5 Page 5 of 51 AGENDA ITEM #1 CALL TO ORDER Chairman Porter called the meeting to order at 9:32 a.m. Following the opening of the meeting, the Pledge of Allegiance was recited and introductions were made. Chairman Porter requested that everyone sign in on the sign-in sheet. AGENDA ITEM #4 PUBLIC COMMENTS No public comments were presented at this time. Chairman Porter requested that the Public Comments item be placed at the end of the agenda. AGENDA ITEM #5 Minutes of the February 26, 2015 Meeting Chairman Porter entertained a motion to accept the draft LEPC meeting minutes of the February 26, Chief Sieber moved approval of the minutes of the February 26, 2015 LEPC meeting as recorded. Mr. Kerkering provided a second which unanimously carried. AGENDA ITEM #6 Southwest Florida LEPC Membership Update Ms. Gwinnett presented the item as it was presented within the agenda packet. She then stated that as a result of discussions with Chairman Porter, she will be contacting those members who have missed three or more consecutive meetings to ask if they are still interested in being a member of the LEPC. Chairman Porter requested Ms. Gwinnett read off which members have not been in attendance. He requested that if any of the members know those members who haven t been in attendance to please contact them. Ms. Gwinnett read the following names: 1. Keith Teague, East Naples Fire Department Chief Sieber moved to approve the transmission of the membership requests to the Florida DEM and Florida State Emergency Response Commission (SERC) for consideration. Mr. Cotterill provided a second which unanimously carried. AGENDA ITEM #7 Southwest Florida Local Emergency Planning Committee s Comprehensive Emergency Management Plan Update Ms. Gwinnett thanked the members for their efforts in assisting with the update. She then presented the item as it was presented within the agenda packet. Chief Sieber moved to approve the final draft of the 2015 LEPC Hazardous Materials Emergency Response Plan Update and authorize staff to submit the plan to the Florida Department of Emergency Management by June 30. Mr. Rhoads provided a second which unanimously carried. AGENDA ITEM #8 LEPC Logo Shirts It was announced that the LEPC Logo shirts information was included in the agenda package for member s consideration. AGENDA ITEM #9 Southwest Florida LEPC Contingency Funds Update Ms. Gwinnett presented the item. She explained that since the contingency funds could not be used for refreshments, but they were donations, she will research the issue to see what those funds could be used for. Ms. Gwinnett noted that donuts and coffee provided at today s meeting are from member contributions. She said that there is a contribution tray on the table if anyone wished to contribute towards the coffee and donuts fund. District 9 LEPC May 28, 2015 Meeting Minutes Page 3

