2 VETERANS MEMORIAL ISLAND SANCTUARY ADVISORY COMMITTEE MINUTES Wednesday, July 1, :00 a.m. Council Chambers, City Hall, Vero Beach, Florida PRESENT: Chairman, Anthony Young, Vice Chairman, Alma Lee Loy; Members: John Matthews, Joel Herman, Barbara Fallon, and Alternate Member, Curtis Paulisin Also Present: Public Works Manager, Don Dexter; Recreation Director, Rob Slezak, Assistant City Attorney, Peggy Lyon, and Senior Administrative Assistant, Rita Hawkins 1. CALL TO ORDER Today's meeting was called to order at 10:00 a.m. 2. PLEDGE OF ALLEGIANCE The Committee members and the audience joined together in the Pledge ofallegiance to the flag. 3. APPROVAL OF MINUTES A) June 3, 2015 Mr. Herman made a motion to approve the minutes of the June 3, 2015 Veterans Memorial Island Sanctuary Advisory Committee meeting. Ms. Loy seconded the motion and it passed unanimously. 4. AUDIENCE PARTICIPATION None 5. NEW BUSINESS A) Veterans Council Donation for Memorial Restoration-Mr. Sam Kouns Mr. Sam Kouns, Veterans Council member, read a prepared letter on behalf ofthe Veterans Council of Indian River County (on file in the City Clerk's office). The letter announced that the Veterans Council contributed $1,000 to the Veterans Memorial Island Sanctuary account to help with the restoration ofthe Lest We Forget Monument. Mr. Young said it is important that the monuments are always maintained and this contribution shows support from the Veterans Council. Ms. Loy said that it is gratifying to the Veterans Memorial Island Sanctuary Advisory Committee to receive this support. B) Korean Armistice Ceremony - Mr. Joe Gomez Mr. Vincent Abbate, Commander of the Korean War Veterans, announced that the Korean War Veterans will be holding a function at Veterans Memorial Island Sanctuary on July 25,

3 Mr. Joseph Gomez said that with permission from the Veterans Memorial Island Sanctuary Advisory Committee, they would like to place markers and flags at the cenotaphs of the Korean War Veterans during their July 25, 2015 ceremony. He passed around a flag with one of the new markers on it to show the Committee members what they will look like. He also passed around a prepared list ofnames ofthe Korean War Veterans that will receive the recognition markers. Mr. Young asked ifthe flags with the medallions will be placed on the Island the morning of their event. Mr. Gomez explained that they will be placed on the Island at 8:00 a.m. because the ceremony starts at 9:00 a.m. Mr. Young said that the Committee members received a handout showing a picture of what the medallion and flag will look like when it is placed at the cenotaph marker (on file in the City Clerk's office). Mr. Gomez said that following the ceremony a lunch will be served at the Irish American Club. They are only expecting 30 to 50 people to attend this 62nd Anniversary ofthe Korean War. They invited the members oftheir Chapter, but he will place an announcement in the newspaper inviting all Veterans to attend. Mr. Matthews offered his assistance ifthey need help printing the programs. Mr. Matthews made a motion to approve the short ceremony and placing the flags and medallions on the markers of the eight (8) members of this community that died in the service of this Country during the Korean War. Ms. Fallon seconded the motion. Mr. Rob Slezak, Recreation Director, asked ifthe ceremony will take place in the main area where the benches are, or will they need chairs. Mr. Gomez replied that they will be using the benches. Mr. Slezak recommended that they have water available, because it is hot even in the morning. The motion passed unanimously. 6. OLD BUSINESS A) Proposed Updates to Veterans Memorial Island Sanctuary Rules and Regulations for Plaques, Memorials, and the Master Plan Mr. Young stated that the Committee members received a draft copy ofthe revised Resolution and the Authorized Uses and Rules (on file in the City Clerk's office). He explained that he would like to go through and point out the revisions using the clean copy of Attachment "A". Ifthey need to reference the specific changes they can see that on the lined out and underlined copy ofattachment "A". He continued by going through the changes that were made to Attachment "A". He explained that Exhibit "A" is a map of Veterans Memorial Island, which now incorporates the bridge leading to the Island and the traffic circle on the east end of the bridge. An important fact that was added 2 5

