D Meeting Date: June 24, 2015 TOWN OF MORAGA STAFF REPORT_ To: Honorable Mayor and Councilmembers From: Ellen Clark, Planning Director Subject: Consider Resolution Authorizing the Town Manager to Execute a Professional Services Contract with Amy Skewes-Cox in an Amount Not to Exceed $275,000 to Complete the Saint Mary s College Campus Master Plan Environmental Impact Report (EIR) Request Consider Resolution Authorizing the Town Manager to Execute a Professional Services Contract with Amy Skewes-Cox in an Amount Not to Exceed $275,000 to Complete the Saint Mary s College Campus Master Plan Environmental Impact Report (EIR) Background The current Saint Mary s College Campus Master Plan and EIR were approved by the Town of Moraga in Since 1990, three minor revisions to the Plan have been adopted and a number of facilities proposed under the 1990 Plan have been approved by the Town and constructed. In 2002, the College prepared a detailed Facilities Master Plan that included an extensive public outreach process, analyzed academic space needs, and established implementation priorities. The Facilities Master Plan served as an implementation tool for the 1990 Campus Master Plan, and therefore was not formally adopted by the Town. SMC began a process to update the 1990 Campus Master Plan in The overall goal of the update is for the College to identify future facilities needed by the campus population, including facilities in support of academic programs, athletic programs, and campus life more generally; as well as constraints and opportunities presented by natural resources and other physical conditions through a comprehensive planning process. The Master Plan is subject to review and approval by the Town of Moraga, who will also act as the lead agency for a comprehensive Environmental Impact Report (EIR). 1

2 The Master Plan is still under development, with publication of an initial draft expected in September The College has retained MIG, a Berkeley-based planning consultant to assist with development of the Plan. Discussion Campus Master Plan Update Several key elements of the Master Plan have been completed including adoption of a Vision and Strategic Direction under the leadership of President Donahue in May , and completion of background technical studies. The College has also developed a list of near-term and longer-term projects to be included in the Master Plan, included in Attachment C. Near-term projects, titled Phase 1, are those expected to be completed within approximately five years, and include: A new 60,000 square foot information and learning center. A new 300 space parking structure. Remodel/repurposing of Saint Albert Hall, an existing facility, to academic uses including classrooms and faculty offices. Remodel and expansion of McKeon Pavilion, SMC s existing basketball arena, to add a new Student Athlete Performance Center and entry foyer. Longer term projects, titled Phase 2 listed in Attachment C are those expected to be built in the next five to 20 years. Together with the short-term projects, the long term projects and program-related elements will comprise the Master Plan and will define the exact scope of the project to be evaluated in the EIR. Because the short-term projects are relatively well-defined, the EIR will serve as a joint Project and Program EIR, providing more detailed review and mitigations for the short-range projects to minimize the amount of subsequent CEQA review that may be necessary. The long-range projects will likely require project-specific analysis as they are brought forward for review by the Town. Although the Master Plan will be comprehensively updated, the College does not envision major changes or expansion of existing enrollment or programs in the near future, with new facilities principally intended to serve the needs of the existing campus population. Consultant Selection Staff developed a shortlist of four qualified consultants, experienced in similar environmental review of campus projects, who were invited to submit proposals in a Request for Proposals issued on May 7, The Town received three proposals in response to the RFP, and conducted interviews with all three firms on June 11, One representative from Saint Mary s College and one from the College s consultant team, MIG, participated in the interview along 1 The Strategic Vision is available on-line at 2

