1 THE SCHOOL BOARD OF VOLUSIA COUNTY, FLORIDA MINUTES - REGULAR SESSION JUNE 28, 2011 CALL TO ORDER, PLEDGE AND BOARD MEMBER COMMENT The regular meeting of the School Board of Volusia County, Florida was called to order by Chairman Stan Schmidt at 4:00 p.m. Tuesday, June 28, 2011, DeLand Administrative Complex, 200 North Clara Avenue, DeLand, Florida. The meeting opened with the Pledge of Allegiance to the Flag followed by everyone singing Happy Birthday to Dr. Smith. Ms. Lankford shared her excitement for all those who were to receive new appointments, shared the Florida School Boards Association s What s Super About Public Schools public service announcement winning entries and encouraged all to advocate for public education. Present: Dr. Margaret A. Smith, superintendent; Mr. Ted Doran, school board attorney; and the following board members: Mr. Stan Schmidt, District 3, Chairman Dr. Al Williams, District 2, Vice Chairman Ms. Candace Lankford, District 1 Ms. Judy Conte, District 4 Mrs. Diane Smith, District 5 MINUTES Action: Approval of June 6, 2011-Workshop Session minutes and June 14, 2011-Regular School Board Meeting minutes. Motion: Moved by Dr. Williams, seconded by Mrs. Smith and carried unanimously. AGENDA CHANGES 1. Revised Consent Agenda Item 2-b-2 to include 2-b-8 Federal Programs/Grants Development Services: The Superintendent recommends approval to submit to the Florida Department of Education grant application for the Individuals with Disabilities Education Act (IDEA), Part B in two entitlement areas in the amounts of $13,723, for IDEA, Part B and $310, for IDEA, Part B Preschool for the school year and to authorize necessary budget amendments. Note: This is a decrease of $50, from basic allocations. (Fund Source: I.D.E.A [CFDA No A and A].) The chairman found the change was made for good cause. PUBLIC PARTICIPATION FOR APPROVAL ITEMS None. AGENDA AND CONSENT ITEMS Action: Approval of the school board agenda in its entirety as well as all proposed actions within the consent agenda, as follows. Motion: Moved by Ms. Lankford, seconded by Ms. Conte and carried unanimously. Curriculum and School Improvement Services 1. The School Advisory Council membership changes from Creekside Middle, Deltona Middle, Enterprise Elementary and Starke Elementary. 2. The School Advisory Council (SAC) memberships for all schools with exception to the following who will submit their membership lists in August 2011: Blue Lake Elementary, Campbell Middle, Champion Elementary, Chiles Academy, George Marks Elementary, Holly Hill Elementary, Ormond Beach Middle, Palm Terrace Elementary, Starke Elementary, Westside Elementary, and Woodward Avenue

These are the results of the SAC elections; remaining vacancies to meet statutory requirements will be filled through appointment in August when the SAC is seated. 3. Field trip for ninety Silver Sands Middle students to Springfield, Virginia and Washington, D.C., December 13-17, (Fundraising event at no cost to the district.) 4. Inter-Institutional Articulation Agreement with Daytona State College for school year , VCSB No Memorandum Agreement with the Volusia County Health Department for the provision of Hepatitis B Vaccine Series to all referred Volusia County School employees July 1, 2011 through June 30, 2012, VCSB No Consultant Memorandum Agreement with Christina Yahn, Ed Tech Consulting, LLC for the school year , VCSB No (Fund Source: Race To The Top.) 7. Fourteen pilot schools to switch the September 23 rd professional development day with August 15 th, Continuation for all school improvement plans through October 25, New inservice training components to the Volusia County Schools Master Inservice Plan that comply with new Department of Education Professional Development Protocol and recent Race To The Top requirements. 10. Acquisition of the upgraded version of Next Generation Read 180, the primary resource for our comprehensive reading program to instruct our FCAT reading level 1 and level 2 high school students. The upgrade includes student site licenses, student books, classroom libraries, teacher resource materials, online support, and professional development for the cost of $225, and is funded with FEFP dollars. 