4 under item C. General Matters is that the Sanctuary is protected under the Charter of the City of Vero Beach. Mr. Matthews pointed out one correction under item C. (3). It should read "after approval of the Vero Beach City Council in consideration of... " Mr. Young agreed that the word "in" is missing. He continued going through the changes. Mr. Young stated that about a year ago, an out oftown business tried to use the Island for the taping of a commercial, but that was halted. He asked if they should specifically state that no commercial activity is permitted. Mrs. Peggy Lyon, Assistant City Attorney, said that if they had a commercial group use the Island for an event then maybe they should spell it out. The Committee members agreed that it should be listed. Mrs. Lyon said that she will add "Commercial activity" as number 14 under uses not permitted at the Sanctuary. She also explained that for the correction under item C. (3) she will use the word "after" instead of"in" to keep it consistent with the rest ofthe document. Mr. Young explained that item E. (2) was changed to state that a Report of Casualty Certificate, Form 1300, or equivalent would be accepted for issuing a Cenotaph marker. He said that a Form DD214, which is a release from active duty, is not issued for a casualty, so a Casualty Report should also be accepted as a proper form of verification. Mr. Young said that the Exhibit "B" is the Master Plan and it shows what is now in place for the Island with the addition offour (4) vacant locations for future memorials. Mrs. Lyon stated that she will make the discussed changes and provide a copy of the Resolution to Mr. Young to present to the Veterans Council. Ifthe Veterans Council approves the changes to the documents then it will be put on the City Council agenda for their July 21, 2015 meeting. Mr. Matthews stated that one ofthe main changes they made was removing the requirement that the individual must have died in combat. Mr. Young explained that as he looks back on recent events and current incidents with their Armed Forces, he would hope that individuals who died defending the County in the Cold War and the Gulf War could be recognized. He thinks this new wording will accomplish this. Ms. Fallon made motion to make the two changes in the proposed document as discussed. Ms. Loy seconded motion and it passed unanimously. B) Update on the Lest We Forget Monument Cross Restoration - Mr. Don Dexter, Public Works Manager Mr. Don Dexter, Public Works Manager, reported that he sent a purchase order to the granite craftsman, so the cross is in production. He was told it could take up to 20 weeks, so it should be in right before Veterans Day. Mr. Young asked ifthe work is being done by someone local. 3 5

5 Mr. Dexter replied that Mr. Mark Feldner in Fellsmere is doing the work. The cutting will be done off site but he will do the final polishing and finishing. He confirmed that it will be the six-side cross like the original. Mr. Herman asked if it will be attached with epoxy on top ofthe monument. Mr. Dexter said that it will probably be attached with epoxy. Sometime they run a rod up in the center to help hold it in place, but he is not sure ifthat will be done. Mr. Young announced that the funding request for the replacement cenotaph marker for Jimmie Doles was approved by City Council. Mr. Dexter said that he will get the cenotaph marker ordered. C) Veterans Memorial Island Sanctuary Directory Update Mr. Dexter announced that the company, Cutting Edge, who printed the original map made the correction to the Veterans Council information. Instead ofprinting the whole map they only printed the corrected section, which will be adhered to the map over the old information. Mr. Young said a lady, who is a volunteer at the Victory Center, contacted him about donating a large staghorn fern for Veterans Memorial Island Sanctuary. He said Mr. Dexter searched the Island and found a large Oak Tree that would be an ideal place for it. Mr. Dexter stated that Ms. Nanette Haynes, Grounds Maintenance Manager, went and looked at the fern, but she was not sure how they were going to transport it yet. The fern is very large and is about 5 to 6 feet wide. Mr. Rob Slezak announced that the July 4th fireworks will start promptly at 9:00 p.m. and they will last for 20 to 25 minutes. Mr. Young asked ifthey close the Island around noon when the fireworks arrive. Mr. Slezak reported that the trucks from the fireworks company will arrive on Saturday morning. There will be limited access to the Island, but once they bring the explosives out all access to the Island is blocked off. Mr. Young asked Mr. Slezak if he had any details on the parade that will take place on July 3rd. He said he believes it is sponsored by the Vero Beach Chamber ofcommerce. Mr. Slezak reported that the parade will be on July 3rd and it starts at 5:30 p.m. Participants will assemble on Cardinal Drive, travel along Ocean Drive, go to Beachland Boulevard, and then back to Cardinal Drive. Mr. Matthews announced that his business, John Michael Matthews Fine Jewelry, is sponsoring the Marine Corps float in the parade. He said that all Marines who would like to be part ofthe float are welcome to participate. 7. CHAIRMAN'S MATTERS 4 5

