1 01/10/2011 Hamburg Town Board Meeting Hamburg, New York 1 A regular Town Board meeting of the Town of Hamburg, County of Erie and State of New York was held at the Town Hall, 6100 South Park Avenue, Hamburg, New York on the 10th day of January RESOLVED, that the Town Board adjourn Executive Session at 7:02 p.m. and open the regular meeting. Information on location of Fire exits was provided. Supervisor Walters asks for a moment of silence for all those who lost their lives or were injured in the incident in Phoenix, Arizona involving Congresswoman Gabrielle Giffords.

On a motion of Councilman Gorman, seconded by Supervisor Walters, the following TABLED Ayes 4 Walters, Collins, Gorman, Ziegler RESOLVED, that the Town Board approve the following minutes and incorporate the corresponding audio tapes into the official record. 12/06/2010 Work Session 12/13/2010 Town Board Meeting 12/29/2010 Year end Meeting The following spoke concerning proposed resolution #3: Councilman Gorman, Ken Farrell, Councilman Collins, Supervisor Walters, Councilwoman Ziegler, Joe Kilian, George Lee 3. RESOLVED, that the Town Board approve the membership of the following into the Lake Shore Volunteer Fire Company Inc.: Kevin Hartman 6505 Hackberry Drive Lakeview, New York 14085

RESOLVED, that the Town Board accept the low bid from West Herr Ford, 5640 Camp Road, Hamburg, NY, of $113,051.00, for seven (7) Police Interceptors. Money is available in account B The following spoke concerning resolution #5: Joe Kilian, Chief Williams, Steve Strnad 5. On a motion of Councilwoman Ziegler, seconded by Supervisor Walters, the following RESOLVED, that the Town Board authorize the Recreation Department to issue alcohol waivers for the following February 2011 Taylor Road rentals: 02/05/11 02/06/11 02/12/11 02/13/11 02/19/11 02/26/11 02/27/11 6. RESOLVED, that the Town Board approve the recommendation of the Chief of Police in appointing DANIEL A GALLARDO to the vacant position of POLICE OFFICER (Probationary) with the Town of Hamburg Police Department. Mr. Gallardo is currently on the Civil Service list for Police Officer, established April 11, 2008, Exam # Salary is $23.02 per hour. Appointment is effective January 16, 2011.

On a motion of Councilman Collins, seconded by Councilman Gorman, the following WHEREAS, the Town of Hamburg received a request from McKinley Mall LLC for approval to expand the Mall s main south entrance area to include an Old Navy store and two future tenant spaces (based on a drawing dated June 21, 2010, which is consistent with the Master Plan for the Mall façade improvement approved in 2004); and WHEREAS, the Hamburg Planning Board, at its July 7, 2010 meeting, forwarded a favorable recommendation to the Town Board regarding this request; THEREFORE, BE IT RESOLVED that the Town Board hereby approves the proposed addition to the Mall as recommended by the Planning Board, conditional upon the Town Engineer approving the engineering plans. 8. On a motion of, Councilwoman Ziegler, seconded by Supervisor Walters, the following RESOLVED, that the Town Board approve the hiring of personnel for the Recreation Department as follows: 1. On a motion of Councilwoman Ziegler, seconded by Supervisor Walters, the following BE IT RESOLVED the Town Board authorize Town of Hamburg Buildings and Grounds Employee Joy Brown to attend Gardening Basics (H-33) Continuing Education Class at Hamburg Central School March 3 March 30, 2011 for a total of 8 hours. Total cost of seminar is $30.00

5 01/10/2011 Hamburg Town Board Meeting Hamburg, New York RESOLVED, the Town Board authorizes the following Officers to attend the 2011 Tactical Training Conference in Verona, NY, April 12-14, 2011: Lieutenant Nicholas Ugale, Detective Thomas Brown, and Patrolmen Jeffrey Paluch, Jeffery Bullard, Jason Nappo and Howard Widman. Cost for Seminar: $1, (paid out of 2010 budget) Lodging: 2 $ (3 rooms) $ Tolls: Approximately $ TOTAL: $ Use of Unmarked Town Vehicles for transportation is requested. 11. 6 01/10/2011 Hamburg Town Board Meeting Hamburg, New York On a motion of Councilman Collins, seconded by Councilman Gorman, the following WHEREAS, on December 29, 2010 the Town Board of the Town of Hamburg adopted Resolution No. 19, requesting that the New York State Legislature amend Section 450 of Real Property Tax Law to make taxable real property owned by an Agricultural Society which is not predominantly used within the scope of an Agriculture Society for purposes of operating an annual fair or for agricultural purposes. NOW THEREFORE BE IT RESOLVED, that the Town Board does hereby rescind December 29, 2010, Resolution No. 19. The following spoke concerning resolution #13: Tom Best, Supervisor Walters, Bob Reynolds, Betty Newell, Joe Kilian 13. On a motion of Councilman Gorman, seconded by Councilwoman Ziegler, the following BE IT RESOLVED, that the Town Board approve the out-of-town travel request of Supervisor Steven Walters to attend the New York State Association of Towns Training School and Annual Meeting in New York City from February 20, 2011 through February 23, Part of the attendance will be attending sessions pertinent to town functions. 8 01/10/2011 Hamburg Town Board Meeting Hamburg, New York 8 CAPITAL FUND DISBURSEMENTS: BATCH #1 $283, UNPROCESSED TOTAL CAPITAL FUND DISBURSEMENTS: $283, PAYROLL: PR #P/R #1 $674, TOTAL PAYROLL DISBURSEMENTS: $674, PETTY CASH $0.00 TOTAL CASH DISBURSEMENTS SUBMITTED FOR AUDIT: $994, Reports from Town Board Members and Department Heads Councilman Collins reports that he was recently appointed as liaison to the Engineering, Planning and Building Inspection Departments. He had a successful meeting with the Department Heads. Supervisor Walters reports there will be a Bicentennial Meeting in two weeks and a Veterans Meeting next week. Catherine Rybczynski, Town Clerk, reports that on January 24 th from 8 am to 4 pm in Room 7B there will be representatives from the Veterans Administration, along with Tracy Kinn, to enroll people into the VA Medical System. There will also be representatives from the Buffalo State Small Business Development Center. This past week she transferred over $72,000 into the Towns General Fund for penalties and interest from her accounts. Ken Farrell reports that he received a decision from the Appellate Court concerning a catastrophic injury involving the Cloverbank Railroad crossing. We were named as one of the defendants in that litigation a number of years ago. Last January there was a decision letting them out of the case and that was appealed by the plaintiffs and the Appellate Court just rendered a decision upholding the lower courts decision and therefore concluding the Towns involvement in the case. Secondly he would ask all Elected and Appointed Officials, when they send out the financial disclosure forms required by New York State regulations, to please get them back promptly.

From Community Development he receives very thorough reports every month and he meets with the Department Head who is doing a great job. For Economic Development he met with Mike Bartlett and discussed a report outlining all the money his event provided for Development in the Town of Hamburg. Kurt Allen, Supervising Code Enforcement Officer, reports that he has a summary report for the Building permit activity for last year. It is available to anyone interested. Permit activity is a direct function of construction activity and last year a record was set on total number of permits at 1950, up 348 over the previous record. They did have a 30% increase in new housing units and the establishment of the Electrical Inspection contributed to the increase in permits. He also announces that effective January 1 st his Department will require permits for roof reconstruction. Christopher Hull, Director of Community Development, reports that they will hold their Public Hearing for the Draft Consolidated Plan on January 26 th at 7 pm in conference room 3.