3 with Town staff, with the final selection to be made by the Town. There was consensus, based on the proposals and interviews to select Amy Skewes-Cox to prepare the EIR. Amy Skewes-Cox has provided on-call services to the Town since 2012, and was the consultant assigned to conduct recent CEQA analysis for the Via Moraga and Rancho Laguna projects, as well as providing assistance on the Bollinger Valley EIR. Ms. Skewes-Cox has completed EIRs for the College of Marin, University of California Santa Cruz, and San Carlos School District. EIR Scope and Schedule The draft EIR scope and schedule is included in Attachment B. As noted it includes release of the Draft EIR in approximately late December, 2015; and the Final EIR in April, 2016, to coincide with the expected timing of hearings for approval of the Campus Master Plan. Both the EIR process and the Master Plan update will include a number of opportunities for Town and public review and comments. The Master Plan update anticipates broader community meetings and four study sessions, in addition to public hearings on the Master Plan. The CEQA scope includes two Scoping Meetings, which will provide an opportunity for the community to provide input on the CEQA issues to be studied in the EIR, as well as a meeting during the public review period for the Draft EIR. The schedule is expected to be refined and updated over the next several weeks, and all public meetings will be well advertised and noticed to ensure a high level of participation. Fiscal Impact As the lead agency, the Town will execute the contract and direct the consultant s work, with all costs for consultant services to be borne by Saint Mary s College. Alternatives 1. 6 BEFORE THE TOWN COUNCIL OF THE TOWN OF MORAGA In the Matter of: Authorizing the Town Manager to Execute a Professional Services Contract with Amy Skewes-Cox for a Total Amount Not to Exceed $275,000 for Completion of the Saint Mary s College Master Plan Environmental Impact Report ) ) ) ) ) ) ) Resolution No WHEREAS, in 2009 the Town adopted the Saint Mary s College Campus Master Plan and certified an Environmental Impact Report (EIR) for the project, which has governed development of campus facilities since that time; and WHEREAS, in 2012 Saint Mary s College initiated a comprehensive update of the Campus Master Plan, which will address campus facilities and programs for the next approximately 20 years; and WHEREAS, the updated Master Plan is subject to review and approval by the Town of Moraga, including consideration of review pursuant to the California Environmental Quality Act; and WHEREAS, the Town distributed a Request for Proposals to four qualified CEQA consulting firms with experience in conducting environmental review for similar projects and; WHEREAS, the Town received three proposals and conducted interviews with all three firms; and WHEREAS, based on the review of the proposals and the interviews, the Town selected Amy Skewes-Cox as the preferred consultant to complete the Campus Master Plan EIR; and WHEREAS, Amy Skewes-Cox has over 34 years of experience as a CEQA consultant and has prepared EIRs for a number of similar campus master plan projects, and has been retained by the Town since 2012 to provide on-call CEQA services. NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Moraga hereby authorizes the Town Manager to execute a professional services contract with Amy Skewes-Cox for an amount not to exceed $275,000 for consultant services to complete the Saint Mary s College Campus Master Plan EIR; and Resolution No. XX June 24, 2015

7 BE IT FURTHER RESOLVED that, in accordance with the Town s adopted Master Fee program the applicant (Saint Mary s College) shall bear the full cost to complete the EIR. 9 Chapter III WORK PROGRAM This chapter outlines the detailed work program that the EIR team will follow. The work program and schedule outlined in this proposal are predicated on the following assumptions: The Skewes Cox team will be responsible for public noticing and mailing of environmental documents to the Office of Planning and Research (OPR). The Town of Moraga will be responsible for posting the CEQA documents on the Town s website and for distributing the NOP to the surrounding neighbors. Any additional technical studies to be prepared by our team beyond those we have identified herein will require revisions to the proposed scope and budget which are assumed to be addressed prior to the start of Phase II. We will submit the necessary number of copies to OPR and assume that CDs (with summary text) will be used for the Draft EIR submittal. The project will start on or near July 6, 2015 and be completed no later than November The proposed schedule will be contingent on timely receipt of project description materials and background documents, as well as Town staff comments on the various memos, work products, and Administrative Drafts of the Notice of Preparation and EIR, Draft EIR, and Final EIR described in this proposal. The proposed schedule may require revisions related to any unexpected delays that are outside of our control. Should any changes to the project description occur after work on the EIR is begun, a revision to the proposed scope and budget may be required. Any comments on the CEQA documents by Town staff will be consolidated into one comment copy to avoid conflicts among comments. Any comments on documents will be done using Microsoft Word and tracking, and will not entail comments in a pdf format. The Town will provide a clear site plan in pdf format and a written description of the project identifying locations and sizes of all new buildings, uses, estimated number of new students/staff/faculty, types and sizes of playing fields, landscaping provisions, number of students at full capacity, on site parking provisions, and access. We would also request a copy of any landscape plans, grading plans, and utility plans if available. 17