6 A) Veterans Memorial Island Sanctuary Veterans Highlight: J.A. Keen, W.F. Baker, L.R. Sheffield, R.L. Coleman, and D.S. Humphrey Mr. Young handed out a list ofthe five (5) Veterans that were recognized on the Bob Soos show in June (on file in the City Clerk's office). Ms. Fallon, Mr. Matthews, Mr. Herman, Mr. Young, and Mr. Paulisin each read one ofthe biographies from the list ofveterans. Mr. Young thanked Mr. Ken Daige for the time he served on the Veterans Memorial Island Sanctuary Advisory Committee. 8. MEMBER'S MATTERS Mr. Matthews said that each year the Elks Lodge holds a Flag Day event and this year they honored Mrs. Michelle Dale. Mrs. Dale is a Gold Star mother who lost her son in combat. It was a sad, but a sweet ceremony and he thanked everyone who helped put it together. Mr. Herman suggested that the Genealogical Society put together a booklet or pamphlet containing all the accounts ofthe Veterans who are recognized with cenotaph markers. It would also be nice if they could get a photo ofeach ofthem. Mr. Young replied that there is a book at the archive center that contains the biographical information of each of these Veterans, but it does not have pictures. They hope to add all the accounts oftheir lives and any new information to the book. Ms. Fallon said that a lot ofthose Veterans graduated from Vero Beach High School, so they might be able to get some pictures from old yearbooks. Mr. Paulisin announced that the Veterans Outreach Program is holding a golf tournament on July 11, 2015 at Sandridge Golf Course. The cost is $50 and includes lunch. Mr. Young said the State of Florida published a report indicating that Indian River County had 15,416 Veterans residing here. This information was as of April 16, 2014, but since then that number has increased. 7 RESOLUTION NO A RESOLUTION OF THE CITY OF VERO BEACH, FLORIDA, REPEALING AND REPLACING RESOLUTION , AND AMENDING THE VETERANS MEMORIAL ISLAND SANCTUARY AUTHORIZED USES AND MEMORIALS TO CONSOLIDATE, CLARIFY, AND UPDATE THE USES AND RULES UNDER WHICH THE VETERANS MEMORIAL ISLAND SANCTUARY IS GOVERNED AND MAINTAINED; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Resolution No provides for rules and regulations pertaining to Veterans Memorial Island Sanctuary ("Sanctuary") with the goal of creating a quiet haven for reflection on the sacrifices made by the men and women in the Armed Forces of our Country, and as a memorial to Indian River County's military heroes, and WHEREAS, at its July 1, 2015 Committee meeting, the Veterans Memorial Island Sanctuary Committee ("Committee") voted to recommend the attached changes to the Sanctuary Authorized Uses and Memorials to consolidate, clarify and update the provisions as they have been amended over time; and WHEREAS, such proposed changes have been reviewed and recommended by both the Veterans Council ofindian River County and the Committee; and WHEREAS, the City Council of the City of Vero Beach finds that the recommended changes will serve to further preserve and ensure the Sanctuary as a quiet haven for reflection on the sacrifices made by the men and women in the Armed Forces ofour Country, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERO BEACH, FLORIDA, THAT: Page 1of3 N:\Client Docs\Resolutions\City Council\ Veteran Memorial Island Sanctuary.Replacing Resolution docx

8 Section 1. Veterans Memorial Island Sanctuary Authorized Uses and Memorial Rules. In accordance with Section 54-31(e) of the City of Vero Beach Code of Ordinartces, the amended mles and procedures pertaining to the Veterans Memorial Island Sanctuary, as shown in Attachment '"A" attached hereto and incorporated by this reference, are hereby adopted: SEE ATTACHED ATTACHMENT "A" Veterans Memorial Island Sanctuary Authorized Uses and Memorial Rules Section 2. Repeal and replacement. Resolution No is hereby repealed and replaced by this Resolution No Section 3. Conflict and severability. The provisions of this Resolution shall control over those provisions of previously adopted resolutions in conflict herewith. If any provision of this Resolution is held to be invalid, unconstitutional, or unenforceable for any reason by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining portions. Section 3. Effective date. 10 ATTACHMENT "A" VETERANS MEMORIAL ISLAND SANCTUARY AUTHORIZED USES AND MEMORIAL RULES A. Purpose and Intent. Pursuant to Section 54-31(e) of the City of Vero Beach Code of Ordinances ("Code"), the purpose and intent of these Veterans Memorial Island Sanctuary Authorized Uses and Memorial Rules ("Uses and Rules") is twofold: (1) To create at the Veterans Memorial Island Sanctuary a quiet haven for reflection on the sacrifices made by the men and women of the Armed Forces of the United States of America; and (2) To preserve Veterans Memorial Island Sanctuary as a memorial to Indian River County's military heroes. B. Definitions. The following definitions shall apply to these Uses and Rules: Cenotaphs: individual memorials for fallen veterans whose bodies are buried elsewhere or not recovered. Master Plan: the plan guiding the management and development of Veterans Memorial Island Sanctuary adopted by the City Council of the City of Vero Beach pursuant to Section 54-3l(e) of the Code, as more fully described and identified in Exhibit "B" attached hereto, and incorporated herein. Veterans Memorial