11. Acquisition of the KidzLit program for grades kindergarten through third grade to be used as a reading enrichment program at the Extended Day Enrichment Program (EDEP) sites with primary grade students beginning September The cost of $50, includes a series of three-hour training workshops for district level EDEP staff, site facilitators and select group leaders and will be funded completely by EDEP. 12. Renewal of the agreement with Behavior Change Artists, Inc. to continue providing behavioral analysis, planning, tutoring, modeling, and other behavioral services to students with disabilities and their teachers at an annual cost of $1,496, that is funded by IDEA grant funds, VCSB No Renewal of the agreement with K12 Florida LLC for an online program for Hospital / Homebound students, VCSB No The agreement covers the license, learning management system, educational products, teachers, and services at a cost not to exceed $500, (same as current year) that is funded with General Funds. The cost is determined by the number of Hospital/Homebound students enrolled in the online program and their duration in the program. 14. Renewal of the agreement with Cost Management Services, Inc. for Medicaid loss prevention and claiming services at an annual cost of $60,000.00, VCSB No Renewal of the cooperative agreement with Halifax Health Medical Center and the Department of Children and Families, VCSB No The agreement determines the responsibilities for all three parties involved with Halifax Behavioral Services. 16. Renewal of the cost reimbursable sub-agreement with the University of South Florida to support the grant entitled Project TEN: Transition Education Network an integrated services curriculum design consultant will provide full-time consultation and technical assistance to Florida school districts for students with severe disabilities, alternative education, and juvenile justice education programs. The agreement provides reimbursement for the consultant s salary, benefits, and in-state travel through a state flow through grant. Federal Programs/Grants Development Services 1. Submission to the Florida Department of Education (FLDOE) a grant application for the No Child Left Behind Act (NCLBA) Title I, Part A Improving the Academic Achievement

3 June 28, 2011 Regular Session Page 3 of the Disadvantaged in the amount of $19,255, for the school year and authorized necessary budget amendments. This is an increase of $268, from basic allocation. (Fund Source: NCLBA, 2001, Public Law ) 2. Submission to the FLDOE a grant application for the Individuals with Disabilities Education Act (IDEA), Part B in two entitlement areas in the amounts of $13,723, for IDEA, Part B and $310, for IDEA, Part B Preschool for the school year and to authorized necessary budget amendments. Submission to the FLDOE a grant application for the NCLBA Title I, Part A School Choice with Transportation and SES in the amount of $3,688, for the school year and authorized necessary budget amendments. Submission to the FLDOE a grant application for the NCLBA Title II, Part A Preparing, Training and Recruiting High Quality Teachers in the amount of $2,619, for the school year and authorized necessary budget amendments. This is a decrease of $547, from the basic allocation. (Fund Source: NCLBA, 2001, Public Law ) 5. Submission to the FLDOE an application requesting Carl D. Perkins federal support in the amount of $638, for the school year and authorized necessary budget amendments. This is a decrease of $43, from the basic allocation. (Fund Source: Carl D. Perkins Career and Technical Education Improvement Act of 2006, Public Law ) 6. Submission to the FLDOE an application for the Title III, Part A: Supplementary Instructional Support for English Language Learners (ELL) grant in the amount of $399, for the school year and authorized necessary budget amendments. This is a decrease of $131, from the basic allocation. (Fund Source: NCLBA, 2002, Public Law ) 7. Submission to the FLDOE a grant application for the NCLBA Title I, Part D Local Programs for Neglected and Delinquent Youth in the amount of $339, for the school year and authorized necessary budget amendments. This is a decrease of $28, from the allocation. (Fund Source: NCLBA, 2001, Public Law ) 8. Submission to the FLDOE a grant application for the NCLBA Title I, Part C Education of Migratory Children in the amount of $247, for the school year and authorized necessary budget amendments. This is a decrease of $71, from the basic allocation. (Fund Source: NCLBA, 2002, Public Law ) 9. Contract with A+ Tutoring, Inc. of 617 South Yonge Street, Ormond Beach, Florida whereby A+ Tutoring, Inc. will provide tutoring services to non-public school students for the school year in the amount not to exceed $290,973.00, VCSB No (Fund Source: Title I, NCLBA Public Law ) 10. Contract with Academic Resource Center, LLC of 610 Newton Road, Port Orange, Florida whereby Academic Resource Center, LLC will provide tutoring services to public school-aged children at the Children s Home Society for the school year in the amount not to exceed $23,000.00, VCSB No (Fund Source: Title I, NCLBA Public Law ) 11. The Standard Contract Format for the Title I Supplemental Educational Services Provider/District Contract with State-Approved Supplemental Educational Services (SES) Providers for the school year, VCSB No (Fund Source: NCLBA, 2002, Public Law ) 12. Submission to the FLDOE Budget Amendment #1 for the NCLBA Title I, Part C Education of Migratory Children Grant Program in the amount of $53, for the

Submission to the FLDOE a grant application continuing a network benefiting Severely Emotionally Disturbed Students SEDNET and Integrated Services Curriculum Design for the school year in the amount of $131,00.00 and authorized necessary budget amendments (Fund Source: IDEA Part B SEDNET and IDEA Part B Trust Funds). Human Resources The following as recorded in the Supplemental Minute Book (SMB) for Human Resources: 1. Listed instructional, support and managerial/non-bargaining personnel appointments, transfers, leaves of absence, resignations and separation. All vacant positions outside of the classroom and not directly related to student health and safety are subject to intensive review prior to being filled. 2. The reappointment of all tenured teachers. All reappointments are contingent upon the individual possessing and maintaining the certification necessary for his or her position. 3. The reappointment of the listed annual contract teachers. 4. The reappointment of the listed school-based non-bargaining personnel. 5. The reappointment of the listed district-based non-bargaining personnel. Financial and Business Services 1. Advertisement of the proposed tentative budget and millage rates for the school year for the purpose of advertisement in compliance with F.S Expenditures between July 1, 2011 and the adoption of the tentative budget, in accordance with F.S Budget Amendment #2 for the school year, VCSB No The May 31, 2011 Monthly Financial Report including the cash report and the capital projects report. 5. In accordance with F.S (4), authorized expenditures from all public fund sources during fiscal year for out-of-state travel or cellular phones, cellular phone service, personal digital assistants, or any other mobile wireless communication device or service, including text messaging, whether through purchasing, leasing, contracting, or any other method. 6. Current construction cost estimate is $97, and available funds are $79, (A budget amendment will be required for award of contract from the capital fund balance). 6. Change Order Number 20 (add) to the construction contract for new construction at Elementary Z (Citrus Grove Elementary), DeLand, Florida, (Hawkins, Hall & Ogle Architects), (sales tax fund balance). 7. Certificate of Final Inspection for partial reroofing at Tomoka Elementary, Ormond Beach, Florida, (A/R/C Associates), (LCIF). Technology Services 1. Acquisition of the Microsoft Enrollment for Education Solutions (EES) Faculty Desktop Education licenses and Microsoft Enterprise CAL Suite from GovConnection, VCSB No The school district will upgrade from Windows XP to Windows 7, migrate to Microsoft Office 2010, and begin using Microsoft Sharepoint 2010 for document management and workflow processes. The licensing agreement includes needed server and system upgrades; the agreement also incorporates anti-virus and other security features for the entire Microsoft platform. The total amount is $324, and is funded using the following allocations: 25% from the general fund, $81,238.68; and 75% from the capital fund, $243, Agreement with GlobalScholar for the Pinnacle Instruction platform for Curriculum and Assessment Management, VCSB No This platform supports the Achievement Series District Assessment and Scantron Item Bank; the entire platform will be incorporated together to provide teachers and leaders with a curriculum and assessment management platform that will synchronize with the current Pinnacle Grade environment. The first year total amount is $387, The annual subscription and hosting fee will be funded with general funds in the amount of $243, and Race To The Top (RTTT) funds in the amount of $143, will fund the installation and implementation of the Instruction platform. To meet minimum standards of RTTT Local Instructional Improvement System (LIIS), a curriculum management system is required. LIIS components that support and are attached with agreement includes: 1.0 Standards and Curriculum; 2.0 Instructional Practices; 3.0 Assessment and Growth; 6.0 Analysis and Reporting; and 8.0 Data Integration. 