10 PHASE I MASTER PLAN INITIATION AND CONCEPT DEVELOPMENT TASK I-1 PROJECT INITIATION AND COORDINATION WITH TOWN STAFF We will begin the CEQA process by meeting with Town staff, Saint Mary s College staff, and the Master Plan Consultant Team to coordinate the scope of work, deliverables, and schedule, and to determine protocols for contacting all parties. At this time, we will request copies of any new available project description data and technical information, and address any other relevant CEQA issues. We propose that some members of the CEQA team attend this meeting. In this way, the sharing of information can be described so that it flows smoothly during the EIR preparation. At this kick off meeting, we can review the proposed schedule and the roles that everyone will play. Communication protocol can also be discussed. We may suggest that the Town have the Town attorney in attendance at this meeting also, but this can be discussed further. TASK I-2 ASSEMBLE BACKGROUND INFORMATION We will work closely with Town staff and others to assemble a library of background materials and will create a list of such materials that can be continually adjusted through the process. This list will identify who on the EIR team has been provided the relevant documents and when any revisions are being made. Documents are expected to include those already completed such as the Vision and Strategic Direction Report, the Assets Mapping and Summary Report, and other specific studies completed by the Master Plan Consultant Team such as background biological, cultural, noise, traffic, hydrological, geologic, and other studies that will be especially relevant for the EIR analysis. TASK I-3 SITE VISITS An initial site visit by Ms. Skewes Cox will be coordinated with the start up meeting (Task I 1 above). Many EIR team members will want to do their own site visits (obtaining the necessary permission) for such topics as biology and hydrology. At this time, we are assuming this first site visit will require one half day and will include Saint Mary s College staff, some members of the Master Plan Consultant Team, and Town staff. This site visit will allow the EIR team to become familiar with the campus and to ask questions while there. The first site visit will be attended by Amy Skewes Cox, Natalie Macris, and Kim Butt of Interactive Resources. TASK I-4 MEETINGS WITH TOWN STAFF AND CAMPUS MASTER PLAN TEAM We assume that at least two meetings (in addition to the startup meeting) will be required with Town staff and members of the Master Plan Consultant Team during Phase I. At this time, we propose that Amy Skewes Cox and Natalie Macris attend two meetings in the Town of Moraga or on the Saint Mary s College campus. Additional conference calls can be arranged if these are needed. We assume that each meeting will be 2 hours in duration. Fehr & Peers has included two meetings in their proposed budget. 18

11 TASK I-5 REVIEW BASE MAPS AND TECHNICAL STUDIES A. TECHNICAL STUDIES A number of studies have been completed by the Master Plan Consultant Team. We will review these studies, along with the base maps that have been prepared by the Consultant Team. This review will then feed into the next task below. At this time, based on information contained in Attachment B of the Request for Proposal, we assume there will be technical studies related to the following topics: Existing Infrastructure Biological Resources Cultural Resources Historic Resources Noise and Vibration Traffic Circulation, Mobility, and Parking Hydrology and Drainage Stormwater Quality Sewer and Water Capacity Air Quality and Greenhouse Gas Emissions If additional studies become available, we would have to adjust the budget for this task. B. BASE MAPS We assume that a number of base maps have been prepared by the Master Plan Consultant Team and that we would be provided with these in pdf format. We would also request at least two copies of one to two base maps in hard copy, printed at 11 by 17 inches or 24 by 36 inch format if possible. C. TRANSPORTATION INITIAL PEER REVIEW Fehr & Peers will conduct an initial peer review of the Master Plan team s transportation impact study, including the associated Draft Master Plan Circulation Element document and all provided appendices to both documents, to assess the appropriateness and accuracy of the information, as well as to assess whether the scope of the off site impact analysis is adequate. It is assumed that all relevant technical appendices will be provided to document the data, analysis assumptions, and analysis. Specifically, Fehr & Peers will review and assess the following items: Adequacy of the existing conditions data. Accuracy of the existing roadway network information, including intersection geometries and signal timing/phasing assumptions. Trip generation (both typical day by phase and special events, including mode choice) and trip distribution estimates. Adequacy of the study area (intersections, roadway segments, and freeway segments). 19

12 Assumptions regarding future land uses and transportation system improvements and resulting traffic projections, including review of the model files used to develop future year forecasts. Accuracy of intersection level of service calculations (it is assumed that the electronic files will be provided). Accuracy of the parking supply and demand analysis. Identification of project impacts in relation to significance criteria, and use of appropriate significance criteria for the Town of Moraga. Adequacy and feasibility of the proposed transportation improvements and mitigation measures, including physical and operational characteristics of roundabouts at the campus gateway on St. Mary s Road and the internal T intersection. Adequacy of documentation (description of all assumptions, adequate technical appendices, etc.). As part of the Fehr & Peers peer review, they will observe AM and PM peak hour conditions at the campus entrance and adjacent intersections (St. Mary s Road /Rheem Boulevard and St. Mary s Road/Bollinger Canyon Road), to field verify the Master Plan traffic consultant s description of conditions in this area. Fehr & Peers will prepare a brief memo summarizing the results of the peer review and identifying any deficiencies in data or analysis requiring correction or clarification by the Master Plan team, as well as any recommended additional analyses (such as additional off site analysis locations, special events scenarios, etc.). Fehr & Peers will discuss the findings with the Skewes Cox team and Town staff, and prepare revisions to the peer review findings if so directed. (This applies primarily to recommended additional off site analysis, if any, which may be subject to Town staff discretion.) TASK I-6 ADVISE TOWN ON POTENTIAL ADDITIONAL WORK FOR PHASE II Each member of the EIR team who has reviewed a technical study per Task I 5 will prepare a memo to the Town identifying what, if any, shortcomings were identified in their review of the technical studies. The memo will clearly outline what additional tasks may be necessary to fulfill the needs of the EIR analyses. For example, if we find that some of the recommended mitigation measures may be vulnerable to challenge as deferred mitigation (especially for the project level component of the analysis), we would state what additional work would be needed to avoid deferral. Similarly, if any of the CEQA criteria have not been adequately evaluated, we may either recommend additional work by the Master Plan Consultant Team or suggest that the EIR team members adjust their scope for Phase II to cover the tasks still needed. Having not seen the studies at this point, it is very difficult to know what may come out of this task, but we have made our best guess at the time required for this work. 20

