional Council by NUIT, if Hera is chosen, and passes, any payments made will be reimbursed up to $ by the Regional Council. B/ Trust is putting together an Iwi Management Plan with Hera s help. It will come back to the hapu for ratification. There are 3 stages for the hapu to approve: Inform the Hapu what the Iwi Management plan is & it s purpose, Draw up the plan and take back to the Hapu, and submit final draft for the Hapu approval. Funding received from Council for $ to implement and initiate the Iwi Management Plan. The $4800 is not included in the financial plan, as it came in after 31 March 2011 but will be shown in the next AGM report. Any payment made is part of the $4800:00, which also includes compiling all the information together. C/ Funding from Te Puni Kokiri for Fruit Trees: Request for nut trees to be included with other fruit trees. Use the expertise in the whanau to grow the fruit trees well. Permission has been given by Whakapoungakau 18 trustees to start our orchard but we should be aware of the airport height restrictions. Economic 3 Year Plan: Discussion Although the NUIT constitution states that decisions made must be passed by a vote of 70% by the trustees, NUIT Trustees have agreed that any resolutions made concerning the putea is that all Trustees must be unanimous or the resolution is lost. A seminar was held re Investments and companies. Ryan Hahipene believes he can assist Maori Trusts and entities to create wealth using the same methods as the banks, using the same amount of low risks that the banks offer. It ap

16 pears Lakes Trust has some faith in him, as he is working in an office set aside by them, however our Trust would want more assurances before taking on anything concrete with him. The principal part and statement of the claim was about Ruamata being moved from the top to where it is now, and the way the whanau had to dig into their own pockets to have this whole matter addressed. The good of the claims is that everyone benefits, however in light of this past history, more monetary allocation and consideration should have been given to Ruamata, who are in need of more e.g. for their toilets. The Chair suggests that this history is valuable and should be written up by Blanche and presented to the Trust. It can then be included in the Iwi Management Plan. The NUIT Trust will look into this more but must consider the interests of both marae. Social Plan 3 Year Plan: A/ Needs analysis some haven t been receiving the panui until very recent, but there has been very constructive things identified in the analysis. B/ Is there a plan for domestic violence? Any agencies that are already out there taking care of Government funded things. We do not want to re-invent the wheel, nor use our million dollars if Government is already giving out 20 billion dollars to these agencies, who are already in place to offer these services. C/ Ask the Kangen water presenters to come at a later date, to give a presentation on the health benefits of this alkaline water. D/ Te Arawa Standing Committee Water Quality is a huge social issue. Hera presented a korero on the Puarenga stream which has been closed due to the spraying in the forest, from which the residue has now saturated the forest, and trees are dying. There is a natural disease. Native trees can be dealt with it but not the pine trees. Tests have been done on different types of water e.g snowflakes. Trials in Japan and Thailand have proven that water responds to different music and spiritual energy, which produces clean water. Wally Lee and Hera have been doing submissions for a couple of years already and are just getting some pathway. E/ The Eastern Arterial Another important issue which impacts on our hapu from Vaughans Road up to us. Communication 3 Year Plan: There has been positive korero about the booklet, but talking about the whakapapa and give mind to Ngati Te Kanawa. We are the descendants of Hinepito and Uenukukopako and we need to be mindful of this. There are registration forms on line, but it has to come back and be verified by the kaumatua. Te Pumautanga o Te Arawa Update: Presented by Donna Te Kanawa TPT Representative: Two of the TPT leaders are not very well. Ruka Hughes has taken on the Chair s role at the moment until Eru and Rawiri able to resume their duties. June Hui was held last Friday, so will update as much as she can from May 2011 until now. Roger Pikia has a brilliant business mind and moves very quickly to secure investments for us. TAGH: A lot of the information is commercially sensitive and our TPT reps are sworn to that. Things look promising and a full report will be given at the AGM in August There is 30 million dollars worth of assets. Have Investments in Mainfreight and Craters, Food Retailers, with 8% bottom margin they are on the upper strata in terms of business and have lots of progress in work. 16 Ngati Uenukukopako Iwi Trust 2012