7 Page 7 of 51 AGENDA ITEM #10 Sunshine 811 System - Presentation Mr. Brian Dean of Sunshine 811 gave a presentation on the Sunshine 811 system. He explained that the Sunshine 811 agency doesn t have any State authority so they can t make anyone do anything. They just try to get everyone in the same room and talking to one another. He said that he will give his contact information to Ms. Gwinnett for her to distribute. Mr. Wolfe asked if the fire departments could develop a policy. Mr. Dean explained that any agency that can go through the clerk of the courts can enforce Chapter 556, F.S. --- law enforcement, code enforcement, code inspectors, etc. He noted that the citable offenses are: Failure to call Failure to wait two business days Failure to contact the utility Failure to stop digging if the marks/markers are no longer visible The members/operators can be cited for failure to locate Failure to follow local marking standards Calling in a false emergency on a ticket Mr. Dean explained that the issue of issuing a citation against a member for not locating is who do you hand the citation to. Many local law enforcement agencies don t want to issue civil citations because they are very difficult to enforce, which causes issues in these cases. Mr. Wolfe asked if there has been any outreach efforts made to the fire departments. Mr. Dean said that he would be more than happy to assist the fire departments; however, he cannot tell the fire departments what to do, but he could assist. He has assisted the Estero Fire Department, Lee County Code Enforcement and is currently working with the Lee County Sheriff s Department to give a presentation on the 811 system. Mr. Wolfe asked Mr. Dean if he had reached out to the fire marshals. Mr. Dean explained that he has worked with the State Fire Marshals at conventions and also the Lee County Fire Marshal s Office. Mr. Dean announced that the Florida Code Enforcement is holding a conference in Naples at the end of June where he will be hosting a round table discussion. AGENDA ITEM #11 State Hazards Analysis Work Group Update - SERC Due to the absence of the LEPC s Training Chair Matt Marshal, Chairman Porter gave a brief report on how the State is continuing to update the system for the supplemental environmental projects. It is anticipated that within the near future the system will be finalized. The benefits to the system are it can be amended at any time and is able to hold many projects. 8 Page 8 of 51 AGENDA ITEM #12 Florida DEM Training Mr. Mike Beha, DEM Exercise Coordinator for Homeland Security gave a presentation on how to get involved in the State s training. He explained the State s SERC TRAC which lists trainings throughout the State. SERC TRAC is located on the SERC s website at He noted that SERC TRAC is also a way for agencies to post trainings. One of the issues that DEM faces is where one agency offers a class and then within a short time later another agency offers the same class. He said that it would be nice to be able to have coordination between the agencies and the courses that they are offering. Mr. Beha explained that in each spring, DEM with working through the local emergency management offices does a local training and exercise plan for each emergency management office and also on a regional basis. What DEM is looking for at the local training and exercise plan workshops is what particular training is needed and is that agency required by law to offer certain services or representing individuals who require specific training. As DEM accumulates the information, they in turn reach out to those agencies who offer those specific trainings in order to meet both the local and regional training and exercise needs. He then explained that if a training or exercise is offered by the State there is no cost. The State receives funding for a lot of training and so typically there isn t a charge for the trainings or exercises. However, local agencies also receive funding for trainings, so there may or may not be a fee for those trainings. Mr. Beha noted that there are many vendors throughout the State and many of them offer the same training as the State and also charge a fee. So he encouraged the members to first either contact DEM or go onto SERC TRAC to see if the same training is being offered by the State at no cost before going to a training that is given by a vendor with a fee. However, he did note that there is specific training that is not offered by DEM which both the fire departments and law enforcement agencies have specific trainings that they need and the only way to get those trainings is through a vendor. Ms. Barnes asked Mr. Beha if there are a minimum number of students required for the trainings that DEM provides. Mr. Beha said that typically 15 students is DEM s minimum requirement. He also noted that there is a consortium in which FEMA provides specific training and their minimum is 25 students. Mr. Beha explained that his primary goal is to help the local agencies find the specific training that is needed. He said that from what he has heard from previous meetings, some of those trainings are available. Chairman Porter noted that within the Florida HazMatters each of the districts lists their training schedules. AGENDA ITEM #13 Florida State Emergency Response Commission Meeting Update Ms. Gwinnett presented the item and explained that both the HazMatters Newsletter and the April SERC meetings summary were included within the members packets. 9 Page 9 of 51 distributed was the hazardous materials incident report from February through April. AGENDA ITEM #14 Florida SERC Training Task Force Update Chairman Porter stated that the Task Force is very active and is proceeding with their initiatives. MEMBERS COMMENTS Ms. Cerquera referred back to Agenda Item #7 LEPC HazMat Plan and said that under Section Environmental Sensitive Areas of the District on page 1-2 where it referenced Map-34 and she wasn t completely sure that it was accurate. She suggested replacing the reference to the map with the website link. Ms. Barnes announced that Hendry County s new Emergency Management Director is Brian Newhouse, who replaced Ms. Lupe Taylor. PUBLIC COMMENTS Mr. Wolfe thanked the LEPC for the award that was presented at the LEPC s February meeting for his membership on the LEPC. He apologized for not being able to be in attendance; however, Mr. McCarthy accepted the award in his honor. ADJOURNMENT Ms. Gwinnett announced that the next meeting was scheduled for August 27, 2015 at 9:30 a.m. in the SWFRPC s conference room. There being no further business, the meeting was declared adjourned at 10:11 a.m. by Chairman Porter. An LEPC can only submit the name of a single nominee for the award. However, certificates of appreciation can be submitted for others with outstanding participation or accomplishments in the field of hazardous materials. The recommended awards are typically reviewed by the Florida State Emergency Response Commission (SERC) during the last meeting of the year. RECOMMENDED ACTION: Consider a nominee or nominees recommended by staff, or consider nominations from the floor for the Thomas Yatabe State Emergency Response Commission s Awards Program.