13 TASK I-7 PREPARE DRAFT PROJECT DESCRIPTION Ms. Skewes Cox, working closely with Ms. Macris, will prepare a detailed project description for review and approval by both Town staff and the Master Plan Consultant Team. Because the EIR will be both a Program EIR and a Project EIR (for specific components), the project description will distinguish between the program and project aspects of the Master Plan and explain the level of detail for each. We used this approach in our EIR on the College of Marin campuses. As part of this task, we would suggest a refinement of Table 1 above that we have included in our proposal. The project description will also address many other project components other than just square footage of new construction. We assume that digital and hard copies of the following plans (with number of copies needed shown in parens) will be provided in full set scale as background for the project description: Base topography (2) Grading plan (3) Tree removal plans (2) Base site plan showing building layouts, access points, parking, landscaping, and playing fields (7) Utility plan (2) Building elevations (if available, or massing drawings by architects) (3), in both hard copy and digital format for those project address at project level Landscaping plans (2), if available, especially as related to screening of buildings in areas where significant tree removal is proposed On site vehicle circulation plan (including emergency access) (2) We would also request digital copies of the above graphics (pdf or Adobe Illustrator format) to be incorporated into the EIR. A full list of data needs is provided in Appendix B. Based on materials provided by the Town, we will prepare graphics necessary for an adequate project description (e.g., Regional and Project Location, Site Plan, etc.) and for an adequate assessment of environmental impacts. Our budget assumes that all graphics will be 8.5 by 11 inches and black and white, except for up to eight graphics that are assumed to be color graphics that are 8.5 by 11 inches. The project description section of the EIR will identify the following: Size and location of project site. Defined area of disturbance for each new building that includes building envelope (which is assumed to include likely surrounding construction zone). General size and height of new buildings (and if available, any proposed elevations or massing drawings). Projected on site student and staff population (both faculty and staff). 21

14 Usage for special events (timing and frequency for such elements as use of the stadium, etc.). On site natural features, such as vegetation. Proposed drainage provisions, including on site detention. Revegetation plans and proposed vegetation removal. Proposed grading (cut and fill volumes, etc.). Lighting plans, if available. Alternative energy and energy conservations measures (summarized). Access roads and emergency access provisions (external and internal). Staging areas for construction and types of construction equipment to be used (needed for noise analysis), and surge space that may be needed for relocated classrooms or other facilities, as needed. Utility line extensions and new utility corridors (including mapping). Total net new area of impervious surface to result from new construction. Timing and staging of project. Parking and fencing (with emphasis on total parking to be provided at completion). College s objectives for the project. Summary of required permits. This task assumes one round of edits after Town review, requiring no more than 8 hours of Ms. Skewes Cox s time. Please note that we are requesting that formal Town approval of our draft of the project description be completed prior to our starting the EIR analysis. It is critical that the Town understands that analysis of the project will have to be redone if the project changes during the EIR process. We would like to minimize changes to the scope of work and budget as much as possible. TASK I-8 REFINE PHASE II SCOPE OF WORK AS NEEDED This task includes revising the scope of work as presented for Phase II based on the review of the technical reports, and based on any changes to the project description that may occur. We assume that the contract with the Town will be divided into Phase I and Phase II so that necessary changes may occur. 22