17 Hera would like TAGH to be wary of things which cause concern e.g mining and how it relates to us e.g. overseas companies. We have a whakapapa and moral obligation to our extended whanau. Some companies are dealing strongly with China as a super power. USA is not been considered as the leading power any longer. Shareholders Certificates: Nothing formal for our Trusts to be tied to TPT and now this is happening. Draw Down: Approximately 2014, we will have some more putea coming our way. CNI : Mana whenua process won t be finished by 2015, and this stage cannot be rushed. Rangitoto: Uncle John and Uncle Rua are looking at this on behalf of Ngati Uenukukopako. As it has come back up for lease, part of the number 4K 2E 2 block some comes back under Rangiteaorere. At least it has come back from the Crown and we own it and the logistics needs to be sorted between Rangiteaorere and Uenukukopako. Some of the aerials, sit on the part of number 4 block that Mihiterina is a Trustee and owner. Blanche has a list of owners. Under the cultural redress, this is where Rangitoto comes under it doesn t come under Mana Whenua process. Nireaha invited Blanche to become part of the team with Rua and John. The group are DOC, Volunteer coastguard, and get what it is worth and not what they demand. Rua and Kathy put the claim in under Ngati Rangiteaorere and it was brought back to the hapu, but sits with Ngati Uenukukopako with TPT. Te Arawa Tangata Strategy: The committee wants to work closer with Whanau Ora, with our pepi, violence etc as there is a great need. Christchurch Relief: There is a Booklet of the whanau who were assisted by TPT and Te Arawa Whanau. It is an acknowledgement of the great work by Korowai Aroha, and other Te Arawa groups. Insurance: This is a huge kaupapa for all marae. As a Te Roro o te Rangi Hapu trustee, he would like this take taken back to TPT by our N.Uenukukopako representative. This same take comes on the table every hui. Clark is on the risk and management committee of TPT and he raised this take again. The request was, could TPT broker for all the affiliates, or go through TAGH for funds to accommodate insurance for all our marae affiliates. It has been tabled and minuted and just waiting to hear. Reports moved Blanche and Wharangi and carried. General Business: 17 17

18 a/ NUIT Social Structure involvement 1 st responsibility is to grow the investment before all else, NUIT does not have at our disposal millions of dollars to tackle the social issues that our Maori people face. We are not about reinventing the wheel especially if there are other agencies already addressing the social issues of our Maori people. b/ Mihiterina is on the Mokoia Island Trust with Nireaha and Huhana, and has just started attending the hui. EBOP will train people to do certain environmental processes. Mihiterina wants to tono for the purchase of a waka for use by our respective hapu, to ensure that autonomy stays with the hapu, and not outsiders. Dennis wants to be sure of leasees and leasers rights so that each party is clear. Mihiterina is looking for a sheetmetal worker, to construct hangi cookers for the Mokoia Island Trust. Mihiterina is looking for scrub eradication workers on Mokoia Island. Would we purchase a waka and would Te Roro and Tuteniu come in on the purchase with Uenukukopako? The leasee renewal is coming up. Resolution: Ngati Uenukukopako Iwi Trust look into this issue and consider the request for a waka purchase and cost of quarantine, Moved Blanche 2 nd Clark and carried. Simon will submit a formal letter for Itiitireia, (Lakes High and Rongomai) to assist to take them to Whangarei for Kapa Haka Nationals next year. Simon will also ask Te Roro o te Rangi Hapu Trust to assist. Since we have Te Puku, Western Heights and Raukura also going to Nationals, we may receive formal letters from them also, as we have whanau in them all. There is a Te Reo Wananga and Matariki Wananga at Owhata Marae to be held 24 June 2011, straight after the usual Friday waiata. We would welcome some elders do some old korero, while the youngies will be in Hinemoa, having activities. Hepa Te Roro is looking at a commercial arm for investments or other income, and would like to know if NUIT will consider combining with them. Nireaha said yes but also mentioned that a business can still be operated by a charitable trust and having the same criteria of zero tax. 34 Strategic Plan Update Communication With our communication portfolio we are looking at hosting our own website within the next year. We intend to hopefully add details of the various Trusts that operate within Ngati Uenukukopako area and hope that this will help our people find the correct person or representative to contact. We also wish to add free advertising space for businesses that our own people own or operate on our website plus the normal things you would expect to find while visiting any page. This website would also be a means for our people to register with Te Pumautanga o Te Arawa. The Panui is a great success and the Trust will continue to publish a quarterly newsletter at this stage. Although the cost of producing our newsletter is