Santana, City Administrative Office~ G l/- Transmittal from the Board of Police Commissioners dated July 5, 2012; referred for report on August 9, PORT SECURITY GRANT PROGRAM ADDITIONAL GRANT AWARD -POLICE DEPARTMENT SUMMARY On August 23, 2011, the Council adopted an action authorizing the Police Department (LAPD) to accept a 2010 Port Security Grant Program (PSGP) from the Department of Homeland Security (DHS). The grant awarded was for $1,529,000 for the period of September 30, 2009 through January 1, The purpose of the Port Security Grant Program is to strengthen the nation's critical infrastructure against risks associated with potential terrorist attacks and enhance the response of law enforcement entities within the jurisdiction. Earlier this year, the DHS approved an additional allocation of $475,000 for LAPD to purchase a 9-meter rigid hull inflatable boat to address the increased use by smugglers of boats to bring narcotics and weapons to our coastline. The LAPD now requests authority to accept the additional grant funds and to execute an amendment to the MOA to add the additional grant funds to the existing award amount. The Underwater Dive Unit (UDU) of the LAPD Metropolitan Division (Metro) utilized the original grant amount of $1,529,000 to purchase necessary vessels and equipment for officers from the UDU and Special Weapons and Tactics (SWAT) team tasked with response to incidents within the Port. The equipment purchased included three Zodiac-type inflatable vessels, one 49-foot primary dive vessel, one 34-foot SWAT surveillance and boarding vessel, and two underwater metal detectors. These vessels and equipment will replace existing equipment that has reached the end of its life span. RECOMMENDATIONS That the City Council, subject to the approval of the Mayor: 1. Authorize the Chief of Police, or his designee, to accept the additional award of $475,000 for the Port Security Grant Program (PSGP) from the Department of Homeland Security (DHS) for the period of September 30, 2009 through January 1, 2014;

2 CAO File No. PAGE Authorize the Chief of Police, or his designee, to execute an amendment to the Memorandum of Agreement (MOA) between the Los Angeles Police Department (LAPD) and the Marine Exchange of Los Angeles-Long Beach Harbor, the Fiduciary Agent (FA) for the PSGP grant, to add the additional PSGP funds, subject to the review and approval of the City Attorney as to form and legality; 3. Authorize the LAPD to spend the additional 2010 PSGP funds, up to, the total 2010 PSGP fund amount of $2,004,000 in accordance with the grant requirements; 4. Authorize the Controller to increase the amount of the existing grant receivable to $2,004,000 and increase the appropriation account, Account No. HS55, within Fund No. 339, Department No. 70, for the disbursements of Port Security Grant Program funds; 5. Authorize the LAPD to submit additional grant reimbursement requests to the FA and deposit grant receipts in Fund No. 339, Department No, 70; and 6. Authorize the LAPD to prepare Controller instructions for any technical adjustments, subject to the approval of the City Administrative Officer, and authorize the Controller to implement the instructions. FISCAL IMPACT STATEMENT There is no impact to the General Fund. Approval of the recommendations in this report are in compliance with the City's Financial Policies as all grant eligible expenditures are fully covered by the allotted grant funds. 5 The Honorable Board of l'olicc Commissioners Page DISCUSSION The LAPD subiditled an application for the 2010 Port Securjty Grant Program to the Department of Homeland Security and was approved fl1r $1,529,000 in funding for the period of September 30,2009 through January 1, e purpose ofthe Pmt Security Orant Program is Lo strengthen the nation's critical infrastructure against risks associated with potential terrorist attacks and enhance the response of law enforcement entities within the jmisdiction. The Board approved the acceptance of this gr3.dt <md the execution of an MOA on May 31, 2011 and!he Council approved on August 16,2011 (CF # 10~1955). On or about May 29,2012, the Department ofhomdand Secmity, acting through the grant's FA, approved an add1tional $475,000 of funding to LI\PD under this grant The additional funding of$475,000 will be used to purchase a 9.. meter rigid hull inflatable boat The 1~APD does not currently possess a reliable, extended-range pursuit boat capable of sustained speeds over ever increasing ranges. This boat will be used to address the increased use by smugglers ofpanga boats to bring narcobcs and. weapons to our coastline. The United States Coast Guard, Border Patrol, and Homeland Security agencies do not presently possess the assets required to adequately address this problem without regional assistance. Request is now being made to accept the additional grant fw1ds and to execute an am.endment to the MOA to add the additional grant funds. 6 FIRST AMENDMENT TO THE MEMORANDUM OF AGREEMENT BETWEEN THE MARINE EXCHANGE OF LOS ANGELES-LONG BEACH HARBOR AND THE CiTY OF LOS ANGELES This FlRST AMENDMENT ("First Amendment") to that certain Memorandum of Agreement ("MOA") is made and entered into by and betvveen tt1e City of Los Angeles, a municipal corporation ("City"), acting by and through its Los Angeies Police Department (''LAPD"), and the Marine Exchange of Los Angeles- Long Beach Harbor, a California corporation ("Marine Exchange"), with reference to the following: WHEREAS, the Marine Exchange has been nominated by the Area Maritime Security Committee ("AMSC"), and appointed by the Federal Emergency Management Agency ("FEMA") on behalf of the Department of Homeland Security ("DHS"), to act as the Fiduciary Agent ("FA") for the FY 2010 Port Security Grant Program award (DHS Award No: ;2010~PU-T~O-K004) ("Grant Award"); and WHEREAS, the City has previously been awarded Grant Award funds in the amount of U.S. $1,529, (the "Original Allocation") to be used by the City in the planning, development and execution of certain projects as set forth in the City's Investment Justification ("lj'') under the Grant /'\ward; and WHEREAS, on or about October 6, 201'1, the Marine Exchange, as the FA for the Grant Award, and the City execute\j the MOA in connection with the use and disbursement of the Original Allocation of Grant Award funds; and WHEREAS, subsequently, FEMA awarded additional Grant!\ward funds in the amount of U.S. $475, to the City (the "Additional Funds") to be used in accordance with the City's IJ under the Grant Award; and WHEREAS, the Marine Exchange and the City (each a ''Party" and collectively the "Parties") each desire to enter into this F;irst Amendment to add the Additional Funds to the MOA and to bind the responsibilities and obligations of both Parties under the MOA to the use of the Additional Funds. NOW, THEREFORE, in consideration of the mutua! covenants hereln set forth and the mutual benefits to be derived therefrom, the Marine Exchange and the City agree that the MOA be amended effective.june 1, 2012 as follows: 1. The MOA is hereby amended to include the following provision: "10. Dual FZole VesseL The award and use of the Additional Allocation is hereby made a part of this MOA, and all provisions of this MOA shall apply thereto." 2. Except as herein amended by this First J\rnendment, all other terms and conditions of the MOA shall remain unchanged and in full force and effect by way of this First Amendment 3.
