1 MINUTES of the 14. meeting of COOMET Technical Committee TC 2 "Legal Metrology" 14 th meeting of TC2 was held on 17 of September, 2013 in INM, Kishinev, Moldova. 34 participants from 14 COOMET member-countries took part in the meeting: Armenia, Azerbaijan, Belarus, Germany, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Romania, Slovakia, Tajikistan, Uzbekistan, the Ukraine members of TC 2 and their representatives, members of SC 2.1 SC 2.4, and invited experts. 4 OUTCOMES OF THE MEETING Opening of the session The meeting was welcomed by director of National Institute of Moldova (NIM) Mr. Vitalie Dragancea and Ms. Victoria Prisak, Ministry of Economy of Moldova. The meeting was opened by Mr. Peter Ulbig, TC 2 Chairman, together with TC2 Secretariat, who greeted participants of the meeting and wish them effective work. Introduction of participants Participants introduced themselves (see list in the beginning of this Minutes). Adoption of the agenda The Agenda was approved by participants. 1. Review of decisions of the 13 TC 2 meeting Mr. Maxim Shabanov, TC 2 Secretariat, informed participants of decisions of the 13 th TC 2 meeting and noted that the majority of decisions are fulfilled or being executed and the information of progress will be given at the meeting. Information is placed on TC 2 page of COOMET web-portal ( 1 ) and can be found in working materials of TC Outcomes of the 23 COOMET Committee meeting in the framework of TC 2 activities Mr. Peter Ulbig, TC 2 Chairman, informed participants of the decisions of 23 COOMET Committee meeting in the framework of TC 2 activities which were prepared taking into consideration decisions of the last TC 2 meeting. 3. Exchange of information on changes in the field of Legal Metrology in COOMET member countries Participants gave information about changes in legal metrology in their countries. Mr. Maxim Shabanov noted that TC 2 page of COOMET web-portal ( contains summary of legal metrology infrastructure in Azerbaijan, Belarus, Bulgaria, Germany, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Lithuania, Russia, Romania, Tajikistan, Ukraine, and asked participants to review the information already available on the TC2 webpage with regard to recent changes in legoslation. It was agreed to complete the page with summaries of other COOMET member countries (Armenia, DPR of Korea, Cuba, Slovakia, Uzbekistan). 1 TC2 and SCs members should request TC2 Secretariat for login and password to view restricted access pages TC2 section on the COOMET web-portal (shabanov@belgim.by или coomet@belgim.by). 4/15

About TC 2 structure 4.1 About appointment of Chairperson of SC2.3 "Competence and Assessment of Bodies in Legal Metrology" The participants were informed that Mrs. Olga Maletskaya (Ukraine) resigned as Chairperson of SC2.3 "Competence and Assessment of Bodies in Legal Metrology". Mr. Peter Ulbig, TC 2 Chairman, on behalf of participants of the meeting acknowledged her contribution to TC2 development. After a discussion on the SC2.3 projects TC 2 members agreed to eliminate SC2.3 "Competence and Assessment of Bodies in Legal Metrology" because of lack of projects. This decision should be approved by CООМЕТ Committee and appropriate changes introduced to TC 2 Regulation. 4.2 About establishment of a Working group on measuring systems within SC2.2 and appointment of its chairperson Mr. Peter Ulbig, TC 2 Chairman, informed the participants that Presidential Council of COOMET (Lviv, Ukraine, 2012) decided to establish ad-hoc Working group on measuring systems within SC2.2. Mr. Alexander Krichevets (DP NDI "Systema", Ukraine) told about prerequisites of this decision and was proposed to take the leadership of of the WG by the participants of the meeting. Mr. Peter Ulbig, supported this decision so far as this issue is also prevailing within EC. Mr. Maxim Shabanov, SC 2.2 Chairperson, expressed his doubt in correct selection of the subject of research work proposed because the object discussed with a high probability is a certain type of systems based on high level software dealt by software development companies and, sometimes, conformity assessment bodies. The participants agreed that detailed information is required for them to take a decision on participation in projects within the WG. Mr. Alexander Krichevets was asked to prepare a concept of work and propose initial projects. The decision is given in the resolutions. 