creeping up, the bulk of the cost being prepaid envelopes; it is achieving some of our goals which are, to find ways of keeping our people informed. The Trust would still like the newsletter to have a column from a perspective of our younger generation and kaumatua, hoping that this would build intergenerational awareness and understanding. Cultural The Trust gave 5000 each to Ruamata and Pikirangi Marae around the beginning of the year separate from the 100,000 allocated for major projects. By doing this we achieve another of the Trust goals of making sure our Marae are safe and continue to retain a place for our people. We have and continue to support Matariki and ANZAC commemorations that are held on our Marae each year. These sorts of events creates whanaungatanga and as a means to pass on knowledge and values of our Tupuna. These goals are on going of which the Trust is dedicated to maintain and foster. The Trust is looking into setting up a program utilising the skills of our cooks so that they are passed on to the next generation i.e. butchery, baking etc, gathering of kai i.e. watercress, puha, koura, pipi, kuku and so on. Recently Te Pumautanga o Te Arawa put together a Marae Master Chef which put those skills to the test. This succession plan for our people working in the back could also be used in other areas like our Trust. We could have shadow Trustees where they sit in on meetings and give their input but have no voting rights. Sport events also support whanaungatanga plus team building and team work of which our Trust was happy to sponsor Whakapoungakau at the last Te Papa Takaro o Te Arawa games. The Trust was also able to give a grant to Itiitireia kapahaka (Rotorua Lakes & Rongomai combined) to help with travel and accommodation to the Secondary Schools Kapahaka Nationals in Whangarei. Social As previously stated the Trust is not about re-inventing the wheel when Government funded Agencies are already looking after some of the social issues that Maori face. One of those issues that the Trust identified was housing of which the Trust was able to address through the purchase of the Airport Motel. This allowed the Trust to supply affordable housing to our people and a sense of stability. Currently 5 of the 9 units are occupied by Hapu members and the occupants of the other 4 remaining units are from all over the Motu. The tenants have been informed that members of Ngati Uenukukopako will have first preference if their flat was to be vacated. Recently the Trust received a tono from the Rotokawa Bath Trust seeking assistance to erect 2 retaining walls that urgently needed doing. The Trust provided the materials and machinery with Chris Cookson providing the expertise and plans for the project. One of the reasons we actually agreed to help the Rotokawa Bath Trust was the kaupapa 34 Ngati Uenukukopako Iwi Trust 2012

35 and that is that they provide housing for our koeke. Knowing that the Bath Trust is made up of representatives from Te Rorooterangi, Rangiteaorere and Uenukukopako, and that our koeke are more or less one of the same, we decided to ask Te Rorooterangi Hapu Trust and Tuteniu Hapu Trust if they would consider us working together and help fund this project. Both Trusts decided not to be a part of this project for whatever reasons but our stance was that this kaupapa fitted in with our Cultural and Social obligations to our people that we could not say no. Economic The Trust acquired the Airport Motel in late December for about 510,000 GST inclusive, to provide a more substantial return than what the Banks were offering. The Trust budgeted $90,000 plus rentals to have our units brought up to scratch. The actual return at this particular time is $1080/wk, but by December we will see all rentals increased slightly to bring in a return of just over $1,160/wk. In two years the Trust would look at another rent increase to take the average rental of $145/wk to $160/wk by The Trust has chosen this path to lessen the effect on our families that are struggling to make ends meet. Realistically the rentals that we charge are well below market rate with the average rental for a 2 bedroom house is between $180-$190/wk on the eastern side and $120-$130/wk for a bedsit. From when the Trust took control of the property it was earning just $865/wk and so in the short time that we have had this property we have increased our returns by nearly 25% and by end of year that would be slightly more. The Trust wanted a name to call our whenua and so Uncle Rua offered to do some research and he came back with the name Kakahoroa. Kaka means "a ridge of a hill" and Horoa describing "a slip in the land". Uncle Paraone also gave a explanation with kaka describing "the ridge of the nose" and horoa describing the hupe flowing from the nose. In addition he said that the explanation he gave was a form of love and so saying that it is a place of love. Uncle Rua's research also found that there was a pumice quarry on this whenua and that it was owned by Eric Robinson. They would take