Their popularity has been accompanied by increasing interest from policy makers, regulators and entertainment industry competitors. Some question the legality of certain aspects of DFS while others are calling for a regulatory structure to better protect consumers. This activity is causing most DFS operators to adopt more rigorous consumer protection practices. At the same time, various jurisdictions are debating whether to ban the activity; impose consumer protection regulations or bring it under the umbrella of gaming regulation. An additional concern is whether the activity violates exclusivity provisions of certain tribal compacts. This session will discuss the legal and policy issues relating to this debate and provide a forum for informed panel discussion and audience questions on the complex issues that will be a focus of legislative, legal and regulatory activity in many jurisdictions in 2016 and beyond.