5. About members of TC2 and members of subcommittees SC 2.1 SC 2.4 Mr. Peter Ulbig, TC 2 Chairman, one more time informed participants of the meeting that Mr. Dmitry Korneev (head of department of metrological support to innovative technologies of VNIIMS, Russia) was approved as chairperson of SC 2.1 "Harmonization of Regulations and Norms in Legal Metrology" at 23th СООМЕТ Committee. The participants congratulated Mr. Dmitry Korneev with the appointment and wished him successful work. Updated information of the membership in TC 2 and SCs is available on the COOMET webportal (TC 2 page). Taking into consideration decision of ТC 2 about elimination of SC2.3 "Competence and Assessment of Bodies in Legal Metrology", it was decided to change sequence numbers of SCs and transfer participants of the former SC 2.3 to SC "Legal Metrology Control". This decision will be processed by COOMET Secretariat after approval of the changes by COOMET Presidential Council (November 2013); the information updated will be made available on TC2 web-page. Participants of the meeting supported prоposal for renewal of TC 2 membership information. 6. State of realization of TC 2 work program for (Reports of SC Chairman s or/and coordinators of projects) and perspective SC 2.1 SC 2.4 Chairpersons (on SC2.3 reported TC2 Secretariat) participants reported on realization of TC 2 work program and proposals for perspective development of SCs (ref. point of the Minutes). 5/15

6 6.1 Activities of SC 2.1 "Harmonization of Regulations and Norms in Legal Metrology" and perspectives Mr. Dmitry Korneev (Russia), SC 2.1 Chairperson, informed participants that project COOMET 550/RU/12 "Translation of international vocabulary of legal metrology (VIML)" is under development and it will be finalized after publication of VIML. He also proposed new projects: - To develop COOMET reference book on organization members and on principal directions of metrological assurance of the national economy; - To develop a procedure for determining the scope of state regulation in different countries. Receive reports on countries COOMET; - To conduct preparations on mutual recognition of testing and calibration results for the members of COOMET. The participants agreed to proceed with the development of projects after they have concept for the purpose to define the level of competence required. Mr. Maxim Shabanov (Belarus) informed participants of the meeting that COOMET web-portal (section "Projects of TC2") contains projects of COOMET publications developed by BelGIM in the framework of the following CООМЕТ projects: - 427/BY/08 "Analysis of requirements in the field of legal metrology including examples of application of these requirements to measuring instruments"; - 523/BY/11 "Development of a procedure for attributing technical devices to measuring instruments", He noted that these publications can be prepared as COOMET Recommendations as far as there were received no substantial rejections of comments. However, he asked potential participants to read the documents and comment on them by the end of It was agreed that the lack of comments may be regarded as consent to follow the practice proposed and should be regarded as a prerequisite for publication of COOMET Recommendation and it approval at the next TC2 meeting in Chairperson of SC 2.1 noted that an analysis was made in 2013 within CООМЕТ projects 582/RU/13 "Comparative analysis of the legal framework of COOMET member countries with international practice, as well as the document OIML D 1 "Elements for a Law on Metrology" which covered legislation of the member countries of Custom Union. The work will be continued in Activities of SC 2.2 "Technologies of Measuring Devices and Systems in Legal Metrology" and perspectives Mr. Maxim Shabanov (Belarus), SC 2.2 Chairperson, welcomed election of Mr. Alexander Krichevets (Ukraine) as a leader of Working group on measuring systems and wished him success. Mr. Maxim Shabanov informed participants about continued work over COOMET project 425/BY/08 "Development of a template of test procedure for software of measuring instruments". He proposed to finish the project in the first quarter of Thus the coordinator will prepare the draft document and send it to SC2.2 members. COOMET project 437/BY/08 "Development of a program for generating reference data sets for the purpose of software testing" is still in suspended state. It was admitted that the project will be demanded and should be finalized after certain norms will