An ordinance amending the Occupational Privilege Tax Ordinance as amended, to be renamed and entitled The Emergency and Municipal Services Tax Ordinance which shall be levied upon those persons engaging in an occupation within the Municipality in accordance with the Local Tax Enabling Act pursuant to Act 511, P.I. as amended by 222 of 2005, H.B An ordinance managing rights of way within the Municipality of Monroeville; establishing a rental fee; requiring insurance and indemnification; and creating mechanisms for enforcement. 4. An ordinance establishing an Integral Part Trust to hold assets for Retiree Health Care Benefits.

BIDS AND PROPOSALS 1. Request for proposals were received and opened on Tuesday, May 2, 2006, at 10:00 a.m. for Cavitt Road Reconstruction. A tabulation sheet of the proposals received is presented to Council under separate cover. 2. Request for proposals were received and opened on Tuesday, May 2, 2006, at 10:00 a.m. for Route 130 Water Reduction Project. A tabulation sheet of the proposals received is presented to Council under separate cover. 3. Request for bids were received and opened on Tuesday, May 2, 2006, at 10:00 a.m. for Fleet Vehicles. A tabulation sheet of the bids received is presented to Council under separate cover. 4. Request for bids were received on Tuesday, May 2, 2006, for the 2006 Paving Program. A tabulation sheet of the bids received is presented to Council under separate cover. 5. Request for proposals were received on Monday, May 1, 2006, for the Website Redefined Combined Project. A report and recommendation is presented to Council under separate cover.

OLD BUSINESS Z SCOTT BELEY Applicant is requesting a one (1) lot rezoning from R-1, One-Family Residential, to R- 2T, One-Family Residential, Zoning District. The property is located at 2554 Haymaker Road at its intersection with McGinley Road. Total size of the property is.51 acres SUB SCOTT BELEY Applicant is requesting Final Subdivision Approval for a five (5) lot subdivision; to include Lot 1 of.09 acres, Lot 2 of.07 acres, Lot 3 of.08 acres, Lot 4 of.09 acres and Lot 5 of.17 acres, totaling.51 acres. The property is located at 2554 Haymaker Road at its intersection with McGinley Road. It is zoned R-1, One-Family Residential, with a proposed rezoning to R- 2T, One-Family Residential, Zoning District. The Applicant has requested withdrawal of this application ST(R) SCOTT BELEY Applicant is requesting Site Plan Approval to construct four (4), three-story residential townhouses and associated site improvements. The property is located at 2554 Haymaker Road at its intersection with McGinley Road. It is zoned R-1, One-Family Residential, with a proposed rezoning to R-2T, One-Family Residential, Zoning District. B. NEW BUSINESS ST THE PLAZA GROUP, LLC Applicant is requesting Site Plan Approval to add a drive-thru window at the western side of an existing shopping center. The property is located at 2525 Monroeville Boulevard. It is zoned C-2, Business Commercial.

The proposed development is located at 4363 Northern Pike, situated north of and adjacent to the Cedars, Monroeville Christian Judea Foundation property. Total property area equals acres. It is zoned R-4, Multi-Family Residential ST CEDARS COMMUNITY HOSPICE Applicant is requesting Site Plan Approval for a Personal Care Home, 2 ½ stories in height and 28,393 square feet in size, and associated site improvements. Total property area equals 16.5 acres. The property is zoned C-2, Business Commercial, and M-2, Industrial ST WIDEWATERS MONROEVILLE COMPANY Applicant is requesting Site Plan Approval for the construction of a Retail Shopping Center, 36,660 square feet in size, and associated site improvements to be located west of the existing Haymaker Village Shopping Center. Total property area equals 16.5 acres. The property is zoned C-2, Business Commercial, and M-2, Industrial.

7 Council Agenda 7 May 9, SUB LISA MARIE YUHASCHEK Applicant is requesting Final Subdivision Approval for a three (3) lot subdivision to include Lot 1 of 10,734 square feet, Lot 2 of 12,766.4 square feet and Lot 3 of 42,162 square feet to total 65, square feet. The property is located at 3890 Logans Ferry Road, and is bound on the east by property belonging to Tom and Jane Henningsen, to the north by the Ridgeview Estates Plan of Lots and to the west by property belonging to Tim and Sara Skoog. The property is zoned R-2, One-Family Residential. The Planning Commission recommends tabling however the Municipal Solicitor advised that this proceeds to Council as the reasons for tabling exceeded Planning Commission jurisdiction SUB ROBERT MAHAN Applicant is requesting Final Subdivision Approval for a two (2) lot subdivision to include lot line revisions creating a new Lot 1 of.43 acres and a new Lot 2 of.86 acres to total 1.29 acres. The property is located at 2578 Stroschein Road, The property is zoned R-2, One- Family Residential C CROWN CASTLE USA, INC./MONROEVILLE VOLUNTEER FIRE COMPANY #5 Applicant is requesting Conditional Use Approval for the installation of seven (7) microwave dishes on an existing commercial communication tower. The communication tower is located at 100 Seco Road. Total property area involved equals.53 acres. It is zoned M-1, Planned Industrial C PENNECO OIL COMPANY/JOHN J. BRUNO Applicant is requesting Conditional Use Approval as per Section 401.8, Conditional Uses, Monroeville Zoning Ordinance, 1443, as amended, allowing for the preparation of an access road and drill site, drilling operation and the extraction of natural gas from one (1) well site. The project is located at Johnson Road. Total property area involved equals 10 acres. The property is zoned R-2, One-Family Residential.

8 Council Agenda 8 May 9, C PENNECO OIL COMPANY/ SCOTT AND JUDITH HILL Applicant is requesting Conditional Use Approval as per Section 401.8, Conditional Uses, Monroeville Zoning Ordinance, 1443, as amended, allowing for the preparation of an access road and drill site, drilling operation and the extraction of natural gas from one (1) well site. The project is located on the eastern side of Pitcairn Road and bound by Wallace Drive. Total property area involved equals 3 acres. The property is zoned S, Conservancy C PENNECO OIL COMPANY/ EDWARD AND VIRGINIA GRATTON Applicant is requesting Conditional Use Approval as per Section 401.8, Conditional Uses, Monroeville Zoning Ordinance, 1443, as amended, allowing for the preparation of an access road and drill site, drilling operation and the extraction of natural gas from one (1) well site. The project is located at 271 Wallace Drive. Total property area involved equals 5.9 acres. The property is zoned R-2, One-Family Residential. C. RESOLUTIONS 1.