15 PHASE II EIR PREPARATION TASK II-1 ADDITIONAL REVIEW OF MASTER PLAN CONSULTANT TEAM STUDIES A. GENERAL APPROACH Depending on the results of Task I 5 above, this task may entail very little time or quite extensive time. We have made an approximation of the time required for this task, but we would highly encourage the Town to allow a revision of this scope/budget once Task I 5 has been completed. If additional work is completed by the Master Plan Consultant Team, we will assess the new studies and use these in the EIR analyses. B. TRANSPORTATION PEER REVIEW If necessary based on the initial peer review in Task I 5, Fehr & Peers will conduct a second peer review of the Master Plan Consultant Team s updated transportation impact study, including the associated updated Draft Master Plan Circulation Element document and all provided appendices to both documents, as amended. Fehr & Peers will revisit all of the items addressed in the initial peer review, focusing particular attention on potential deficiencies, clarifications, and recommended additional analyses identified in the initial peer review. It is assumed that all relevant technical appendices will be provided to document the data, analysis assumptions, and analysis. The budget for this task is estimated based on a small to moderate amount of additional information and analysis in the second submittal; if a large amount of additional work arises from the initial peer review (for example, more than two additional intersections, or assessment of alternative scenarios such as special events), a budget amendment may be needed. Fehr & Peers will prepare a brief memo summarizing the results of the peer review and identify any outstanding deficiencies in data or analysis requiring correction or clarification by the Master Plan Consultant Team. The budget for this task assumes no substantial additional information will be needed from the applicant. If additional work is needed that necessitates a third round of peer review, a budget amendment will be needed. TASK II-2 SCOPING MEETINGS We have included two scoping meetings in our scope of work due to the complexity of the project and the fact that many people may be interested in attending. We suggest that one meeting be held on a weekday evening and a second meeting be held on a Saturday. These meetings would allow the public to comment on CEQA topics that they would like addressed in the EIR. We will make a presentation about the project to be evaluated, using maps provided by the Town and the Master Plan Consultant Team, and briefly explain the CEQA process and topics to be addressed. The meeting will then be opened to public comments and notes will be taken. These notes will be summarized in the EIR. We would ask that Town staff assist in notification of this meeting and the arrangements for a meeting space. Ms. Skewes Cox can make the formal presentation related to the 23

16 EIR. We would suggest that Town staff and/or members of the Master Plan Consultant Team begin with a short presentation on the project itself, but that this presentation be limited to no more than 15 or 20 minutes. This presentation would be followed by Ms. Skewes Cox explaining the CEQA process and the topics to be addressed. A handout will be provided for those who want to comment in writing rather than orally at the meeting. It is also a good idea to have large scale drawings of the project on display in the meeting room so that people can view these before and after the meeting. We assume that each scoping meeting will be no more than 2 hours in duration. At this time, we propose that only Ms. Skewes Cox attend the scoping meetings, but if the Town would like additional team members to attend, this can easily be arranged. TASK II-3 NOTICE OF PREPARATION AND CHECKLIST We will prepare the Notice of Preparation (NOP) for the EIR and make one round of edits based on Town comments. We suggest that the NOP include a brief Initial Study Checklist that will check the boxes that are relevant to the EIR analysis. For those topics to be in the EIR, we will explain that very briefly. For those topics that don t apply, we will also provide an explanation of why this is the case. Digital copies of the administrative draft NOP/Checklist will be prepared for Town staff to review. We will revise the NOP/Checklist and distribute this, as needed. We assume that the Town will be responsible for mailing the NOP/Checklist to neighbors. We have included the cost of printing 20 copies of the NOP/Checklist. We also assume that the Town will post the NOP on the Town s website. At this time, we assume that the EIR will cover all topics except the following topics that will be dismissed in the NOP: agricultural/forestry resources and mineral resources. We may also be able to eliminate the topic of population and housing, since no housing would be displaced or removed by the project. The issues of growth inducement would be addressed in the CEQA considerations chapter of the EIR. All other CEQA topics will be shown as being addressed in the EIR, with some specific criteria not being addressed that are not relevant (e.g., aircraft safety). The comment period for the NOP will be 30 days, and we will incorporate comments into an appendix of the EIR in summary format. The EIR will address NOP comments in the EIR analysis, as appropriate. TASK II-4 ADMINISTRATIVE DRAFT EIR The EIR team will prepare the Administrative Draft EIR, including all text, graphics, and footnotes, for review by Town staff. The content and format of the EIR will be presented to staff early in the process to ensure that the format meets Town standards. In particular, the EIR will fully evaluate all standards of significance identified in this document. We will provide the Town with one digital copy (non write protected) and five hard copies of the Administrative Draft EIR. We anticipate that the EIR will evaluate the topics listed below. For each topic, we will clearly identify existing conditions, potential 24

17 impacts, and reasonable mitigation measures for potentially significant impacts. The Administrative Draft EIR will also include an introduction, a summary chapter (summarizing impacts and mitigation measures), and a project description (see Task 4.A below). As required by CEQA, alternatives to the project will be evaluated as described below. Please note that we would request assistance from the Master Plan Consultant Team and Town staff in developing possible alternatives to the project. For example, alternative site plans that include fewer new buildings may be considered. The issue of alternatives is addressed further below. As both a Program EIR and a Project EIR, the document will need to identify impacts and mitigation measures that are appropriate for each level of review. In a similar situation for the College of Marin Master Plan, we focused on the adopted CEQA criteria for the impact analysis but called out specific project related impacts for that criterion when applicable. Then, mitigation measures were identified as being related to either the entire Master Plan or the specific project. A. PROJECT DESCRIPTION The project description is a critical element of the EIR because it sets the stage for the environmental analysis that follows. While we have included preparation of the Project Description in Phase I, we suggest that this Phase II work include refinement of the Project Description in case changes have occurred. This task assumes only minor revisions to the work done for Phase I. B. LAND USE This EIR section will focus on the projectʹs compliance with existing Town of Moraga General Plan policies and zoning regulations. Because the project site is already used for a college and is designated for such use, land use impacts are not expected to be significant. Compliance with policies and zoning regulations is also not expected to be of major concern. We propose to identify relevant policies of the General Plan in table format and to identify the project s relationship to these policies in the EIR, as relevant. Land use compatibility will also be addressed. Ms. Skewes Cox will complete the following tasks for this EIR section: Identify existing land uses at the site and in the immediate environs, including easements owned by East Bay Municipal Utility District and any other applicable easements. Describe applicable planning documents relevant to the project site. Assess the compatibility of the proposed changes with surrounding land uses, with secondary impacts being addressed under such topics as visual resources and noise. The reader may be referred to other EIR sections for secondary impacts. Prepare a summary table identifying the project s relationship to relevant General Plan policies and the need for mitigation measures when conflicts may be identified. Identify mitigation measures as necessary. 25