BRIEF DESCRIPTION OF ACCOMPLISHMENTS: Mr. Gibbons started at the Southwest Florida RPC on March 22, 1989 as a Regional Planner. He was staff for the District 9 LEPC from 1989 to when he retired in During his tenure, the SWF LEPC was awarded various types of awards. In 2004 the SWF LEPC received an Honorable Mention from the Chemical Education Foundation for the LEPC s active and important work. In 2006, the SWF LEPC received the Second Runner-Up award from the Chemical Education Foundation for Chemical Safety. Mr. Gibbons always took great pride and was committed in moving the SWFL LEPC forward. In 2003 District 9 LEPC hosted the January 2003 LEPC Chairperson/Staff Contact and SERC meetings, as well as the Training Task Force meetings. One of Mr. Gibbons accomplishments was being appointed to FEMA/Federal DOT National Hazardous Materials Pollution Prevention Guidelines Committee from He also assisted in the preparation of the National Federal Guidelines for Public Sector Hazardous Materials Training publication in March 1998.

24 Page 24 of 51 FY14-15 HMEP PLANNING PROJECT SOUTHWEST FLORIDA LEPC DISTRICT 9 COMMODITY FLOW STUDY STATUS UPDATE In accordance to the SWFRPC s procurement guidelines, on June 9, 2015 LEPC staff submitted a Request for Proposals (RFP) to the Florida Administrative Register for publication on June 10, 2015 for a commodity flow study for Southwest Florida. The deadline for submitting an RFP was at 2:00 p.m. on July 1, 2015, two proposals were submitted. The two proposals were evaluated in accordance to the evaluation criteria listed within the RFP on July 6, 2015 by LEPC Staff and the LEPC s Training Chair. As a result, Advanced Planning Consultants, LLC was awarded the project. The contract between Advanced Planning Consultants and the SWFRPC/SWF LEPC was executed on July 14, 2015; and Advanced Planning Consultants began work on July 15, The attached document illustrates the locations for the Southwest Florida LEPC District 9 Commodity Flow Study. As of August 10, 2015, Advanced Planning Consultants had completed the following site visits/observations at the following locations: Glades County US-27 (North/South) Hendry County SR-8 (East/West) and US-29 (North/South) Lee County US-41 (North/South) and SR-78 (East/West) Lee County I-75 (North/South) Collier County US-41 (North/South) and SR846 (East/West) Collier County I-75 (North/South) Both Sarasota and Charlotte counties remain to be completed. In accordance to the contract, Advanced Planning Consultants is scheduled to complete their visits/observations by the end of August and then submit the final report to both LEPC Staff and DEM for their review and approval by September 30, 2015.

(APC) is proposing that visual surveys for the Southwest Florida LEPC District 9 Commodity Flow Study take place in the locations outlined in this document. These locations have been chosen for various reasons including, but not limited to: proximity to major roadways/highways, clear visual of all hazardous material transportation vehicles traveling on the identified roadway/highway, personnel safety, and equal survey information gathered in each of the six counties within the Southwest Florida region. The following section will show an overview map of the region with each survey location identified by number. The next section after the map will detail the corresponding location information including county, approximate address, observation direction(s), and a Google Maps picture. 1 P a g e