3. Renewal of the maintenance agreement with Mainline Information Systems, Inc. to provide hardware and software support for the iseries and IBM systems which support the district s Human Resource Student Information and Portal applications. This is a renewal of a general fund expense in the amount of $66, for fiscal year Renewal of the Managed Home Access and Software Upgrade Plan with SAFARI Montage which allows instructional staff to view and arrange playlists from locations

This is a renewal of a general fund expense in the amount of $28, through Acquisition of a server and associated software from SAFARI Montage for Citrus Grove Elementary School to enable remote access to the video collection. This is a capital fund expense in the amount of $2, which includes hardware warranty through Agreement with Truenorthlogic to assist in constructing Local Instructional Improvement System (LIIS) component 4.0 (Facilitator Profile) as part of the requirements for fulfilling the RTTT grant, VCSB No Truenorthlogic will serve as the Human Resources and Professional Development management systems to assist in the coordination of efforts toward improving human capital. The system integrates human resources, professional development, and student data systems that will assist with decisionmaking and overall leadership functions. The Truenorthlogic's K-12 Human Capital Management Platform is comprised of over ten modular applications built on best practices driven by Truenorthlogic s user community which would now include Volusia County Schools: 1. Performance Management Suite: a. Individual Growth Planning Management; b. Assessment & Survey Management, c. Employee Evaluation Management 2. Professional Learning Management System: a. Professional Learning Communities Management; b. Online Content & Delivery Management 3. Induction Management 4. Mentoring & Coaching Management 5. Performance Pay Management 6. Certification & Licensure Management This is a RTTT funded expense in the amount of $325, for software services, installation, and implementation. Mr. Russell expressed appreciation for his appointment to area superintendent and presented a moving tribute to retiring area superintendent, Mr. Stan Whitted, after which all those in attendance honored Mr. Whitted with a standing ovation. Board members expressed appreciation to all retiring staff.

9 June 28, 2011 Regular Session Page 9 SCHOOL BOARD POLICY 217 STUDENT APPEARANCE AND DRESS CODE Mr. Richard Kizma, chief counsel, Mr. Stan Whitted, area superintendent, and Ms. Nancy Wait, director for community information services, presented information regarding School Board Policy 217-Student Appearance and Dress Code. Mr. Kizma noted the proposed policy had previously been thoroughly discussed by the board and stated it will be reviewed in January 2012 to assess compliance. Ms. Wait shared information regarding the communication plan and the implementation phase. Board discussion ensued and included appreciation to Ms. Wait for the proactive approach. Action: Approval of School Board Policy 217-Student Appearance and Dress Code, which will be included in the district s Policy and Procedure Manual, VCSB No Motion: Moved by Ms. Conte, seconded by Ms. Lankford and carried unanimously SCHOOL DISTRICT BUDGET PRESENTATION Dr. Robert Moll, deputy superintendent for financial and business services, assisted by Ms. Stephanie Weaver, budget director, presented information regarding the school district s operating budget for Fiscal Year (FY) Dr. Moll stated this presentation was a follow-up to the May 9 budget workshop. Presentation points included: budget calendar final adoption on September 13; Volusia Florida Education Finance Program (FEFP) revenue reductions noted the continued decline from state dollars, also that Volusia was one of sixteen school districts in the state that the