18 C. BIOLOGICAL RESOURCES James Martin of Environmental Collaborative will perform the peer review of the background studies on biological and wetland resources prepared by TRA for MIG and the project applicant and will prepare the biological resources section of the Master Plan EIR. The site includes both the developed campus and natural lands that contain suitable habitat for a number of special status species, as well as native grasslands, riparian sensitive natural communities, and jurisdictional waters. The main campus contains numerous trees that would qualify as protected trees under the Town s Tree Protection Ordinance and may support nesting birds protected under the federal Migratory Bird Treaty Act. The biological resources assessment will entail (1) initial review and compilation of existing information on resources occurring in the campus vicinity, (2) a field reconnaissance survey of the planning area to confirm the adequacy of the background studies by TRA, (3) input into the memo on the adequacy of the project applicant s studies, and (4) preparation of the biological resource section of the EIR. Tasks will include the following: Collect and review existing information on biotic resources in the campus vicinity. Information sources will include the technical background reports prepared by TRA for MIG and the project applicant, environmental documentation for specific development applications in the vicinity, wetlands mapping prepared as part of the National Wetland Inventory, records on occurrences of special status taxa and sensitive natural communities maintained by the California Natural Diversity Data Base, and information on sensitive or special status taxa available from the Town and County, the California Department of Fish and Wildlife (CDFW), and the U.S. Fish and Wildlife Service (USFWS). Conduct a field reconnaissance of the site. The field effort will be limited to a one day reconnaissance, which should be sufficient to verify mapping by TRA and evaluate existing conditions and any sensitive resource areas. No detailed field surveys, tree inventory, or wetland delineation mapping are proposed as part of this scope. Further detailed assessment may be recommended to confirm presence or absence of sensitive resources at specific locations as part of the environmental review process for future improvements if potentially suitable habitat is present. Prepare the biological resources section of the Draft EIR. Existing vegetation types, wildlife habitats, jurisdictional waters, and any sensitive natural community types on the site will be described, and potential impacts will be assessed. Where appropriate, tables and maps of special status species and other sensitive resources contained in the TRA background studies will be included in the section. The Master Plan will presumably be self mitigating through avoidance of sensitive resource areas, supplemental detailed surveys, and implementation of comprehensive compensatory mitigation programs, if necessary. Where necessary, additional policies and mitigation will be recommended to address any significant impacts on biological resources. 26

19 Respond to comments on the Administrative Draft EIR, and on public comments on the Draft EIR. A total of 8 hours is budgeted to respond to comments. If additional detailed assessment or additional time is necessary to adequately respond to comments on the Draft EIR, this scope may be expanded. ASSUMPTIONS: For purposes of this proposal, it is assumed that the background assessments prepared by TRA for the project applicant will provide a thorough inventory of biological and wetland resources on the campus property, sufficient to perform the environmental review. The scope assumes that no detailed field surveys, protocol surveys for special status species, conduct of a jurisdictional wetland delineation, or inventory of trees within the area of potential effect will be required. The scope also assumes that no detailed, compensatory mitigation plan, consultation with resource agencies, or permit application and consultation will be provided. D. VISUAL RESOURCES The project site is within an existing campus location, set within a topographic bowl (campus core) in southern Moraga. Proposed new development would generally stay within the campus core, leaving much of the undeveloped portions of the campus unchanged. The main visual issue of concern is likely to be increased light and glare, especially if playing fields are lit at night. The level of analysis for this section of the EIR is highly dependent on the level of detail available for proposed buildings when the EIR is begun. At this time, we assume that elevations will be provided for the projects that will be assessed at a project level of detail. Any relevant Design Guidelines will be discussed, especially in the context of how such guidelines are intended to minimize visual impacts from the development. Ms. Skewes Cox will complete the following tasks: Document existing visual conditions, using photographs to supplement the text, with photos taken from key viewpoint locations approved by Town staff. Assess the potential for impacts on scenic vistas and view corridors. Because the site is located within level terrain, new buildings would not be expected to have significant impacts on scenic vistas. New buildings are expected to be in scale with existing campus buildings. Existing vegetation and topography screen much of the site from view from St. Mary s Road and other locations. Identify the potential for increased light and glare from new development, especially as seen from nearby residences. For this analysis, we will especially need information on proposed lighting of fields and hours of operation of fields. Document proposed landscaping and evaluate how such landscaping may minimize potential visual impacts of new development. If specific areas for visual screening have not been identified, we will suggest these as part of the recommended mitigation measures and include monitoring for the success of such screening. Document visual changes related to the proposed buildings and evaluate how these will relate to on campus buildings as well as the scale of nearby residential development. OPTIONAL: At this time, our scope of work includes optional visual simulations, as we think these are effective tools for the public s understanding of visual impacts. However, 27