35 Page 35 of 51 Florida Supplemental Environmental Project How to Guide LEPC Key Points concerning SEPs: LEPC s through their board members, should provide outreach to facilities to ensure they are aware of the option to fund a SEP o Contact the facility upon notification of possible Federal EPA interaction o Ensure the facility understands the decision is ultimately up to them o The Federal EPA may accept or deny the SEP, we are only there to assist in the process If accepted by the Federal EPA, the facility can direct penalty funds by submitting a SEP to the local community, instead of the US Treasury. Essentially, only a Pollution Prevention SEP (one that eliminates or dramatically reduces the potential pollution; like changing the process at a facility to no longer use the chemicals of concern) will give a facility a dollar for dollar mitigation. o The original monetary fine may be mitigated down to 25% o Up to 75% of the remainder will be the SEP o Final determination will be made by the Federal EPA LEPC s through their board members, should research response agencies in their area of responsibility that might benefit from an SEP in accordance with EPA guidelines o Contact Local Responders o Fire Department and Haz-Mat units o Police and Sheriff Departments o City/county responding agencies o City water/waste water departments Remember there should be a relationship between the facility chemical release and the SEP o Consider all factors of the chemical release o Identify how the SEP might better enhance public safety o Facility preparedness o Emergency Response o Transportation & Evacuation o Shelter in place, local school etc. Consider multiple SEP Budgets o Plan for a High, Medium and Low budget costs o Based upon severity of release o Prior fines from other Regions

36 Page 36 of 51 A Supplemental Environmental Project (SEP) is an environmentally beneficial project that a respondent agrees to undertake as part of an enforcement action settlement. A SEP must improve, restore, protect, or reduce risks to the public and or the environment, with focus on ensuring first responders are prepared and aware of the chemicals stored at the facility. Characteristics of SEPs Because SEPs are part of an enforcement settlement, they must meet certain legal requirements. There must be a relationship between the underlying violation and the human health or environmental benefits that will result from the SEP. A SEP must improve, protect, or reduce risks to public health or the environment. The SEP must be undertaken in settlement of an enforcement action as a project that the violator is not otherwise legally required to perform. Using a SEP to bring a facility into compliance with Recognized and Generally Accepted Good Engineering Practices (RAGAGEP) will not be approved. Categories of Acceptable SEPs EPA has set out eight categories of projects that can be acceptable SEPs. To qualify, a SEP must fit into at least one of the following categories: Public Health: SEPs may include examining residents in a community to determine if anyone has experienced any health problems because of the company's violations. Pollution Prevention: These SEPs involve changes so that the company no longer generates some form of pollution. For example, a company may make its operation more efficient so that it avoids making a hazardous waste along with its product. Pollution Reduction: These SEPs reduce the amount and/or danger presented by some form of pollution, often by providing better treatment and disposal of the pollutant. Environmental Restoration and Protection: These SEPs improve the condition of the land, air or water in the area damaged by the violation. For example, by purchasing land or developing conservation programs for the land, a company could protect a source of drinking water. Emergency Planning and Preparedness: These projects provide assistance to a responsible state or local emergency response or planning entity to enable these organizations to fulfill their obligations under the Emergency Planning and Community Right-to-Know Act (EPCRA.) Such assistance may include the purchase of computers and/or software, communication systems, chemical emission detection and inactivation equipment, HAZMAT equipment, or training. Cash donations to local or state emergency response organizations are not acceptable SEPs.

37 Page 37 of 51 Assessments and Audits: A violating company may agree to examine its operations to determine if it is causing any other pollution problems or can run its operations better to avoid violations in the future. These audits go well beyond standard business practice. Environmental Compliance Promotion: These are SEPs in which an alleged a violator provides training or technical support to other members of the regulated community to achieve, or go beyond, compliance with applicable environmental requirements. For example, the violator may train other companies on how to comply with the law. Other Types of Projects: Other acceptable SEPs would be those that have environment merit but do not fit within the categories listed above. These types of projects must be fully consistent with all other provisions of the SEP Policy and be approved by EPA. Quite often, for EPCRA related cases, the Emergency Planning and Preparedness is a good choice. The proposal needs to include item description(s) and costs and there is a SEP completion document that must be submitted to the USEPA PROJECTS NOT ACCEPTABLE AS SEPs The following are examples of the types of projects that are not allowable as SEPs. This list is not exhaustive. General public educational or public environmental awareness projects (e.g., sponsoring public seminars, conducting tours of environmental controls at a facility, or promoting recycling in a community)-some training is acceptable- IF it completely focuses on the responders Contributions to environmental research at a college or university Cash donations to community groups, environmental organizations, state/local/federal entities, or any other third party Projects for which the defendant does not retain full responsibility to ensure satisfactory completion Projects which, though beneficial to a community, are unrelated to environmental protection (e.g., making a contribution to a non-profit, public interest, environmental or other charitable organization, donating playground equipment, etc.) Studies or assessments without a requirement to address the problems identified in the study (except as provided for in Section V.E above) Projects which the defendant, SEP recipient, or SEP implementer will undertake, in whole or in part, with federal loans, federal contracts, federal grants, or other forms of federal financial assistance or non-financial assistance;