voters approved the.25 mills critical needs levy; certified tax roll history actual tax roll certified on July 1; Full-Time Equivalent (FTE) measures taken, through ,483 total FTE positions reduced; class size compliance information legislature redefined core courses and redistricting affects staffing; May 9 tentative reconciliation and considerations $3.5 million remaining shortfall; June 28 tentative reconciliation, additional projected cost increases and changes in projections leaves a balance of $600,000; other budget concerns McKay scholarships (House Bill [HB] 1329) which was expanded to include 504 Plans, corporate scholarships (HB 965) which are now named Florida Tax Credit Scholarships, and Choice (HB 1331) which was expanded to include D schools as well as F schools; and July 26 tentative budget hearing calculation of rolled-back rate, tentative millage rates and tentative budget. Board discussion ensued; concerns were shared regarding the expansion of McKay scholarships due to the lack of accountability for private schools to where the students might choose to transfer. Dr. Smith stated private schools were not required to have certified teachers, specific curriculum, personnel trained in exceptional student education or have any reporting requirements and noted there were currently sixty-six private schools in Volusia County that accept McKay scholarships. Dr. Moll expressed appreciation to Ms. Weaver and staff. The chairman recessed the meeting for a short break; the meeting resumed at 6:10 p.m. PUBLIC PARTICIPATION No one addressed the board. RESOLUTION DECLARING HOLLY HILL MIDDLE SURPLUS PROPERTY Ms. Saralee Morrissey, director for site acquisitions and intergovernmental coordination, stated, as required by the Interlocal Agreement, district staff had discussed the Holly Hill Middle property with the City of Holly Hill and the City has shown interest in purchasing the property. She stated declaring Holly Hill Middle as surplus property was a first step to selling the property. Board discussion ensued. Action: Approval of Resolution , recorded in the SMB for Resolutions. Motion: Moved by Ms. Conte, seconded by Dr. Williams and carried unanimously.

10 June 28, 2011 Regular Session Page 10 ITEMS FROM SCHOOL BOARD MEMBERS, SUPERINTENDENT OR BOARD ATTORNEY FOR DISCUSSION, ANNOUNCEMENT OR APPROVAL Board members enjoyed the retirement celebration for retiring Area Superintendent Stan Whitted, stated it was a great tribute to him and expressed appreciation for his many years of service. Ms. Conte, Mr. Schmidt and Dr. Williams re-capped the redistricting meetings held in their districts along with the County Council representative. Dr. Williams shared that his wife, Dr. Kathy Williams, received the Hometown Hero Award at the annual Juneteenth Banquet. Dr. Williams and Ms. Lankford attended a dinner where U.S. Senator Bill Nelson was the featured speaker. Ms. Lankford: shared information from Dr. Bonnie Sorensen, director of the Volusia County Health Department, who spoke at the Volusia Council of Governments meeting; stated the Save Our Schools March, scheduled for July 30 in Washington, DC, was specifically about children and public education; suggested school board members develop an advocacy plan; mentioned the Army s March for Success program; and attended the Orlando regional Open for Business summit with Dr. Smith. Mrs. Smith and Ms. Lankford attended the Sun Rail Public Hearing which Secretary of Transportation Prasad also attended and mentioned the positive comments regarding the project by the disabled community. Mr. Schmidt spoke at the City of Port Orange meeting regarding the high tech initiative. Dr. Smith: expressed appreciation for the birthday wishes; shared information regarding a phone call from the new Florida Commissioner of Education; and mentioned the request from the Florida School Boards Association for input on the legislative platform precipitated by the earlier legislative session the board may send recommendations to Dr. Smith who will incorporate into a preliminary list for board input and discussion at an upcoming school board meeting. Mr. Doran noted board members received information regarding Dr. Smith s annual evaluation and requested board members return comments by July 18; Mr. Doran and Chairman Schmidt will assimilate the information into one response that will be presented at the July 26 school board meeting for board approval.