Island Sanctuary Advisory Committee: the committee established pursuant to the Code to ensure the purpose, intent and pn~servation of Veterans Memorial Island Sanctuary and to serve as an advisory committee to the City Council of the City of Vero Beach, hereinafter "Committee." Veterans Memorial Island Sanctuary: the geographic area including all of Spoil Island #31, hereinafter "Island," deeded to the City of Vero Beach on May 5, 1941, the bridge leading to the Island, and the entrance area lying immediately east of the bridge, including the traffic circle and its contents, excluding the roadway, as more fully described and identified in Exhibit "A" attached hereto, and incorporated herein, hereinafter "Sanctuary." C. General matters. (1) The Sanctuary may not be sold, leased, traded, or given away by the City except as specified in Section 5.05 of the Charter of the City of Vero Beach. 11 (3) All work and projects at the Sanctuary shall be implemented by the Public Works Department of the City of Vero Beach only after approval of the Vero Beach City Council after consideration of recommendations from the Committee and the Veterans Council of Indian River County. (4) Initial coordination of uses of the Sanctuary shall be coordinated through the Recreation Department of the City of Vero Beach. D. Rules and Policies. (l) Use of the Sanctuary. (a) All uses shall be in keeping with the purpose and intent of the Sanctuary. (b) All other uses shall be by permit only, issued by the Vero Beach City Manager and consistent with Section 54-31(e) of the Code. (c) Private memorial services held at the Sanctuary shall be limited to services for United States veterans for whom a Certificate of Release or Discharge from Active Duty (Department of Defense Form DD214), or equivalent, issued for reason other than dishonorable conduct, has been provided to the City of Vero.Beach Recreation Department and verified by the Indian River County Veterans' Service Office. Scattering of cremains of such veterans is permitted in the waters surrounding the Island, however cremains shall not be scattered on the Island. (d) The following uses shall not be permitted at the_sanctuary: I. General recreational activities. 2. Weddings. 3. Demonstrations, rallies or politically motivated gatherings. 4. Fund raising events. 5. Sportings events. 6. Band concerts, except those related to military ceremonies or recognized holidays of special national or local significance in which patriotic music shall predominate. 7. Camping. 8. Alcoholic beverages. 9. Bikes, skateboards, scooters, and skates. 10. Kite flying or operation ofmodel aircraft or model vehicles. 11. Water activities such as, but not limited to, swimming, boating, fishing, and the like, except that fishing shall be permitted on the bridge leading to the Island so long as such fishing activity does not interfere with Island events that are a1iowed or permitted pursuant to the Uses and Rules. 12. Motor vehicles and other motorized conveyances, except those utilized in conveying persons with disabilities or utilized in maintenance or approved work by or for the City. 13. 12 E. Individual Memorials. ( 1) Cenotaphs have been used since the dedication of the Island. Cenotaphs shall be consistent in size and design with existing cenotaphs. Vietnam era veterans are honored with engraved granite memorials. Veterans of other conflicts are honored with granite memorials with bronze plaques. Bronze plaques shall be consistent with those of the conflict/era. Plaques shall contain name, date of birth, and date of death. Branch of Service and rank may be included, space permitting. (2) Cenotaphs will honor the men and women of Indian River County who died while defending the United States of America and for whom a Report of Casualty Certificate (Department of Defense Form 1300), or equivalent, issued for any reason other than dishonorable conduct, has been provided to the City of Vero Beach Recreation Department and verified by the Indian River County Veterans' Service Office. Any such qualifying veteran who died while defending our country and was a resident of Indian River County at the time of his or her initial entry into one of the services shall be eligible for recognition. (3) No other individual memorials shall be allowed. (4) Cenotaphs may be approved by the City Council after consideration of the recommendation by the Veterans Council of Indian River County and the Committee. F. Monuments. (1) Monuments have been part of the memorials to honor veterans since the dedication of the Sanctuary. The "Lest We Forget" monument established precedence. Honor is paid to the veterans of World War II, the Korean War, and the Vietnam War. In addition, monuments pay tribute to Pearl Harbor Survivors, Purple Heart recipients, Prisoners of War (POW), and those Missing in Action (MIA). (2) Only veteran organizations sponsoring a monument may be recognized as part of the monument. (3) Plans for construction of monuments shall require approval by the City Council after consideration of the recommendation by the Veterans Council of Indian River County and the Committee. (4) All monuments shall be consistent with the Master Plan and no development shall occur that is not consistent with that plan. G. Service Memorials. Monuments commemorating the branches of the United States Armed Services, i.e. the Army, the Navy, the Marines, the Air Force, and the Coast Guard have been constructed consistent with the Master Plan. Any changes to the existing monuments shall be consistent with the Master Plan and shall require approval by the City Council after consideration of the recommendation by the Veterans Council of Indian River County and the Committee. 