20 such simulations are only likely to be effective for the project level analysis of the EIR. If the Town desires these, we can adjust our scope of work. Also, this work is highly dependent on the design information available at the time of the EIR. We understand that MIG may also be preparing simulations but we have added this optional task if the Town wishes to have this as a more objective element from the public s perspective. The following is a scope of work for this optional task by Environmental Vision, a firm with extensive experience in providing extremely accurate simulations for new development. As an optional task, Environmental Vision will conduct a site visit to photograph the campus and specific development sites from requested ground level public vantage points using a digital single lens reflex (SLR) camera. Systematic photo documentation techniques including photo log sheets, GPS recording and basemap annotation will be employed. Using advanced computer modeling and rendering techniques, Environmental Vision will produce visual simulations showing the proposed campus project improvements superimposed on selected photographic views. The simulation images will be presented as realistic ʺbeforeʺ and ʺafterʺ views of the project site. The simulations will illustrate the location, scale and appearance of the proposed campus project improvements. The images will portray new building massing and architectural treatment such as roof and window elements as well as other visible project elements including new roads, grading, and landscaping. The level of detail shown in the visual simulations will be dependent upon the level of detail available in the project design data. Project landscaping will be portrayed at an agreed upon stage of maturity (typically shown at approximately 8 to 10 years of maturity). The simulation photographs will be selected in consultation with the EIR team and Town staff. For cost estimating purposes, a total of four (4) simulation viewpoints are included. One existing or ʺbeforeʺ and one simulation or ʺafterʺ image will be produced for each viewpoint. The visual simulations will be based on drawings and data provided to Environmental Vision (see data requirements below). The images will be formatted for printing in color on 8.5 by 11 inch or 11 by 17 inch sheets. Digital versions of draft and final images will be provided. One review/revision cycle is included; final simulations will be based on minor review comments. REQUIRED DATA: Digital format drawings are requested in CAD and pdf format, as follows: Proposed site plan showing existing and proposed building footprints and roads, property line, etc. Existing contours and proposed grading. Floor plan and elevations drawings for proposed building(s). Landscape plan. Information describing exterior building materials and color treatment. 28

GEOLOGY, SOILS, AND SEISMICITY BASELINE Environmental Consulting will prepare an analysis of potential impacts related to geology, soils, and seismicity that may result from development of the Master Plan Update, including project level impacts from development of identified Phase I projects. The Saint Mary s College campus is located in a seismically active portion of Northern California, between the Hayward Fault to the west and the Calaveras Fault to the east. Based on current estimates, it is likely that a major earthquake on these or other regional faults will occur during the design life of Master Plan improvements. In preparation of the geology, soils, and seismicity section of the EIR, BASELINE will complete the following tasks: Describe regional and site specific geologic and seismic conditions for the campus based on review of available geotechnical reports and other technical reports for the project site. Identify sources of regional earthquakes and expected levels of seismic shaking (and related potential for ground failure) at the campus. Identify potential slope stability issues in Master Plan development areas. Describe soil conditions (including erosion hazards and shrink swell potential) at Master Plan development areas on the basis of Natural Resource Conservation Service mapping and available geotechnical investigations. Describe the regulatory framework for geology, soils, and seismicity, including state laws and local policies from the Town General Plan. Evaluate the Master Plan for compliance with local ordinances and requirements and standard geotechnical principles. Any potential impacts associated with seismicity, slope instability, or unstable soils will be described. Draft practical mitigation measures that would reduce or eliminate any identified significant impacts related to geologic, soils, or expected seismic conditions to a lessthan significant level. F. HYDROLOGY AND WATER QUALITY BASELINE Environmental Consulting will prepare an analysis of potential impacts related to hydrology and water quality that may result from development of the Master Plan Update, including project level impacts from development of identified Phase I projects. Development under the Master Plan Update will be subject to National Pollutant Discharge Elimination Program (NPDES) permitting during construction and operation. The NPDES Construction General Permit requires implementation of Best Management Practices (BMPs) during construction activities, while the Municipal Regional Permit (MRP) C.3 provisions, implemented locally through the Contra Costa County Clean Water Program, require capture and treatment of stormwater prior to discharge to storm sewers. Flooding is not likely to be an issue, as Federal Emergency 29