43 MEETING SUMMARY OF THE STATE EMERGENCY RESPONSE COMMISSION (SERC) Page 43 of 51 JULY 17, 2015 The State Emergency Response Commission (SERC) met on July 17, 2015 at the Hilton Cocoa Beach Oceanfront Sawgrass Room in Cocoa Beach. The meeting summary below was the result of discussions and dialogues ensued at both the July 16, 2015 meetings of SERC s Training Task Force and the LEPC Staff and Chairs. The SERC meeting was chaired by Marco Island Fire Chief, Mike Murphy. The meeting was called to order at 10:00 a.m., then the Pledge of Allegiance and roll call of SERC members was conducted. Introductions of the audience immediately followed. Approval of the April 10, 2015 Meeting Minutes The meeting minutes of the April 10, 2015 SERC meeting was approved unanimously. New Business Local Emergency Planning Committee Appointments: Ms. Kate McMillian requested approval of membership updates recognized for each LEPC. The requested membership changes for LEPC District 9 were: 1. Primary Member Chief Edwin M. Dwyer, Jr., Estero Fire Rescue District 2. Primary Member Kimberly Rider, Enterprise 3. Alternate Member Melisa Shivers, Glades Count Emergency Management (Angela Colgrove) The request for LEPC membership appointments were approved unanimously. Reports: Report from SERC s Training Task Force (TTF): The following highlights of the April 9, 2015 TTF meeting were identified by Subcommittee Member Chief Mike Murphy. Chief Murphy gave a recap of the April 9, 2015 TTF meeting. He also announced that Don Sessions will be retiring and recommended that he be recognized at the October SERC meeting. Chief Murphy then announced that the 2016 HazMat Symposium planning process has begun and that Jonathan Lamm would be still the Coordinating Officer for the HazMat Symposium. The goal is to be able to open registration during the second week in December. It was announced that the Guidelines for Hazardous Materials Training were presented to both the TTF and LEPCs. Changes included integration of DOD with HazMat Teams within the guide book. 1

44 MEETING SUMMARY OF THE STATE EMERGENCY RESPONSE COMMISSION (SERC) Page 44 of 51 JULY 17, 2015 Mark Tumlin asked whether there were any issues with the guide book. Chief Murphy explained that there were a couple of issues raised; however, they have been resolved. David Mica inquired when the next update process would take place. Mr. Wotherspoon identified that this guide was for 10 years; however, he invited Mr. Tumlin to share any comments that he may have and will see about potential for incorporation. It was announced that the competency regulation changes will take effect by January 1, 2016 for firefighters. The competencies also apply to other disciplines, such as EMS, law enforcement, etc. Ken Wolfe asked whether FDEM had been identified within the document as part of incident command. General consensus was affirmative. It was noted that the guidelines document can be changed relatively easily, with the exception of the training check-off lists. Hazard Analysis Contract Working Group Report: Mr. Dwayne Mundy noted that the Hazard Analysis Work Group met on June 3 rd and the hazard analysis updates were completed. He noted that there was a 100mb limit with uploading documents to the portal. All of the hazard analyses would be placed in one place. There was ongoing work with ESRI to convert files to electronic database accessible in order to be compatible with other programs. It was announced that training will be made available at the FEPA Conference. Tabs for both facilities and chemicals will also be created. Also, there will be sections requiring the following information: 1. Do you have a HazMat Team? 2. What is the frequency of shipments? 3. What is the mode of shipments? It was noted that there will be other sections and it will be recommended that all facilities submit a site plan. If there are any questions, please contact Dwayne Mundy. Supplemental Environmental Project (SEP) Report: DEM presented the SEP report. DEM explained that decision on potential SEPs was entirely made by the facility. Rick Delp inquired whether multiple SEPs could be selected. Mr. Wotherspoon confirmed that multiple SEPs could be selected. Financial Status Report: Mr. Wotherspoon explained that the SERC agenda materials contained numerous tables and graphs depicting program revenues and expenditures over the last several years. 2

