3 Missions MSNG Mission. Provide properly maintained and equipped units available for prompt mobilization for war, national or state emergency, or as otherwise needed. MSNG DSCA Mission. Upon request and approval, provide technical expertise, manpower, and equipment to assist State, County, and Local Officials in their efforts to save lives, protect property, and reduce suffering of Mississippi s citizens and their communities impacted by disasters. 3
4 DoD SAR Policy It is DoD policy to support RCC requests for civil SAR, and DoD forces will fund their own activities without allowing cost reimbursement to delay response to any person in danger or distress. (DoDI ) Immediate response (i.e., any form of immediate action taken to save lives, limbs, or eyesight; prevent human suffering; or mitigate great property damage under imminently serious conditions) will not be delayed or denied solely for lack of a flight hour reimbursement commitment. However, a reimbursement commitment will be sought as soon as practicable when prescribed in governing DoD directives or instructions. (NG Pam 95-5) 4
5 Longevity Limits Length of Immediate Response An immediate response shall end when the necessity giving rise to the response is no longer present (e.g., when there are sufficient resources available from State, local, and other Federal agencies to respond adequately and that agency or department has initiated response activities) or when the initiating DoD official or a higher authority directs an end to the response. The DoD official directing a response under immediate response authority shall reassess whether there remains a necessity for the Department of Defense to respond under this authority as soon as practicable but, if immediate response activities have not yet ended, not later than 72 hours after the request for assistance was received. NLT 72 hrs. After reassessing whether there remains a necessity to keep employed under initial authority, CNGB will coordinate authority for extension, & notify the State.
6 SAR vs Fugitive Search Posse Comitatus Act Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both. We can: Observe Report Transport Law Enforcement from Base to Staging Area We can not: Apprehend Transport Law Enforcement in order to apprehend