be introduced to national legislation regarding software of measuring instruments. COOMET project 601/BY/13 "Translation of OIML D31 "General requirements for software controlled measuring instruments" is under development. There is a translation into Russian. A draft of Belarus standard is prepared and will be afterwards proposed as а regional standard. Participants agreed with the proposals. Mr. Maxim Shabanov (Belarus), SC 2.2 Chairperson, asked Mr. Alexander Krichevets to prepare a concept of work within Working group on measuring systems (objects of metrological control, area of interests etc.), and also proposals for new projects and send them to TC 2 members. After that TC2 members will decide on their collaboration in projects and required level of competence of experts. 6/15

7 6.3 Activities of SC 2.3 "Competence and Assessment of Bodies in Legal Metrology" and perspectives Participants discussed projects managed by resigned SC 2.3 Chairperson, Mrs. Olga Maletskaya (Ukraine): - Projects "The analysis of uniformity of verification/calibration certificates, issued in COOMET countries, and elaboration of proposals on their unification" earlier was in TC2 Work Program. The project must have been registered in COOMET Secretariat. Mrs. Ainura Akhmedzhanova (Kyrgyzstan) and Mrs. Narine Ohanyan (Armenia) reported that a unified template of calibration certificate is developed and have been used by CООМЕТ NMIs when doing work for the purpose of CIPM MRA. A template of verification certificate is set by regional standard PMG Regarding this the project should be eliminated. Participants supported this proposal; - COOMET project 491/UA/10 "Development of COOMET recommendation "General requirements to the competence of verification laboratories" (coordinator Ukraine) should be continued regarding requirements of ISO\IEC and finished after comments are received. It was decided to propose the final version of Recommendation for approval at the next TC2 meeting in After that the member countries are recommended to notify National accreditation bodies of the availability of this document. It was admitted that this document will be of demand by NMIs if NABs rejected accreditation of verification laboratories as a missing object of international conformity assessment approach (ISO\IEC 17025); - Project "Quantitative evaluation of technical competence of verification laboratories" should be excluded because there is no coordinator and parties interested in. Participants agreed with this proposal. Mr. Maxim Shabanov (Belarus) noted that a project "Requirements for the testing laboratories involved in type approval testing" (coordinator Belarus) having the suspended status will be continued in the future. It may be of interest for specialists in Custom Union as document setting additional criteria for choosing testing labs notified to perform type approval tests of measuring instruments; Discussion revealed the lack of new projects in this area. Regarding this TC 2 members decided to eliminate SC 2.3 "Competence and Assessment of Bodies in Legal Metrology" from the structure of TC2. This decision should be approved by COOMET Committee and after that corresponding changes will be introduced to the Regulation of TC2. It was decided to regard COOMET project 426/BY/08 "Development of recommendation regarding realization of interlaboratory comparisons (PT schemes) for verification laboratories for assessing their technical competence" (coordinator Belarus) as finished because of elaboration of a regional standard GOST ISO\IEC It was decided to shift the information about finished projects within SC 2.3 including project 426/BY/08 to the projects of SC "Legal Metrology Control". Project coordinator (Mr. Maxim Shabanov, BelGIM, Belarus) should prepare and sent a form of finished project to COOMET Secretariat. 6.4 Activities of SC 2.4 "Legal Metrology Control" and perspectives Mrs. Ruf Genkina (Russia), SC 2.4 Chairperson, reported on suspension of projects regarding prepackages control because of abrogation of Belarus Technical regulation 2010\004\BY "Prepackages. Requirements to quantities and labeling" and denial of Custom Union in developing similar technical regulation. These are: - 441/RU/08 "Development of template of bilateral agreement on recognition of national prepackages control mark"; - 533/BY/11 "Development of a recommendation for determining amount of prepackage filling with the purpose to make a decision whether this prepackage is a misleading one" suspended on national level; - 603/RU/13 "Development of СООМЕТ Recommendation on specifying requirements to prepackaged products and their metrological surveillance". 7/15