45 MEETING SUMMARY OF THE STATE EMERGENCY RESPONSE COMMISSION (SERC) Page 45 of 51 JULY 17, 2015 Hazardous Materials Incidents Reports: It was explained that detailed listings of Section 304 investigations, fixed facility and transportation-related hazardous materials incidents were prepared and included with the agenda materials to describe incidents occurring between the period of March 1, 2015 and May 31, Such reports included documentation of these incidents and portrayed the number of persons evacuated, injured or deceased down to the LEPC District and ultimately county levels. Update on Staff Activities and Reports by Section: Mr. Wotherspoon noted that a recommendation was made to go to a Co-Chair process with FDEP and FDEM. After discussion a motion was passed to approve FDEP as Vice-Chair and not go to a Co-Chair process. Also, consider DOE s membership request at the October SERC meeting. Mr. Wotherspoon explained that various graphics were provided within the SERC Agenda materials to depict various staff functions and initiatives. These included: Annual enumeration of statewide Hazardous Materials Incident Reports for January 1, 2005 through May 31, 2015; and Section 112(r) Stationary Sources Risk Management Plans Update on LEPC Activities: Newly elected LEPC Chair Richard Delp noted that the same topics were discussed at the LEPC Staff & Chairs Meeting held on July 16 th. 3

46 MEETING SUMMARY OF THE STATE EMERGENCY RESPONSE COMMISSION (SERC) Page 46 of 51 JULY 17, 2015 The following are the tasks identified by LEPC District 9 staff for the period of December 2014 to February 2015: Administrative matters involved discussing and approving updates to the LEPC s membership. Another Administrative matter involved the discussion and approval of the SWF LEPC s 2015 Comprehensive Emergency Management Plan update. Brian Dean of Sunshine 811 gave a presentation on the Sunshine 811 system. He explained how Sunshine 811 is the one call center for the entire State of Florida. He presented the five steps to safe digging that can save time. Mike Beha, Homeland Security Exercise Coordinator for FDEM gave a presentation on what SERT TRAC had to offer as to finding trainings and also be able to post upcoming trainings. He explained that if the training is offered by the State there isn t any charge. OTHER BUSINESS: USCG HazMat Response: Chief Murphy explained that he has been working on this issue since He has been working with Captain Forest Willis of the USCG and he felt that significant progress has been made. He explained that the next step would be to draft an Memorandum of Understanding (MOU) between USCG/FDEM/FFCA and task the Training Task Force (TTF) with creating the training and operational protocols with the USCG. While reimbursement of USCG has been already established, local reimbursement has yet to be determined. Chief Murphy stated that he felt that expenses could be recovered under the USCG regulations. The SERC passed a motion to move forward with the development of the MOU process. Chemical Facility Anti-Terrorism Standards Program: Mr. Wotherspoon presented the item and after discussion it was noted that there needed to be a way to see if any of the facilities overlap with the RMP program. Discussion on new RPC/LEPC Boundaries: Mr. Wotherspoon explained that due to the recent legislative ruling, Withlacoochee RPC/LEPC was eliminated. He stated that at some future date there will be a discussion of removing the district numbers from the LEPCs and just have the LEPC s go by their boundaries. 4

It was recommended that each LEPC decide independently. Mr. Wotherspoon suggested that this issue would be only an informational item for SERC, no action would be needed. Next Meeting: It was announced that the next SERC meeting was scheduled for October 8-9, 2015 in Destin, Florida. Adjournment: The SERC meeting was adjourned at 12:01 p.m. 5