15 ATTACHMENT "A" VETERANS MEMORIAL ISLAND SANCTUARY AUTHORIZED USES AND MEMORIALS-RULES The new Veterans Jvlemorial Island Sanctuary Advisory Committee has had several meetings to review previous policies and to record suggested changes. The follmving is a summary of discussions and general agreement on the following items: *The following asterisked rules and policies adopted by the Veterans Memorial Island Sanctuary l..dyisory Committee and the City Council of the City of Vero Beach regarding "l\'l':emorials," ''Individual Memorials," "Memorials to Branches of Service" and "Plaques and Memorials" shall be in full force and effect oa the Veterans Memorial Island Sanctuary, on the bridge leading to the Sanctuary, and on the entry area immediately east of the bridge, including the traffic circle and its contents, excluding the roadv1ay. The rules and policies adopted by the Veterans l\wmorial Island Sanctuary Advisory Committee and the City Council of the City of Vero Beach regarding "Uses" are expressly limited to the Veterans Memorial Island Sanctuary. See attached map. A. Purpose and Intent. Pursuant to Secti ( e) of the City of Vero Beach. Code of Ordinances ("Code"), the purpose and intent of these Veterans Memorial Island Sanctuary Authorized Uses and Memorial Rules ("Uses and Rules") is twofold: (1) To create at the Veterans Memorial Island Sanctuary a quiet haven for reflection on the sacrifices made by the men and women of the Armed Forces of the United States of America; and (2) To preserve Veterans Memorial Island Sanctuary as a memorial to Indian River County's military heroes. B. Definitions. The following definitions shall apply to these Uses and Rules: Cenotaphs: individual memorials for fallen veterans whose bodies are buried elsewhere or not recovered. Master Plan: the plan guiding the management and development of Veterans Memorial Island Sanctuary adopted by the City Council of the City of Vero Beach pursuant to Section 54-3l(e) of the Code, as more fully described and ideptified_in Exhibit "B" attached hereto, and incorporated herein. Veterans Memorial Island Sanctuary Advisory Committee: the committee established pursuant to the Code to ensure the purpose, intent and preservation of Veterani;; Memorial Island Sanctuary and to serve as an advisory committee to the City Council of the City of Vero Beach, hereinafter "Committee." 16 Veterans Memorial Island Sanctuary: the geographic area including all of Spoil Island #31, hereinafter "Island," deeded to the City of Vero Beach on May 5, 1941, the bridge leading to the Island, and the entrance area lying immediately east of the bridge, including the traffic circle and its contents, excluding the roadway, as more fully described and identified in Exhibit "A" attached hereto, and incorporated herein, hereinafter "Sanctu~ C. General matters. (1) The Sanctuary may not be sold, leased. traded, or given away by the City except as specified in Section 5.05 of the Charter of the City of Vero Beach (2) There shall be no charge for admission to the Sanctuary. Veterans of other conflicts are honored with granite memorials with bronze plaques. (2) Cenotaphs will honor the men and women of Indian River County who died while defending the United States of America and for whom a Report of Casualty (Department of Defense Form 1300), or equivalent, issued for any reason other than dishonorable conduct, has been provided to the City of Vero Beach Recreation Department and verified by the Indian River County Veterans' Service Office. (2) Only veteran organizations sponsoring a monument may be recognized as part of the monument. *PLAQUES,'\ND MEMORIALS No plaques shall be allowed on any memorial designating sponsorship of individuals or organizations except those pertaining to the Veterans Organization. Recognition of contributions may be included either written or verbally at the dedication ceremony. (3) Plans for construction of monuments shall require approval by the City Council after consideration of the recommendation by the Veterans Council of Indian River County and the Committee. Any changes to the existing monuments shall be consistent with the Master Plan and shall require approval by the City Council after consideration of the recommendation by the Veterans Council of Indian River County and the Committee.