the pumice away and use it in the manufacture of concrete and also used on our roads as well. Bonty Ranapiri (Ransfield) worked for Eric as a driver transporting the pumice. The Trust is currently in mitigation with Opus who has been charged by the Rotorua Council to insulate all buildings from noise identified in the red zone. Only the front building of Kakahoroa is within this red zone and with Donna already involved in this mitigation process with Pikirangi and Ruamata Marae she also managed to have Opus work on our property as well. The Trust at this time has deviated from its strategic plan of putting 5% of total income into a managed fund to now concentrating on the rental properties and getting them up to scratch. The Trust also signalled our intentions at the Mokoia Island Trust AGM that we are interested in taking over the lease from Tatou Experiences in Recently the Trust was invited to a Hui with Craig Investments of which they gave a presentation of how well shares in certain companies were returning 15%-20%. They then went into the Government model of the selloff of our State assets if they were to proceed and the company that they think would have more room for growth and value for money. The possibility of buying shares in our State assets has been discussed amongst our Trust Board and TPT Board level but our stance is that the Government should not sale off our State assets, but if they do be prepared to make a decision. Environmental Our orchard is coming along fine and that the Trust is looking into raised gardens in between the rows of trees and maybe utilise more land towards the lake

36 The maara project instigated by Te Rorooterangi Hapu Trust and in conjunction with Tuteniu and Uenukukopako is still a work in progress. NUIT assisted Hera Naera with submissions on the Rotorua District Council 10 year plan. Part of that plan was the Airport of which they wish to spend $4m annually for the next 10 years funded by the rate payers. Originally the Council said that the Airport would not be funded by the rate payers, now they are doing a complete turnaround, which was a concern for the Trust. In our submission we supported having an international airport but at what cost. $40 million for ten years and then what, the question asked was why pour ex- amount of dollars into a white elephant. Also our submission added that Ngati Uenukukopako has not given up its fight for the return of the Airport. A submission with the Regional Council 10 Year plan was also made and the concern that we saw was that the Council wants to take all farming out of the Rotorua catchment by Bearing in mind that most land in the catchment is Maori owned and most are in farming. Our concern is that the Council would have you believe that by following the same model as Taupo, the Rotorua lake will return to the same levels of nitrates and phosphates 50 years earlier by eliminating farming altogether in the catchment by Do we know what those levels were (No!) and by introducing different farming practices would that achieve the same outcome by 2022 (Don't Know!). At the end of the day there is a need for a more balanced approach towards reaching the desired goal and keeping our peoples livelihood intact. Another concern is that the council want to take away that livelihood and give no incentive to change. More information is needed of options for land use in the catchment before deciding to plant pine trees, this being the preferred option of the Regional Council. The Eastern Arterial is another area that the Trust has been keeping a close eye on, plus supporting Hera with the concerns and recommendation of Ngati Uenukukopako with NZTA (New Zealand Transport Agency). NZTA wish to enter into mitigation with all affected parties and judging by the last meeting that was held the feeling still remains the same that Te Ngae Rd Upgrade is our preferred option. A meeting has been called for the 2nd July 9.45am at the Millennium Hotel, Mokoia Room for all interested parties. The Trust supports the recommendation outlined in the Cultural Impact Assessment for Ngati Uenukukopako and also recommends that we don't waiver from that recommendation and not to get caught up in the mitigation process but remember the Cultural and Social issues it causes let alone the Environmental issues the Eastern Arterial Designate would create. By engaging with Government and Local Government agencies the Trust is putting into place some of our aims and objectives, To control, manage, protect, preserve and sustain all aspects of our environment and surroundings for future generations; To give Ngati Uenukukopako the ability to assert their rangatiratanga and kaitiakitanga over the environment within our boundaries; The Iwi makes decisions in partnership with governmental agencies concerning environmental matters within our rohe. 36 Ngati Uenukukopako Iwi Trust 2012