22 Management Agency (FEMA) mapped flooding zones on the campus are limited to the northern campus boundary, along Las Trampas Creek. In preparation of the hydrology and water quality section of the EIR, BASELINE will complete the following tasks: Perform peer review on the Hydrology and Drainage and Storm Water Quality Technical Studies prepared by Fuscoe. Using information from the technical studies and publicly available resources such as the Basin Plan, describe regional and site specific hydrologic and storm drainage conditions in the Master Plan area. Describe surface and groundwater quality in the Master Plan area. Describe the regulatory framework for storm water quality, including federal, state, and local plans, laws, and regulations. These will include local requirements, including the Moraga Municipal Code and measures from the Town General Plan related to stormwater protection. Qualitatively evaluate changes in runoff volume and quality based on construction of new buildings, roadways, and other improvements as part of Master Plan development. Describe potential water quality impacts, including discharge of urban pollutants (petroleum hydrocarbons and heavy metals associated with automobile use) from parking areas as part of Master Plan development. Draft practical mitigation measures that would reduce or eliminate any identified significant impacts related to hydrology and water quality to a less than significant level. G. HAZARDS BASELINE Environmental Consulting will prepare an analysis of potential impacts related to hazards that may result from development of the Master Plan Update, including project level impacts from development of identified Phase I projects. Hazardous materials are not expected to be a potential concern. Likely development under the Master Plan would not involve significant quantities of hazardous materials during construction or operation, and a review of state and local databases did not identify any hazardous materials release sites at or near the campus. However, development under the Master Plan could result in impacts to other public health and safety concerns, such as wildfire hazards and emergency access. In preparation of the hazards section of the EIR, BASELINE will complete the following tasks: Review available regulatory agency records to describe known and potential hazardous materials issues at and near the project site. Describe the existing regulatory framework for public health and hazardous materials, particularly those regulations and programs that may apply to development under the Master Plan. Describe wildfire hazards in the Master Plan area, including wildfire hazard areas mapped by the California Department of Forestry and Fire Protection (CAL FIRE). 30

23 Describe emergency response and evacuation plans in the Master Plan vicinity, as well as existing programs and requirements for emergency response. Describe local policies, including policies in the Town General Plan, that address hazardous materials and other public health and safety concerns. Assess potential public health and safety impacts for future construction workers and future students and workers that could result from Master Plan development. Draft practical mitigation measures to address any identified significant impacts. H. TRANSPORTATION AND TRAFFIC Fehr & Peers will prepare the transportation and circulation chapter of the EIR, using the revised and peer reviewed transportation impact report provided by the Master Plan Consultant Team. Fehr & Peers understands that the transportation impact report will be formatted similar to the standard EIR format, with Setting and Impacts and Mitigation Measures sections that include a description of the analysis methodology, significance criteria, impacts with discussion, and mitigation measures. However, Fehr & Peers has budgeted time for editorial work to re format the chapter into the Town s desired format, including reorganizing the placement of analysis and impact statements. Fehr & Peers will respond to one round of internal Skewes Cox team review (consolidated comments) and one round of Town of Moraga review (consolidated comments), and will prepare editorial revisions if requested at each round. No new technical analysis is assumed as part of the revisions. I. NOISE BASELINE will evaluate the potential impacts related to noise and vibration that may result from implementation of the Master Plan Update, including project level impacts from development of identified Phase I projects. The primary sources of noise within the plan area include traffic on St Mary s Road and outdoor college activities such as sports, festivals, and other special events. Based on review of available information, potential noise impacts from implementation of the Master Plan include temporary increases in noise levels during the construction phase of individual projects, noise from new outdoor activity areas, and permanent noise from sources such as heating, ventilation, and air conditioning systems. In preparation of the noise and vibration section of the EIR, BASELINE will complete the following tasks: Complete a peer review of Noise and Vibration Technical Study prepared by Illingworth & Rodkin. Inc.; Describe the existing regulatory environment for noise and vibration, including policies contained in the Town of Moraga General Plan policies, Noise Ordinance, Moraga Municipal Code, and any applicable Standard Conditions of Approval; Determine the significance of any the noise and vibration impacts, both on a projectspecific level for near term projects and at a program level for future projects implemented under the Master Plan, based on the results of the Noise and Vibration Technical Study; 31