8 Mr. Maxim Shabanov (Belarus) confirmed that COOMET Project 602/BY/13 "Preparation of an overview on the progress with prepackages control in COOMET member countries" (coordinator Nadezda Lyakhova, BelGIM, Belarus) will be continued because it follows earlier adopted decisions, for instance, in the framework of the workshop on prepackages. Taking into consideration low activity of participants at the stage of proposed form circulation (participation confirmed only Uzbekistan), the form will be circulated again by the end of Mr. Maxim Shabanov also expressed belief that Technical Regulation on prepackages and relevant standards will be of great demand because of being a direct obligation of governments in securing rights of consumer and fulfilling requirements of WTO. Participants proposed to chairperson of SC 2.4, Ms. Ruf Genkina, to analyze further ways of developments in SC 2.4 for making it possible to formulate new projects; proposals should be submitted at the next TC 2 meeting in Collecting suggestions for new projects and changes to TC 2 work program Taking into consideration discussions under point 6 of the Agenda the projects mentioned in Resolutions will be included in TC2 Work program after their preliminary consideration by the members of corresponding SCs within time limits defined. Project coordinators should prepare forms of proposed CООМЕТ projects and submit them to COOMET Secretariat for registration and circulation among COOMET member countries for engaging interested parties. Amended TC 2 Work Program for (as of September 2013) is given in Annex 1 to the Minutes and uploaded to COOMET web-portal (TC 2 page) - Taking into consideration decision of TC 2 members regarding elimination of SC 2.3 "Competence and Assessment of Bodies in Legal Metrology" the TC2 Work program should be revised. This will be done by TC 2 Secretariat after approval of the new structure by CООМЕТ Presidential Council (November 2013); the program updated will be sent to TC2 members, placed on TC 2 web page and proposed to COOMET Committee for approval. 8. Miscellaneous There were no points to discuss. 9. Place and date of the next meeting Participants agreed to hold the next TC2 meeting and a satelite workshop in September The place of the meting will be Russia (VNIIMS) or, on certain conditions, Tashkent, Uzbekistan. The final decision will be taken in the beginning of Approval of resolutions of the meeting Participants agreed with the Resolutions of 14 th TC2 meeting (Annex 2). COOMET Workshop "Inspection and market surveillance (as regards metrology)" was held together with TC2 meeting (18 19 of September 2013). When delivering reports participants discussed a lot, that proves relevance. It should be summarized that transformation of surveillance is going on in many countries and this is due to adoption of international standards and revision of legislation in this area. Metrological supervision is gradually excluded from the business of National metrology institutes. Materials of the workshop are available on web-portal of CООМЕТ (TC 2 member access). Closing of the meeting Mr. Peter Ulbig, Chairperson of TC2, and Mr. Maxim Shabanov, TC 2 Secretariat, acknowledged participants for their reports and active participation and also thanked the host institute for the splendid arrangement of TC2 meeting and the workshop, and also thanked interpreter Mrs. Elena Gerltz. To take note of the information about fulfillment of TC 2 decisions, taken at 13 th meeting TC 2 (2012). 2. To ask COOMET Committee to abrogate SC 2.3 "Competence Assessment of Bodies in Legal Metrology" due to lack of proposed projects and exclude it from TC2 structure. To assign sequence number 2.3 to SC 2.4. To consider it advisable to continue projects of the former SC2.3 in the framework of SC "Legal Metrology Control". To include members of the former SC2.3 into SC "Legal Metrology Control". Remark: TC2 Secretariat should amend TC2 Regulation after structural changes are agreed by COOMET Presidential Council (November 2013) with the purpose of further approval of TC2 Regulation by COOMET Committee. 3. To approve candidature of Alexander Krichevets (DP NDI "Systema", Ukraine) as chairperson of Working group on measuring systems. To ask A.