38 TPT Update Kia Ora Whanau The past 12 months has certainly been filled with moments of highs and lows for Ngati Uenukukopako, but with the strong commitment of our Trustees, we have survived many of the challenges successfully. Perhaps for NUIT, the most positive outcome we achieved was to question and resolve areas of concern prior to the signing of the TPT Shareholders Agreement. NUIT convened several Hui with our whanau from Te Roro o te rangi and Tuteniu to discuss areas of concern and as a combined effort, following legal advice, achieved success by having those concerns addressed and resolved. Some of the vital issues were: 1. TAGH to convene Annual General Meetings held annually 2. TAGH Quorum for Board meetings, ie., where after 2 adjourned meetings, the Directors (less than a quorum) cannot make a decision. 3. Payment of Dividends: Confirm that a dividend will be declared by TAGH for payment each year. The Shareholders Agreement was finally signed on November 2011, the Settlement Agreement specify that the first dividend will be payable on the 19 November NUIT, Te Roro o te rangi and Tuteniu have made a commitment to uniting and we continue to facilate monthly hui as the Eastern Affiliates in order to strategize prior to TPT Hui. The combined strategy has benefited our Affiliate strengths and one which we hope to continue in the future. Rangitoto: Following ongoing negotiation by Henare Colbert, TPT on behalf of NUIT, the renewal of the lease of Rangitoto to Rotorua Coastguard has been resolved. The lease has been reassigned to 2016, the annual rent agreed to by the Rotorua Coastguard is $ GST. Rangitoto as a Cultural Redress property is scheduled to be handed back to NUIT in the first stages of devolution back to Affiliates in accordance with Mana Whenua. Deed of Assignment: Since the capitalization of TAGH in 2009, TPT has passed a number of resolutions transferring the management of TPTs commercial assets to TAGH. The assignment relates specifically to the rights and incomes derived from: a. The school lands b. Rotoehu Forest land c. Shares in CNI Iwi Holdings Ltd held by TPT TAGH will be entitiled to those income streams only for a set period of approximately 32 years. In addition: TPT will retain ownership of the commercial assets; TAGH will exercise all management rights in respect of the TPT commercial assets; The Assignment will apply for the period that aligns to the CNI Mana Whenua process (approx. 32 yrs) As NUIT Representative, I voiced my concern that Rotokawa School has been classed as a commercial asset and as such is locked into the 32 yr term, despite Mana Whenua being undisputed. However, the Te Arawa Deed of Settlement was negotiated as a whole package and fragmentation of same would place TPT in certain jeopardy. CNI: CNI has held a further meeting to consider and discuss the replant options. What is becoming increasingly clearer to the CNI is the high cost of investment in a replant regime that will not see any return for years. 38 Ngati Uenukukopako Iwi Trust 2012

39 The returns have been predicted to be around 8%. As noted previously, this will be a big decision for all PSGE s to make particulary the smaller groups. Discussions continue around the review of the Mana Whenua Process. This now expected to extend to mid July In the interim TPT has finalised the standard guidelines for Affiliates engaging in kanohi ki te kanohi hui with other CNI Iwi and identified the mana whenua teams who will be involved in those engagements. Kanohi ki te kanohi hui are being arranged and held between the various claimant groups. It is hoped that the kanohi ki te kanohi process will go a long way towards the final allocation of land. However it is apparent that some groups want the review to change the fundamental principles and basis on which mana whenua is to be determined. This position that TPT will not agree to. That was not the basis on which TPT signed up to the CNI Deed of Settlement. Te Arawa Tangata Strategy: Te Arawa Tangata (TAT) operates under the banner of Te Pumautanga o Te Arawa Charitable Trust. The work programme of TAT has 3 main components. 1. Unit infrastructure; Key objective : To establish a credible unit that adds value to TPT Affiliates and Te Arawa. 2. Hapu Development; Key objective: To support the Affiliate entity s to build capacity to achieve their aspirations. 3. Kotahitanga; Key objective: To leverage our collectivity and foster projects that brings Te Arawa together. TAT has initiated a series of Affiliate breakfast hui, the most recent being held on 30 May 2012 at Te Kuirau Marae. A very successful Te Arawa Marae Master Chef was held at Owhata 6 May. The programme included Hunting/ Fishing, mahi kai competition, Marae kai competition and Marae cook off. Taheke and Te Takinga Marae worked together as a late entry in the competition of which they managed to win the overall award for the TAT Marae Master Chef. Taheke Marae have already offered to host the next Marae Master Chef. In the space allowed me, I hope I have given you a fair overview of the important issues from the TPT forum. I will endeavour to keep you all updated through the TPT column in NUIT quarterly Panui.
